The recovery ship M/V Edda Fjord had secured the vessel and all personal items, including an IPhone. The ship found the vessel floating overtumed at position N 32*11,65' W 061°51,1. This is ‘approximately 170 miles off the east coast of Bermuda." March 19, 2016 ‘We received pictures from the Captain of the Edda Fjord, showing the vessel, the motor with ‘several close-ups showing several parts with numbers and personal items found on the vessel. The portion of the bow on both sides where registration numbers are normally found was missing. We were able to determine that this was the vessel involved in the missing teen's case. This was determined by the identification ofthe serial number on the motor in one of the photos. The families where notified that the vessel had been located and we shared some of the photos from the recovery with both families. The IPhone that was recovered was idenified as Austin's phone by his father, Blu Stephanos. ‘The Captain of the Edda Fjord agreed to send the IPhone and tackles boxes to FWC when they got to their ‘next port of call. They also notified us that they were also going to ship the vessel back to the States at their expense to assist with the investigation. March 24, 2016 Captain Ardelean and Lt. Omold interviewed Rex Richards to go over the photos received from the Captain of the Edda Fjord. Richards explained: 1) Electronic outlet was hooked to the 12 volt battery and he used it for the spotlight. This was installed by Richards 2) The battery that was missing was under front portion of the center console starboard side 3) He installed the rubber tubing on the shelf of the center console. The tubing was installed for a foot rest, 4) He agreed to look at vessel when it came in if necessary April 14, 2016 ‘A package arrived from Portugal via DHL. The package and its contents was photographed and logged into evidence at the FWC Jupiter office by Investigator David Fowir. + See attached for report from Captain of Edda Fjord including photos of the recovery 1[Page April 22, 2016 After several discussions with Mr, Blu Stephanos, Captain Jeff Ardelean and Bud Vielhauer (FWC Legal Office-General Counsel) about the return of the IPhone to the legal over, Mr. Stephanos, it was agreed upon that the phone would be retuned as requested. Mr. Stephanos stated that he wanted to have {he phone examined by the best possible source at his expense. The phone was severely damaged from being submerged in saltwater for eight months with no protective case. Exposure to ar was causing the Phone to become further corroded even though it was packaged in rice. The original photographs of the phone that were taken do not clearly depict the amount of damage to the phone. The corrosion was Causing the phone to swell and actually spit the phone open. There was a concem that the phone would Continue to deteriorate and all agreed that it needed to be examined by a forensics team as soon as possible ‘Mr. Stephanos shared his concem that i Law Enforcement was allowed to forensically examine the hone, any information recovered from the phone would become public record. Mr. Stephanos agreed to share any information related to the boating accident; including calls, text or snap chats from either of the boys with FWC as part ofthe ongoing investigation. That evening Captain Ardelean notified Nick Komilff and Pamela Cohen ofthe decision to return the phone to Mr. Stephanos. They did not agree with our decision and requested assistance from their personal attomey to have the case reviewed by a civil judge in Palm Beach County. The next day Mr. Stephanos called Captain Ardelean and advised him that he had Convinced Apple, the phone manufacture to examine the phone. Mr. Siephanos requested that a FWC Law Enforcement representative fly wth him to deliver the IPhone to Apple in California. We declined that request April 25, 2016 Photographs ofall tems found in the tackle boxes were sent to Nick Koriloff and Pam Cohen for ‘he purposes of identifying any belongings that may have belonged to Perry Cohen. Mr. Stephanos Packaged the bag of rice containing the phone into a FedEx box then sealed it and turned the phone over toa third party. April 29, 2046 Lt Mike Omold and I lagged out of evidence the tackle boxes and the fishing lures within the tackle boxes and returned them to the owner, Carly Black. The fishing tackle was documented and photographed before returning 2 May 16, 2016 Captain Jeff Ardelean, Lieutenant Lindsay McDonald, Lieutenant Richard Omold, Investigator Brian Coffin, and Investigator Rebeoca Teems received the recovered vessel atthe Broward Otfice located at Port Everglades. The vessel was packed in a shipping container for transport from Norway. The vessel was then unloaded, put on trailer and placed into the evidence storage room #123 May 19, 2016 Prior to examining the vessel and motor, | met with the owner, Carly Black and she signed a consent to search form for the 1978 18ft SeaCraft Hin #SECF80110977 and the 2005 Yamaha Motor Model F115TLRD Serial # 68 VL-1037927.4 ? Saladrigas and Steven Caceres of the Florida Department of Law Enforcement (FDLE) - Miami Regional Operations Center met with Captain Ardelean, Lt Omold and myself at the FWC regional office, FDLE had agreed to assist with the forensic inspection ofthe vessel and meet with family members to review the case and address any concems, May 25, 2016 Captain Ardelean, Lt Omold and | along with Special Agents William V. Saladrigas and Steven Caceres met with representatives from Yamaha Motor Corporation, USA, and Crime Scene Analyst from FDLE at the Broward FWC office at Port Everglades. © ‘Mr. Caleb Chesser (an engineer from Yamaha) in the presence of Mr. Daniel J. Kissane (a Jacksonville-based attomey retained by Yamaha) examined the Motor and the Electronic Control Unit (ECU). During the examination they were able to conclude that they would be able to attempt a download of the ECU at a later date. All examinations were videotaped by Paul Smith of Orange Legal representing the Yamaha Corporation, The forensic examination ofthe vessel was performed by Steve Balunan, Senior Crime Laboratory Analyst, and Katy Reidy, Crime Lab Analyst, of the FDLE Fort Myers Regional Operations Center ® They Conducted mult-dimensional photographic examination of the vessel as well as examined the vessel in its entirety for any forensic evidence? May 31, 2016 Captain Ardetean and | met with Rex Richards to discuss the vessel and to receive explanations for some of the vessel's configurations, First we talked about the outlet switch which he advised was a 12 volt hook up, and was not an AC Outlet as it appeared. He stated that he had explained the difference to Austin but did not think he fully comprehended the difference. ‘Secondly we discussed the Perko battery switch and the aftermarket markings on the Perko. He explained the aftermarket markings were to establish the positon of the Perko which were the same as the ‘manufacturers’ positions. He stated the previous owner put them on because the switch was located in a place where the switch was not easily visible and the aftermarket markings made it easier to determine its position. Third we talked about the hole in the bottom of the vessel. He explained the hole was a drain/ ‘washout for the fish box and would not allow water onto the vessel. * See attached for report from Wiliam V. Salagrigas FOLE {See attached photos and report of the Forensic analysis. ” For a complete log of people on scene see attachments. 4|Page Finally, we discussed the gauges and battery system, He advised the battery was a Deleo Marine battery and it was a new battery less than a year old. He explained there was a bilge switch on the console, and one gauge. The other gauge that came with the motor goes to the fuel management system was not installed on the vessel when he placed the motor on the vessel. He sill had the gauge and showed it to us, dune 2, 2016 Captain Ardelean and | along with Special Agent Steven Caceres (FDLE) met with representatives from Yamaha Motor Corporation, USA, at the Broward FWC office. At this time Mr. Caleb Chesser removed the ECU from the subject motor and installed it onto an exemplar motor that he brought with him for the download process. He was able to complete a download of the ECU and provide a jump drive with the data that was downloaded. | ook the ECU and logged it into evidence at the Jupiter compound. All examinations were videotaped by Paul Smith of Orange Legal. June 13, 2016 FWC received a memorandum from the office of Daniel Kissane the Attomey representing Yamaha. The memorandum discussed Yamahas finding from the ECU download and the ‘steps they took to receive those findings 8 Yamaha provided clarification reference to the download information. The download shows 7 items of data. Items 1, 5, and Zare information gathered from the subject motor. tems 3 and 4 are from the exemplar motor. Items 2 and 6 do not show any data entry June 15, 2016 Captain Ardelean and | along with Special Agent William V. Saladrigas (FDLE) met with Brian Stetier of Stetler Marine Surveyors at the Broward FC office. Mr. Stetler completed an independent survey of the vessel and the motor. At the end of the survey we requested Mr. Stetler to review the findings from Yamaha and the download information received off the ECU. He agreed with Yamaha and their findings. June 17, 2016 FWC received a report from Brian Stetler of Stetler Marine Surveyors, which shows the findings of his survey? July 6, 2016 | spoke with Frances Rossen who advised she had recently seen the boys in Miami, Fl, She Claimed to have seen the boys on two diffrent occasions. Once at Black Pointe Marina and once at Key Biscayne. | ask her if she had a picture or proof of seeing the boys. She advised it was too dangerous to try and take pictures, She was also questioned if she could take me to the boys and advised no. | gave her the incident number and the number fo our dispatch center and advised her to calf she located the boys again. told her we would respond immediately if she located them or was able to take a photograph of the boys. $ See attached for Memorandum from Daniel Kissane ° See attached for report from Brian Stetler 5[Page August 3, 2016 Frances Rossen showed up at the Florida Fish and Wildlife Conservation Commission's Regional Office and ask to speak with me. | was not at the regional office, and Captain Ardelean ask Lt. Tom Hayworth to speak with her. She gave the same information to Lt Hayworth the same information that she relayed to me on July 6°, August 9, 2016 Captain Ardelean and | contacted Frances Rossen via telephone, to ask her i she had any Updated information. She advised she did not have any other information, and could not take us to the boys. We again advised her if she saw the boys to call 911 and our agency dispatch center and we would respond immediately Conclusion On March 18, 2016 a shipping vessel M/V Edda Fjord located a vessel floating overturned at Position N 32°11,65' W 061*51,1". This is approximately 170 miles off the east coast of Bermuda. The Captain and his crew secured the vessel along with all personal items aboard the Edda Fjord. All the Personal items were returned to the Florida Fish and Wildife on April 14, 2016. inthe following days all the personal items were returned to the family members. On May 16, 2016, Captain Jeff Ardelean, Lieutenant Lindsay McDonald, Lieutenant Richard Omold, investigator Brian Coffin, and Investigator Rebecca Teems received Austin's vessel at the Broward Office. The vessel was placed into the evidence storage room #12. FWC investigators closely examined the vessel. In addition, we requested assistance from multiple vessel and motor experts as well as the Florida Department of Law Enforcement (FDLE) Forensics team ‘and Special Agents. Representatives from Corporate Yamaha forensically examined the vessel and the motor which included a download of the Electronic Control Unit. A Memorandum was provided by Yamaha, which concluded that the vessel was running and the motor became submerged at the time of the accident, Stetier Marine Surveyors performed an independent examination of the vessel. After his examination, Stetler was provided a copy of the Yamaha Memorandum to review. Steller's report states that he concurs with Yamaha's conclusions. FDLE forensic technicians/investigators completed an extensive forensios. examination. FWC investigators and FDLE Special Agents completed follow-up interviews with witnesses and family members. ‘The FIC team of investigators agreed that all evidence gathered to date supports the conclusion that Austin Stephanos and Perry Cohen had a weather related incident out at sea that caused their vessel {to capsize. There are many scenarios speculating what might have occurred prior to and during the apsizing but the evidence in not conclusive enough to confirm any particular scenario on what happened ‘hat tragic day, other than the fact that the vessel took on water and capsized. Austin Stephanos and Perry Cohen still remain missing and are listed in the National Data Base for Missing and Exploited Children. ‘Any new information or additional leads will be investigated if received. 6 [Page On May 16, 2016 at approximately 19:45, Captain Jeff Ardelean, Lieutenant Lindsay McDonald, Lleutenant Richard Ornold, Investigator Brian Coffin, and Investigator Rebecca Teems with the Florida Fish and Wildlife Conservation Commission, while at the Broward Office inside of Port Everglades, was advised by Officer Donald Vacin the tractor trailer that had the container with the vessel inside was enroute from the ship to the office. At approximately 19:54 hours, Officer Vacin escorted the tractor trailer and Hyster/top loader into the Broward Office compound. At approximately 20:00 hours, the container was taken off the trailer by the top loader. At approximately 20:02 hours, the top loader turned the container around so the door was facing south in the compound. ‘At approximately 20:04 hours, the top loader placed the container on the ground At approximately 20:08 hours, a blue lock, #00133203 on the container door, was cut using a bott cutter. At approximately 20:09 hours, container doors were opened. Inside the container, a white, center console with a single engine vessel was located, At approximately 20:20 hours, while Investigator Coffin was utilizing a forklift with straps and rollers, we ‘were able to slowly move the vessel out of the container and place it on metal stands with wheels. At approximately 20:45 hours, Officer’s Nathan Brock and Christopher Gamage arrived to assist. At approximately 20:55 hours, while investigator Coffin was utilizing a fork lift with straps and vessel on {he metal stands, we were able to move the vessel off the stands and placed the vessel on a department issued FWC trailer. At Approximately 20:59 hours, utilizing the fork lft, the vessel and trailer was placed into the Broward Permanent Evidence Storage #12. ‘At approximately 21:01 hours, container was picked up. MEMORANDUM -_ To: FLORIDA DEPARTMENT OF LAW ENFORCEMENT (Attention: Special Agent William Saladrigas) FLORIDA FISH & WILDLIFE CONVERSATION (Attention: investigator Kyle Patterson) FROM: DANIEL J. KISSANE SUBJECT: COHEN/STEPHANOS INSPECTION DATE: JUNE 13, 2016 Pursuant to the written protocol (attached), the data from the Electronic Control Unit ECU") of the Yamaha F115 outboard motor mounted on the 1978 Seacraft vessel (HIN: SECF80110977) owned by Carlson Frances Black (herein “subject outboard motor’) was downloaded on June 2, 2016 by Yamaha's Product Specialist, Caleb Chesser. This was performed pursuant to the formal request of the Florida Fish & Wildlife Conservation and the consent of the owner. This downloaded data was provided electronically to those in attendance and printouts are attached hereto (a total of three pages). In summary, the data downloaded from the subject outboard motor confirms that the outboard motor was properly operating at all relevant times, and had no mechanical or electrical maffunctions that would have caused the outboard motor to stop running (prior fo being completely submersed). This data is consistent with a vessel that was taking on water within the last 13 minutes of operation of the subject outboard motor. The subject outboard Engine Control Unit (ECU) had a total of 7,023.2 hours of operation. The ECU records the last 13 minutes of operation on a data logger. This data confirms the outboard was properly operating, including the following: proper battery voltage, normal Throttle position sensor voltage, normal cooling water temperature, normal intake air pressure and proper oll pressure switch orientation. The data confirms that engine was operated at 2,250 RPMs from -13 minutes through -4 minutes. Thereafter, during the final 3 minutes of operation of the subject outboard it was run at idle speed (650-700 RPMs). During the final 6 minutes of operation of the Subject outboard the following codes were triggered: 1) The Pulser Coil (Code 13); 2) The Thermo Sensor (Code 15); and 3) The Air Pressure Sensor (Code 29), All three of these codes occurred at 1023.2 hours of operation on the outboard motor and all three codes occurred during the last 6 minutes of operation of the motor. These three codes are consistent with the outboard motor taking on excessive water and establish for Yamaha that the outboard motor in question continued to run properly until the vessel sank (ie. the outboard motor was submersed), None of these three codes ‘would have caused an audible alarm or have otherwise been detectable by the user. Based on Yamaha's inspections of the subject outboard motor and the data downloaded from the Yamaha diagnostic system, there were no operational problems or issues with the subject outboard motor. VIZAs Report on Salvage of Overturned Boat MPSV Edda Fjord was on 03.18.2016 on route from Port Fourchon, LA to Punta Delgada, Azores when a single engine boat was discovered overtumed approx 30 feet from the vessels port side. Weather conditions were Southerly Winds force Fair. Seastate 4 with about 7-9 foot ground swell coming from NW. Airiemp 21 € and Pressure 1014 Local time the boat was discovered in position N32 11°39" W 6151" 6 FRC was launched and appro: hed the overtumed boat. They brought some lings to try and att to the boat. Initially they attached a sting to the eye ned boats keel. This was hooked up to Edda Fjords ‘ane and an attempt was made to lif the boat out ofthe water We discovered that the innerliner seemed loose and decided to aitach an extra, sling to the outboard engine or the stem. This proved to be abit difficult but the FRC crew succedad after a few attempts. Again both slings were attached to the provision crane and a new lifting etempt was made. The boa left the water wit fhe bow first and the liner separated break loose. I gave the order the hi me cables. ‘ure as much as possible as the liner appeared to be When ne splash zone, one of the cables broke free and a clear green liguid, gasoline, started pouring out into the sea, | ordered the crane drive carefully slew towards the ships side with the crane to attempt to secure the hose, but we were unsuccessful as | deemed the hanging boa! too dangerous to work under hull above our heads to be some minutes the fuel leak red I gave the order to proceed to li the boat over to the deck, well fF the liferafts, The crane had just enough height to pass the load over the rail and we landed the boat on top af an I-b. on the deck. The inner liner landed upside down, Further leakage wa y using absorbant pads, The total amount of fuel to leak out is hard to estimate but at least 4 gallons maybe ever: more, | observed that 4 tackle boxes lef the line the boat was lifted out of the water and I sent the FRC to pick them up. Edda Fjord returns to d to my office to investigate some. A a few goog to contact USCG Jupiter to report the salva; the boat which looked a lot like Austin and Perrys boat reported missing July The boat suffered some damage and alterations from its original state when it was hoisted ‘onto our ships deck, and later stowed in its cradle. Inner Tiner separated from the hull when lifted from the sea. Likely because of the {otal weight ofthe water in the center console and the fel in the tank Fuel hose parted when the liner separated. When going through the video [ ean see {hal the fuel spilled for about 4 minutes. Quantity of fuel enboard can perhaps be calculated based on this. Starboard stern decivhatch was tom loose and broke ffee. This was salvaged and later placed onboard.
