ExecutivebranchexecutesthelawandtheJudicialbranchinterpretsthelaw.Havingidentifiedthesethree
branches,itmustalsobenotedthatapowerfulpoliticalpartyingovernmentnegatestheeffectivenessofthe
parliament.
ThereishoweveralackofsuchevidencepertainingtotheseparationofpowershereinMalaysia.Inhis1970book
TheMalayDilemma,ourformerPrimeMinisterandUMNOstrongmanstatedthat,Inthemain,Parliamentary
sittingswereregardedasapleasantformalitywhichaffordedmembersopportunitiestobeheardandquoted,but
whichwouldhaveabsolutelynoeffectonthecourseoftheGovernment.Thesittingswereaconcessiontoa

Checksandbalancesaretheretoprotectthecitizenslibertyandnationsdemocracy.Parliamentarydemocracy

(Executive)andCabinetMinisters(Government)areselectedfromtheParliament(Legislative),andthesepostings
areusuallyfromthecoalitionofBarisanNasionalcomponentparties(orwecansay,thewinningparty).Eventhe
Judiciaryareselectedbythiswinningpartyandnotelectedbytheirpeers.Thisfusionofallthreebranchesmakes
thisnetworkofchecksandbalancesalmostcomicalandalmostobsolete.Isaidalmostobsoleteforthereasonthat
theprospectforgoodandresponsiblegovernanceisstillinexistencehere,buttheprobabilityofcorruptionwithout
discoveryisalsohigherinagovernmentwithouttheproperseparationofpowers.
Nodemocraticsystemexistswithanabsoluteseparationofpowersoranabsolutelackofseparationofpowers.It
mustbebalancedwithaviewtotheimprovingofthesocietyandthenationasawhole.Absoluteseparationof
powersslowsdownthegovernmentwhilstthelackofseparationofpowerspromotescorruptionandtyranny.
Withthisapparentdilemma,howcanMalaysiabegovernedfairlyandresponsibly?Hencethechecksandbalances
byindependentagenciesandcommissionsthatpossessfullprosecutionpowersandlegalauthoritytobringthe
perpetrator(s)ofsuchunlawfulactstoacourtoflawpresidedbyanimpartialjudgethatiselectedbyhispeersand
endorsedbyParliament.Accountabilitymusttakeprecedenceovereverything.Thisishoweverabsentwithinthe
Malaysiansystemoflawandorder,andoffairandresponsiblegovernance.
