SUMMARY

That on or about 6:39 pm of April 3, 2017, while taking a walk in Quezon City
Memorial Circle with the victim, JUAN SAN JUAN, did then and there, willfully,
unlawfully, and feloniously, with malice and premeditation attacked the latter with a
knife, wounding him on the back, producing wounds which are necessarily fatal, thereby
causing immediate death.

STIPULATION OF FACTS

Admitted

The Defense Counsel admitted the existence and veracity of the documentary exhibits
such as the business license of the TRASH THAT JUNK SHOP.

The Prosecution admitted the existence of the a receipt from Jollibee SM North EDSA.

Disputed

Version of the Prosecution:

That on or about 6:39 pm of April 3, 2017, in Quezon Memorial Circle, Pedro San
Pedro stabbed Juan San Juan three times on the back, causing instantaneous death.

Version of the Defense:

That on or about 6:39 pm of April 3, 2017, Pedro San Pedro was not in Quezon
Memorial Circle and was in SM North Edsa with his wife.

Issues to be resolved

Whether or not the accused committed the crime as charged.

HEARING DATES

The trial date is set on July 26, 2017, September 2, 9, 16, 23, 2017 at 7:30 AM.
It is understood that the testimony of the witness should be completed on the scheduled
date of hearing allotted to said witness under the One-day Examination of Witness Rule.
The Court however, has the discretion on whether or not to extend the direct and/or
cross examination of witnesses for good cause shown.
Failure of the party or his counsel to comply with the aforementioned schedule of
hearings and deadlines may be a ground for imposition of fines and other sanctions by
the Court.
