2. ICOW the above cited subject and reference, please be informed that on or about
10:00 pm of November 3 2012 along V.V. Soliven Avenue, Cainta Rizal a stabbing incident
transpired wherein victim identified as one ROEL JOHN POSADAS y SANTOS, 22 years
old, single, Student, a native of Pampanga and presently residing at No. 10. Aquino St., Taytay,
Rizal, was stabbed by the suspect identified as one JAKE REYES y CRUZ, aka JR, 22 years
old, single, laborer, a native of Northern Samar and presently residing at No. 11 M. H. Del Pilar
St., Cainta, Rizal.

3. Initial investigation conducted showed that on cited TDPO, while the victim was
walking along VV. Soliven Avenue, Cainta Rizal way back to their house. Suddenly, he noticed
Jake Cruz Reyes following him. When he reached the corner of the street, JAKE REYES y
CRUZ blocked the way of ROEL JOHN POSADAS y SANTOS and said GAGO KA!
SINULOT MO SYOTA KO!. After his words, he got his knife to his pocket and stabbed Roel
John Posadas three times that caused him fell to the ground. Jake Cruz Reyes immediately
escaped the place after the incident but he immediately caught by the concern citizens. The
residents of the place immediately helped the victim and sent to the nearest hospital that caused
him to survive from the death.

4. Suspect was turned over to the station investigation division together with the
confiscated evidence for proper action and disposition.

SCENERIO

On November 3, 2012, 10 oclock in the evening, Roel John Posadas

walking along VV. Soliven Avenue, Cainta Rizal way back to their house.

Suddenly, he notices Jake Cruz Reyes following him. When he reaches the corner

of the street, Jake Cruz Reyes block the way of Roel John Posadas and said

GAGO KA! SINULOT MO SYOTA KO!. After his words, he gets his knife to

his pocket and stab Roel John Posadas three times that causes him fall to the

ground. Jake Cruz Reyes immediately escapes the place after the incident but he is

immediately catches by the concern citizen. The residents of the place immediately

help the victim and send to the nearest hospital that causes him to survive from the

death.

There are three (3) stabbed wounds entered in the nape noted.
All stabbed entered in the stomach but did not hit any vital organs.

Sagot : habang ako po ay naglalakad sa V.V. Soliven Ave. pauwi ng aking bahay
napansin ko pong sumusunod sa akin si Jake Reyes y Cruz, bigla nya po akong
hinarangan at sinabing GAGO KA! BAKIT MO SINULOT SYOTA KO?! At
bigla nya po akong pinagsasaksak ng tatlong beses sa aking tiyan, agad po syang
tumakas ngunit nahuli din sya ng mga residente, agad din po akong nasugod ng
mga residente sa malapit na hospital dahilan ng aking pagkasagip sa tiyak na
kamatayan.

FACTS OF THE CASE:

Investigation conducted showed that on or about 10:00 PM of 03 November 2012 along V.V
Soliven Avenue, Cainta, Rizal above named suspect, armed with evidence no. 7, with any provocation,
with intent to kill the victim, suspect stabbed the victim 3 times that causes him quite die.CONTRARY
TO LAW. Accused violated the Art. 248 of Revised Penal Code.This case will be presented to you by
SP02 Roberto Pascual III of Cainta Police Station.

On the account of foregoing , the suspect was placed under arrest and the charges of
FRUSTRATED MURDER against him will be brought to the attention of an inquest Prosecutor for
proper disposition and recommendation.

10:00 pm of November 3 2012 along V.V. Soliven Avenue, Cainta Rizal a stabbing incident
transpired wherein victim identified as one ROEL JOHN POSADAS y SANTOS, 22 years
old, single, Student, a native of Pampanga and presently residing at No. 10. Aquino St., Taytay,
Rizal, was stabbed by the suspect identified as one JAKE REYES y CRUZ, aka JR, 22 years
old, single, laborer, a native of Northern Samar and presently residing at No. 11 M. H. Del Pilar
St., Cainta, Rizal.

3. Initial investigation conducted showed that on cited TDPO, while the victim was
walking along with the witness identified as one ANGELIQUE RAMOS y VILLAR, aka
Angel, 26 years old, single, model, a native of Bicol and presently residing at No. 56 Nadurata
St., Taytay, Rizal., above named suspect, apparently drunk and armed with a short firearm
identified to be a .45 Initial investigation conducted showed that on cited TDPO, while the victim
was walking along VV. Soliven Avenue, Cainta Rizal way back to their house. Suddenly, he
noticed Jake Cruz Reyes following him. When he reached the corner of the street, JAKE
REYES y CRUZ blocked the way of ROEL JOHN POSADAS y SANTOS and said GAGO
KA! SINULOT MO SYOTA KO!. After his words, he got his knife to his pocket and stabbed
Roel John Posadas three times that caused him fell to the ground. Jake Cruz Reyes immediately
escaped the place after the incident but he immediately caught by the concern citizens. The
residents of the place immediately helped the victim and sent to the nearest hospital that caused
him to survive from the death.

4. Medico Legal examination conducted by PSINSP Jennifer Lopez M.D that the
victim has three stabbed wounds in the stomach causes him quite die.

5. Finger print examination conducted by SPO2 ROBERTO PASCUAL III he

examined the weapon used by the suspect and SPO2 ROBERTO PASCUAL found a finger print
patern on the blade of the knife POSITIVE MATCH to the index finger of the suspect.

6. That, based on the aforesaid result, cases of violation of FRUSTRATED

MURDER which is defined and penalized under Art 248 of the Revised Penal Code (RPC) of
the Philippines were charged against suspect Mr. Jake Reyes y Cruz before the office of the
Provincial Prosecuter, Province of Rizal who after inquisitorial investigation. Sentence of
Frustrated Murder is RECLUSION TEMPORAL 12 yrs. And one day to 20yrs. Accused JAKE
REYES y CRUZ is now detained at the Provincial Jail of Rizal.

incident to arrest and conduct an ocular investigation.
