BACKGROUND OF THE PROJECT:

The original target of the project is the delineation and titling of Sabangan
Ancestral Domain as a whole. Incidentally, Sabangan Ancestral Domain is
one (1) of the four (4) pilot areas of the NCIP-World Bank A.D. titling project
in the entire country. Accordingly, the NCIP-World Bank A.D. titling project
will end on August 15, 2010.

On June, 2009, initial funds for the project in the amount of five hundred
forty five thousand eight hundred sixty pesos only (P 545,860.00) was made
available which prompted the PDT, following the Omnibus Rule, to conduct
the social preparation activities in the fifteen (15) barangays of Sabangan
such as information, education campaign (IECs), consultations for the
ICCs/IPs’ free and prior informed consent (FPIC) for the A.D. titling project,
data gathering and documentation for A.D. proofs, and ancestral domain
boundary conflict resolution meetings with adjacent communities/A.Ds.

Unfortunately, after the social preparation activities for the delineation and
titling of Sabangan as a whole, it was found out not feasible at the moment
due to the unresolved ancestral domain boundary conflicts with adjacent
communities such as with Lower Bauko, Sagada and Bontoc ancestral
domains despite diligent efforts by the parties thru their authorized elders
and leaders to settle the conflicts amicably using their traditional justice
system called “tong tong”.

During the assessment meeting with the A.D. elders/leaders and LGU officials
of Sabangan last December 2, 2009, they proposed that the delineation and
titling of Sabangan will be done by Area considering that it is not feasible for
the whole Sabangan to be titled as a whole municipality. Incidentally, the
fifteen (15) barangays of Sabangan was clustered in to four (4) areas by
previous municipal administration. The proposal was to start the delineation
and titling of Area 4 which is boundary conflict free.

Thru a consultation sometimes January, 2010, the Indigenous


Peoples/Indigenous Cultural Communities (ICCs/IPs) Area 4 of Sabangan
comprising barangays Napua, Namatec, Busa and Capinitan agreed to the
proposal of the elders and leaders to delineate and title Sabangan by area
such that a Petition dated January 10, 2010 was issued by them manifesting
their collective desire to have Area 4 be delineated and titled considering
that Area 4 is boundary conflict free.

During the said consultation, the representatives from Area 4 barangays,


agreed to name Area 4 as Tinmakudo Ancestral Domain in recognition to Mt.
Tinmakudo as their mountain resource of abundant waters supply for their
domestic and irrigation use. Further, they authorized the four (4) Punong
barangays of Area 4 to file and follow-up their CADT application with NCIP.

Said request was supported by a Sabangan Sangguniang Bayan Resolution
numbered 21010-01, series 2010 dated January 18, 2010 requesting the
NCIP to issue CADT by Area in the municipality of Sabangan.

The Petition was validated during a series of consultations with the


representatives of Area 4 comprising Napua, Namatec, Busa and Capinitan
on February 8, 9, 10 and 11, 2010 respectively where they affirmed their
petition for the delineation and titling of Tinmakudo Ancestral Domain,
Sabangan.

As a process and a requirement for the conduct of perimeter survey of


Tinmakudo Ancestral Domain, the Social Preparation Activity Report (SPAR)
was prepared and submitted to the Regional Director thru the Regional
Review Body (RRB). The SPAR was reviewed by the RRB and was referred
back to the PDT for appropriate action citing that the original petition covers
the whole municipality of Sabangan while the recommendation of the PDT is
for the delineation of a certain portion only.

Further, the RRB recommended that proper validation be conducted to


confirm if the indigenous peoples inhabiting that portion (Area 4) belong to
en ethnic group who are entitled to avail themselves of the provisions of the
IPRA, particularly on the delineation and titling of their ancestral domain. The
PDT was also advised to propose to the petitioners to amend their petition to
specifically indicate the land they want to be delineated and titled.

With the findings and recommendation of the RRB, the PDT of Mt. Province
coordinated with the Ancestral Domains Office (ADO) of the NCIP-CO for
additional fund for the project thru a Project Proposal for the validation of
proofs and a revised work and financial plan (WFP) for supplemental budget
for the project.

With the project proposal for validation of proofs, the ADO coordinated with
the World Bank representative which resulted to the release of eighty
thousand pesos only (P80,000.00) as their counterpart for the project.

On June 24, 2010, witnessed by the representatives from the NCIP-World


Bank A.D. titling project, Ms. Victoria Florian Lazaro - team leader, Ms. Myrna
L. Caoagas – Project Manager and ADO Director, Engr. Jeanette Manuel - ADO
Recognition Division Chief, Mr. Recto C. Alawas – NCIP-CAR RRB member and
TMSD Division Chief, Engr. Michael Baldonado – ADO Staff, Engr. Cathy
Gollunan, team member and Region 4 TMSD division Chief, the ICCs/IPs of
Tinmakudo Ancestral Domain (Area 4, comprising Napua, Namatec, Busa and
Capinitan) once and for all re-affirmed their petition or free and prior
informed consent (FPIC) for the delineation and titling of Area 4 as
Tinmakudo Ancestral Domain. During the validation activity, as
recommended of the RRB to confirm if indeed the people of Area 4 or
Tinmakudo are IPs, the people inhabiting Area 4 or Tinmakudo A.D. are
members of the Kankana-ey tribe and are Indigenous Peoples. The CADT
application was also amended as Tinmakudo Ancestral Domain of Sabangan
instead of Sabangan Ancestral Domain.

For the revised work and financial plan (RWFP) earlier submitted to the
Regional Office for endorsement to Central Office, it had to undergo rough
sailing in the TMSD courtesy of the point person. In order to avoid further
unnecessary delay, another copy of the revised WPF had to be furnished to
the Central Office this time not passing to the concerned point person.The
revised WFP providing for a supplemental budget for the project was then
approved by the NCIP Chairman and thru CO memo no. ADO-07-2010-473
dated July 21, 2010, an approved revised WFP was transmitted to the PDT of
Mt. Province for implementation.

On July 28, 2010, a partial release of the supplemental fund was released by
CO to NCIP-CAR, a copy of the notice of transfer of allocation (NTA) dated July
23, 2010 in the amount of three hundred fourteen thousand eight hundred
ten pesos only (P 314,810.00) was furnished the Regional Office. Thru text
and call, the PDT thru Engr. Olsim was advised to prepare an
Activity/Training design for the purpose of accessing the fund for its
immediate implementation.

With the fund availability, the perimeter survey of Tinmakudo ancestral


domain will start asap
