These proceedings shall be read in continuation of the proceedings dated 16.3.2015. Commission had directed DM
Jaunpur to take steps for rehabilitation and providing the complainant the alternative means of livelihood within one
month. It was further directed to provide the complainant work under MNREGA. She should be issued BPL or Antodaya
card as per the eligibility, certificates of her identity i.e, aadhar card may also be issued to her and steps to be taken to
Direction issued by the Commission ensure that complainant and her family are able to afford the basic necessities of life. DM Jaunpur submitted his report
dated 14.11.2013. It has been communicated that the brick kiln owner Subhash Singh has been booked under crime
no. 276/11 u/s 16/17/18 of Bonded Labour (Abolition) Act 1976. He was arrested during investigation and sent to jail.
Charge sheet no. 41 dated 9.11.2011 has been filed. Case is pending before the court. Cases have also been filed
against the accused under the Minimum Wages Act and other acts. DM Jaunpur in his report dated 6.5.2013 have
communicated that brick kiln labourer Nandu Mushar has been provided Antodaya card, Prem Mushar and Border
Mushar BPL card has been attached with Mahender Kumar Yadav. Nandu s/o Bonu card under MNREGA bearing no.
UP-58-033-044-022/38 has been issued. He has been given work under MNREGA in year 2011-2012 for 87 days, in year
2012-2013 80 days, in 2013-2014, 105 days, in 2014-2015, 27 days. Under Samajwati Pension Scheme, he has been
paid Rs. 6,000/- in his UBI account maintained at Rampur. SP Jaunpur had communicated that accused has been charge
sheeted u/s 3(1)/6 SC/ST Act and additional charge sheet 47A dated 14.12.2014 has been filed in the court which is sub
judice. Assistant Labour Commissioner, Jaunpur, in his report dated 20.4.2015 submitted that labourer Guddu and
other freed labourers have been rehabilitated and each has been paid Rs. 20,000/- . A list has been submitted along
with the report, showing the payment in their accounts. Commission had considered the report submitted by the
authorities. No further action is required. The case is closed.
