REGULATION ORDINANCE NO. 2008-392

AN ORDINANCE AMENDING THE TITLE AND CERTAIN SECTIONS
OF ORDINANCE NO. 85 S. 1991 ENTITLED "AN ORDINANCE
PROIDBITING AND PENALIZING THE PRINTING, CIRCULATION,
SALE, DISTRIBUTION OR EXHIBITION OF IMMORAL OR OBSCENE
PICTURES, FILMS ARTICLES, BOOKS OR ANY OTHER KIND OF
PORNOGRAPIDC PUBLICATIONS AND PROVIDING PENALTIES FOR
VIOLATIONS THEREOF".

WHEREAS, local legislation needs to be updated from time to time so as to keep abreast
with the demands of the evolving pace of trend and time;

WHEREAS, there is a need to give teeth to Ordinance No. 85, Series of 1991, to act as
deterrent against future commitment of the herein prohibited offenses;

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City oflloilo

Section 1. The title of the ordinance is hereby amended to read as follows:

"An ordinance pena/izi,ng the printing, circulation, sale, distribution,

screening or exhibition of immoral or obscene pictures, films, video cassette
discs (VCDs), digital video discs (DVDs), articles, books or any other kind of
pornographic publications and providing penalties for violations thereof."

Section 2. Definition of Terms - For the purposes of this ordinance, the following shall
be construed to mean:

Screening - refers to the act of testing that is open to the public video materials,
tapes, or films by way of viewing thru DVD, VHS, VCDs, Betamax players or
wide screen of pornographic, obscene or immoral publicationa.

Section 3. Any immoral and obscene pictures, films, CDs, DVDs, articles, books or other
kinds of pornographic publications and materials and such apparatus, equipments, or
paraphernalia used in the printing, circulating, selling, distributing, screening or exhibiting such
immoral, obscene and pornographic publications shall be subject to summary confiscation.

Section 4. Any person apprehended printing, circulating, selling, distributing, screening,

or exhibiting such immoral and obscene pictures, films, CDs, DVDs, or other kinds of
pornographic publications or materials shall be subject to the penalty of a fine of P5,000.00 or
imprisonment of not more than five (5) months at the discretion of the court.

In addition, if such person, partnership or corporation is engaged in business in the City

of Iloilo of printing, circulating, selling , distributing, screening or exhibiting such immoral
and/or obscene pictures, films, CDs, DVDs, articles, books, or any other kind of pornographic
publications or materials, his business permit shall be cancelled and/or revoked in accordance
with existing ordinances.

Section 5. Repealing Clause. All ordinances and resolutions inconsistent herewith are
hereby considered repealed or modified accordingly.

Section 6. Separability Clause. In the event that any of the provisions of this ordinance
is declared illegal, the validity of the other provisions shall not be affected by such declaration.

Section 7. Effectivity. This ordinance shall take effect ten (10) days its approval and
publication in a newspaper of general circulation in the City of Iloilo.
