SUPPLEMENTAL AFFIDAVIT
(Affidavit of Desistance)

I, EDWIN R. AQUINO, 44 years old, Filipino, and with

residence address in Barangay Makapilapil, San Ildefonso, Bulacan,
after having been sworn to in accordance with law, hereby depose
and state THAT:

1. I am the private complainant in the above-titled

administrative case which is now pending before the
office of Tarlac Provincial Internal Affairs Service, in
Tarlac City;

2. My complaint against the respondents PO1 Menardo F.

Vijandre, Jr. and PO1 Jeremiah Pangan stemmed from
the Resolution issued by the Office of the Provincial
Prosecutor of Bulacan in which an initially inquest
proceeding was then converted into a preliminary
investigation for delivering the person arrested without

warrant beyond the reglementary period. Further, an

order was issued for the release of the arrested person,
EDGAR SATURAY y ESPIRITU.

3. EDGAR SATURAY y ESPIRITU is the one who hacked

me on 15 January 2017 in Barangay Makapilapil, San
Ildefonso, Bulacan;

4. After careful deliberation of what transpired, I believe that

this complaint arose out of pure misunderstanding and
misapprehension of facts and the respondents are not the
one responsible for the delay in the delivery of the
arrested person without warrant before the office of the
provincial prosecutor;

5. The reason for the delay in the delivery of the arrested

person without warrant before the office of the provincial
prosecutor is attributable to myself on my desire to settle
the matters between me and EDGAR SATURAY y
ESPIRITU as we are relatives;

6. Even though the proceeding before the provincial

prosecutor was converted to a preliminary investigation,
my right as a complainant was not impaired;

7. My complaint against PO1 Menardo F. Vijandre, Jr. and

PO1 Jeremiah Pangan is purely a misunderstanding and
caused by stream of emotion;

8. In view of the above-mentioned reason, I am desisting

from further prosecuting this case against PO1 Menardo
F. Vijandre, Jr. and PO1 Jeremiah Pangan and would
like to withdraw my complaint against them;

9. Further, I would like to request from the Honorable

Hearing Officer, PSUPT. RODINA D. NIONES to dismiss
the case against PO1 Menardo F. Vijandre, Jr. and PO1
Jeremiah Pangan;

10. I executed this instrument freely and voluntarily,

withoutany consideration, promise or reward of
whatsoever in exchange formy desistance but solely for
the reason as above-mentioned;

11. Further, I executed this Affidavit of Desistance with full

knowledge of its consequences, that the said case can be
dismissed at this stage;

12. Furthermore, I am executing this affidavit to attest to the

truth and veracity of all the foregoing facts.
