(a) the latest position of numbers of elephants getting killed in locomotive accident
on Railway track in the country ;
(b) Whether keeping in view the present situation. Government have adequate plans
to meet the situation; and

i) The Animal Accident Reduction Group has been formed to improve analysis of the
accident statistics and coordinate the actions of the various organisations involved.
iii) Awareness programmes are being organised among the villagers living on the
National Highways and Railway tracts.
iv ministry of Railway has been suggested to instruct the drivers to reduce the speed
and not to cross 30km per hour.
iv) My Ministry has also given proposal to Ministry of Railways and surface transport
to install Elephant repelling system by using infrasonic sound with auto sensor and .

Advance alert system by using microwave sensors along with radio transmission to
coming by locomotives driver and nearest control room.

a) the foreign exchange earnings from tourists during the last two years and its
contribution to GDP?
b) What are the National policies there to for the development of Tourism?
Minister of Culture; Madam Speaker , The GDP of the tourism sector has expanded
229% between 1990 and 2011.
(a) the estimated foreign exchange earnings from tourism during the last two years were
as follows;
Foreign exchange earnings from tourism in 2011 was Rs.68.721 crore.Foreign exchange
earnings from tourists visiting India till November 2012 was Rs.83,938 crore, with a
growth of of 22.1 percent over the same period in 2011.
(b)The Ministry of Tourism designs national policies for the development and promotion
of tourism. Concerted efforts are being made to promote new forms of tourism such as
rural, cruise, medical and eco-tourism. The Ministry also maintains the Incredible
India campaign. As a result 6.29 million Foreign tourists arrived in 2011, earning the
country $16.5 billion. The number of foreign tourist arrivals in the country in 2012 (till
November) increased by nearly six per cent over the same period in 2011.
Ms.Swagata Das: For women, the country is still a house of horrors!Will Tourism in
India be affected by the attacks on foreign tourists specially on women? If so, what
effort the ministry has taken so far to enhance the image of the nation abroad?
Minister of Culture: Madam,I do admit such issues will create a sense of insecurity
among the foreign tourists. But I am confident to say my ministry has taken and will
take firm steps to tackle these issues in collaboration with the ministry of Home Affairs.

In 2012, the "Clean India" campaign was launched by the tourism ministry to enhance
the image of the country abroad. The tourism ministry also launched an international
campaign "Find What You Seek" and a domestic campaign "Go Beyond These
Campaigns" at the World Travel Market 2012 in London. In 2012, India sold tourism
packages in Saudi Arabia with road shows as well. Above all Mega star Amir Khan has
been appointed as brand ambassador with the message Atithi devo bhava
Ms Upali Banerjee:"India has the highest potential in medical tourism in the world,"
Minister OF Culture: Madam, "India has the highest potential in medical tourism in the
world." The growth in Indias medical tourism market will be a boon for several
associated industries, including the hospital industry, the medical equipment industry,
and the pharmaceutical industry.In terms of medical tourists, the number would touch
1.3 million by 2013 at a CAGR of 19%. "However, the industry is at a nascent stage
and requires a few years to reach the platform already established by the IT sector."

(b)The question regarding ministrys effort-my ministry has constant touch with External
affairs and Ministry of Health and Family Welfare.
The govt. has relaxed its tourist visa rules. Apollo Hospitals, Fortis Healthcare and Max
Healthcare, Medica like chain of hospitals have been encouraged to attract foreign
patients. It is estimated that India could be hosting 24 lakh medical tourists by 2020,
almost four times the number it catered to in 2010. And thats not all. The figure is
projected to rise to 49 lakh tourists by 2025.

time to think about Eco tourism. Yes , I can appreciate Honble Minister for his concern
towards Eco Tourism. What effort govt. has taken so far for the promotion of Eco

The Ministry of Culture has the specific agenda to promote tourism in the country in a
responsible and sustainable manner
(a) The local community should be involved leading to the overall economic
development of the area.
(b) The likely conflicts between resource use for eco-tourism and the livelihood of

of Chhattisgarh killed 27, on02.07.2013 in Dumka district of Jharkhand Maoists killed a
superintendent of police and four policemen , on 13.07.2013 Yerkad village in
Gadchiroli A former special police officer (SPO), who had been associated with the
banned Salwa Judum, was allegedly shot dead & on 17.07.2013 in Bihar Five security

MINISTER FOR LAW & JUSTICE : Madam Speaker,I beg to move : Electoral Reform
Bill part III,2013
That the Bill to provide for the more effective prevention of crime in politics
and for matters connected therewith or incidental thereto,be taken into consideration.
Madam, One of the fountain heads of corruption is election where large amounts of
money are needed for the battle. Despite an effective Election Commission, it is an
open secret that money still plays an ugly role in garnering votes. No amount of anti-
corruption measures will be effective unless this murky aspect of Indian political life is
eliminated.
My Ministry has set out certain urgent proposals for electoral reforms in areas that have
not been taken up in the past by the Commission and which have arisen due to
implementation of certain laws enacted or based on certain directions given by the
Supreme Court and the High Courts.
1. Stringent punishment to offer all kinds of freebies to people during election time.
2. The amount of money and muscle power that is involved in elections has to be
very closely monitored and stern steps to be taken against people involving in the
malicious use of money and muscle power.
3. The people of a constituency should be accorded the power to recall.
4. State funding of elections &Government Sponsored Advertisements
5. Audit of electoral expenses
6. Fast Track courts against elected MP's with corruption or criminal charges
7. Fixing Educational Qualification-Graduate & Retirement age-65 to be fixed
for the members
8. Political Representative Incentives Commission
9. Performance reporting against Election Manifestos by Election Commission
10. All Officials Appointed in Connection with Conduct of Elections to be included in
Clause (7) of Section 123.
11. No candidate can contest in more than one constituency and to one House.
Madam. Speaker, I am confident that the all Honble Members of this House
irrespective of party affiliation will welcome the Bill whole heartedly and through it
help to eliminate criminalization of politics once for all. With these words, I now
move that the Electoral Reform Bill part III,2013, be taken into consideration.

Ms.Dipshita Chaudhury: Honble Speaker, I rise to support this Bill. The recentincident
of corruption has evoked widespread condemnation from all parts of the country.The
media has also played its part in highlighting this incident. Parliament has taken full
notice of it. Government has come out with legislation, a Bill which in a sense is a
symbol of its determination to fight, a symbol of its will to see that the nation does not
once again slide back into obscurantism. When India became independent and declared
itself a democratic republic, there was hope that India would make unprecedented
progress in every field. But with great regret I would likje to inform you that good
people shun politics as if it were worse than leprosy. The people of India are rapidly
losing confidence in democracy.
SPEAKER: Leader of Opposition
Leader of Opposition: Sir, It is with mixed feelings that have to address this august
House. The whole country was shocked and humiliated by the recent incident of
corruption and the supreme court verdict. There are movements throughout the country
condemning and demanding prevention of this type of crime and my party was in the
fore-front of these agitations. It was only after this strong reaction from the people that
the Government has been forced to bring in this legislation.
But, sir, what is painful is that the legislation which they have brought forward now is
full of flaws and have been drafted without consulting any of the leading crusaders
who are in a better position to give valuable suggestions, as they have done a lot of
work in this sphere.
1. This Bill provides that attempt to cleansing the corrupt people from Indias
Parliament but in reality it is not. On the name of reform we are going to
encroach on the fundamental rights of the citizens. The part 7 of the Bill Fixing
Educational Qualification for the members will debar many good administrators to
serve the country. Can anybody say the educational qualification of
Mahapadmananda, Qutb-ud din Aibaq, Akbar and many othersWerent they good
administrators.
2. Similarly in the part 7 of the bill there is a provision of Retirement age
My dear friends it is taking me back to my class VIII English book .the very first
chapter was the land where there were no old man.Laugh.......................

On the name of bringing reforms simply we are going to dump the experience of
senior people.Isnt it madam.No country of the world has such type of provisions.
So, my party is not able to understand why such type of provisions are kept.
3. Another big loophole is in the part 1 that the offence has not been categorized as
cognizable and non-bail able. This is really surprising that a crime is punishable by
death and then it is not cognizable. This also should be gone into. The Bill as it
is now, if it is passed will not have the desired effect. It will be ineffective in
preventing this terrible crime.
Rather I would like to suggest to include that:
There should be a close monitoring on peoples participation. In this age of
technological advancement effective use and role of technology is very important.
The process of voting instead of visiting the polling station with the help of
technology can be made through the internet where one can visit the website and
cast ones vote Therefore, while I support the idea of bringing forward such a Bill I also
have to state that this Bill should be suitably amended, before it is passed.
Prime Minister: The purpose of democracy will be defeated if we fail to design a
system in which good candidates are willing to come forward as candidates. The first
task before us is to cleanse the Westminster system of the socialist dross that has
destroyed its vitality and prevents good people from contesting elections.
Three simple electoral reforms can fix most of the defects in Indias democracy:a) State
funding of elections b) Audit of electoral expenses c) Fast Track courts against elected
MP's with corruption or criminal charges
So, the Election Commission should be charged with fast-tracking criminal cases. Cases
against elected MPs should be be given top priority and heard without break until
completed. While the Commission has no power to prosecute anyone for non-election
related criminal offences, it has a responsibility to ensure that India does not get
heinous criminals as its MPs. It should be empowered to apply extra resources where
needed (through the court system), enforce tight timelines, and punish those officials
(e.g. police officials) who deliberately delay the justice process. A small budget of Rs.
20 crores for the Election Commission could go a long way to rid criminals from Indias
Parliament.
SHRI Akash Sarkar : Honble Speaker, Madam, I rise to support this Bill. Government
has come out with legislation, a Bill which in a sense is a symbol of its determination
to fight, a symbol of its will to see that the nation does not once again slide back into
obscurantism. if you pay peanuts, you will get monkeys. Chanakya, who helped unite
India over 2000 years ago into the largest empire it has seen (Mauryan) knew this very
well.Arthashastra specifies that the highest salary paid by a king should be 800 times

that given to the lowest functionary. This was done so as to attract the best talent of
the country to the higher positions, which require greater knowledge and judgement.
We started paying MPs low salaries (which the MPs have circumvented through
perquisites and corruption). The immediate result was that good people refused to join
politics, preferring to earn a respectable living through other affairs. This has contributed
to the inexorable decline in quality of Indias political leaders. Either we get the corrupt
or we get demagogues. Honest talented Indians have fled politics. To address this
serious problem of inappropriate compensation to our leaders, The provision in the bill
to create an independent Political Representative Incentives Commission (PRIC) is
highly commendable proposal. The commission should be charged with research on,
and making recommendations on a compensation mechanism for peoples
representatives that will eliminate all reasonably foreseeable incentives for corruption, or
will otherwise promote the freedom of citizens.
Ms. Pallabi Guha:Madam, I strongly object The recall mechanism by which voters can
remove an elected public official before the next scheduled election. Although many US
states include provisions for the recall in their constitutions, the mechanism is not used
at national level in the USA.But I am apprehensive my friends on the name of bringing
stabilization are going to destabilize the nation. Recall is a weapon that could be used
unfairly at a time of political passion to tear down a man who held honest views on a
subject which, on later investigation, might be proved right, but it would then be too late
to correct the error.one after the other people will recall the members and it will create
anarchy in the country.so, Istrongly objectclause 3 provision of the bill .

cont.and have some doubt If a mechanism for citizens initiated elections were to
be introduced, the initial question would be whether this would just involve the
dissolution of the Legislative Assembly, or it would also involve the election of half of
the Legislative Council, or indeed the whole of the Legislative Council (i.e. a double
dissolution)? A second question would be whether the petition itself should initiate the

early election, or it should simply initiate a vote upon whether an early election should
be held, which if successful would be followed by an early general election? Issues
arise here about the expense of holding two elections to determine the matter and the
democratic legitimacy of the use of a petition to overturn a democratically elected
government and initiate a new election?
MINISTER FOR LAW AND JUSTICE: Sir, I am grateful to all the Members who have
supported the Bill I am also grateful to those members who have given their

constructive criticism on it. I am grateful to those members who have given their
constructive criticism on it. I am grateful for the advice that has been given to us.
With regard to the main suggestion. I would like to say that I do agree that the whole
problem of cleansing politics is a herculean task. Before preparing the draft we have
invited many social activists to present their views. The loopholes pointed by the
honourable opposition party leader on the clause number 7 of the bill Iwould like to
say that can anybody pointed out a developed country where illiterates are entering
into politics.
Miss Bhavna Manhas: you cannot also find a developed country having such a large
number of Illiterates............
MINISTER FOR LAW AND JUSTICE:yes let me explain the points.Educated people are
the torch bearer of the society.To enter into ICS minimum qualification is
Graduation.after completing post graduation people are joining as substaff. So, in such a
condition there is no harm to fix the educational qualifications.Moreover one who has
interest in politics will be educated.it will inspire many educated people to enter into
p[olitcs.
Regarding Retirement age honourable members pointed out to cite an example of a
country where there is fixed age of retirement.
Ms. Suchendra:Honourable member has pointed out any European country
MINISTER FOR LAW AND JUSTICE: yes, yes Iam sorry, it was European
country.Can anybody cite an example where people are not able to walk still holding
the chair. So, we are not against the use of experience, If they are active they should
be in advisory body.only by holding chair one can not bring revolution.
About the members concern on Recall. Iwould like to suggest the members to go
through the bill carefully.The recall is a mechanism by which voters can remove an
elected public official before the next scheduled election. lt is one element of a system
of direct democracy.Through a mechanism corrupt, incompetent or lazy members will
be removed and in the election who was placed in the second position will be given a
chance to enter into the office.so, there will be no fresh election and no anarchy. The
bill has developed a clear mechanism for this.
I hope I have answered most of the points, raised by the Members in the
course of my speech. Other parts of the bill our honourable Prime Minister has already
addressed. I once again thank you for your support and need your cooperation in
implementing this measure. I request the House to pass the Bill

Report by a prominent news agency that India is the sixth most dangerous country in
the World for children even worse thancountries like Afghanistan and Myanmar. It is
worth remembering that children are the building blocks of the nation and to squander
away this precious wealth is truly tragic, to say the least. To quote the Human
Development Report "a sharp reminder of the human potential the world is wasting.

Thank you for giving me a chance to debate. The report of the Survey is not a
revelation, but a confirmation of what we have always suspected. That our Children
are exposed to higher levels of danger than most other countries. Where else do
youhave Children working in mines, quarries, firework factories? Where else do you
have children sleeping on pavement andeating food picked up from garbage dumps?
Where else do you have trafficking slipping away from the laws? So, I think this is the
first time that a Child Specific anti trafficking law is under debate. As long as a
strong and specific law in this direction is not passed. So long as we cant spear head
the national champion against Child Trafficking.

honourable member for drafting the bill .Madam, I believe, our friend in her attempt to
bring justice has over reached regarding the severity of punishment like death sentence.
How can someone be indicating for life imprisonment for employing of children as
domestic keep and corporate punishment?Madam, it is important to get at the basics of
why such crimes takePlace? There after madam, I believe protectors of law cannot
become Perpetrators of crime under the disguise of implementing law.In implementing, it
can be severely misused and overused. Irepeat misused and overused.

Miss Roshmita Roy: Madam, I thank you for giving me an opportunity to participate in
this debate. The only thing I would like to point out is that though this Bill tries to cover
one Social evil, the fact remains that many people in this Country are still utilizing
innocent Children to materialize their vested interest taking the loopholes of the laws.
The govt. should seriously consider as to how the building blocks of the nation can be
saved by passing rigorous punishment to the offenders.

Minister of Women and child Development(Prime Minister): coming to the part of
legislation I am not able to understand the necessity of the new law. There is a
plethora of laws and acts which ensure protection of the Child from anykind of
exploitation.For Example: The Child Labour (Prohibition and RegulationAct) 1986, 1993
etc. on December 10th, 1996, the Supreme Court of India in a historic judgment also
banned the practice of employing children in hazardous industries and ordered the
creation of a corpus fund with contribution of Rs. 25,000/-each from the employer and
the govt. to ensure compulsory education of the child.Taking a due from the above
judgment, employers of children should make a beginning by providing then with at
least the basic of facilities conducive to a healthy working conditions and the employer
should provide them medical benefit apart from housing, insurance, recreational and
educational facilities and incentives such as free meals books, stationery and uniforms
to sustain the childs interest in school. So, in my opinion we should implement the
existing rules strictly instead of experimenting one after another rule.
In view of the efforts undertaken by the government to meet this problem, sir,
through you, I request honourable member to withdraw her resolution.

support to my resolution . In view of the assurance given by the Honble Prime Minister
and since a law has already been enacted to deal with this menace. I hope that the
