Subject: A.12-04-019 Email Ruling Granting Extension to File Statement of Issues and Comments

ADMINISTRATIVE LAW JUDGE'S RULING

On June 13, 2017, Citizens for Just Water (Just Water) by email to Judge Weatherford requested that it
be granted an extension of the June 23, 2017 deadline for filing and serving its Statement of
Issues. (See June 9, 2017 Ruling.) Just Water reports that it did not receive email service of the June 9
Ruling and its group needs a few extra days to respond.

Commission staff investigated the service problem. Commission records show that email service of the
July 9, 2017 Ruling was performed but, due to technical problems, was not fully completed until one
business day later, on July 12, 2017. It also appears that there may have been problems by some parties
with receipt of the Ruling or other confusion. The request might be granted but, if granted, for equity it
should be granted not only for Just Water but for all parties. If the initial filing date is extended, the date
for filing comments should also be extended given the July 4 holiday during the comment period. The
Commission expects parties to make a reasonable effort to file one joint Statement of Issues. A brief
extension may also assist parties achieve that goal.

Just Water is, and all parties are, reminded that any party requesting an extension must first make a
good-faith effort to ask other parties to agree to the extension when other parties are affected by the
extension, and must report the results when it makes its request. (Rule 11.6 of the Commission's Rules
of Practice and Procedure.) The requirement is waived here to secure just, speedy and inexpensive

determination of the issues. (Rule 1.2.) This requirement will not necessarily be waived in each such
instance.

IT IS RULED that the dates for filing a Statement of Issues and comments are extended. The
Statement of Issues shall be filed and served by June 30, 2017. Comments, if any, on a Statement of
Issues shall be filed and served by July 11, 2017. The Docket Office shall formally file this Ruling.
