REGULATION ORDINANCE NO. 2017-032

AN ORDINANCE ALLOWING THE ILOILO SCIENCE AND
TECHNOLOGY UNIVERSITY (ISAT-U) TO USE THE AIR SPACE AND
THE CONSTRUCTION OF ACCESS ROUTE CONNECTING THE OLD
SITE TO THE NEW SITE CROSSING THE PROVINCIAUNATIONAL
ROAD THAT SEPARATES THE TWO SITES OF ISAT-U, LA PAZ.
CAMPUS, PROVIDED THAT THE BRIDGE SHALL BE USED
EXCLUSIVELY FOR SCHOOL PEDESTRIAN

WHEREAS, Local Government Code of 1991, Article Ill, Section 458 on the
Powers, Duties, Functions and Compensation of Sangguniang Panlungsod, (2) (vi)
states that the Sangguniang Panlungsod can "prescribe reasonable limits and restraints
on the use of property within the jurisdiction of the city";

WHEREAS, Local Government Code of 1991, Article Ill, Section 458 (5) (v)
states that the Sangguniang Panlungsod may "approve ordinances which shall ensure
the efficient and effective delivery of the basic services and facilities" and "regulate the
use of streets, avenues, alleys, sidewalks, bridges, parks and other public places and
approved the construction, improvement, repair and maintenance of the same";

WHEREAS, ISAT-U is an educational institution located at Burgos Street, La

Paz, lloilo City;

WHEREAS, ISAT-U is proposing to construction an access route connecting the

old site to the new site crossing the Provincial/National Road that separates the two
sites of ISAT-U;

WHEREAS, the construction of the access route is for the safety of the students
who will no longer cross the streets going to the other building;

WHEREAS, an ordinance from the Sangguniang Panlungsod allowing the use of

the airspace is a pre requisite for ISAT-U's application for a building permit.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City

of lloilo, in session assembled, that:

Section 1. - The lloilo Science and Technology University (ISAT-U) is hereby

allowed to use the airspace and the construction of an access route connecting the Old
Site to the New Site crossing the Provincial/National Road that separates the two sites
of ISAT-U, La Paz Campus; Provided, that the bridge shall be used exclusively for
pedestrian purpose. Commercial and income generating facilities and similar
endeavors are strictly prohibited;

Section 2. - The access route to be constructed shall conform to the standard,

specifications and design as approved by the Office of the City Engineer, lloilo City;

Section 3. - The access route to be construction shall have a total vehicular

clearance from the road surface of six (6) meters;

Section 3. - This ordinance shall take effect immediately upon it approval.
