WHEREAS, It is a policy of the State to recognize the vital role of the youth in
Nation Building and promote and protect their physical, moral, spiritual, intellectual, and
social well-being;

WHEREAS, Pursuant to Section 16 The General Welfare Clause of Republic


Act 7160 Otherwise known as the Local Government Code, the Sangguniang Panlungsod
may enact ordinances intended to prevent, suppress lll!d impose appropriate penalties for
habitual drunkenness in public places, vagrancy, mendicancy, prostitution, gamblin~ and
other prohibited games of chance, juvenile delinquency among others, and such other
activities inimical to the welfare and morals of the inhabitants of the City;

WHEREAS, Some of the provisions of Regulation Ordinance No. 2001-103) as


amended) which deal with youth offenders are deficient and ambiguous and does not
adopt to the present situation;

WHEREAS, It is necessary that the provisions be clarified and strengthened so as


to promote their effectiveness in dealing with children in conflict with law and juvenile
delinquency;

Be it ordained by the Sangguniang Panlungsod that:

Section I. - This Ordinance shall be known as the Comprehensive Ordinance


Prohibiting Minors to Wander, Saunter, Or Loiter in Any Places Specified Herein
after 11: 00 PM and before 4:00 AM.

Section 2. -Definition of Terms:


I. Minor - a person under the age of 18 years old.

2. Child in Conflict with the law - a child who is alleged as, accused of, or
adjudged as, having committed an offense under Philippine laws.

3. Loiter- stand around idly: to stand around without any obvious purpose.

4 Saunter - slow walk: a slow leisurely walk


- Stroll: to walk at an easy unhurried pace

5. Wander-An aimless or leisurely moving from place to place

6. Parent/ guardian - those who is either the father or the mother, ond/or both
who exercise parental authority over the minor or and in their absence, those
who can exercise substituted parental authority pursuant to the Civil Code of
the Philippines as amended.

7. Community Civic Work - unpaid work for the community performed by a


child in conflict with law as an alternative form of penalty in lieu of
imprisonment.

8. Insolvency-the persons' incapacity to perform his financial obligations as


they fall due.

Section 3. - It shall be unlawful for any minor to wander, loiter or saunter in places
specified in Section 4 herein after l 1:00 PM and before 4:00 AM. This prohibition does
not apply if such minor is accompanied by his parent/guardian or adult in-charge of his
custody, or in a lawful pursuit of his parent's or guardian"s livelihood with a business
certificate/ permit duly issued by the City Mayor or his authorized representative, or if
such minor may be found in such places with causes beyond his control upon excusable
reason. These curfew hours shall be applicable all days of the week except Fridays and
Saturdays, which shall have curfew hours from 12 a.m. to 4 a.m.

Section 4. - It shall be unlawful for any minor to loiter or dance during the time specified
in section 3 in any public views, nightclubs, ballrooms or in any amusement places such
as internet cafes, video arcades, billiard halls, beach resorts and other similar
establishments, and to loiter, wander, or saunter in parks, plazas or public roads subject to
the exceptions provided in this ordinance.

Section 5. - Provisions of sections 3, & A shall not be applicable to minors while


attending educational program, social, civic, religious and fiunily gatherings such as,
convocation, conventions, seminars, scholastic and commencement activities, Christmas
Eve, New Year's Eve, Holy Week, Yuletide Mass, Weddings and Birthdays, All Saints
day and Fiesta, and while on their way home from such activities.

Section 6. - Except as provided under Section 5 hereof, it shall be unlawful for any
business establishments engaged in the operation of restaurants, music lounges, disco
bars/houses, night clubs, amusement places like internet cafes, video arcades, billiard
halls, beach resorts and other similar establishments to admit, accept or allow minors
within the premises of their establishments.

These establishments above-mentioned shall be required to post notices enforcing


curfew hours on minors provided in section 3 and 4 at the entrance and other conspicuous
places in their establishments and shall be required to make an announcement, one (1)
hour or 30 minutes before the start of curfew hour, reminding minors inside their
establishments that curfew hours is fast approaching.

Section 7. - All Police Precincts shall be required to cause their siren to blow on 15
minutes before the designated curfew hours, to warn the minors and provide them an
opportunity to lead back home, and a second siren at exactly 11 :00 o~clock in the evening
to inform that curfew hours has started.

Section 8. - The Sangguniang Kabataan (SK) officials, representatives from Department


of Social Welfare, together with the Civilian Voluntary Officer, shall be deputized to
conduct rounds on establishment in their respective barangays for the purpose of
enforcing and compliance of this ordinance.

Section 9. - The Sangguniang Kabataan Council in every barangay are required to make
an appropriation in their annual budget for the issuance and distribution of Identification
Cards (ID's) for the youth in the barangay aging from 9 years to 18 years old.

Section 10. - Any establishments found violating this ordinance shall be punishable by a
fine:
a) First Offense - P 3,000.00
b) Second Offense - P 4,000.00
c) Third & Successive Offenses - P5, 000.00

and/or revocation of business permit and closure of business establishment upon the
discretion of the court or of the City Mayor.

Section 11. - Any minor found violating this ordinance shall be committed to the
custody, and shall render community civic works under supervision of the DSWD and
shall be punishable by rendering community civic work such as, but not limited to
cleaning esteros, road islands, public toilets/buildings/structures and other social services
under the supervision of the Department of Social Welfare and Development
representatives in coordination with the Punong Barangay in his barangay of residence
for a period of 24 to 72 hours.

The parent or guardian of the minor who is found guilty of violating this ordinance shall
be liable for the payment of fines in the following amount:

a) First Offense -Pl, 500.00


b) Second Offense- P3, 000.00
c) Third & Successive Offenses-P 5,000.00

and shall be required to undergo seminars on values formation to be conducted by the


DSWD, together with his child in conflict with the law.

Section 12. - The Barangay Captain where the minor had rendered his community civic
works is required to issue a certification after the completion of the community service by
the minor to the City Social Welfare and Development Office.

Section 13. - All heads of private & public schools within the city shall be directed to
properly disseminate and educate their students to adhere and observe strictly to the
provisions of this ordinance by directing heads of private and public schools to post
copies of this Ordinance in conspicuous places or bulletin boards.

They shall also be required to properly coordinate with different police precincts
regarding their schedule of activities for the exemption of their students on curfew hours
on such occasions or activities.

Section 14. - The Office of the City Secretariat shall be required to provide copies of this
ordinance to all the 180 barangays, public and private schools in the City of Iloilo fur
proper information and dissemination.

Section 15. Separability Clause. If any provision or provisions of this Ordinance


shall be declared invalid or unconstitutional by appropriate Court or by competent
authorities, other provision or provisions hereof which are not affected thereby shall
continue to be in full force and effect.

Section 16. Repealing Clause. This ordinance repeals Regulation Ordinance No. 2001-
103, as amended by Regulation Ordinance 2003-358, otherwise known as an Ordinance
Prohibiting Minors to Wander, Saunter or Loiter in Any Places Specified Herein After
11:00 PM and Before 4:00AM AND providing Penalties thereof and all Ordinances
inconsistent with the provisions herewith.

Section 17. Effectively. This ordinance shall take effect after 10 days from publication in
local newspaper of general circulation.
