trespassing Law (R.A. 3828) your evaluation and proper disposition wherein the
person accused is one.

SUSPECT: Joshua Dasalang 25 yrs old, native of Tondo Manila, married, jobless and
presently residing at Brgy. Dela paz Antipolo City.

VICTIM: Ernesto Nobena 35 yrs old, native of Cebu City, single, businessman, and
presently residing at kamias St. Antipolo City

FACTS OF THE CASE:

On or about 1:30 PM, Feb. 18, 2016 in a private house of Mr.

Ernesto Nobena at kamias St. Antipolo city, a trespassing incident transpired. While
Mr. Ernesto Nobena went to his work there is a person entered to his land identified
as Mr. Joshua Dasalang. Mr. Joshua Dasalang tried to get the laptop of Mr. Nobena
but he failed because he has been saw by Mr. Jomar Demata Security Guard of the
house. Base on his statement he saw Mr. Joshua Dasalang getting the laptop of Mr.
Ernesto Nobena. He immediately call a police to arrest the suspect. The police
responder PO1 Kevin Deguzman and PO1 kyle Clemente immediately captured the
suspect.

2. ICOW the above and reference please be informed that on or about February
18,2016 at 1:30 PM at the private house along Kamias St. Antipolo City a
Trespassing incident transpired where in the suspect identified as one Joshua
Dasalang 25 yrs old, Native of Tondo Manila, married, jobless an presently
residing at BRGY Dela paz Antipolo City and the victim identified as one
Ernesto Novena 35 yrs old, native of Cebu City, businessman, single and
presently residing at Kamias St. Antipolo City
3. On initial investigation conducted showed that on cited TPDO while above
named victim was came from his work there is a person entered to his
property. The suspect trying to get the laptop of Mr. Ernesto Novena, but he
failed because the Security of the property saw him. The security guard
immediately call a police to arrest the suspect and after the police responded
lead by PO1 Kevin De Guzman and PO1 Kyle Clemente immediately captured
the suspect.

Facts: ON Cited TPDO while the victim went to his work there is a person
entered to his house or his property identified as the suspect. The suspect
tried to get the laptop of the victim but he failed because the security Guard

commencing from 8:00 AM to 8:00 PM daily:

That on or about 1:30 PM of February 18, 2016, while we were on our duty
in Antipolo City District we receive a Call into this office that trespassing incident
transpired along Kamias St. Antipolo City we immediately respond to arrest the
suspect, identified himself as Mr. Joshua Dasalang ; 25 yrs. Old, native of Tondo
Manila married, jobless and presently residing at BRGY. Delapaz Antipolo City.

That, the suspect was apprised of his constitution rights who prepared to
remain silent Antipolo City Police together with the Complainment identified as one
Ernesto Nobena 35, yrs. Old native of Cebu City, single, business, and presently
residing at Kamias St. Antipolo City.

TRESPASSING

Trespass is an entry onto land without the consent of the landowner. This section explains the
intent and knowledge requirements, express consent, implied consent, and the differences
between criminal and civil trespass.
An unlawful act committed against the person or property of another; especially, wrongful entry on
another's real property.

ELEMENTS OF TRESPASSING

Continuing Trespass: A trespass in the nature of a permanent invasion on another's rights, such

as a sign that overhangs another's property.

Criminal Trespass:1) A trespass on property that is clearly marked against trespass by signs or

fences. 2) A trespass in which the trespasser remains on the property after being ordered off by a
person authorized to do so.

Innocent Trespass: A trespass committed either unintentionally or in good faith.

Joint Trespass: A trespass that two or more persons have united in committing, or that some have

actually committed while others commanded, encouraged, or directed it. [1]

If you are convicted of criminal trespassing as a misdemeanor, the most common type of
conviction, then you will face:

Up to one year in county jail

Up to $1,000 in fines

If you are convicted of criminal trespassing as a felony, also known as aggravated trespassing
then you will face:
 Up to three years in state prison

Up to $2,000 in fines

S: Nais ko pong tumistigo sa illegal na pag pasok sa binabantayan kong tirahan.

T: Kailan at saan naganap ang sinasabi mong ileegal na pagpasok sa iyong
binabantayang tirahan?

S: Noon pong ika 18 ng pebrero sa taong kasalukuyan sa Brgy. Delapaz Antipolo

City.

T: Sino naman ang nakita mong pumasok sa bahay ?

S: Si Joshua Dasallang po ang nakita kong pumasok sa aking binabantayang

tirahan.

T: Maari mo bang isalaysay ang buong pangyayari kung iyo pang natatandaan?

S: Opo, Noon pong sinabi kong araw, oras, at lugar, Habang ako po ay naka duty sa
binabantayan kong tirahan nakita ko po si Joshua Dasallang na bigla na lang pong
pumasok sa bahay at pilit na inaabot ang laptop ng may ari ng binabantayan kong
tahanan. Agad po akong tumawag sa inyong tanggapan upang mahuli itong si
Joshua Dasallang.

T: Nasaan na ito ngayong sinasabi mong si Joshua Dasallang?

S: Agad po siyang hinuli ng mga rumispundeng mga pulis.

T: Sino sino naman ang mga pulis na sinasabi mong humuli kay Joshua Dasallang?

S: Si PO1 Kevin Deguzman at PO1 Kyle Clemente na pawang naka duty sa inyong
tanggapan.

T: Pansamantalang wala na muna akong itatanong sa iyo may nais ka bang idagdag
o ibawas sa iyong salaysay?

S: Wala nap o.

T: Ikaw ba ay nakahandang lumagda sa ibaba ng iyong salaysay bilang patunay na

ikaw ay hindi tinakot, sinaktan, at pinangakuaan ng anumang mahalagang bagay at
ito ay kusang loob mo?

S: Opo
