CITY ORDINANCE NO. 715-06 Series of 2006 AN ORDINANCE ENUMERATING THE PUBLIC-OR PRIVATE STREETS OR ROADS USED AS ALTERNATIVE ROUTES OR THOSE FORMING THE SO-CALLED FRIENDSHIP ROUTES TO EASE OR DECONGEST TRAFFIC ALONG THE MAIN THOROUGHFARES OF THE CITY, INTRODUCING CHANGES THEREIN, IMPOSING A PENALTY FOR ANY VIOLATION THEREOF, PROVIDING FUNDS THEREFOR AND FOR OTHER PURPOSES. WHEREAS, on July 28, 1995, this August Body enacted Municipal Ordinance No. 152-93, Series of 1993 entitled “An Ordinance Directing the Owner/Developer, Homeowners Association, Receiver! Conservator or any Person in Charge of Subdivision, Villages or Compound to Open and Allow the Public Free of Charge to Use thelr Street or Road as Alternative Routes to East or Decongest Traffic Along Alabang-Zapote Road and Other Main Streets or Roads in Las ifias, ‘Imposing 2 Penalty for Violation Thereof, Providing Funds Therefor and for other Purposes"; WHEREAS, the said Ordinance was further amended by City Ordinance No. 410-98, Series of 1998, City Ordinance No, 419-98, Series of 1998 and Clty Ordinance No, 542-01, Series of 2001; WHEREAS, Section 4 of Republic Act No. 8251, otherwise known as the Charter of the GiY of Las Pifas, states that "The City shall have an independent, common seal and may alter the same at pleasure. It shall exercise the powers to levy taxes, and subject to the pertinent Provisions of the Constitution, open or close roads, streets, alleys, parks or squares, or any other open space, including those of subdivisions, villages or compounds, in order to serve 4 public purpose"; WHEREAS, the enactments of the above-mentioned Municipal/City Ordinances hi cased the traffic along the main thoroughfares of the City, benefiting the City residents have continuously used the so-called Frlendship Routes for the past ten years; WHEREAS, there is a need to consolidate the provisions of the above-stated Ordinances and to incorporate several-matters to strengthen their implementation, especially under th Charter ofthe City of Las Pifias, and based on the pronouncements ofthe Supreme Court in thes ‘se of Sangalang versus Intermediate Appellate Court (G.R. This Ordinance shall be known as the Friendship Route Ordinance. Any and. all owners, developers, homeowners associations, receivers, conservators, or any person in chai ge of a subdivision, village or compound, are directed to open and allow the City’s residents to use, free of charge, the Friendshiy ip Route as provided in Section 2 of this ordin Tiod, the residents of the City shall be allowed, free of charge, to use their roads or streets forming part of lance as alternative routes to ease or dlecongest trafic in the City of Las Pfias. Provced, that said roads or streets shall be accessi for the purpose of private vehicles only to the exclusion vehicles, cargo trucks and/or carriers. Providk thereof, inclu led further, that the repair and maintenance of all types of public eee iding the street lights installed thereon shall be for the account and expense of the City of Las Pifias. ee EY QROINANCE NO. 715-06, Series of 2006. AN ORDINANCE ENUMERATING THE PUBLIC OR PRIVATE STREGTS 8 ROADS USED AS ALTERNATIVE ROUTES OR THOSE FORMING THE SO-CALLED FRIENDSHIP ROUTES 10 EASE SRADECONGEST TRAFFIC ALONG THE MAIN THOROUGHFARES OF THE CITY, INTRODUCING CHANGES THERGIN, IMPOSING A PENALTY FOR ANY VIOLATION THEREOF, PROVIDING FUNDS THEREFOR AND FOR OTHER PURPOSES. SECTION 5. Delivery vehicles of basic necessities such as water, liquefied petroleum 4g8s (LPG) and cooked food shall also be allowed to use the Friendship Routes, provided that their 'use of such roads shall be limited to actual delivery only and not for passing through to cher areas of the City. In such instances, the drivers of the vehicles shall be asked to deposit an identification card with the guard of the affected subdivision, with the same to be returned When the vehicle exits. SECTION 6. The Chief of Police of the PNP Las Pifias District is hereby authorized to deploy or assign traffic policemen and aldes along the Friendship Route to enforce traffic rules and regulations. SECTION 7. For the easier Identification of vehicles belonging to Las Pifias City residents and prevent non-residents from galning access to villages and subdivisions, the City Mayor Is hereby authorized to issue the necessary Friendship Route Sticker’ for the implementation of this Ordinance. The design, quantity and frequency of issuance of the stickers shall be subject to his sound discretion. The Friendship Route Sticker shall be issued free of charge to bana fide Las Pifias City residents, after submitting proof of residency through a Certified True Copy of a Voter's Registration Record issued by the Las Pifias City COMELEC Office and validated copies of Original Receipts and Certificate of Registration of the Motor Vehicle in the applicant’s name, SECTION 8. The City Mayor is hereby authorized to delineate a one-way traffic scheme within the Friendship Route, as he shall deem it necessary. He Is likewise authorized to order the opening of the Friendship Route for a longer period of time, particularly during emergencies, heavy traffic conditions and holiday season, SECTION 9. The following acts are hereby declared illegal: a. Use of Fake Friendship Route Stickers; b. Use of Genuine Friendship Route Stickers not properly and/or permanentiy attachedfixed In the vehicles’ windshield; . Use of laminated Genuine Friendship Route Stickers, SECTION 10. Within thelr respective areas of jurisdiction, Private Security Guards manning the various Subdivision Gates of the Friendship Routes are hereby authorized to.
