    ThisfollowsupmyDecember17,2010postentitledServiceofProcessFundamentalsForThePlaintiffLender.Inthatpost,Idiscussedhowandwhythedeliveryof
    asummonsandcomplainttriggerstheforeclosureprocess.Ialsomentionedthatineffectiveserviceofprocessprohibitsatrialcourtfromhavingpersonaljurisdiction
    overadefendant.Attimes,challengeswithserviceofprocessresultinquestionsaboutwhetheraplaintifflendercanorshouldproceedtojudgment.Today,Itackle
    thequestionofwhattodoaboutserviceofprocessoncethedefendantfilesanappearanceandrespondstothecomplaintwithoutassertingaclaimthatservicewas
    insufficient.Theansweristheadequacyofserviceofprocessshouldnolongerbeaconcern.
    TrialRule12(H)(1).IndianaRuleofTrialProcedure12(B)(4)recognizesthedefenseofinsufficiencyofprocess.But,pursuanttoSection(H)(1),thedefensecan
    bewaived:
    Adefenseoflackofjurisdictionovertheperson,...insufficiencyofprocess,insufficiencyofserviceofprocess,...iswaivedtotheextentconstitutionally
    permissible:
    (b)ifitisneithermadebymotionunder[Rule12]norincludedinaresponsivepleading[suchasananswer]....
    Waiver.TrialRule12(H)(1)hasbeeninterpretedbytheIndianaCourtofAppealsinatleastthefollowingtwocases:Hillv.EbbetsPartners,812N.E.2d1060(Ind.
    Ct.App.2004)andPhillipsv.GreatLakesHealthCongress,354N.E.2d307(Ind.Ct.App.1976).InHill,thedefendantonappealcontendedthatthetrialcourtdid
    nothavepersonaljurisdictionoverherbecausethesummonswasnotservedproperlyand,assuch,thesummaryjudgmententeredagainstherwasvoid.TheCourt
    disagreedandcitedtoT.R.12(H)(1),whicheffectivelyrequiresthatapartydesiringtoassertthedefenseoflackofpersonaljurisdictionmustdosoineitherthe
    answerorinaseparatemotionfiledbeforetheanswer.Althoughserviceofprocessmaynothavebeenproperlyeffectuated,thedefendantappearedatthetrialcourt
    andfiledaresponsetotheplaintiffsclaim.Becauseshedidnotbringanyjurisdictionalchallengebeforetheappeal,defendantwaivedtherighttoraisethisissue.
    Similarly,inPhillips,theCourtsaidwherethepartyinquestionhasformallyappearedandelectedtoanswerthecomplaint,thereisnoconstitutionalbartothe
    courtsjurisdictionovertheperson.
    Moveon.Workoutprofessionalsandcounselprosecutingforeclosureactionsmaysometimesbeanxiousaboutthesufficiencyofservice.Inthepast,Ivehad
    lingeringquestionsconcerning,forinstance,whetherwehadavalidaddressforatargeteddefendant.But,underIndianalaw,oncethatdefendantfilesan
    appearanceintheactionandfailstoattacktheissueofserviceofprocess,eitherinaresponsivepleadingorinaseparateT.R.12(B)motiontodismiss,wecanbe
    assuredthatthevalidityofserviceofprocessisnolongeranissue.Inthatcase,whetherthedefendantwasactuallyservedisirrelevant.
