Purpose <To prove that the property is co-owned by extra, pas away and sobrangbait>

Q. How are you related to the defendant?

A. He is my first cousin. Our parents are siblings

Q. Do you know the complainant? How are you related to her?

A. She is also my cousin

Q. Do you know Don Juan Luna? How do you know him?

A. He was my uncle.

Q. Were you close to Don Juan?

A. Yes. I lived with him when I was studying law at Law University of Cavite

Q. Can you describe your relationship with the defendant and complainant?
A. I am very close with the defendant and complainant as they also stayed with me at the
residence of Don Juan when they were also in college

Q. Where was the residence of Don Juan?

A. Bonggacious Street, Corner Paknapak Avenue, Bacoor, Cavite.

Q. How long did you stay at the residence of Don juan?

A. For four years throughout my law school life.

Q. And after that you moved where?

A. I went back in our province in Quezon to practice law.

Q. What year was that?

A. 2014

Q. When did Don Juan Luna died?

A. March 9 2015

Q. When you found out that Don Juan died, did you attend the burial?
A. Yes.

Q. Have you seen the defendant and complainant during the wake and/or burial of Don
Juan?
A. Yes we were all there.

Q. After that what happened?

A. The executor of Don Juan gathered me, pas away and sobrangbait and our parents in
one room right after the burial.
Q. What happened next?
A. The executor read the last will and testament to us

A. we found out that he left his residence to us

Q. To whom did he left his residence?

A. to me, pas away and Sobrangbait

A. after the settlement of the estate of Don Juan, we registered the property in our name:

A. Yes.

Q. For how long have you co-owned the property?

A. We havent really divided the property yet. so for maybe at least 5 now.

Q. and there has been no partition yet?

A. Yes.

Q. What is the nature of the property?

A. It is a four-door apartment

Q. Before you inherited the said property to Don Juan, was it already an apartment?
A. Yes

Q. Do you live there now?

A. No. I still live in our province in Quezon

Q. Who then lives in the apartment?

A. Pasaway lives at lot 4, while sorbing bait at lot 1 and lot 3 is being occupied by my
sister while lot 4 is being occupied by our tenant

Q. So are you saying that pas away and sobrangbait are occupying the said apartments
with your consent?
A. Yes since we all agreed to occupy one apartment each

Q. Is that agreement still binding?

A. yes

Q. Is that a written agreement?

A. No we just verbally agreed on such matter.
