SESSION POLICIES
This agreement is between the Client and Lori Lokken Photography.
Please read my session policies carefully. If you have any questions, please contact me ASAP.
By signing this contract, you agree to everything listed.

1. CANCELLATION/POSTPONEMENT: In the event of a cancellation or

postponement of the portrait session/agreement by Client, the deposits paid are non-
refundable. Deposits are transferable if a date change is necessary due to inclement
weather, illness, or other unforeseen circumstances. Forty-eight hours notice of
postponements or cancellations is appreciated.
2. WEATHER: If, in the opinion of the photographer, conditions are not suitable for a
successful portrait session, the photographer and client will agree upon a rescheduled
date at no additional fee.
3. RESCHEDULING/LATE ARRIVALS: In the event that the Client requests to
reschedule a session, the retainer shall be applied to a reschedules session if notice is
given at least 7 days prior to the schedule event. Reschedule must be within the same
calendar year. Any Client that is late arriving to the session will have the amount of
time late deducted from the time allotted for the session.
4. PREVIEWS: Session previews will be available for online viewing on Facebook within
two weeks of session date.
5. RETAINER: You agree to pay a 50% deposit, due within 3 days of booking. If this is
not paid within 3 days, you will forfeit the day and time of your session. This is non-
refundable if you dont show up or cancel without a 48-hour notice.
6. MODEL RELEASE: The photographer retains the copyright and ownership of all
images of the portrait session and reserves the right to reproduce images for portfolio,
studio display, gallery display, website, self-promotion, photo contests, etc. No camera
other than the photographers is allowed in the portrait session.
7. COPYRIGHT AND REPRODUCTION OF IMAGES: All images, including web
gallery, and final portraits are protected by the Federal Copyright Law. It is unlawful to
copy any images without written permission of the photographer. Clients are not allowed
to reproduce any images produced by the photographer for any purpose. Likewise,
clients cannot authorize any reproductions of the images in labs, whether it is for
commercial or personal use. Clients are not allowed to scan, print or send images
through internet or use images for photographic competition. Copyright violations are
punishable up to $150,000 per violation per Federal Copyright Law. Exceptions to any of
the above may only be made with express written permission from Lori Lokken
 Photography. If you decide to upload any images not watermarked by Lori Lokken
Photography, please give me credit by tagging my business page: Lori Lokken
Photography. This is a way for me to market my business.
8. WAIVER OF LIABILITY: Safety is a top priority at all portrait sessions, however the
Photographer is not responsible for any behavior or risk on the client's part which may
undermine safety concerns. Client expressly releases the photographer, her employees
and agents from all claims, damages, and liabilities that may result from accidents or
incidents that occur during the portrait session. This waiver of liability includes waiver of
any claim that may be a result of negligence.
9. FAILURE TO PERFORM: If the Photographer is unable to perform this agreement
due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of
the Photographer, the Photographer and Client shall make every attempt to
reschedule the session. If a reschedule is unable to be agreed upon, Photographer
shall return the retainer to the client and shall have no further liability. Further, if
the Photographer is unable to deliver photographic materials due to technological
malfunctions, including but not limited to camera and processing, or otherwise lost
or damaged without fault of the Photographer, liability shall be limited.
10. PHOTOGRAPHERS STANDARD PRICE LIST: The charges in this agreement are
based on the Photographers Standard Price List. This price list is adjusted periodically
and future orders shall be charged at the prices in effect at the time when the order is
placed.

11. MISCELLANY: This Agreement incorporates the entire understanding of the parties.
Any modifications of this Agreement must be in writing and signed by both parties.
Any waiver of a breach or default hereunder shall not be deemed a waiver of a
subsequent breach or default of either the same provision or any other provision of
this Agreement. This Agreement shall be governed by the laws of the State of WI.

12. ATTORNEYS FEES: If either party to this Contract brings a legal action against the
other party to this Contract to secure the specific performance of this Contract, collect
damages for breach of this Contract, or otherwise enforce or interpret this Contract, the
prevailing party shall recover reasonable attorneys fees and all costs, premiums for
bonds, fees, and other expenses expended or incurred in the action in addition to any
other relief that may be awarded.
