1. In or about and between January 2016 and February 2017, both dates

bJing approximate and inclusive, within the Eastern District of New York and elsewhere, the

d fondant FERNANDO MARTE, together with others, did knowingly and intentionally

conspire to import a controlled substance into the United States from a place outside thereof,

ich offense involved a substance containing cocaine, a Schedule JI controlled substance,

c trary to Title 21, United States Code, Sections 952(a) and 960(a)(l). The amount of

cocaine involved in the conspiracy attributable to the defendant as a result of his own

co duct, and the conduct of other conspirators reasonably foreseeable to him, was five

lci ograms or more of a substance containing cocaine.

2. On or about February 7, .2017, within the Eastern District of New York

a d elsewhere, the defendant FERNANDO MARTE, together with others, did knowingly

d intentionally impott a controlled substance into the United States from a place outside

t ereof, which offense involved five kilograms or more of a substance containing cocaine, a

S hedule II controlled substance.

CRIMINAL FORFEITURE ALLEGATION

3. The United States hereby gives notice to the defendant that, upon his

q nviction of either of the offenses charged hetein, the government will seek forfeiture in
a: cordance with Title 21, United States Code, Sections 853(a) and 970, which require any

p rson convicted of such offenses to forfeit: (a~ any property constituting, or derived from,

y proceeds obtained directly or indirectly as the result of such offense, and (b) any

p operty used, or intended to be used, in any manner or part, to commit, or to facilitate the
i

c mmission of, such offenses.


4. If any of the above-described forfeitable property, as a result of any act

omission of the defendant:

(a) cannot be locatedfpon the exercise of due diligence;

(b) has been transfen-bd or sold to, or deposited with, a third pa1ty;

(c) has been placed bbyond the jurisdiction of the court;

(d) has been substant~ally diminished in value; or
