FACTS:
1. IFI is a duly registered religious corporation and was the owner of
a parcel of land which is subdivided in 4 lots located in
Tuguegarao
2. Lots A and B were sold by the Supreme Bishop, Rev. Ga, to
Bernanrdino Taeza for P100k through installment with mortgage.
Subsequently, Taeza completed the payments.
3. Taeza registered the parcels of land and consequently, a TCTs
were issued in his name. Taeza occupied a portion of the land.
4. A complaint for annulment of sale was filed by IFI through
Supreme Bishop Pasco against Taeza.
The lower court rendered judgment in favor of IFI holding
that the deed of sale between Ga and Taeza was null and
void. It ordered Taza to vacate the premises and surrender
the same to the plaintiff.
5. Upon appeal, CA reversed RTCs decision.
The CA ruled that petitioner, being a corporation sole,
validly transferred ownership over the land in question
through its Supreme Bishop, who was at the time the
administrator of all properties and the official
representative of the church. It further held that [t]he
authority of the then Supreme Bishop Rev. Ga to enter into
a contract and represent the plaintiff-appellee cannot be
assailed, as there are no provisions in its constitution and
canons giving the said authority to any other person or
entity.
HELD:
1. In constructive implied trusts, the trustee may acquire the
property through prescription even if he does not repudiate the
relationship. It is then incumbent upon the beneficiary to bring
an action for reconveyance before prescription bars the same.
2. A constructive trust being an offspring of the law, an action for
reconveyance must perforce prescribed in 10 years. The ten-year
prescriptive period begins to run from the date of registration of
the deed or the date of the issuance of the certificate of title over
the property
3. In the case at bar, the TCT were issued on February 7, 1990 while
the action was filed on January 1990. Hence, the action for
reconveyance being brought within the prescriptive period, it is
only just that the subject property be returned to its rightful
owner.
