Dear Ms. Tran:

This written notice is issued in response to your email request dated June 22, 2016 to the
Michigan Land Bank Fast Track Authority (MLB) for information under the Freedom of
Information Act (FOIA), MCL 15.231 et seq., which was received at this office on June 23, 2016.

You requested the following:

"1. What is the operational authority of the Detroit Land Bank Community Development
Corporation?

The DLBCDC, a Michigan corporation, has informed me that it is aquasi-governmental


organization. All QGOs have operational agreements with a governmental entity.

2. What is the public instrument of oversight? This would include any charters, statutes,
policies, memoranda of understanding, contracts, or any other agreement.

3. What is the jurisdiction of oversight?

4. Would this be LARA, municipal, county, state or federal? Please cite the statutory
source.

This is a form of checks and balances in dealing with residents. How does a resident file
a grievance or request for investigation in the operations of the DLBCDC?

5. If no specific authority of oversight is found in the state record, then where does one
go to file a grievance or to report fraud? It would be defeat the purposes of civil rights
protections to report the alleged violations) to the transgressors of the alleged
violation(s).

6. Is this an issue of civil rights protection under the purview of the Office of the Attorney
General?

7. Is this an issue of consumer protection under the purview of the Office of the Attorney
General?

8. What is the state agency assigned this task of monitoring DLBCDC as asub-recipient
of federal funds. The State of Michigan is the recipient, mandated to monitor these said
funds."

After diligent search and inquiry, it has been determined that the information requested does not
exist in the name you requested or in any other name reasonably known to the MLB. Therefore
your request is denied.

As to the denial of your request, pursuant to section 10 of the FOIA, you may do either of the
following:

Appeal this decision, in writing, to Steve Arwood, Director, Department of Talent and
Economic Development, 300 N. Washington Square, Lansing, Michigan 48913. Your
written appeal must specifically state, using the word appeal, that it is an appeal of this
decision and must specify the reasons you believe the denial should be reversed. Mr.
Arwood or his designee must respond to your appeal within 10 business days of its receipt.
Under unusual circumstances, the time for response to your appeal may be extended by 10
business days.

2. File an action in the Michigan Court of Claims to compel disclosure of the records. The
action must be filed within 180 days after the date of the final determination to deny the
request. If you prevail in such an action, the court is to award reasonable attorney fees,
costs, and disbursements. Further, if the court finds the denial to be arbitrary and
capricious, you may receive punitive damages in the amount of $1,000.
