Acollectionofpersonalinformationinthecustody orcontrolofaninstitutionwouldbeapersonalinformationbankifit
hasthefollowingcharacteristics:
itmustcontainpersonalinformation
informationcontainedinthebankmustbeacollectionoflikeorsimilarinformationaboutindiv iduals
informationmustbelinkedtoanidentifiableindiv idualand
theinformationmustbecapableofbeingretriev edby theindiv idual'snameoridentify ingsy mbol(suchasaclient

Forexample:Apubliclibrary 'scirculationrecordsthatcontainthenames,addressesandborrowingrecordsofpatrons

Institutionswilloftenhav ecollectionsofrecordscontainingsomepersonalinformation,butthesedonotmeetthe
criteriaforthedefinitionofapersonalinformationbank(e.g.,recordsofpurchaseordersorgeneralcorrespondence).
TheActdoesnotrequireaninstitutiontorearrangeitspersonalinformationintopersonalinformationbanks.
Collectionsofpersonalinformationthatmeetthecharacteristicsofapersonalinformationbank(assetoutabov e)must
beidentifiedanddescribedby theinstitution.Generally ,indiv idualshav earighttoinformationaboutthemselv es

Theheadmay delegatethepowersanddutiesinwritingtoanofficerorofficersoftheinstitutionor,underMFIPPA,of
anotherinstitution.Thedelegationwouldusually betoaposition,ratherthantoanamedindiv idual.Thedocumentthat
setsoutthedelegationshouldmakeclearthedutiesandfunctionsbeingdelegated.
Forexample:Theheadmay wishtodelegateroutinedutiessuchassendingoutnotices(e.g.,acknowledgmentletters,
feeestimates),preparingtheannualreport,anddecidingthefeestobecharged,butmay retainparticularly important
dutiessuchastheauthority todecideifanexemptionfromdisclosureapplies.
AppendixIIIcontainssomesamplesofwrittendelegationsundertheAct,showingallthepowersandresponsibilities
thatmay bedelegated.
Itisimportanttodelegateresponsibilitiestoanofficerorofficersofaninstitutionwho,ifrequired,hav eaccessto
decisionmakersandwhocanactquickly withinthetimeperiodsprescribedintheAct.
ConflictofInterest
Aconflictofinterestmay existwhereapublicofficialknowsthathe/shehasapriv ateinterestthatissufficiently
connectedtohis/herpublicdutiestoinfluencethosepublicduties.Thefocusforconflictofinterestisfrequently
financialmatters.Itmay alsoarisewhentheheadismeetinghis/herdecisionmakingresponsibilitiesundertheAct.
Aheadmay beinaconflictofinterestsituationwhereitisreasonabletoassumethathe/sheismakingdecisionsbased
ontheirpersonalinterestratherthanthepublicinterest.Insomeinstances,theconflictofinterestmay bemore
apparentthanreal.Itisrecommendedthatdelegationsofthehead'spowersreflectthepossibility ofconflictofinterest
andprov ideforalternatedecisionmakersinthoseinstances.

DeterminingSecurityRequirements
Beforeestablishingmeasuresprotectingrecordsfromunauthorizedaccess,aninstitutionshoulddeterminethedegree
towhichaccesstoitsrecordsshouldbecontrolled.Althoughitmay benecessary todetermineappropriatelev elsof
accesstoindiv idualdocumentsorfiles,usually thisdeterminationwouldbeonthebasisofrecordseries.When
consideringaccesscontrolsforrecordseries,thelev elofsecurity shouldbeappropriateforthemostsensitiv e
informationintheseries.
Allrelev antfactorsshouldbetakenintoaccountindeterminingwhetheraccesstorecordsshouldbecontrolled,andthe
scopeandextentofthosecontrols,including:

isseekingaccesstohis/herownpersonalinformation,therequestmustalsoidentify thepersonalinformationbankor
thelocationofthepersonalinformationbeingrequested.If,afterathoroughsearch,theinstitutioncannotlocatethe
requestedpersonalinformationandtherequestercannotprov ideany credibleev idencetosupporttheexistenceof

Sometimesarequestmightbeintheformofaquestion.Forexample,arequestermightwrite,"Doesthisinstitutionhav e
any informationontenders?"Inthissituationitisunlikely thattheinstitutioncoulddeterminewhatinformationthe
requesterwants.Forthisreason,requestsintheformofquestionsarenotgenerally acceptableandshouldbeclarified
withtherequesterbeforeproceedingtoprocesstherequest.
Thereisaprescribedformforaccessrequests,howev er,aletterthatmakesreferencetotheActwouldbeconsidereda
requestifaccompaniedby therequiredapplicationfeeof$5.00.Ifaninstitutionisindoubtaboutwhetherornota
requesterwishesaletterofinquiry tobetreatedasarequestundertheAct,therequestershouldbecontactedand
clarificationoftheinquiry obtained.

Inresponsetoarequestfortherecord,theinstitutionwouldadv isetherequesterthattherecorddoesnotexist.
Arequestmay alsobemadeforaccesstorecordsthatarecapableofbeingproducedfromamachinereadablerecord
usingthehardware,softwareandtechnicalexpertisenormally usedby theinstitution.
Forexample:Aninstitutionmay generateareportinacertainformatfromdatainacomputerfile.Arequesterunder
theActmay askforadifferentkindofreportusingthesamecomputerdatasortedorpresenteddifferently .

Personalinformationonmagneticmediasuchastapeordiskshouldbedisposedofby magneticerasureorby
destructionofthemedium,whenthemediumisreleasedfromtheprocessingenv ironment.Wherethemediumis
retainedandreusedwithinasecureprocessingenv ironment,howev er,personalinformationmay bedisposedofby

Authorizationofhead:Wherepersonalinformationisinthecustody orunderthecontrolofaninstitution,no
personshalldestroy itwithouttheauthorizationofthehead.Theheadmay delegatethisresponsibility .The
authorizationmay apply tospecificdataortogeneralclassesorcategoriesofrecords,andmustbeconsistentwith
any retentionorothermanagementrequirementwhichmay apply totherecordofpersonalinformationthrough
legislationorpolicy .
Protectingsecurity andconfidentiality :Theheadshallensurethatallreasonablestepsaretakentoprotect
thesecurity andconfidentiality ofpersonalinformationthatistobedisposedof,includingprotectingitssecurity
andconfidentiality duringitsstorage,transportation,handlinganddestructionortransfertotheArchiv esof

Exceptiftheappealconcernsarequestforcorrection,theappellantmakeshis/hersubmissionswithouttheopportunity

Thefactthataparty isnotentitledtoaccessanoppositeparty 'ssubmissionsdoesnotmeanthatthey areprohibited
fromseeingthem.Inrestrictedcircumstances,theCommissionermay permitaparty tohearorrev iewthesubmissions

Onoccasion,institutionsareaskedtoprov ideinformationtotheCommissionerinaffidav itformtoestablishthat
recordsdonotexistorthatanadequatesearchwasundertaken.Anaffidav itisawitnessstatementthatdeclaresunder
oaththatacertainsetoffactsaretrue.Thepersonswearingoraffirmingthestatementrev iewsandsignsitbefore
aCommissionerforOathsoralawy er.InappealinquiriesbeforetheIPC,anaffidav itisacceptableasev idenceinthe
sameway asoraltestimony giv enunderoath.ItisacriminaloffenceundertheCriminalCodetoswearafalseaffidav it.
TheEffectofaCommissioner'sOrder
Afterreceiv ingsubmissionsfromtheinterestedparties,theCommissionerwillissueabindingorderthatisnotsubject
toappeal.Anordermay concludewithastatementrequiringtheinstitutiontodisclosetherecordsreferredtointhe
orderwithin35day sfollowingthedateoftheorderandnotearlierthanthe30thday followingthedateoftheorder.
Day oneisthefirstday afterthedateoftheOrder.Therefore,iftheOrderwasdatedMay 1,thecountingstartsonMay 2
