The PUNJAB YOUTH COUNCIL BILL 2016


A
Bill
to establish the Punjab Youth Council.

WHEREAS it is expedient to establish a Youth Council to develop and promote Youth potential, Put
Youth in forefront of development paradigms, activate Youth for good governance, effective Youth
participation;

It is enacted as follows:

Short title, extent and commencement

1) This Act may be called the Punjab Youth Council Act 2016.
2) It extends to the whole of the Punjab.
3) It shall come into force at once.

1. Definitions

In this Act;
i. Act means the Punjab Youth Council Act 2016;
ii. Council means the Punjab Youth Council;
iii. Board means the Board of Governors of the Council constituted under section 6;
iv. Chairperson means Chairperson of the Board;
v. Minister means Provincial Minister of the Punjab;
vi. Chief Minister means Chief Minister of the Punjab;
vii. Member means a member of the Board includes persons under i, ii, iii, iv and v of Section 6(3);
viii. Elected means elected in the last elections held under the Punjab Local Government Act 2013;
ix. Prescribed means prescribed by rules or regulations made under the Act;
x. Nominating Authority means the person who have power to nominate a member or Office Bearer
under this Act;
xi. Office Bearer means the person having the office of the council under Section 10(II);
xii. Executive Director means Executive Director of the Council; and
xiii. Ward, Union Council, Municipal Committee, Municipal Corporation, Metropolitan Corporation,
Government and Local Government shall be defined as in the Punjab Local Government Act 2013.

2. Incorporation

1) The Council shall be incorporated in accordance with the provisions of the Act.
2) The Council shall be a body corporate having perpetual succession and a common seal with power
to acquire, hold and dispose of movable and immovable property and may sue and be sued by the
said name.
3) The Council shall not, without prior approval of the Government, sell, mortgage or permanently
alienate any of its property or raise loans or advances.
3. Functions
The Council shall;

1) Provide Youth the opportunities to access the quality higher, technical and professional education.
2) Protect, restore and enhance the environment, to ensure public health, environmental quality and
economic vitality.
3) Facilitate Youth to protect them against hazardous diseases and to achieve and maintain healthy
lives.
4) Improve the quality of Youth life and alleviate poverty by enhancing their access to financial
services.
5) Promote respect for human dignity transcending religious, sectarian, racial, geographical, cultural,
linguistic, and ideological and gender differences.
6) Provide sports and recreational opportunities that contribute to the six dimensions of wellness,
physical, emotional, social, spiritual, intellectual and environmental.
7) Organize the Youth, enhance their capacities in order to harness their potential and resources to help
themselves.
8) Enlighten Youth with the ideology of Pakistan and prepare them for community leadership, drugs
eradication, emergency response, humanitarian assistance and women development.
9) Perform any other function which incidental to any of the above functions or as may be prescribed.

4. Funds

The funds of the Council shall comprise -


i. Grants made or loans advanced by the Local Government, or the Federal Government or any
Provincial Government;
ii. Aid and assistance, contributions, grants, advances, donations and other non-obligatory funds
received from any person, corporations and other body or entity, national or international agency;
iii. Nominations Fees, Program Name Sponsors, Project Partners, Sponsorships, Charity events,
Charity Business Projects;
iv. Income generated from various activities of the Council like classes, rental charges of facilities,
fees of consultancies and services, etc.;
v. Any other source approved by the Board.

5. Punjab Youth Fund

The Council shall create a fund to be known as the Punjab Youth Fund. The Board shall manage the fund
and authorize expenditures of the Council.

6. Board of Governors

1) The management, overall control and supervision of the affairs of the Council shall vest in a Board
of Governors.
2) The Chief Minister shall be Patron in Chief of the Council.
3) The Board shall consist of eighteen members including;

i. The Minister Local Government & Community Development or any other Minister or
Parliamentary Secretary nominated by the Chief Minister as the Chairperson;
ii. The Minister Social Welfare & Bait-ul-Maal or any other Minister or Parliamentary
Secretary nominated by the Chief Minister as the Vice Chairperson;
iii. Twelve Program Advisors [including at least four women] as members;
iv. The President, Senior Vice President and Secretary General of the Provincial Youth
Committee as members; and
v. Executive Director, Punjab Youth Council as ex-officio members who shall also be the
Secretary of the Board.

4) The members of the Board of Governors shall be appointed for a term of two years but shall be
eligible for reappointment.

7. Program Advisors

The Chief Minister shall nominate the Ministers or the Parliamentary Secretaries or the Members of
Punjab Assembly as Program Advisors for the following organizational Programs;

1) Drugs Eradication Program


2) Education Program
3) Emergency Response Program
4) Environment Program
5) Health Program
6) Humanitarian Assistance Program
7) Livelihood Program
8) Peace Program
9) Sports Program
10) Women Development Program
11) Youth Leadership Program
12) Youth Mobilization Program
13) Any other Program proposed by the Board

8. Functions of the Board

The Board shall


a) Act as a resource and provide vision in the light of the chartered functions of the Council leaving
the routine work to the functionaries of the Council;
b) Approve budget of the Council;
c) Approve Projects, Programs and major activites for the Council;
d) Approve strategies, policies and procedures of the Council;
e) Approve functions of the Executive Youth Committees, powers and responsibilities of the Board
Members and the Office Bearers; and
f) Approve financial and other cases not within the competence of the Executive Director or, as the
case may be, Chairperson.

9. Meeting of the Board

1) The Board shall meet at least three times a year.


2) The Chairperson or, in his absence, the Vice Chairperson shall preside over a meeting of the Board,
and, in the absence of the Vice Chairperson, the members present at a meeting shall nominate a
member to preside at that meeting.
3) One third of the total members shall constitute the quorum for a meeting of the Board.
4) All decisions of the Board shall be made by majority of votes of members present and voting and, in
case of a tie; the person presiding shall have the casting vote.
5) All members shall perform their duties without any remuneration except such travelling and daily
allowance as may be prescribed.

10. Executive Youth Committees

I. The organization of the Council shall vest in the following Executive Youth Committees:-

i. Community Youth Committee; The elected General Councilor of the Ward shall be Patron and
shall nominate the Office Bearers of the Community Youth Committee.
ii. Union Youth Committee; The elected Chairman of the Union Council shall be Patron and shall
nominate the Office Bearers of the Union Youth Committee.
iii. Municipal Youth Committee; The elected Chairman of the Municipal Committee shall be
Patron and shall nominate the Office Bearers of the Municipal Youth Committee.
iv. District Youth Committee; The elected Chairman of the District Council or the elected Mayor
of the Municipal Corporation / Metropolitan Corporation shall be Patron and shall nominate
the Office Bearers of the District Youth Committee.
v. Provincial Youth Committee; The Minister Youth Affairs and Sports of the Punjab or any
other Minister or Parliamentary Secretary nominated by the Chief Minister shall be Patron
and shall nominate the Office Bearers of the Provincial Youth Committee.
II. The organizational Executive Youth Committees of the Council shall have the following office
bearers for their business;
1) A Parton
2) A President
3) A Senior Vice President
4) Vice President(s)
5) A Secretary General
6) A Secretary Finance
7) A Secretary Media
III. There shall be a Vice President for each Division in the Provincial Youth Committee and a Vice
President for each Tehsil / Town in the District Youth Committee.
IV. The term for the office bearers shall be 4 years. They would continue to serve until new office
bearers are nominated to replace them.

11. Meetings of the Executive Youth Committees

1) The Executive Youth Committees shall meet at least six times a year.
2) The President or, in his absence, the Senior Vice President shall preside over a meeting of the Executive
Youth Committee, and, in the absence of the Senior Vice President, the Vice President shall preside over a
meeting.
3) One third of the total members shall constitute the quorum for a meeting of the Executive Youth Committee.
4) All decisions of the Executive Youth Committee shall be made by majority of votes of Office Bearers present
and voting and, in case of a tie; the person presiding shall have the casting vote.
5) The Office Bearers shall perform the duties without any remuneration except such travelling and daily
allowance as may be prescribed.

12. Delegations of Powers

The Board or Executive Youth Committee may, subject to such conditions and limitations as it may impose,
delegate any of its functions to the Chairperson, Vice Chairperson, Secretary, a committee or to an institution
or authority established under any law except the function to:
a) Make, amend or repeal regulations;
b) Constitute a committee or fill a vacancy in a committee; or
c) Approve any project, annual budget, audited accounts and annual report of the Council.

13. Age limit for the Office Bearers

i. Any Pakistani Young Citizen between 18-35 years of age having domicile of the Punjab may be
nominated as Office Bearers of an Executive Youth Committee without any discrimination of gender,
religion, colour, creed etc.
ii. The age limit shall not apply to the Patron (All Executive Youth Committees), Board Chairperson,
Board Vice Chairperson and Program Advisors.
14. Disqualifications

No person shall be nominated or shall continue as the Chairperson, Vice Chairperson, Program Advisor or
Office Bearer of the Executive Youth Committee, if he:
a) Has been convicted of an offence involving moral turpitude; or
b) Has been found guilty of misconduct; or
c) Has been declared to be of unsound mind by a competent court; or
d) Has been or is adjudged as un discharged insolvent; or
e) Is incapable of discharging his duties by reason of physical or mental infirmity and has been so declared by a
Special Medical Board appointed by the Board; or
f) Is an employee or member of the staff of the Board other than the Executive Director; or
g) Fails to disclose any conflict of interest at or within the time provided for such disclosure by or under this
Act or contravenes any of the provisions of the Act; or
h) Stands disqualified by the order of the Court to hold any public office; or
i) Fails to attend more than three consecutive meetings of the Board without leave.

15. Executive Director

The Executive Director shall;


a) Be the Chief Executive of the Council and shall be appointed by the Board ordinarily for a period of three
years which period may be extended by the Board if deemed appropriate;
b) Act as Secretary to the Board and shall maintain record of its proceedings;
c) Make strategies, policies and procedures for the nominations, meetings, finance, fund raising, assets
management, networking and partnerships, dispute resolution, suspension & expulsion of office bearers,
programs, projects, organizational activities, human resource management and other important matters of the
Council; and
d) Act as Senior Purchase Officer for procurement of stores in terms of the Purchase Manual.

16. Staff

The Council may employ such persons as may be necessary for the efficient performance of its functions in
such manner and on such terms and conditions as may be prescribed.

17. Casual Vacancy

The nominating authority shall fill a casual vacancy caused owing to removal or permanent absence of a
member, other than an ex-officio member, for the unexpired period of the term of the member.

18. Resignation

1. The Chairperson or Vice Chairperson or Program Advisor or Executive Director may resign his office
by tendering his resignation in writing to the Patron in Chief of the Council.
2. An Office Bearer may resign his office by tendering his resignation in writing to the Patron of the
Executive Youth Committee.

19. Removal
The nominating authority may, at any time, remove an office Bearer, other than an ex-officio member, from
the Board or the Executive Youth Committee without assigning any reason.

20. Budget

The Executive Director shall prepare annual budget comprising the expected income and expense for the
ensuing financial year and submit it to the Board for approval in such form and manner as may be
prescribed.

21. Accounts

1) The Council shall maintain proper accounts and other records relating to its financial affairs including its
income and expenditure and its assets and liabilities in such form and manner as may be prescribed.
2) The Board may open and maintain its accounts in a scheduled bank approved by the Government.
3) After the end of a financial year, the Council shall prepare the statements of account which shall include a
balance-sheet and an account of income and expenditure during the last financial year.

22. Audit

The accounts of the Council shall be annually audited by a Chartered Accountant or a firm of Chartered
Accountants or as may be prescribed by the Board.

23. Immunity

No suit, prosecution or other legal proceedings shall lie against the Council, Patron, Chairperson, Vice
Chairperson, member, Officer Bearer, Executive Director, consultant, officer or other employees of the
Council in respect of anything done or intended to be done in good faith under the Act.

24. Annual Report

1) The Council shall, within three months of the close of a financial year, submit to the Government an
annual report.
2) The report shall consist of:
a) The statement of accounts of the financial year;
b) A comprehensive statement of the work and activities of the Council during the preceding
financial year;
c) Future plans and projects; and
d) Such other matters as may be prescribed or as the Board may consider appropriate.

25. Rules

The Board may, by notification, make rules for carrying out the purposes of this Act.

26. Regulations

Subject to the Act and the rules, the Board may, by notification, frame regulations to give effect to the
provisions of the Act.

STATEMENT OF OBJECTIVES AND REASONS

A large set of Pakistani youth is dissatisfied, frustrated and in a state of disarray due to low education levels
and large scale unemployment. This has led to serious social problems including drug abuse, crime, mental
disorder, terrorism and religious fanaticism. Despite of all these factors, Pakistani Youth believes that
community issues can be resolved more effectively by Putting Youth in forefront of development paradigms
and developing coordination of the community Youth groups with public representatives and government
institutions. Pakistani Youth envisions A peaceful democratic society; where Youth have enormous
economic opportunities and better social services.

We cannot always build the future for our youth, but we can build our youth for the future. Therefore, The
Punjab Youth Council bill 2016 is introduced to the Punjab Assembly to establish The Punjab Youth
Council with the mission to organize the Youth of Punjab, enhance their capacities and synergize their
efforts for socio - economic development in their communities.
