You, C.O. Sanford Speight, were working as a search officer in (Intake, HCJC) along with C.O. Robert Pangallo on
February 2, 2015, at approximately 0300 hrs. when Mr. Scott Myron (1558467), entered into the Hamilton
County Justice Center. Mr. Hudgins had been arrested by an officer from the Cleves Police Department, for
"Disorderly Conduct While Intoxicated." You stated that you were attempting to assist C.O. Pangallo in securing Mr.
Hudgins but by the time you got involved Mr. Hudgins was already being held by C.O. Pangallo and Sergeant
Elsasser. You were asked during our interview "did the guy (Mr. Hudgins) come up with his hands at all as to defend
himself or come at you in any way?" and your answer was "No sir." Mr. Hudgins' arms were being held down and
he was against the wall. He was unable to defend his face from your punch (closed fist). Prior to you striking Mr.
Hudgins you grabbed Mr. Hudgins' head and manipulated it in such a manner to get it placed in a position for you to
punch him in the face. The manipulation of Mr. Hudgins head was done so there were no obstructions in your way to
get a clear punch. Even though there was only one punch thrown to Mr. Hudgins' face and he was not injured, you
used excessive force. There was no need for you to strike Mr. Hudgins.

You are in violation of Hamilton County Sheriff's Rules, Regulations and Disciplinary Process, section:

2.0, Sheriff's employees shall conduct themselves at all times in such a manner as to reflect most favorably on
the Sheriff's Office. Conduct unbecoming an employee shall include that which brings the Sheriff's Office into
disrepute or reflects discredit upon the employee as a representative of the Sheriff's Office, or that which
impairs the operation or efficiency of the Sheriff's Office or its employees. Such offenses need not be
speCifically defined or set forth in this manual.

2.54 ShMiff's employees shall not verbally and/or physically mistreat persons who are in custody and shall
protect them from mistreatment by others. Sheriff's employees shall handle such persons in
accordance with the law and Sheriff's Office procedures.

2.55 Sheriff's employees shall not use more force in any situation tha11 is reasonably necessary under the
circumstances. Employees shall use force only in accordance with the law and Sheriff's Office
procedures, and shall report such use to the immediate supervisor in accordance with said procedure.

Disciplinary Action Justification

3.38 Employees shall be disciplined only for just cause. No employee shall be reduced in pay or position,
suspended or removed except for the following: incompetency, inefficiency, dishonesty,
drunkenness, immoral conduct, insubordination, discourteous treatment of the public, neglect of duty,
violation of such rules or section of the Director of Administrative Services or the commission or any
other failure of good behavior or any other acts of misfeasance, malfeasance or nonfeasance in office.
Specific actions of misconduct included but not limited, are as follows:
a. Failure to learn the laws and statutes which a member is sworn to enforce.
b. Failure to learn the rules, regulations, policies and procedures governing the operation of the
Sheriff's Office or respective division.
c. Violating a rule, regulation, policy or procedure of the Sheriff's Office or respective division
