units or (2) the controlled substance possessed was heroin and the amount possessed was less than
0.05grams.

TheComplainantstatesthatthefollowingfactsestablishprobablecause:

OnWednesday,August2,2017,atapproximately7:45a.m.,ChiefJesseAndersonoftheBreitungPolice
Departmentwasdispatchedtoaresidentialstructurefireat813ThirdStreetNorthintheCityofTower,St.
LouisCounty.Uponarrival,ChiefAndersonobservedflamescomingfromtherearwindowonthefirstfloor,
ontheeastsideoftheresidence.ChiefAndersonobservedheavysmokecomingfromthesecondstoryon
thenorthsideoftheresidence.TheTowerFireDepartment,BreitungFireDepartmentandGreenwood
FireDepartmentcontainedthefireandventedsmokefromtheinterioroftheresidence.

Atapproximately8:45a.m.,TowerfirefighterLanceDoughertyemergedfromtheresidencecarryingan
unresponsivemalechild,lateridentifiedasBentleyJoeLewisKoski,DOB:8-30-16.Thechildhadbeen
locatedinthecrib,inabedroom,onthesecondfloor.Thechildwasunresponsiveandattemptsat
resuscitationwereunsuccessful.Thechildwasdeceasedatthescene.

InitialexaminationbytheMedicalExaminer'sOfficerevealedthechildhadsootintheesophagus,stomach
andupperandlowerairways.

Ownersoftheresidence,KristaJoanSwansonandCodyJoeKoski,whowerealsotheparentsofthe
deceasedchild,arrivedonscene.ChiefJesseAndersonwaslaterabletotakeastatementfromthe
parents,whostatedtheyhadbeengoneforthenightandthattheyleftthechildwithCodyKoski'sbrother,
JesseLeeBonacci-Koskitobabysitthechild.However,uponarrivaloftheemergencyrespondersthat
morning,Bonacci-Koski,hereinafterreferredtoastheDefendant,wasnowheretobefound.

Atapproximately11:25a.m.,ChiefAndersonwasnotifiedofasuspiciousmalethathadbeenseatedinan
employee'scaratBenchwarmersBarandGrillinTower.Thecallerindicatedthatthemalerannorthbound
towardsthebiketrail.Itwasreportedthatthemalewasverymuddyandwaswearingagreenshirtand
camouflagepants.Themaleleftadogbehind,whichwaslaterdeterminedtobethefamilydogofKrista
SwansonandCodyKoski.

ChiefJesseAndersonspokewiththeownerofthevehicle,whowasidentifiedasLeiaMarieEdwards.
Edwardsstatedthatshehadcalled911becausesomeonewasinhercarandleftsomestuffinit.Edwards
statedthatthemaleleftabackpackandadogleashinhervehicle.Edwardsstatedthatsheaskedthe
individualwhathewasdoinginhercar.Edwardsstatedthattheindividualsaidhewassorryandleft,
headingtowardstheTowerCivicCenter.Edwardsthenmentionedthatashorttimelatersheobserveda
vehiclecomingthroughtheparkinglot.Edwardsrecognizedthedriverasthesameindividualwhohad
beensittinginhercar.EdwardsstatedthevehiclewasaJeepCherokeethatsherecognizedasbelonging
toKennyFolstad.

KennyFolstadwaslatercontactedandstatedthathehadlefthisvehiclewiththekeysinitonthemain
streetofTowerandhadgivennobodypermissiontousehisvehicle.

ThevehicleownedbyFolstadwaslaterlocatedinaditchat6854Hwy.169inPikeTownship.Officersfrom
theSt.LouisCountySheriff'sOfficerespondedandsearchedtheareaforthesuspectwhohadtakenthe
car.ThesuspectultimatelycameoutofthewoodsinfrontofDeputyTrevorBanksfromtheSt.LouisCounty
Sheriff'sOffice.Hewastakenintocustodyatthatpoint.ThesuspectwasidentifiedastheDefendant.The
Defendanthadoutstandingfelonywarrantsforhisarrest.

TheDefendantwastransferredtotheSt.LouisCountySheriff'sOffice.OnceinsidetheVirginiaSheriff's
St. Louis County, MN
Officegarage,theDefendantaskedSgt.BorchersfromtheSt.LouisCountySheriff'sOfficeifhewasthe
onethatwasgoingtointerviewhim.Borcherstoldhimthathewas.TheDefendantstatedtoSgt.Borchers
thathewasguiltyofneglectingthechildandhadleftthechildalonefortwohoursintheresidencewhere
thefirehadoccurred.

OnAugust3,2017,ChiefAndersonandSgt.BorchersagainspokewiththeDefendant.TheDefendant
agreedtoallowtheofficerstosearchhisbackpackandinsidethebackpackwerelocatedasyringeanda
spoonthatcontainedresidueofsuspectedcontrolledsubstance.Thesubstancewaslatertestedand
testedpositiveformethamphetamine.IntheinterviewswiththeDefendant,itwasdeterminedthathehad
leftthechildattheresidenceinTowerinordertogoandbuycontrolledsubstances.Afterheleftfor
approximatelytwohours,hesawfiretrucksgoingtotheresidenceandwentbacktotheresidence.After
hesawfirefightersattheresidence,theDefendantsaidheturnedaroundandlefttheresidencewithout
speakingtoanyofthefirefightersandwenttotheBenchwarmersBarandGrill.Hesaidhelaterstolea
Jeepthatwasparkedonmainstreet,puttheJeepintheditchnearPikeTownshipandranintothewoods
andswamp.Hewaslaterseencomingoutofthewoodsandontothehighwayandwastakenintocustody
bytheSt.LouisCountySheriff'sOffice.
