3. The Bidders can download the tender documents from the Portal:
http://mcfbd.etenders.in. Tender Documents Fees has to be paid online
through payment gateway during the "Downloading of Tender
Document & Payment of Tender Document fees" stage and Earnest
Money Deposit has to be submitted through Demand Draft in favour of
Commissioner, Municipal Corporation Faridabad. The particulars are
to be given online at the e-tendering website of the department:-

made by the agency

4. The tender shall be submitted by the bidder in the following three


separate envelops online:
1. Earnest Money and all the documents
in support of eligibility criteria - Envelope 'ED'
2. N.I.T. and Technical Bid - Envelope 'T I'
3. Price Bid - Envelope 'C I'

Note:- Online Bidders shall submit the EMD. Documents in support


of eligibility criteria shall also be submitted in Envelope 'ED'.
Price Bids are to be submitted mandatory online and shall not
be accepted in any physical form.

Reference of the EMD is to be mentioned online.


The envelopes 'ED' & 'TI' shall be kept in a big outer envelope, which shall also be
sealed. In the first instance, the Envelop - 'ED' of all the Bidders containing the
Earnest Money and documents supporting eligibility criteria shall be opened online.
If the Earnest Money and eligibility of bidder is found proper, the Envelop 'TI'

containing Technical Bid shall be opened in the presence of such bidders who either
themselves or through their representatives choose to be present. The Technical and
Financial bid shall be opened only if the bidders meet the eligibility criteria as per
the Bid document.
The bidder will submit the necessary documents as under.
Envelope 'ED' - Earnest Money Deposit and eligibility criteria Envelop
Online EMD Envelope-Reference details of the Earnest Money Deposit instrument
and scanned copy of documents supporting eligibility criteria.
Envelope 'TI' - Technical Bid Envelope
Online Technical Envelope - All the information and scanned copies of the
Documents / Certificates as required to be submitted as per the Tender. Also, all
such documents, if any, that cannot be submitted online i.e. all the Information and
Documents / Certificates as required to be submitted in physical technical envelope
as per the Tender.
Envelope 'CI' - Price Bid Envelope

To be submitted mandatory online- "Information related to Price Bid of the Tender".


The Envelopes "ED" & "TI" shall be placed in another envelop of bigger size clearly
marking the name of agency & name of work. In case, the Bidders have submitted
all the information and documents/ certificates required as a part of Technical Bid
online, physical Envelope "TI" shall be submitted clearly marking "Blank".

ANNEXURE-A
CONDITIONS OF E-TENDERING
Instruction to Contractor on Electronic Tendering

These conditions will over-rule the conditions stated in the tender documents,
wherever relevant and applicable.

1. Registration of contractors on E-tendering Portal:-

All the Contractors intending to participate in the tenders processed online, are required to
get registered on the Electronic Tendering System on the Portal http://mcfbd.etenders.in.
For more details, please see the information on the Registration info link on the home page.
2. Obtaining a Digital Certificate:

2.1 The Bids submitted online should be encrypted and signed electronically with a
Digital Certificate to establish the identity of the bidder bidding online. These
Digital Certificates are issued by an Approved Certifying Authority, by the
Controller of Certifying Authorities, Government of India.
2.2 A Digital Certificate is issued upon receipt of mandatory identity (i.e. Applicants
PAN Card) and Address proofs and verification form duly attested by the Bank
Manager/ Charted Accountant/ Any Gazatted Officer whose stamp carrying
emblem of Ashoka. Only upon the receipt of the required documents, a digital
certificate can be issued.
2.3 The contractors may obtain Class-II digital certificate from any Certifying
Authority or Sub-certifying Authority authorized by the Controller of Certifying
Authorities or may obtain information and application format and documents
required for the issue of digital certificate from:

2.4 Bid for a particular tender may be submitted online using the digital certificate,
which is used to encrypt the data and sign the hash during the stage of bid
preparation & hash submission. In case, during the process of a particular tender,
the user looses his digital certificate (be it due to virus attack, hardware problem,
operating system or any other problem) he will not be able to submit the bid online.
Hence, the users are advised to keep a back up of the certificate and also keep the
copies at safe place under proper security (for its use in case of emergencies).
2.5 In case of online tendering, if the digital certificate issued to the authorized user of a
firm is used for signing and submitting a bid, it will be considered equivalent to a
no-objection certificate/power of attorney /lawful authorization to that User. The
firm has to authorize a specific individual through an authorization certificate
signed by all partners to use the digital certificate as per Indian Information
Technology Act 2000. Unless the certificates are revoked, it will be assumed to
represent adequate authority of the user to bid on behalf of the firm in MC
FARIDABAD tenders as per Information Technology Act 2000. The digital
signature of this authorized user will be binding on the firm.
2.6 In case of any change in the authorization, it shall be the responsibility of
management / partners of the firm to inform the certifying authority about the
change and to obtain the digital signatures of the new person / user on behalf of the
firm / company. The procedure for application of a digital certificate however will
remain the same for the new user.
2.7 The same procedure holds true for the authorized users in a private/Public limited
company. In this case, the authorization certificate will have to be signed by the
directors of the company.
3 Opening of an Electronic Payment Account:
For purchasing the tender documents online, contractors are required to pay the tender
documents fees online using the electronic payments gateway service. For online payments,
please refer to the Home page of the e-tendering Portal http://mcfbd.etenders.in
4 Set up of machine:
In order to operate on the electronic tender management system, the users machine is
required to be set up. A help file on setting up of the system can be obtained from M/s
Nextenders (India) Pvt. Ltd. or can be downloaded from the home page of the website -
http://mcfbd.etenders.in.
5 Online Viewing of Detailed Notice Inviting Tenders:
The contractors can view the detailed N.I.T and the time schedule (Key Dates) for all the
tenders floated through the electronic tendering system on the MC FARIDABAD e-tenders
website http://mcfbd.etenders.in

The tender documents can be downloaded from the Electronic Tendering System through
the Portal http://mcfbd.etenders.in
7 Key Dates:
The contractors are strictly advised to follow dates and times as indicated in the Notice
Inviting Tenders. The date and time will be binding on all contractors. All online activities
are time tracked and the system enforces time locks that ensure that no activity or
transaction can take place outside the start and end dates and the time of the stage as
defined in the Notice Inviting Tenders.
8 Bid Preparation (Technical & Financial) Online Payment of Tender Document Fee
and Submission of Bid Seal (Hash) of online Bids:
8.1 The Payment can be made by eligible / contractors online directly through Credit
Cards / Internet Banking Accounts / Cash Cards. The contractors have to pay the
cost of the tender documents online by making online payment of tender document
fees using the service of the secure electronic payment gateway. The secure
electronic payments gateway is an online interface between contractors and credit
card / online payment authorization networks.
8.2 Submission of bids will be preceded by submission of the digitally signed bid seal
(Hash) as stated in the time schedule (Key Dates) of the Tender.
9 Generation of Super Hash:
After the submission of Bids (Hash) by the Contractors, the bidding round will be closed
and a digitally signed Super Hash will be generated by the authorized Municipal
Corporation FARIDABAD officers. This is equivalent to sealing the tender box.
10 Submission of actual online bids:
Contactors have to submit their encrypted bids online and upload the relevant documents
for which they generated the hash at the stage of hash generation & submission after the
generation of Super Hash. The process is required to be completed within the date and time
as stated in the Notice Inviting Tenders (Key Dates). The electronic bids of only those
contactors who have submitted their bid seals (Hashes) within the stipulated time, as per
the tender time schedule (Key Dates), will be accepted by the system. A contractor who
does not submit his bid seal (Hash) within the stipulated time will not be allowed to submit
his bid.
Note:- Bidders participating in e-tendering shall check the validity of his/her Digital Signature
Certificate before bidding in the Tenders floated online at e-tendering portal of MC
Faridabad website http://mcfbd.etenders.in.

1. Instructions to Bidders:

1.1. Municipal Corporation Faridabad, intends to set up a 50 MLD Sewage Treatment Plant
on SBR process followed by Tertiary Treatment at Faridabad
1.2. With the aforesaid objective, Municipal Corporation Faridabad invites detailed
proposals from consultants for the Project.
1.3. Consultants for the Project in order to provide services for preparation of DPR,
Technical Assistance for approval and tender document for engagement of contractors
1.4. Municipal Corporation Faridabad, Intends to adopt a two stage bidding process for
selection of technical consultant.
1.5. The Proposals received from the Bidder shall be evaluated on the basis of the criteria
set out in this RFP document. The Bidder is expected to submit only one (1) Proposal
per project. Any Bidder who submits more than one Proposal shall be disqualified.
1.5.1. Joint ventures/ Association up to a maximum of two agencies are permitted.
1.5.2. At least one of the consultant firm/ agency, forming the joint venture/
association, The consultant firm should have similar experience of services for
preparation of DPR for a project capacity not less than 50 MLD
1.5.3. At least one of the consultant firm/ agency, forming the joint venture/
association, should have an average turnover of at least Rs. 1 Crores in the last
three financial years.
1.5.4. None of the consultant firm/ agency, forming the joint venture/ association
must not be a black listed agency or any agency affiliated to black listed firm or an
agency

1.6. The Successful Bidder would have to enter into a Consultancy Agreement with
Municipal Corporation Faridabad, the broad terms of engagement; payments are
described in the RFP.
1.7. The Proposal shall remain valid for a period not less than three months from the
Proposal Due Date (Proposal Validity Period). Commissioner, reserves the right to
reject any Proposal without assigning any reason.

1.7.1. Format and Signing of Proposal

1.7.1.1. The Bidder would provide all the information as per this RFP would evaluate
only the Proposals that are received in the required format and are complete in all
respects.

1.7.1.2. Each Proposal shall comprise the following:


A. Technical Proposal will be submitted manually as per time schedule as well as
online also.

a. Covering letter in the format set out in Appendix A

b. Details of the Bidder in the format set out in Appendix B


c. Technical Proposal comprising
i. Project Data Sheets in the format set out in Appendix C,
with supporting proof as indicated in Item 3.
ii. Approach to the study and methodology
iii. Curriculum Vitae of persons who would be working on the
Assignment
d. Earnest Money deposit in the form of Bank Draft favoring,
amounting to Rs. 10,000/- (Ten Thousand Only) in favour of Commissioner,
Municipal Corporation Faridabad, payable at Faridabad

B. Financial Proposal Submission.


The Financial proposal will be submitted online as per Appendix D.

1.7.1.3. The Proposal shall be typed or written in indelible ink and each page shall be
initialed by an authorized signatory of the Bidder. All the alterations, omissions,
additions, or any other amendments made to the Proposal shall also be initialed by the
person(s) signing the Proposal.

1.7.2. Sealing and Marking of Proposal

Each of the envelopes, both outer and inner, must be superscripted with the following
information:
a. Name and Address of Bidder
b. Contact person and phone numbers.
c. Invitation for Appointment of Consultant for Preparation of DPR for 50 MLD
Sewage Treatment Plant at Faridabad

1.8. All the envelopes shall be addressed to:

1.8.1. If the envelope is not sealed and marked as instructed above, assumes no responsibility
for the misplacement or premature opening of the contents of the Proposal submitted
and such Proposal, may, at the sole discretion of, be rejected.

1.8.2. The Bidder is expected to examine carefully the contents of all the documents
provided. Failure to comply with the requirements of RFP shall be at the Bidders own risk.

d. It shall be deemed that prior to the submission of the Proposal, the Bidder has:
e. Made a complete and careful examination of terms and conditions/ requirements
and other information asset forth in this RFP document;
f. Received all such relevant information as it has requested from Municipal
Corporation Faridabad and
g. Made a complete and careful examination of the various aspects of the Project

1.8.3. Municipal Corporation Faridabad shall not be liable for any mistake or error or neglect
by the Bidder in respect of the above.

1.8.4. Municipal Corporation Faridabad, reserves the right to reject any Proposal not
submitted on time and which does not contain the information/documents as set out
in this RFP document.

1.8.5. To facilitate evaluation of Proposals, Municipal Corporation Faridabad, may, at its sole
discretion, seek clarifications in writing from any Bidder regarding its Proposal.

1.9. Responsive Proposal

1.9.1. Prior to the evaluation, the Proposals shall be checked for responsiveness with the
requirements of the RFP and only those Proposals, which are found to be responsive,
would be further evaluated in accordance with the criteria, set out in this RFP
document
1.9.2. The Proposal would be considered to be responsive if it meets the following conditions:

a. It is received / deemed to be received by the Proposal Due Date including


any
b. extension thereof.
c. It is signed, sealed on document
d. It contains all the information and documents as requested in the RFP.
e. It contains information in formats specified in this RFP.
f. It contains EMD mentioned in RFP
g. It mentions the validity period as set out in RFP
h. It provides information in reasonable detail. (Reasonable Detail means
that, but
i. for minor deviations, the information can be reviewed and evaluated by
without communication with the Bidder) reserves the right to determine
whether the information has been provided in reasonable detail.
j. There are no inconsistencies between the Proposal and the supporting
documents.
k. A Proposal that is substantially responsive is one that conforms to the
preceding
l. requirements without material deviation or reservation. A material
deviation or reservation is one, which affects in any substantial way, the
scope, quality, or performance of the Project, or which limits in any
substantial way, inconsistent with the RFP, rights or the Bidders
obligations under the Agreement, or which would affect unfairly the
competitive position of other Bidders presenting substantially responsive
Proposals.

1.10. The responsive proposals shall be evaluated as per the criteria set out in Item 3
clause 3.3.2.

1.11. The Bidder obtaining the highest Composite Score would be declared as the
Preferred Bidder may accept the Proposal of the Preferred Bidder with or without
negotiations.

1.11.1. In case there are two or more Bidders obtaining the highest Composite Score,
may in such case call all such Bidders for negotiations and select the Preferred
Bidder on the outcome of the negotiations. The selection in such cases shall be at
the sole discretion of Municipal Corporation Faridabad

1.12. Municipal Corporation Faridabad Reserve the right to reject any Proposal, if:

a. At any time, a material misrepresentation is made or discovered; or


b. The Bidder does not respond promptly and diligently to requests for
supplemental Information required for the evaluation of the Proposal.

1.13. In the event of acceptance of the Preferred Bidder with or without negotiations,
shall declare the Preferred Bidder as the Successful Bidder, will notify the
Successful Bidder through a Letter of Acceptance/Award (LoA) that its Proposal has
been accepted.

1.13.1. The Successful Bidder(s) shall be required to execute the Consultancy Agreement
within two week of the issue of LoA or within such further time as may agree to in its
sole discretion.
1.13.2. Failure of the Successful Bidder to comply with the requirements mentioned in RFP
shall constitute sufficient grounds for the annulment of the LoA. In such an event,
reserves the right to

a. Either invites the next best Bidder for negotiations Or


b. Take any such measures as may be deemed fit in the sole discretion of, including
annulment of the bidding process.
c. The EMD will be forfeited.

1. Notwithstanding anything contained in this RFP, reserves the right to accept or reject any
Proposal, or to annul the bidding process or reject all Proposals, at any time without any
liability or any obligation for such rejection or annulment, without assigning any reasons
thereof.

Wastewater
Design and Drawing for Treatment Process - Primary, Secondary, Tertiary Treatment
Cost Estimation BOQs, Operation & Maintenance
Sustainability Assessment
Environmental and Social Impact Assessment
o Preparation of Draft Detailed Project Report
o Preparation of Final Detailed Project Report
o Technical Assistance for approval of DPR
o Preparation of tender Document
o Provide Assistance to MCF for Evaluation of tender and Selection of Executing
Agency

3. Evaluation:

3.1. Eligibility Criteria

3.1.1. Joint ventures/ Association up to a maximum of two agencies are permitted.


3.1.2. At least one of the consultant firm/ agency, forming the joint venture/
association, The consultant firm should have similar experience of services for
preparation of DPR for a project capacity not less than 50 MLD or similar 2
projects of not less than 30 MLD.
3.1.3. At least one of the consultant firm/ agency, forming the joint venture/
association, should have an average turnover of at least Rs. 1 Crores in the last
three financial years.
3.1.4. None of the consultant firm/ agency, forming the joint venture/ association
must not be a black listed agency or any agency affiliated to black listed firm or an
agency

3.2. Proposal Evaluation: Technical Proposal Submission

3.2.1. The Technical Proposal Submitted Proposal would first be checked for
responsiveness and other evaluation requirements of the RFP including EMD.

3.2.2. In case the details in Technical Proposal are found to be inadequate,


Commissioner, Municipal Corporation Faridabad may request the Bidder to
submit clarifications. If required, the Bidder would be asked to make
presentation.

3.2.3. The evaluation of the Financial Proposal Submission would be taken up only
after the contents of the Technical Proposal are found to meet the requirements
of this RFP. Commissioner, Municipal Corporation Faridabad reserves the right to
reject the Proposal of a Bidder without opening the Financial Proposal Submission
if, in its opinion, the contents of Technical Proposal Submission are not
substantially responsive with the requirements of this RFP.

3.2.4. Financial Proposal Submission, of the technically qualified bidders shall be


opened in the presence of such Bidders, who choose to be present.

3.3. Scoring Methodology: Technical Proposal Submission

3.3.1. The total maximum points under this evaluation of Technical Proposal are 100
marks.

3.3.2. This score shall be based on an assessment of the Technical Proposal of the
Bidder. The Technical Proposal submitted by the Bidder would be assessed
through rating of various parameters set out in the table below.

1.1.1. The Bidders shall submit copies of the letters/ work orders from the client,
indicating their involvement Sewage Treatment Plants in India/ Globally.

1.1.2. The score under the Technical Proposal Submission would be the arithmetic
sum of the marks assigned to the Bidders under each of the parameters listed
above in para 3.3.2.

4. Evaluation Methodology:

4.1 The bidders who secure 75% marks in technical proposal evaluation qualify for next
step of financial proposal opening. Bidders securing less than 75% marks will treated
as disqualified and their financial bids will not be considered for opening.

4.2 The Financial Proposals of the Bidders who qualify in Technical Proposal Evaluation
shall be opened.

4.3 The Bidder obtaining the highest Composite Score would be declared as the
Preferred Bidder.

The composite score shall be calculated on the basis of QCBS; the calculations shall
be done as follows:

The technical score of the bidder shall be worked out as per formula detailed below:-
St = 100 x T/Tmax, where
St is the technical score of the Technical Proposal being evaluated,

T is the quote of the Technical Proposal under consideration, based on Clause 3.3.2 above.
Tmax is the quote of the highest rated Proposal, based on Clause 3.3.2 above.

The score for other Financial Proposals will be computed as follows:

Sf = 100 x Fm / F where:
Sf is the financial score of the Financial Proposal being evaluated,
Fm is the quote of the lowest priced Financial Proposal,
F is the quote of the Financial Proposal under consideration.

The composite score shall be computed as (80:20); QCBS


Composite score = (0.8 X St) + (0.2 X Sf);

The agency getting highest composite score shall be invited for negotiations and award of
work.

5. Payment of Fee:

The fees payable by to the Consultant would be as per the following table:

6. Confidentiality and publicity:

6.1. All plans, drawings, specifications, designs, reports and other documents prepared by
the Consultant in performing the Services shall become and remain the property and
copyright of Municipal Corporation Faridabad , after payment therefore, and the
Consultant shall, not later than upon termination or expiration of this Agreement,
deliver all of the foregoing to Municipal Corporation Faridabad
6.2. The Consultant shall treat the details of the output of the assignment and the Services
as confidential and for the Consultant's own information only and shall not publish or
disclose the details of the output, deliverables/milestones submitted to Faridabad
Municipal Corporation or the Services in any professional or technical journal or paper
or elsewhere in any manner whatsoever without the previous consent in writing of
Municipal Corporation Faridabad

7. Responsibilities and obligations of the consultant:

The successful Consultant shall:


7.1. Provide the Services in accordance with the scope of work as mentioned in the tender
document

7.2. Exercise the degree of skill, care and diligence normally exercised by members of the
profession performing services of a similar nature ;
7.3. Be bound to comply with any written direction of to vary the scope sequence or
timing of the Services ;
7.4. Use all reasonable efforts to inform itself of s requirements for the Deliverables for
which purpose the Consultant shall consult throughout the performance of the
Services.
