Galdjie v Darwish (SC052737) - Minutes, as printed from Sustain, the Court’s case management
system, provide unique example of the alleged fraud in conduct of the litigation as well as the fraud
inherent in Sustain – the case management system of the court.

Minutes in the case document litigation that was administered with no semblance of compliance with the law.
• Judges and clerks with no authority at all entered false records in the case management system.
• The case was juggled back and forth among a group of judges with no authority at all.
• Notice and service were routinely “waived”.
• Minutes were routinely back dates, at times by months.
• No Initial Case Conference was ever held.
• No Trial Setting Conference was ever held.
• Jury trial was “waived”, and the case transferred on the same day, with no authority at all to a Municipal
Court.
• No judgment was ever entered.
• No order appointing receiver was ever entered.
• No writ of execution was ever issued.
• No conveyance of title was ever executed.

The minutes, as printed from Sustain, in themselves do not allow to determine if the one case, where minute
were possibly authenticated, were indeed noticed and served. The court denied repeated requests to access to
the Sustain log of notices mailed to parties, in alleged violation of First Amendment rights.

Defendants David Darwish, Barbara Kramar-Darwish, The
Barbara Kramar-Darwish and David Darwish Revocable
Living Trust, The 1319 Yale Street T~ust, Gingko
Rose, LLP and Loqerm, LLC's demurrer to the Second
Amended Complaint is sustained without leave to amend
as to all claims except the Ninth cause of action
against defendants Trust, Gingko Rose, and Logerm
LLC.
As to the individual plaintiffs and their living
trust, the demurrer is overruled as to the First,
Second, Third, Fourth, Fifth, Sixth, Seventh, Ninth,
Twelfth and Thirteenth causes of action. The demurrer
is sustained without leave to amend as to the Eighth
cause of action for conversion as it lacks specificity
regarding a sum certain, and the Tenth and Eleventh
causes of action for failure to allege a sum certain
and a basis for how the sums are owing by defendants.
Defendants' motion to strike portions of the Second
Amended Complaint. is granted as to attorneys fees,

MOTION FOR ORDER FIXING UNDERTAKING ON APPEAL;

Cause is called for hearing. The Court hears argument


by counsel. After argument by counsel the Court makes
the following ruling for the reasons stated in open
court and fully reflected in the verbatim notes of
the COLrt reporter.
The defendant's IT.otion is granted and the undertaking
is fixed at $399,000 pursuant to Section 917.4 of the
Code of Civil Procedure. The Court finds that the
property at issue in this case is in grave danger of
waste and loss of the value of use and occupancy due
to the conduct of defendants and appellants.
Defendants and appellants admit that they intend to
keep the building vacant of tenants "pending the out-
come o:E the appeal," and that "as matters now stand,
there will be no rental income from the Property while
the appeal is pending." Darwish Decl., 4:12-16. In
addition, there are environmental issues on the
property that defendants admittedly are not remedying.
Vangel v. Vangel, 116 Cal. App. 2d 615 (1953), on
which defendants and appellants exclusively rely, is
distinguishable because in this case, unlike Vangel,
plaintiff and appellant has no access to the property
to protect his interest in the property. Finally,
although both sides concede that the property has
appreciated since 1998, plaintiff and respondent
does not submit any evidence on which to fix the
