COUNTER AFFIDAVIT

I, AURELIO SANTOS, of legal age, married and a resident of Brgy.

Timog Sta. Clara Village, Tagbilaran City after having been duly sworn to in
accordance with the law do hereby depose and says:

1. That I am accused for the crime of Possession and Sale of

Dangerous Drugs under Republic Act 9165, now pending before
the Provincial Prosecution Office of Bohol;

2. That I vehemently deny the allegations in the complaint filed

against me for being false, fabricated and malicious, the truth
being that;

a. That in the afternoon of January 17, 2017 aroung 4:00, my

friend Juan Manuel Marques and I were buying in a sari sari store
in Sta. Clara Village.

b. Then after buying from the store 2 hooded men approached us

and discretely pointed a gun at us and said that Sumama kayo sa
 amin kung gusto nyo pang mabuhay. We had no choice but to go
with them because of our fear for our lives.

c. The 2 hooded men brought us to a street with a parked van and

they told us to go inside and they will only have a chat with us.

d. But instead both hooded men started to punch us and started to

threaten us inside the van. They told us that one of us must make it
appear that we were selling shabu.

e. Because of fear, we gave in to their demands. Neither of us

volunteered to be the one selling the shabu but because it was
consuming time of who will be the one to make it appear to be
selling it. One of the hooded men just randomly picked one of us
and I was the one picked.

f. The 2 hooded men instructed me of what will happen later on

that night. That I was supposed to hand sachets of shabu to the
persons who will come up to me and ask to buy shabu from me.

g. My friend Juan Manuel was taken by them as assurity that I will

fulfil the tasks ask of me.

i. When the night came, I followed the instructions given by the

hooded men and 2 persons came up to me and bought shabu, upon
giving the money, I was shocked that police suddenly came out and
it was a buy bust operation.

3. That I was extremely surprised in everything that transpired.

4. That the case filed against me is motivated by bad faith and ill motives

5. That I am executing this counter affidavit to attest to the truth of the

foregoing statement and to support for the dismissal of the case filed
against me.
