LEGAL DOCUMENTS - CHECKLIST
INSTRUCTIONS
1. BEFORE SUBMITTING ORIGINAL DOCUMENTS TO HDFC, YOU ARE REQUESTED TO
MAKE SUFFICIENT NUMBER OFmmJItIItDIIIoF THE DOCUMENTS FOR YOUR OWN
RECORD AND FUTURE USE.
2. Please submit all documents TOGETHERand NOT IN PARTS. On perusal of the documents submitted,
if any other documents are required you will be advised to submit the same.
3. The borrower(and the co-borrower,if any) is/arerequiredto visit our office at the time of first disbursement
of the loan to execute the loan documents.
4. The first instalment of the loan will be released only after completing all legal formalities, technical
Inspectionand when your own contribution(TotalCost-LoanAmount) is spent in fulltowardsconstruction
or purchase.
I. CONSTRUCTION / EXTENSION / IMPROVEMENT CASES
1;. Original title document!s registered in favour of applicant or co-applicant or jointly.
2. Encumbrance certificate for 13 years showingall transactions during the period.
3. Parent document (Link Document!s)linking the chain of transactions for the past 13 years.
4. Approved plan copy along with permission -photocopy,if not submitted along with the application.
5. Detailed estimate of the cost of Construction/ Extension/ Improvement.
II. READY PURCHASE OF INDEPENDENT HOUSE. FLAT (RELEASE/SECOND SALE)
1. Original agreement for sale with the seller.
2. Original Encumbrance certificate for the past 13 years showingall transactions during the period till the
date of submissionto HDFC.
3. Sellers title document photocopy (Original should be submitted for verification.)
AND
The link documents linking the chain of the transactions for the past 13 years.
4. Photocopy of the latest house tax receipts.
5. Copy of the approved plan and planning permission.
6. Request Letter for release ofloan amount, with details like Amount and Cheque in favour of (Name).
NOTE: If HDFC has already financed any flat in the project in which the proposed flat of the
applicant is located, then link documents

need not be submitted.
III. PURCHASE OF FLAT FROM BUILDER
1. Original agreement of sale duly signed by the land owner/s, Builder/developerand Purchaser.
2. If the flat is registered. Original Sale Deed in favour of the applicant / co-applicant (If undivided share /
semifinishedflat is registered, submit completion/ constructionagreement also).
3. Original stamped receipts - payments made to the builder/developertowards own contribution.
4. No objection certificate from the builder/developeras per HDFC's format (Refer next page).
5. Request Letter for release of loan amount, with details like Amount, Stage of constructionand Cheque in
favour of (Name).
The applicant has to submit photocopies of the following documents and arrange for verification of
the Original documents at HDFC's Office.
. Photocopyof the Land owner's title documents.
. Developmentagreement!Agreementof sale/GeneralPowerof Attorneyor anyarrangementagreedbetween
the land owner/s and the builder.
. Encumbrance certificate for the past 13 years showingall transactions during the period.
.. The link documents linking the chain of transactions for the past 13 years.

. Copy of the approved plan with planning permission.


Legal opinion if any obtained by the builder from an advocate commenting on the land onwer/s title.
NOTE: If HDFC has already financed any flat in the project in which the proposed flat of the
applicant is located, these documents need not be submitted. But applicants are advised to obtain
the same from the builder/developer for their future use.

1. Original allotment letter.
2. No objection certificate to mortgage the property in favour ofHDFC.
3. Original receipts/challan for payment made.
4. Request Letter for release ofloan amount, with details like Amount and Cheque in favour of (Name).

We confirm that the scheduled described property and the land appurtenant there to is free from all '

encumbrances, charge, liability or otherwise any kind whatsoever. Also we confirm that the scheduled
described property is having absolute, clear, legal and marketable title.
We have no objection to your giving a loan to the above buyer/s and his/her/their mortgaging the said
flat (described in the schedule mentioned hereunder) with you by way of security for repayment, not
withstanding any thing contrary contained in the said agreement. .

Further we undertake to hand over the original registered document after registration directly to HDFC
to enable you to complete the mortgage formalities.

We also undertake to inform and give proper notice to HDFC as and when the flat Owners Association
which is recognized by Government of Andhra Pradesh is formed.
In case the Agreement is cancelled due to payment not begging made on the due dates as specified in
the Agreement, we undertake to inform HDFC, 15 days before such an event.
This is to confirm you that we have brought the original title land documents of the property to your
office for verification by your Legal Department. We further confirm that all the original documents of
the property are in our safe custody with us and we have not mortgaged the said property to any Bank/
Institution. We shall make all original land documents available for inspection on any working day the
address given.
