Re: Jesse Jackson, Jr. Dear Mr. Collette: ‘This letter will confirm our conversation of August 12, 2015 with respect to your client, Jesse Jackson, Jr. Mr. Jackson has informed the government of potential violations of law by him and others, and has indicated that he desires to undertake certain actions, including participating in monitored and/or recorded telephone and/or email conversations and meetings, with the intention of providing the government with additional information regerding these potential violations of law. In undertaking these actions, Mr. Jackson and you agree that the investigative agents of the government may communicate with Mr. Jackson without Mr. Jackson's attomey being present. It is understood that of this date, no cooperation agreement exists between Mr. Jackson and the government, It is further understood that these actions to be undertaken by Mr. Jackson are not part of any agreement by the goverment to make @ motion Mr. Jackson's behalf pursuant to Section 5K1.1 of the United States Sentencing Guidelines ("US.S.G-”). Nothing herein shall be construed as an agreement by thc government to enter into a cooperation agreement with Mr. Jackson, or as an agreement by the government not to prosecute Mr. Jackson. It is further agreed that any downward departure from the Sentencing Guidelines for substantial assistance is only permissible pursuant to a motion by the government, and that Mr. ‘Fackson shall not seek a downward departure on the basis of any assistance rendered pursuant to this letter under U.S.S.G.
