ACCUSED, through the undersigned counsel, before this Honorable Court,

most respectfully submit this Pre-Trial Brief:

SUMMARY OF ADMITTED FACTS

AND PROPOSED STIPULATION OF FACTS

The accused admit the following:

1. the identities of those charged in the information and that of the
persons arraigned are one and the same;
2. the identity of Cheska U. Moza-Olalia, the victim;
3. the killing of the victim

EVIDENCE FOR MARKINGS

1. Affidavit of accused, Albert U. Olalia

Purpose: to prove that he did not do the killing of the victim;
2. Life Insurance Policy No. 034768060
Purpose: to prove Alberts motive in killing his wife being designated as the
irrevocable beneficiary;
3. Affidavit of an insurance agent, Marifelle Isip
Purpose: to prove that the husband has motive to kill the victim because of the
enormous insurance proceeds;
4. Affidavit of Dr. Donna Ingusan
Purpose: to prove that the assailant used his right hand to kill the victim
although he was not proficient in using the same;
 5. Affidavit of Marius Sumira
Purpose: to prove the character of the accused and the husband of the victim,
Alfred Olalia

ISSUES

1. Whether or not the accused committed the crime charged;

2. Whether or not he was guilty thereof.

WITNESSES

1. Accused Albert U. Olalia to testify on the matters and circumstances

attending the killing of the victim;
2. Witness Marifelle Isip to testify on the existence of the insurance
contract and the designation of Alfred Olalia as the irrevocable beneficiary;
3. Dr. Donna Ingusan to testify on the use of right hand of the assailant to
kill the victim;
4. Witness Marius Sumira to testify on the character of the accused and
the husband of the victim, Alfred Olalia
