MOTION

ON BEHALF OF RESPONDENT: Jennifer L. Ansay, Esquire

APPLICATION: Reopening and termination

The respondent moves to reopen and terminate proceedings without prejudice in order to pursue

adjustment of status before the Department of Homeland Security (DHS), Citizenship and

Immigration Services (CIS), based on the approval of his application for T-1 Nonimmigrant

Classification. Considering the totality of the circumstances presented with the respondent's

motion, including the absence of a response to the motion by the DHS, the motion will be granted

under the provisions of 8 C.F.R. 1003.2(a).

ORDER: The motion to reopen is granted and removal proceedings are terminated without

prejudice so that the respondent may seek adjustment of status before the CIS.
