A. PROJECT OVERVIEW
The City of Los Angeles Department of City Planning (CITY) proposes to develop a pre-
qualified list of on-call environmental consultants to:
Prepare Environmental Impact Reports (EIR) for the Community Plans Program,
including assistance with implementing ordinances;
Prepare environmental clearances for General Plan Elements, General Plan
Amendments, specific plans, overlays and supplemental use districts, nexus studies,
facilities financing plans, and other implementing ordinances;
Compile, revise, and update CEQA regulatory framework, mitigation measures and
conditions of approval, CEQA Thresholds, Existing Settings, and facilities maps;
Conduct 3rd party review of CEQA documents;
Provide CEQA training to City Staff;
Develop CEQA documentation and preparation software and provide technology
updates and additional technology-based services; and
Complete other tasks as needed to include CEQA compliance and other related
environmental services.
B. RFQ RESPONSES
All responses to this Request for Qualifications (RFQ) must be submitted (one original copy,
six hard copies, and an electronic copy provided on a USB flash drive) and received by the
Department of City Planning by Thursday, August 24, 2017 at 5:00 pm (PST).
SOQ/Proposals not received by the deadline will be deemed unresponsive, and will be
disqualified. Sealed SOQ/Proposals should be clearly marked SOQ/Proposal for
Environmental Consultants for the Community Plans, Policy Planning and Environmental
Review Services.
Timely submission of the SOQ/Proposal is the sole responsibility of the proposer. No fax or
email submission will be accepted. All SOQ/Proposals become the property of the City of Los
Angeles.
Contract Duration
The City anticipates that the contract resulting from this RFQ will be for a term of five years,
with the option to extend up to an additional two (2) years. The City reserves the right to
terminate the contract for any reason upon 30-day notice.
Pre-Proposal Conference
End of Section I
A. BACKGROUND
Consultants should respond to this RFQ with a statement of qualifications for one or more
of the following services.
The City of Los Angeles includes 35 community planning areas which, together,
comprise the Land Use Element of the General Plan. The Department of City Planning
is pursuing a systematic program to comprehensively revise and update these plans
to reflect changing trends and community needs.
The primary goal of the Community Plan is to facilitate the evolving needs of the
community, to create vital and healthy neighborhoods, and to promote social and
economic well-being. The plans demonstrate the vision of the community by
identifying issues and opportunities in the community, setting goals and objectives,
and recommending implementation programs to achieve the community's identified
goals and objectives.
In an effort to more quickly update all of the Citys 35 Community Plans by the year
2024, the Department will be launching a total of five separate Community Planning
teams that will each carry out the simultaneous update of groupings of two to four
Community Plans at a time. In order to achieve the goal of updating all of the Citys
Community Plans by the year 2024, the process to update an individual grouping of
Community Plans will need to be executed in a three-year period. The Department of
City Planning (DCP) anticipates that bid letters will be released annually for one or
more groupings of Community Plans and projects may be awarded to more than one
firm.
The State of California requires that General Plans and their plan Elements be updated
on a regular basis. Several years have elapsed since various plan elements have been
updated. The Infrastructure Systems, Mobility, Open Space/Conservation, and Public
Facilities and Services and other elements are anticipated to be updated in the future.
California Environmental Quality Act (CEQA) clearance may be required for these
updates.
Consultant services may be required for CEQA clearances for General Plan
Amendments, Master Plans, Overlay Plans, Streetscape Plans, Specific Plans,
Redevelopment Plan Amendments, and other implementing Ordinances. CEQA
clearances may also be required for nexus/fee studies, code studies, and facilities
financing plans prepared by the City or other consulting firms.
The Department of City Planning staff prepares CEQA Initial Studies consistent with
CEQA Statute and Guideline requirements, which lead to the preparation of a Negative
Declaration (ND), Mitigated Negative Declaration (MND), or an EIR. Several of the
reference resources that are commonly relied upon to prepare these documents need
to be updated to reflect current practices and others need to be supplemented to
reflect changes to CEQA itself.
In 2006, the City of Los Angeles adopted the Los Angeles CEQA Thresholds Guide as a
city-wide resource for determining the potential for a projects environmental impact
and to provide guidance on the analysis of those impacts. Historically, maintenance
of this document was the responsibility of the Environmental Affairs Department
(EAD), but that function was continued on when EAD was dissolved. Since that time,
changes in State law have altered CEQA and the Citys guideline no longer contains
the guidance needed, most specifically, with regard to the analysis of greenhouse gas
emissions and alternative transportation impacts.
To provide evidence for the conclusions of our CEQA documents, the City often
requires detailed technical studies, which require specific expertise in various areas
to determine their adequacy. In the past, City staff has consulted with experts to verify
information. Services could range from answering technical questions on documents
and providing additional measures to prevent environmental impacts, to reviewing
technical studies and reports, and providing feedback and edits for correction.
City staff currently take UCLA extension, AEP, and APA classes off-site to receive CEQA
training, as well as from private entities. It would be more efficient and relevant to
have training provided specifically to Los Angeles City staff with specific issues that
target what the City is currently working on and the issues that affect current
documents.
City staff utilizes a proprietary software program (E-Forms) to prepare and store
Negative Declaration and Mitigated Negative Declaration documents. E-Forms is a
database into which staff inputs project-related data and then generates standardized
documentation. Input data is stored so that it can be recalled on-the-fly or made
available to other programs. In addition to user-input data, E-Forms accesses
information from the Departments other proprietary programs, Planning Case
Tracking System (PCTS) and Zoning Information and Map Access System (ZIMAS),
to auto-populate certain data fields. Typical stored data include project descriptions,
environmental settings, dates, addresses, phone numbers, environmental impact
analysis, and mitigation measures. Staff interfaces with the database through a series
of generated web pages which guide the user through the analysis. The system is
accessible by multiple users simultaneously working on multiple unrelated projects.
CEQA clearance may be required for technical studies as needs arise. Analysis may
require preparation of programmatic or project level CEQA clearance. Other required
services may include assessments and evaluations for environmental review
compliance under the California Environmental Quality Act. Assistance may range
from the preparation of individual sections to entire CEQA documents.
Contractor/Proposer may also complete other tasks as needed to include CEQA
compliance and other related environmental services.
B. SCOPE OF WORK
All consultant work and deliverables are expected to meet the requirements of existing
State law and any changes to those laws while under contract. The following descriptions
identify the minimum scope of services that will be provided by a qualified consultant.
The respondent should identify any additional tasks that are recommended to meet the
objectives of the project in the response that will follow the RFQ process once a project
has been identified. Duties and information required as part of the scope of services will
include the following:
a. Compile all the CEQA required regulatory framework for project level
EIRs within the City of Los Angeles, including local, City, County, State, and
Federal regulations;
b. Update the City of Los Angeles CEQA Thresholds;
c. Create a standard list of Conditions of Approval for use for projects; and
d. Update the standard mitigation measures and conditions of approval with new
technologies, methods, mitigations, and ideas that can help improve projects
in the City of Los Angeles.
Provide City staff training in CEQA, including intense targeted and specialized
training in technical areas and training in how to conduct reviews. Areas of training
include, but are not limited to:
a. CEQA law and case law;
b. The various types of environmental documents, including Initial studies,
Environmental Impact Reports, Categorical Exemptions, and Mitigated
Negative Declarations;
c. How to respond to the Appendix G questions;
d. Proper use of mitigation measures and mitigation monitoring programs;
e. Review of technical documents and studies and when to require them; and
f. CEQA Streamlining.

The RFQ has been structured to provide specific requirements which function as a
standardized framework for the evaluation of prospective Proposers qualifications.
Proposers may submit an SOQ for one or all of the areas listed in Section II, B. Scope of Work.
Each SOQ/proposal shall be prepared simply and economically, avoiding the use of elaborate
promotional material beyond what is sufficient to provide a complete and accurate
presentation. The responses to this RFQ must be made in accordance with the format set
forth in this Section. Only SOQs that have been determined to be responsive will be
considered. Failure to adhere to the following format may cause rejection of the SOQ as non-
responsive.
1. Cover Letter
The SOQ shall contain a cover letter and introduction (limited to one page) which
includes the company name and address, the name and telephone number of the
persons who will be authorized to represent the Proposer regarding all matters
related to the SOQ/proposal and any contract subsequently awarded to the Proposer.
This letter shall be signed by any person(s) authorized to bind the company to all
commitments made in the SOQ. If the Proposer is a partnership, the SOQ must be
signed in the name of the partnership by a general partner thereof. If the Proposer is
a corporation, the SOQ must be signed on behalf of the corporation by two authorized
officers (Chairman of the Board of Directors, President or Vice-President and a
Secretary, Treasurer or Chief Financial Officer) or an officer authorized by the Board
of Directors to execute such documents on behalf of the corporation. All signatures
above must be original and in ink on at least one copy of the SOQ submitted to the
City.
2. Addendum Acknowledgement
Brief summary of the Proposers understanding of SOQ objectives and Scope of Work.
4. Qualifications of Proposer
a. What is the general type of work performed by your firm? Does your firm have
a focus? If yes, please elaborate. State the number of years your firm has
performed this type of work.
b. If your firm specializes in one aspect of a project, how would you propose to
work with other consultants to complete the whole project defined in a
Request for Bids (RFB) by the City?
d. What is your firms experience working with the City of Los Angeles or other
municipalities?
k. Many firms have adopted a profile for the managers they hire. Does your firm
have such a profile? Please explain.
l. What are your firms quality assurance measures for this type of contract
work?
m. Describe any situation over the past three years in which your firm did not
complete a contract for a client. Describe the details of the situation, and
explain the reasons for the incompletion (e.g., firm default, client withdrawal,
non-payment of invoices, etc.?
o. How will you handle staff changes and vacancies created over the life of the
project? How will the City be assured any replacement staff is approved before
staff changes are made on a project? What is the turn-over rate of your firm?
p. What are your firms Equal Employment Opportunity and Affirmative Action
programs and accomplishments?
q. Provide any additional information regarding your firm to assist the City to
better evaluate your firm.
This section includes, but is not limited to, a listing of all required personnel and
qualifications for each position. A Project Manager must be designated and identified,
and a detailed resume must be submitted; resumes of other key personnel should be
provided. An organizational chart of management personnel shall also be included
in this section.
The Proposers organization will be evaluated based upon the capability of the
Proposer to meet the terms of the RFQ, such as the ability to accomplish the work
within the estimated time frame, plus the related studies or projects recently
completed by the Proposers organization, which demonstrates expertise in
accomplishing similar work. The qualifications of proposed staff will be evaluated in
terms of their previous experience and capabilities. The relevant experience of key
personnel, especially the Project Manager, will be of major importance in the
evaluation of the SOQs. Proposers shall provide thorough answers to the following
list of questions. In the SOQ, each question should be restated followed by the
response.
a. Who will be the responsible Principal for the project? What is this persons
background, experience and role within the firm? Include a resume of this person.
How long has this person been with the firm?
b. Who will be the Project Manager(s)? Describe the background, experience, and
availability over the life of the contract. Attach a resume for each staff person who
will be working on the project
c. Identify other professional staff who could be working on the project(s) in this
SOQ .
d. Who will be the Sub-Contractors for these types of projects, if any? What aspect
of the project will they work on and what are their qualifications?
e. What is your firms previous experience working with the proposed Sub-
Contractors?
6. Fee Schedule
Provide hourly billing rates for team members according to their roles and
responsibilities. Note that contract awards from the City will be tied to project tasks
and deliverables, and not by monthly, hourly billings.
7. References
Name, title, address, telephone number and email address of three (3) former and/or
current clients who have, within the last five years, contracted with the Proposer for
services similar to those described in this RFQ. If teams represent more than one
firm/organization, provide three references for each. Provide references for
completed projects which represent the range of tasks required under this RFQ.
Include project name, brief description, contact name, address, phone number and
email information.
The City may request a set of work product completed within the last five years that
demonstrates experience with projects similar in scope to the work described in this
RFQ during the evaluation period. The City will provide approximately two weeks
notice should such work sample be requested.
9. Additional Data
Include any other data the Proposer considers essential to the evaluation of the SOQ.
The Proposer should submit a detailed company portfolio including the companys
financial viability within the past three (3) years, credit references, on-going projects,
and all pending litigation in which the company may be directly or indirectly involved.
Proposers may be invited to an interview with the Evaluation Committee and should be
prepared to have key management personnel available for these interviews. The successful
Proposer(s) will be named after the SOQs are evaluated. The Evaluation Committee will
make recommendations to the Director of City Planning. If interviews are not held, final
selection will be based solely on the RFQ submittal.
B. LIMITATIONS
1. Notwithstanding any other provisions of this RFQ, the City reserves the right to reject
all SOQ/proposals and to waive any submission or task contained within a
SOQ/proposal, if doing so would be to the advantage to the City or its taxpayers.
2. The Proposer understands and agrees that the City shall have no financial
responsibility for any costs incurred by the Proposer in responding to this RFQ.
3. The City of Los Angeles requires that every SOQ, proposal, bid, or offer shall have
thereon or attached thereto the affidavit of the Proposer indicating that: such
SOQ/proposal is genuine, not sham or collusive, nor made in the interest of any
person therein named; that the Proposer has not directly or indirectly induced or
solicited any other Proposer to submit a sham SOQ/proposal or to refrain from
proposing; and that the Proposer has not in any manner sought by collusion to secure
for himself an advantage over any other Proposer. Any proposal/SOQ made without
such affidavit, or found to be in violation thereof, shall not be considered.
C. SUBMISSION OF SOQ/PROPOSAL
2. Award of Contract
The Proposer to whom the contract is awarded shall be required to enter into a
written contract with the City of Los Angeles in a form approved by the City Attorney.
3. Pre-SOQ/proposal Conference
The pre-SOQ/proposal conference will be held on the date and time stated in the
cover letter.
After expiration of the time to submit SOQ/proposals and continuing until a contract
has been awarded, all City personnel and all others involved in the project will have
been specifically directed against holding any meetings, conferences or technical
discussions with any Proposer except as provided in this Section.
The response to this RFQ must be made in accordance with the format set forth in this
Section. Failure to adhere to this format may be cause for rejection of the
SOQ/proposal as non-responsive.
SOQ/Proposals which set forth conditions or limitations to those set forth in the RFQ
may be considered non-responsive and rejected.
Any change to or interpretation of the RFQ will be sent by the City to each firm or
individual that requests such changes. Receipt of any such changes or interpretations
shall become a part of said RFQ and may be incorporated into any contract awarded.
If the Proposer is a partnership, the proposal/SOQ must be signed in the name of the
partnership by a general partner thereof. If the Proposer is a corporation, the
proposal/SOQ must be signed on behalf of the corporation by two authorized officers
(a chairman of the Board, President or Vice-President and a secretary, treasurer of
chief financial officer) or an officer authorized by the Board of Directors to execute
such documents on behalf of the corporation. All signatures above must be original
and in ink on at least one copy of the SOQ/proposal.
9. Disposition of SOQs/Proposals
All SOQs/proposals submitted in response to this RFQ will become the property of
the City of Los Angeles and a matter of public record. The Proposer must identify, in
writing, all copyrighted material, trade secrets or other proprietary information that
it claims is exempt from disclosure under the Public Record Act, (California
Government Code Section 6250 et seq.). Any Proposer claiming such an exemption
must also state in the SOQ/proposal its refusal to disclose such material, trade secrets
or other proprietary information to any party making a request. Any Proposer who
fails to include such a statement shall be deemed to have waived its right to an
exemption from disclosure as provided by said Act.
Each SOQ/proposal prepared in response to this RFQ shall be prepared at the sole
cost and expense of the Proposer and with the expressed understanding that no
claims against the City for reimbursement will be accepted. All SOQs/proposals will
become the property of the City and will not be returned to the Proposer. The
Proposer should not include confidential information or trade secrets without
expressly stating and identifying the information or trade secrets to be considered
confidential, since all accepted SOQ/proposals will become public information.
However, if such information is necessary to assure a competitive SOQ/proposal, then
the Proposer is to follow the guidelines for confidential information as discussed
below.
The City assumes no responsibility for disclosure or use of unmarked data for any
purpose. In the event properly marked data are requested, the Proposer will be
advised of the request and may expeditiously submit to the CITY a detailed statement
indicating the reasons it has for believing that the information is exempt from
disclosure under federal, state, and local law. This statement will be used by the City
in making its determination as to whether or not disclosure is proper under federal,
state, and local law. The City will exercise care in applying this confidentiality
standard but will not be held liable for any damage or injury that may result from any
disclosure that may occur. The Proposer agrees to assume and pay for all costs
incurred by the City, including attorneys fees awarded by the court, if the Proposer
requests the City to resist disclosure of material provided to the City by the Proposer.
All SOQ/proposals submitted in response to the RFQ shall become a matter of public
record and the property of the City.
The Proposer will be required to maintain insurance in effect during the term of the
contract as set forth in Appendix II of this RFQ.
The City reserves the right, at its discretion, to pursue any or all of the following
actions in regard to this RFQ:
Award multiple contracts based upon the evaluation criteria contained in this
RFQ;
Request additional information and/or clarification from the Proposers;
Reject any or all SOQ/proposals, permit the timely correction of errors, or waive
minor deviations;
The City may consider SOQ/proposals that contain provisions which deviate slightly
from the requirements in this RFQ, if the deviation(s) are not considered material.
However, if the originator of such a SOQ/proposal is awarded the contract, the
Proposer will be expected to perform in full compliance with the objectives described
herein. This RFQ does not obligate the City to accept any SOQ/proposal, negotiate
with any Proposer, nor award a contract in response to this RFQ. Furthermore, the
City does not guarantee project awards for any firm on the established on-call list.
Any interested party who has an objection to this RFQ or to the awarding of a contract
to any Proposer by the City, pursuant to competitive SOQ/proposal procedures, shall
submit that protest, in writing, to the Director of Planning, City of Los Angeles,
Department of City Planning, prior to contract award by the City of Los Angeles. The
protest shall clearly state the grounds of protest and the relief sought.
Any interested party who submits, or who plans to submit a SOQ/proposal, may file
a protest based on the content of the RFQ within ten (10) calendar days after the
request for SOQ/proposal is first advertised. Protesters shall have an opportunity to
appear and be heard before the Los Angeles Department of City Planning prior to the
evaluation in the case of protests based on the content of the request for
SOQ/proposals.
A protest based on the content of the RFQ may be renewed by re-filing the protest
with Los Angeles Department of City Planning within three (3) calendar days after
the staff recommendation for award has been made available to the public. The staff
recommendation is considered to be public when the item is calendared on the
agenda of the Planning and Land Use Committee of the City Council, City of Los
Angeles.
Each SOQ/proposal will be bound, not stapled, with pages numbered sequentially and
be prepared simply and economically avoiding the use of elaborate promotional
materials beyond those sufficient to provide a complete, accurate and reliable
presentation. Submittal of non-relevant or promotional material will result in a lower
score for the evaluation of the Project.
The Contractor shall abide by and obey all applicable Federal, State, and City laws,
including, but not limited to, the Nondiscrimination and affirmative action provisions
of the laws of the United States of America, the State of California, and the City. The
selected Proposer shall stipulate that in any action related to the awarded contract,
venue shall be in the County of Los Angeles, State of California. All service contracts
with the City of Los Angeles, including the contract for this project shall include and
are required to comply with all the Standard Provisions for City Personal Services
Contract (Rev. 03/09). (Appendix I)
The Contractor must provide evidence of coverage with minimum limits, submitted
and approved prior to occupancy/start of operations. All insurance certificates must
be submitted ONLINE using the self-service site at http://Track4la.lacity.org.
(Appendix II)
Proposers are advised that any contract awarded pursuant to this procurement
process shall be subject to the applicable provisions of Los Angeles Administrative
Code Section 10.8.2., Non-discrimination Clause.
All contracts (both construction and non-construction) for which the consideration is
$1,000 or more shall comply with the provisions of Los Angeles Administrative Code
Sections 10.8.3., Equal Employment Practices Provisions. By affixing its signature on
a contract that is subject to the Equal Employment Practices Provisions, the
Contractor shall agree to adhere to the provisions in the Equal Employment Practices
Provisions for the duration of the contract.
All contracts (both construction and non-construction) for which the consideration is
$25,000 or more shall comply with the provisions of Los Angeles Administrative Code
Sections 10.8.4., Affirmative Action Program Provisions. By affixing its signature on
a contract that is subject to the Affirmative Action Program provisions, the Contractor
shall agree to adhere to the provisions in the Affirmative Action Program Provisions
for the duration of the contract.
It is the policy of the City to provide Minority Business Enterprise (MBE), Women
Business Enterprise (WBE), Small Business Enterprise (SBE), Emerging Business
Enterprise (EBE), Disabled Veteran Business Enterprise (DVBE), and all Other
Business Enterprise (OBE) concerns an equal opportunity to participate in the
performance of all City contracts. Proposers will assist the City in implementing this
policy by taking all reasonable steps to ensure that all available business enterprises;
including MBEs, WBEs, SBEs, EBEs, DVBEs, and OBEs, have an equal opportunity to
compete for, and participate in, City contracts. Equal opportunity will be determined
by the Proposers BIP outreach documentation, as described in Appendix IV the
Business Inclusion Program, of this RFQ. Participation by MBEs, WBEs, SBEs, EBEs,
DVBEs, and OBEs may be in the form of subcontracting. Proposers must refer to
Appendix IV, Business Inclusion Program of this RFQ for additional information and
instructions. BIP outreach must be performed using the Business Assistance Virtual
Network (www.labavn.org). A proposer's failure to utilize and complete their BIP
Outreach as described in Appendix IV may result in their proposal being deemed non-
responsive.
Unless approved for an exemption, contractors under contracts primarily for the
furnishing of services to or for the City and that involve an expenditure in excess of
$25,000 and a contract term of at least three (3) months, lessees and licensees of City
property, and certain recipients of City financial assistance, shall comply with the
provisions of Los Angeles Administrative Code Sections 10.37 et seq., Living Wage
Ordinance (LWO) and 10.36 et seq., Service Contractor Worker Retention Ordinance
(SCWRO). Proposers shall refer to Appendix V, Living Wage Ordinance and Service
Contractor Worker Retention Ordinance for further information regarding the
requirements of the Ordinance.
Proposers who believe that they meet the qualifications for one of the exemptions
described in the LWO List of Statutory Exemptions shall apply for exemption from the
Ordinance by submitting with their SOQ/proposal the Bidder/Contractor Application
for Non-Coverage or Exemption (Form OCC/LW-10), or the Non-Profit/One-Person
Contractor Certification of Exemption (OCC/LW-13), or the Small Business
Exemption Application (Form OCC/LW-26A). These exemption forms are available
on the Bureau of Contract Administration website at http://bca.lacity.org/index.cfm.
The List of Statutory Exemptions is included in Appendix V.
Proposers are advised that any contract awarded pursuant to this procurement
process shall be subject to the applicable provisions of Los Angeles Administrative
Code Section 10.8.2.1, Equal Benefits Ordinance (EBO).
All Proposers shall complete and submit the Equal Benefits Ordinance Affidavit,
available on the City of Los Angeles Business Assistance Virtual Network (BAVN)
residing at www.labavn.org, prior to award of a City contract that exceeds $25,000.
The affidavit shall be valid for a period of three years from the date it is first uploaded
onto the Citys BAVN. Proposers do not need to submit supporting documentation
with their proposals. However, the City may request supporting documentation to
verify that the benefits are provided equally as specified on the EBO Affidavit.
The City of Los Angeles requires that all Contractors and Sub-Contractors be in
compliance with the American with Disabilities Act 42 U.S.C. 12101 et seq., and its
implementing regulations. The Proposer will provide reasonable accommodations to
allow qualified individuals with disabilities to have access to and to participate in its
programs, services and activities in accordance with the provisions of the Disabilities
Act. The Proposer will not discriminate against persons with disabilities nor against
persons due to their relationship to or association with a person with a disability. Any
subcontractor entered into by the Proposer, relating to this contract, to the extent
allowed hereunder, shall be subject to the provisions of this paragraph. Proposers
shall complete and submit the attached Certification of Compliance Form.
(Appendix X)
Section 10.10 of the Los Angeles Administrative Code, Child Support Assignment
Orders Ordinance, requires that all Contractors and Sub-Contractors performing
work for the City comply with all reporting requirements and wage and earning
assignments relative to legally mandated child support. (Appendix XI)
This statement certifies that consultants work for the City as independent

Unless otherwise exempt, in accordance with the provisions of the Slavery Disclosure
Ordinance, any contract awarded pursuant to this RFQ will be subject to the Slavery
Disclosure Ordinance, Section 10.41 of the Los Angeles Administrative Code.
All Proposers shall complete and electronically sign the Slavery Disclosure Ordinance
Affidavit available on the City of Los Angeless Business Assistance Virtual Network
(BAVN) residing at www.labvn.org prior to award of a City contract.
Unless approved for an exemption, contractors under contracts primarily for the
furnishing of services to or for the City, the value of which exceeds $25,000 with a
term of at least three (3) months, and certain recipients of City Loans or Grants, shall
comply with the provisions of Los Angeles Administrative Code Sections 10.44 et seq.,
First Source Hiring Ordinance (FSHO).
All Proposers shall complete and electronically sign the FSHO Compliance
Affidavit available on the City of Los Angeles Business Assistance Virtual Network
(BAVN) residing at www.labavn.org prior to award of a City contract. The affidavit
shall be valid for a period of three years from the date it is first uploaded on the Citys

In accordance with California Public Contract Code Sections 2200-2208, all bidders
submitting proposals for, entering into, or renewing contracts with the City of Los
Angeles for goods and service estimated at $1,000,000 or more are required to
complete, sign, and submit the Iran Contracting Act of 2010 Compliance Affidavit.

All proposers must submit a completed Bidder Certification CEC Form 50 regarding
the Citys Municipal Lobbying Ordinance to the awarding authority at the same time
the response is submitted. SOQs submitted without a completed CEC Form 50 shall
be deemed non-responsive. (Appendix XVIII)
All proposers must submit a CEC Form 55 regarding the Citys Municipal Campaign
Finance Ordinance to the awarding authority at the same time the response is
submitted. SOQ/proposals submitted without a completed CEC Form 55 shall be
deemed non-responsive. (Appendix XIX)
The City requires that the Proposer is subject to the provisions of the Contractor
Responsibility Ordinance, Section 10.40 et seq. of Article 14, Chapter 1 of Division 10
of the Los Angeles Administrative Code. By executing a contract with the City, the
Contractor pledges to comply with all applicable federal, state, and local laws in
performance of the contract. This Ordinance requires that all proposers complete
and submit, with their response, the attached Form and/or Questionnaire. Failure to
return the completed questionnaire may result in the proposer being deemed non-
responsive. (Appendix XX-XXI)
Proposers shall complete and submit the attached Contractor/Bidder History Form.

All contractors are required to submit one copy of their City of Los Angeles Business
License, Tax Registration Certificate or Vendor Registration Number. To obtain a

All contractors are required to complete and submit proof of IRS Number (W-9) Form.
At the end of this contract, the City will conduct an evaluation of the Contractor's
performance. The City may also conduct evaluations of the Contractor's performance
during the term of the contract. As required by Section 10.39.2 of the Los Angeles
Administrative Code, evaluations will be based on a number of criteria, including the
quality of the work product or service performed, the timeliness of performance, the
Contractor's compliance with budget requirements, and the expertise of personnel
that the Contractor assigns to the contract. The Contractor will be provided with a
copy of the final City evaluation and allowed 14 calendar days to respond. The City
will use the final City evaluation, and any response from the Contractor, to evaluate
SOQ/proposals and to conduct reference checks when awarding other personal
services contracts.
