ITB 1.2 The Bidding Document is issued under Procurement Method:

International Competitive Bidding (ICB)
ITB 4.1 The individuals or firms in a joint venture, consortium or association shall be
jointly and severally liable.
ITB 5.5 The Bidder is required to include with its bid, documentation from the
Manufacturer of the Goods, that it has been duly authorised to supply, in Malawi,
the Goods indicated in its bid. This letter of authorisation should be original and on
the letterhead of the Manufacturer and should be signed by a person with the proper
authority to sign documents that are binding on the Manufacturer. The authorisation
should mention specific items authorised to supply and state warranties and
guarantees.

B. Bidding Document
ITB 7.1 Bid Briefing and Site Visit shall be held on 1st, 2nd and 3rd March 2017 as

C. Preparation of Bids
ITB 11.1 (i) The Bidder shall submit with its bid the following additional documents:
(a) Tax Certificate
(b) Certificate of Incorporation / Registration Certificate
(c) Evidence that the Bidder has performed similar Contracts
(d) Quality Certificate
(e) Materials Brochures and detailed specification
(f) Audited Accounts for the past two years
(g) Trade references
(h) Manufacturer Authorisation

ITB 13.1 Alternative bids will not be considered.

ITB 14.5 The Incoterms edition is: 2010

ITB 14.6 For Goods and Related Services, the Bidder shall quote prices using the following
Incoterms: CIP, Blantyre.
ITB 14.7 The prices quoted by the Bidder for goods originating outside of Malawi shall be:
United States Dollars or three readily convertible currencies and shall be
fixed for the duration of the Contract.
ITB 15.1 The prices quoted by the Bidder for goods originating in Malawi shall be: shall be
Malawi Kwacha and fixed for the duration of the Contract
ITB 20.1 The bid validity period shall be 120 (One Hundred and Twenty)days

ITB 21.1 A bid security shall be required, the amount and currency of the bid security shall
be MWK7,500,000.00 or equivalent submitted in the currency of the Bid.
The Bid Security shall be in the format provided in the Bidding Document.
Domestic Bidders may use a Bid Securing Declaration if they so wish.

D. Submission and Opening of Bids

ITB 22.1 In addition to the original of the bid, the number of copies required is: Two (2)

Note:
All Bids will first be registered at the address shown in ITB 7.1 before being
deposited in the Tender Box situated at Ground Floor, ESCOM House
(Annex Building). The Corporation will not be held liable for Bids that are
not registered.

E. Evaluation, and Comparison of Bids

ITB 31.3 The methodology to adjust the price to reflect the price of the missing or
nonconforming item or component is : Not Applicable.
ITB 34.1 The currency that shall be used for bid evaluation and comparison purposes to
convert all bid prices expressed in various currencies into a single currency is:
Malawi Kwacha, the source of exchange rate shall be the Reserve Bank of
Malawi rate ruling at 14 days before the Bid Opening date.

ITB 35.1 A margin of preference shall not apply.

Where a margin of preference applies, the application methodology is shown in
Section 3: Evaluation Methodology and Criteria.
ITB 36.6 Multiple awards to one Bidder will be permitted.
The evaluation methodology to determine the lowest-evaluated combination of lots
shall be detailed in Section 3: Evaluation Methodology and Criteria.

F. Award of Contract
ITB 40.1 Award shall be on a lot by lot basis, and ESCOM reserve the right the reject
lots with overpriced individual items.
ITB 41.1 The percentage by which quantities may be increased is: 15%
