Facts On The War On Drugs

Imagine you are sitting at home or your workplace with one thought coursing through

your mind, that you're being accused of doing drugs and have to take a test what are you going

to do? Well heres what you can do, the fourth amendment talks about us and our right to

freedom from unwarranted searches. With many drug tests could also turn up a false positive.

And in most cases you can turn down a search warrant but its not always a good idea.

Some say that drug testing is a violation to our right of privacy. And it is illegal for police

to search your homes without a good reason, so why should it be acceptable to search your

blood or urine without reason. Drug testing can also reveal other facts the someone might want

to keep private, and many drug tests result in false positives. Urine testing is when you are

given a plastic cup and told to piss in it then they will take it and you are told to wait while they

run it through the lab where the actual test is performed with multiple steps and procedures to

test for different or multiple substances that may or may not be present. With the right of

privacy it states that an officer or employer must have a probable cause, informed consent, and

continued of evidence to enter your premises or test you for anything.

In many cases you have the right to turn down any search without warrant. But if you

refuse a drug test you can end up with a police record. Also if you refuse a test or search it is

the same or be treated the same as an admission of guilt. In 1948 the united nations developed

the universal declaration of human rights this includes right to life, security, freedom, expression,

and education. Until fairly recent children had almost no rights even in the united states the law

considered children to be property of their parents. The dissenting justice said that random drug

tests violates the rights of many more. However some personal constitutional rights are waived

in schools for the greater of the entire student class. Although due to possible errors who ever

took the test if it comes back positive or a possible error occurred you can request for a second

re-test. The fourth amendment protects us from due process you have the right to ask what the

charges are and the penalties. But the decision must be based on a number of factors including

probable cause, age, history of behavior, and number of uses.

Today in some cases filling out/ taking a drug test is like filling out a job application. In

fact, the average workplace drug testing is up to 277% from 1987 and an in accurate and

unproven ways to stop the use of drugs. And claims of billions of dollars is lost because failed

drug testing due to guess work and not real evidence. Drug testing is not work related because

they do not measure whether the job is impaired or not. A drug test only states that a substance

was used not stating whether it is a frequent use or not. And sometimes drug tests fail to

determine whether the drug taken is legal or illegal only states that it was used.over the counter

drugs like ibuprofen has shown up on a marijuana test, even poppy seeds used in baked goods

can produce a positive reading of a test for heroin. Deprohil, a prescription drug used for testing

parkinson disease has shown up as amphetamine. As of mid 1947, only a handful of states

decided to ban the use of drug testing that is not based on individual suspension. And is said

that the prisons are intended for the high threat level of crimes and the lower threat level

crimes shouldn't need jail time. And most surveys shows the prisons are not known to serve

any useful purpose.

We reach a different plane of social and moral values when we pass the privileges

immunities that have been taken over from the federal bill of rights and brought within the

fourteenth amendment by a process of absorption. If the fourteenth amendment has absorbed

them, the process of absorption has had its source in the belief that neither liberty nor justice

would exist if they were sacrificed. The state is not attempting to wear out the accused by a

multiple of cases with accumulated trials. The supreme court is one of the last american

appellate courts where decisions are announced orally, but many justices disagree with this

practice, it was said to be a waste of time. The court gives no advance press released, and will

tell no one when and what cases will be decided and that given time. Due process- due process

is the legal requirement that the state must respect all legal rights to each person. Due process

balances the power of law and the land and protects each individual from it. When a

government harms a person without following the exact course of law, this is a due process

violation. Due process developed from clause 39 from magna carta in england although it is no

longer upheld in england but became incorporated in the u.s constitution.

In most cases people wouldn't agree with me and my topic although their viewpoints are

not logical but here is what people told me when I brought up the topic to them. President bush

was not alone in making cuts in spending for domestic prevention and treatments. Most elected

officials seem frustrated in the failure to produce a drug-free america and sober drug addicts.

Drugs first surfaces in the united states in 1800s it first started with opium after the civil war the

followed with cocaine in the 1880s, then morphine was discovered in 1906 and used for

medical reasons. Cocaine was used in coca-cola, and morphine was used as a pain reliever.

The abuse of opium and cocaine at the end of the 19th century reached epidemic proportions.

The harrison narcotics act was the first federal drug policy passed in 1914 in the united states.

The act restricted the use and distribution of marijuana, cocaine, heroin, and morphine and the

act is still aggressively enforced. And the physicians who were prescribing the drugs to addicts

that were in maintenance programs were harshly punished. The united states first federal

drug policy targeted physicians and pharmacists. In 1919 the supreme court ruled against the

maintenance of addict as a legitimate form of treatment in the webb et al.

So in conclusion i have read and made new discoveries that i didn't know about before
