REGULATION ORDINANCE NO. 2017-036


AN ORDINANCE ESTABLISHING COLOR CODING SCHEME FOR
TRICYCLE FOR HIRE OPERATING WITHIN THE TERRITORIAL
JURISDICTION OF THE CITY OF ILOILO

Grace L. Baronda, Hon. Armand S. Parcon and Hon.
Eduardo L. Periaredondo

WHEREAS, Section 458 (v) (vi) of Republic Act 7160 otherwise known as the
Local Government Code of 1991 empowers the Sangguniang Panlungsod to:

"(v) Regulate the use of streets, avenues, alleys, sidewalks,


establish bus and vehicle stop and terminals or regulate the use of the
same by privately owned vehicles which serves the public, regulate
garages and operation of conveyance for hire"

(vi) Regulate traffic on all streets."

WHEREAS, Section 447 (vi) of Republic Act 7160 otherwise known as the Local
Government Code of 1991, empowers the Sangguniang Panlungsod to:

(vi) Subject to the guidelines prescribed by the Department of


Transportation and Communication, regulate the operation of tricycles and

grant franchises for the operation thereof within the territorial jurisdiction of
the municipality. n

WHEREAS, to help regulate and identify the tricycle units for hire that ply outside
of their designated route a color coding scheme should be implemented whereby
tricycle units for hire within a particular district must have a uniform color, different fomr
that of other districts.

NOW, THEREFORE, let it be ordained by the Sangguniang Panlungsod of the


City of lloilo, in session assembled, that:

Section 1 - A color coding scheme is hereby mandated for all tricycles-for-hire in


the City of lloilo as follows:

DISTRICT TRICYCLE
CITY PROPER GREEN
LA PAZ ORANGE
JARO BLUE
MOLO WHITE
MANDURRIAO YELLOW
VILLA RED
LAPUZ VIOLET

Section 2. - This ordinance shall be applicable to tricycle units of operator who


have been granted franchises to operate provided that their franchise have not yet
expired;

Section 3. - Penalty - Violation of this ordinance shall subject the operator to


penalties as follows:

1st offense - A fine of Five Hundred Pesos (Php 500. 00)


~d offense -A fine of One Thousand Pesos (Php 1,000.00)
~ offense - lmpoundment of tricycle unit and revocation of tricycle franchise
Plus fine of Php 1,000.00

Section 4. - This ordinance shall be implemented by the Traffic Management and


Transportation Regulation Office (TMTRO) by determining first if the tricycle unit has a
\l lid or unexpired franchise as well as an updated MTOP.

If there is a valid or unexpired franchise as well as an updated


MTOP, the traffic auxiliary shall issue a Traffic Citation Ticket- to the
operator, if present, and in the absence of the operator, to the driver of the
tricycle for violation of this ordinance.

Should the operator or driver be absent, the traffic auxiliary shall


impound the tricycle.

However, if it is determined that the tricycle unit does not have any
valid or unexpired franchise and an updated MTOP, a Citation Ticker may
be issued for any violation of existing ordinances, if warranted.

Impounded tricycle shall be kept at the designated impoundment


area and should be claimed by the owner only after payment of the
corresponding fines and other fees.

Impounded tricycles not claimed within six months from date of


impoundment shall be auctioned and the proceeds from such sale shall be
forfeited in favor of the City of lloilo after payment of costs incurred by
private persons or companies, should there be any.

THE PENALTY OF IMPOUNDMENT SHALL ONLY BE


IMPLEMENTED UPON THE ESTABLISHMENT BY THE CITY OF THE
THEIMPOUNDMENTAREA

Apprehensions in violation of this Ordinance shall not preclude


separate apprehension for violation of other laws or ordinances such as,
but not limited to, "Out of Route" violation and ":Driving a Motor Vehicles
Without a License".

Other procedures applied by the TMTRO in the apprehension of


traffic violations shall apply in a suppletory manner.

Section 5. - Let a copy of this ordinance be furnished to the Transportation


Management and Traffic Regulation Office (TMTRO) and the tricycle federation
presidents for information and implementation;

Section 6. - Provisions of previous ordinances that cannot be harmonized with


this ordinance shall be deemed amended. If any party or provision of this ordinance is
declared by a court of law to be ultra-vires, unlawful or unconstitutional, it shall not affect
other parts or provisions;

Section 5. - This ordinance shall take effect sixty (60) days after the same is
published in a newspaper of general circulation in lloilo City.
