SUBJECT : Spot Report re Shooting Incident that Resulted to the Death of

NESTOR DELA TORRE y Urdas

DATE : April 25, 2010

1. On April 25, 2010 at about 10:00 oclock in the morning a shooting incident
transpired at So. Hanawa, Brgy. Matangcong, Sigma, Capiz wherein victim one Nestor Dela
Torre Y Urdas, 46 years old, married, laborer, and a resident of So. Hanawa, Brgy. Matangcong,
Sigma, Capiz, was shot by suspect Harry Baradero Y Legaspi, 47 years old, married, farmer,
and a resident of the same place. As a result thereof, the victim sustained multiple gunshot
wounds in the different parts of the body and was rushed to Mambusao General Hospital
Mamusao, Capiz for medical treatment but was pronounced dead on arrival (DOA) by the
attending physician thereat. The suspect was arrested at his house during hot-pursuit operation
conducted, but the weapon used in the commission of the crime was not recovered and he is
now under the custody of this station for investigation and proper disposition. The cadaver of the
victim was moved to Regional Crime Laboratory Office, Camp Martin Delgado, Fort San Pedro,
Iloilo City for autopsy examination.

2. The motive of incident is undetermined and the case still under investigation.

1. Please be informed that Mohammad Jafaar Sabewang Maguid@ Tokboy Abu Ghaib Bin
ud is known to be a notorious criminal personality and leader of Ansar Al-Khilafah
Philippines, claiming to be an ISI sympathizer. Following are the Warrant of Arrest issued
to the above- named person by the issuing courts in the Province of Sarangani, to wit:
a. Warrant of Arrest for Murder/Murder/Destructive Arson/Arson/Robbery with
Violence against and/or Intimidation of Persons and Robbery with Violence
against/or Intimidation of Persons docketed under Criminal Case Nrs. 3043-
08/3044-08/30545-08/3047-08 and 3048-08, all issued by RTC Branch 38,
Alabel, Sarangani Province;
b. Warrant of Arrest for Attempted Murder/ Attempted Murder/Frustrated Murder/
Attempted Murder/ Attempted Murder/Frustrated Murder docketed under Criminal
Case Nrs. 3043-08/3044-08/30545-08/3047-08 and 3048-08, all issued by RTC
Branch 38, Alabel, Sarangani Province dated January 8,2010;
c. Warrant of Arrest for Robbery with Violence against and/or Intimidation of
Persons docketed under the Criminal Case Nrs. 3555-10 issued by Hon. Jaime l.
Infante, Executive Judge of RTC 11, Branch 38, Alabel, Sarangani Province
dated January 26,2010;
d. Warrant of Arrest for Robbery with Homicide docketed under the Criminal Case
Nrs.4080-11 issued by Hon. Oscar P. Noel, Jr. Executive Judge of RTC 11,
Justice on Wheels, Alabel, Sarangani Province dated December 8, 2011;
e. Warrant of Arrest for Frustrated Homicide docketed under the Criminal Case
Nrs.5297-14 issued by Hon. Oscar P. Noel, Jr. Executive Judge of RTC 11,
Justice on Wheels, Alabel, Sarangani Province dated July 1, 2014;

2. At about 6:00 in the morning of September 30, 2016, joint operating units of Sarangani
PPO Led by PSSUPT JOSEPH SEMILLANO, APD SPPO, PPSC SPPO, PIB, EOD
SPPO, RPSB 12, PNP MARITIME, PNP Maasim, PNP SAF Led by PCI LARRY
CORALES, Coy Comdr., 42nd SAB and CTIS-9NICA), started its infiltration of troops to
 conduct operation to serve the above -mentioned Warrant of Arrest against Jafaar
Sabewang Maguid@ Tokboy Abu Ghaib Bin ud.
3. At about 7:00 in the morning of September 30, 2016 during the service of Warrant of
Arrest to alias Tokboy at Sitio Bual, Barangay Daliao, Maasim, Sarangani Province.
Wherein the troops recovered IED components as follows; twelve (12) bottles of flying
tiger denatured alcohol, one (1) bottle rugby excel, eight (8) kilograms urea (13-0-46)
made in Israel, eight (8) kilograms ammonium nitrate, five(5) kilograms of nails (3 and 4
inches), one (1)pc. Mixing bowl, three (3) pcs of packaging tape, one(1) pc masking
tape, one pc (glue stick, three (3) pcs battery charger, two 2) pcs Samsung CP, one (1)
pc ZH8K cp, one(1) pc handheld radio(TT two way radio), four(4) double-A Sony battery,
four(4) kilograms of sulphur.

4. Furthermore, the recovered IED components wew properly turnover to EOD Sarangani
PPO.
