MECHANICAL BULL RENTAL AGREEMENT and RIDER’S RELEASE &

WAIVER OF LIABILITY

1. This MECHANICAL BULL RENTAL AGREEMENT (hereinafter

“AGREEMENT”) is entered into between the MECHANICAL BULL OWNER JOSE
LUIS GARCIA ((hereinafter “BULL OWNER”) and
________________________________________[“BULL RENTER”] for the rental of
the Mechanical Bull (hereinafter “BULL”) subject to the terms contained herein and in
the Rider’s Release and Waiver of Liability. All other obligations regarding this bull
rental and Agreement are covered in the Rider’s Release and Waiver of Liability
document provided to riders of the BULL.

2. MECHANICAL BULL OWNER JOSE LUIS GARCIA agrees to provide,

deliver, and install for______________________________ [“BULL RENTER”] its
BULL at the following Rental Delivery location

3. Parties agree to the following FEE SCHEDULE: $__________________per

[day/hr] due at either signing of this contract or delivery. For certain rental deliveries that
require significant travel arrangements, BULL RENTER may be assessed an additional
FUEL FEE, which will cover travel costs (including overnight stay, if applicable) to
ensure safe delivery and installation.

4. BULL OWNER ensures that BULL is subject to regular maintenance, routine

inspection, and operated in accordance with the BULL’s operational manual.

5. BULL OWNER and BULL RENTER ensure that BULL will be operated in
accordance with the highest safety precautions, including, but not limited to, maintaining
a high-density foam padding that is a minimum of 18 inches thick; maintaining an
emergency shut-off switch on the BULL; ensuring that the operators of the BULL are at
lease 19 years old; and to strictly enforce the rules and regulations contained in the
RIDER’S RELEASE & WAIVER OF LIABILITY.

6. BULL RENTER AGREES TO HOLD HARMLESS BULL OWNER and

understands that JOSE LUIS GARCIA does not maintain any insurance policy, other
than ____________insurance coverage. As such, BULL RENTER takes notice and
should review its own personal insurance portfolio.

I have read and understand my obligations and responsibilities regarding the use of the
mechanical bull owned by Jose Luis Garcia, BULL OWNER.

It is my express intent that this AGREEMENT operate to hold harmless Jose Luis Garcia
and Aidee Ramirez and shall bind my employees, agent, members of my family and
spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased,
and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT
TO SUE BULL OWNER. I hereby further agree that this Riders Release & Waiver of
Liability shall be construed to hold harmless JOSE LUIS GARCIA, AIDEE RAMIREZ,
their employees, operators, assignees, and agents in accordance with the laws of the State
of California.

 RIDER’S RELEASE AND WAIVER OF LIABILITY

A. I__________________________________[RIDER’S FULL NAME] am fully

aware of the unusual risks involved and hazards connected with RIDING THE
MECHANICAL BULL, including but not limited to death, dismemberment, or
permanent disability. I hereby elect to voluntarily participate in said activity with full
knowledge that said activity may be hazardous to my personal effects and my person. I
VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS,
PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that my be
sustained by me, or any loss or damage of property owned by me, as a result of being
engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF
RELEASEES OR OTHERWISE.

B. I further hereby AGREE TO INDEMNIFY, RELEASE, AND HOLD

HARMLESS the MECHANICAL BULL OWNER and OPERATOR from any loss,
liability, damage or costs, including court costs and attorney fees, that they may incur due
to my participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF
RELEASEES or otherwise.

C. RIDER ALSO AGREES, BY INITIAL, TO THE FOLLOWING:

1. Rider is participating in riding the mechanical bull at their own risk and the
operator and owner are not liable for any accident or injury to any person
regardless of how it was caused. _________

2. No one under the age of 18 will be allowed to ride the mechanical bull without a
signed in-person waiver of liability produced by the minor’s parent or guardian.

guardian or legal guardian does hereby represent that he/she is, in fact, acting in such capacity and
agrees to save and hold harmless and indemnify each and all of the parties referred to above from
liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because
of any defect in or lack of such capacity to so act and release said parties on behalf of the minor
and the parents or legal guardian.]

3. Individuals with pre-existing back, leg, neck, head, or arm injuries, or other
preexisting conditions or persons that are pregnant are NOT permitted to ride the
bull. ________

4. Employees, Operators, and Owners are NOT responsible for determining the
physical condition or ability of the potential bull riders. _________

5. Riders ride at their own risk, but may stop the ride at ANY TIME. ________

 6. Employees, Operators, and Owners are required to STRICTLY ENFORCE the
rules and regulations of use, and thus will refuse service or remove a Rider from
the BULL at any time. ________

harmless BULL OWNERS, their employees, operators, assignees, and agents in
accordance with the laws of the State of California.
