THE RABIES PREVENTION AND CONTROL ORDINANCE OF THE


PROVINCE OF SULTAN KUDARAT.

WHEREAS, rabies is a dangerous disease of dog transmissible to humans through the bite of
an infected animal and that disease can be prevented through mass immunization of pet dogs,
responsible pet ownership and strict regulations;.

WHEREAS, Republic Act No. 9482 or The Anti-Rabies Act of 2007, was approved into
law, defining among others, the roles and responsibilities of concerned offices, the local government
units, the assistance and participation of NGOs and academe, in establishing a system of control,
prevention, spread, and eventual eradication of human and animal rabies by 2020;

WHEREAS, 98 percent of rabies cases are attributed to dog bites;

WHEREAS, Memorandum Circular No. 2011-30 dated March 3, 2011 of the Department of
Interior and Local Government requires all Local Government Units to enact local ordinances that
will support the National Rabies Prevention and Control Program and ensure compliance to
regulations set forth in Section 7 of RA No. 9482, the Anti-Rabies Act of 2007;

WHEREAS, impelled by the increased incidence of dog bites in 2016 numbering 5,599 or
74.45% increase over the 2015 statistics of 4,170 with three (3) reported deaths, two of which are 3
and 10 year old children, there is an imperative need for the eradication through enactment of the
Sultan Kudarat Provincial Anti-Rabies Ordinance for a Rabies-Free community;

NOW THEREFORE, on motion of Hon. Rene C. De Manuel, Sr., and duly seconded by the
members present, BE IT ORDAINED by the 14TH SANGGUNIANG PANLALAWIGAN OF
SULTAN KUDARAT that:

SECTION 1. TITLE: - This Ordinance shall be known as The Rabies Prevention and
Control Ordinance of the Province of Sultan Kudarat.

SECTION 2. DECLARATION OF POLICY - it is hereby declared policy of the


Provincial Government of Sultan Kudarat to protect and safeguard the health of its constituents.
Towards this end, a synchronized system for the control of stray animals and prevention of the
spread and eventual eradication of animal rabies shall be provided.

SECTION 3. ROLE AND RESPONSIBILITIES: In adherence to the mandate of


RA No. 9482, the Anti-Rabies Act of 2007, the Province of Sultan Kudarat in coordination with its
component city, municipalities and barangays shall:

a) Creation of Provincial, City and Municipal Multi-Sectoral Committee to undertake


Anti-Rabies Prevention and Control Program;

b) Ensure that all dogs are properly immunized, registered and issued a corresponding
dog tag for every immunized and registered Dog;

c) Strictly enforce dog impounding activities and field control to eliminate stray dogs;

d) Ensure that dogs are leased or confined within the premises of the owners house or
owners fenced surroundings;

e) Allocate funds to augment the implementation of the National Rabies Prevention and
Control Program, particularly on the financing of supplies for human and dog vaccines
needed for immunization;

f) Ensure the enforcement of Section 6 of Republic Act No. 8485 or The Animal
Welfare Act of 1998, as amended by RA 10631;

g) Enact additional local ordinance that will support the National Rabies Prevention and
Control Program that should include the regulation of the traditional treatment locally
known as tandok;

h) Adoption of Ordinance banning the consumption and trade of dogs for meat, providing
sanctions pursuant to law;

i) With respect to city and first class municipality, establish and maintain a dog pound
where impounded dogs shall be kept, and other municipalities, shall, on their own,
establish a dog pound or opt to share the expense of establishing and maintaining a
dog pound with other adjoining municipalities and/or with private animal shelters and
control facilities;

j) Appointment of Veterinarian Officer and the creation of Veterinary Office in city and
first-class municipality, in conformity with the Local Government Code of 1991;
Provided further, that other municipalities, shall, on their own, opt to share the
expenses of having a veterinary office shall

k) Prohibit the use of electrocution as a euthanasia procedures

l) Require pet shops to post information regarding rabies and responsible pet ownership;
and,

m) Collect the fines imposed by RA 9482 and this Ordinance for the violation of any of
its provisions, and RA No. 10631 amending RA No. 8485 (The Animal Welfare Act
of 1998).

SECTION 4. DEFINITION OF TERMS As used in this Ordinance, the following terms


shall mean and defined as follows:

a) Animal refer to any animal of whatever specie, genus, family, size and purpose which
include, but not limited, to dogs, cats, birds, etc.

b) Askal - a colloquial name for local native or low grade dog, literally, asong kalye or street
dog

c) Animal Owner refers to any person keeping, harboring or having charge, care or control
of an animal including his/her representative and allows any such animal to remain about his
premises for a period of no less than ten (10) days.

d) Animal Welfare Organization refers to licensed group of individuals, whose main


concern is the welfare of animals.

e) Bitten refers to an act by which a dog seizes, cuts and grips with its teeth so that the skin of
the person has been wounded, pierced or scratched;

f) Committee- Local Rabies Prevention and Control Committee

g) Dog refers to a common quadruped domestic animal belonging to the other Carnivora
(male or female), scientifically known as canis familiaris.

h) Euthanasia refers to the process of painless death to dogs and other animals or an end to
the life of the animal by humane means in accordance with Republic Act 8485, the Animal
Welfare Act, as amended;

i) Pound refers to public enclosure for stray animals.

j) Impound refers to a public enclosure for stray animals.

k) Impounding refers to the process of capturing and confining stray animals;

l) Neutering refers to the surgical removal under anesthesia of the ovaries and uterus in the
female and testicles for the male animals, performed by a licensed veterinarian.

m) Public places refers to any place open to the public like parks, malls, markets, streets, etc.

n) Suspected Rabid Animal biting animal with a potential to have rabies infection based on
usual behavior, living conditions like stray dogs, endemicity of rabies in the area and no
history of immunization;

o) Other animals refers to animal other than dogs and cats which are kept or cared for by
persons as pets.

p) Pet Shop any store or establishment selling live animals as pets.


q) Rabies refers to a highly fatal disease caused by a Lyssa virus, transmitted mainly through
the bite of an infected animal and is characterized by muscles paralysis, hydrophobia and
aerophobia and other neurological manifestations

r) Rabies Vaccination of Dogs refers to the inoculation of a Dog with Rabies vaccine by a
licensed government or private veterinarian or trained individual under the direct supervision
of a licensed veterinarian.

s) Responsible Pet Ownership refers to giving proper care to pets by providing vaccinations
against rabies at 3 months of age and every year thereafter; providing clean, comfortable and
proper shelter; providing enough exercise, care and proper nutrition; keeping pets within
their own backyard where they are free from contact with infected dogs and keeping them on
leash when taken for a walk; and brining the pet for regular health consultation with the
veterinarian;

t) Restrained means tethered, leashed or cage;

u) Susceptible Species all warm blooded animals including humans are susceptible. In any
given area the rabies virus appears to adapt to a specific host species which then tends to
maintain the disease.

v) Stray Animal means any unlicensed or licensed animal leaving its owners place or
premise and found loose anywhere in the City/municipal limits. Also an animal tied outside
its owners premises without its owner or is not under its owners control. It also refers to
any Dog leaving its Owners place or premise and no longer under the effective control of
the Owner.

w) SKRPCC means the Sultan Kudarat Rabies Prevention and Control Committee.

x) Vaccination means inoculation of dog/cat with standard Rabies vaccine by a licensed


government or private veterinarian or trained individual under the direct supervision of a
licensed veterinarian. The services of the said trained individual shall be limited only to
rabies vaccination injection in dogs and cats and only during government mass vaccination
campaigns.

SECTION 5. STRATEGIC PLAN FOR RABIES PREVENTION AND CONTROL


PROGRAM. To attain the objective of eliminating rabies disease in the province of Sultan Kudarat,
the following strategic plans and interventions is hereby recommended, viz:

1) Creation of Rabies Control Coordinating Committees, at all levels (Provincial,


Municipal and Barangays)

2) Mass vaccination of Dogs;

3) Eradication of stray Dogs;

4) Impounding, field control and disposition of unregistered, Stray and


unvaccinated Dogs;

5) Information and education campaign on the prevention and control of Rabies

6) Organize Bantay Rabis sa Barangay for monitoring and reporting of rabies


incidence. Report of such cases to be submitted to the Municipal and Provincial
Rabies Control and Coordinating Council for appropriate action.

7) Ensure sufficient supply of anti-rabies vaccines for immediate response to any rabies
incidence;

8) Provide necessary budget for the purchase of vaccines and other medical supplies;
9) Coordinate with DOH PMT and the Bureau of Animal Industry for augmentation of
supply of anti-rabies vaccines and dog immunization vaccines;

10) Establish Bite Centers in all municipalities for immediate treatment and laboratory
examination to confirm rabies incidence.

SECTION 6. RABIES CONTROL COORDINATING COMMITTEE. There shall be


created Provincial Rabies Control Coordinating Committee to oversee the implementation of the
rabies control program and assist in eradicating and/or neutralizing the threat of rabies against the
population to be composed of the following:

A. Provincial Rabies Coordinating Committee (PRCC)

Chairman - Provincial Governor


Vice Chairman - Provincial Veterinarian
Members:
- Provincial Health Officer
- SP Chairman, Committee on Agriculture
- Provincial Agriculturist
- Schools Division Superintendent, DepEd
- Provincial Director, DILG
- The PNP Provincial Director
- The Provincial Legal Officer
- The DOH Provincial Health Team
- President, Liga ng mga Barangays
- NGO Representative
- PET Shop Representative

B. Secretariat. The Provincial Veterinary Office and the PHO Coordinator shall act as
Secretariat for the Committee.

SECTION 7. POWERS AND FUNCTIONS OF THE SULTAN KUDARAT RABIES


CONTROL COORDINATION COMMITTEE (SK-RPCC).

1. To provide a forum for inter-agency consultation and collaboration for the


formulation of long term, medium term and annual rabies prevention and policies;

2. To undertake the planning, implementation and monitoring of its Anti-Rabies


programs, projects and activities;

3. Create a technical working group which shall likewise be multi-sectoral or multi-


agency for the purpose of assisting the committee;

4. To encourage participation of citizenry in the prevention and control of rabies in the


province;

5. Develop in consultation with concerned participating agency the appropriate


information and educational materials on rabies;

6. Enforce the apprehension of dog and dog impounding to eliminate stray dogs.

7. The committee in coordination with the participating agencies, conduct community


Information Dissemination Campaign to in regulating and/or eliminating the use of
traditional treatment locally known as tandok.

8. Conducts Search for Best Barangay in Rabies Prevention and Control Program to
assess or evaluate if the objective of the program is achieved.
9. It shall identify rabies risk barangays or areas within the city/municipality.

10. Serves as advisory council to the Sangguniang Panlalawigan;

11. Perform such other functions and responsibilities, deemed necessary.

SECTION 8. INTER-AGENCY RESPONSIBILITIES:

A. PROVINCIAL VETERINARIAN
i. Supervise and monitor the activities and projects of the Provincial Rabies Prevention
and Control Committee in compliance with Republic Act 9482 and its IRR
ii. Prepare and submit annual Provincial Rabies Prevention and Control Program Action
Plans to the DA-Regional Field Unit or Regional Coordinator for consolidation and to
the Sangguniang Panlalawigan;
iii. Monitor the implementation of rabies ordinance and dog control measures in city and
municipalities within the area of responsibility;
iv. Organize rabies control committees in all component LGUs of the province and assist
in the establishment of the Barangay Bantay Rabis;
v. Allocate and distribute vaccines to component municipalities, and monitor proper
storage;
vi. Assist the training of vaccinators to undertake mass immunization;
vii. Monitor proper vaccine tilization during vaccination campaigns;
viii. Collect used vaccine vials and return it to the Regional Coordinator for proper
disposal;
ix. Consolidate and submit dog survey results, including other monitoring data for
inclusion in the National Anti-Rabies Control and Prevention Compliance Summary
Report;
x. Formulate complementary measures to eliminate rabies cases in the province.
xi. Advise the Provincial Governor and the Sangguniang Panlalawigan on all matters
pertaining to the improvement of the provincial anti-rabies campaign and dog
immunization program.
xii. Perform such other functions related to the Program, as may be directed.

For City/Municipal Vetrinarian/Agriculturist or any counterpart (as Municipal/City


Coordinator)

i. Coordinate all rabies control activities within the local government unit;
ii. Ensure proper implementation of this Ordinance, City/Municipal Anti Rabies,
Dog Pound and Stray Dog Control Ordinance;
iii. Take the lead in the conduct of dog population survey, and submit results to
provincial level for consolidation and updating;
iv. Receive anti-rabies vaccine allocations for the barangay from the Provincial
Veterinarian;
v. Ensure cold storage of dog vaccine and provide vaccine container (styrofoam) to
maintain and ensure temperature requirement while vaccinating in the area;
vi. Provide mobility for vaccinators during campaign; and,
vii. Collect and return used anti-rabies vaccine vials to the Provincial Veterinarian for
purposes of proper monitoring and accounting.

B. PROVINCIAL HEALTH OFFICE/DOH PROVINCIAL HEALTH TEAM


i. Act as a frontline in undertaking activities that may reduce human rabies cases in the
province.
ii. Ensure the availability and adequate supply of DOH pre-qualified human Anti Rabies
vaccine in animal bite treatment centers at all times and shall coordinate with other
implementing agencies and concerned NGOs for this purpose;
iii. Be responsible in handling dog bite victims and establish Animal Bite Treatment
Center (ABTC).
iv. Conduct seminars on Rabies and Proper Handling of Dog Bite Victims together
with the City and Municipal Veterinary Office.
v. Provide Post-Exposure Treatment at the minimum expense to individuals bitten by
animals suspected of being rabid which will consist of the initial vaccine
and immunoglobulin dose.
vi. Provide Pre-Exposure Treatment to high-risk personnel, and other persons working
with Rabies virus for free.
vii. Coordinate with the OPAG, OPVET and DOH-CHD in the development of
appropriate health education strategy to inform the public on Rabies prevention and
control and responsible pet ownership.
viii. Develop and maintain a human Rabies surveillance system.

C. SANGGUNIANG PANLALAWIGAN
i. Enactment of additional policies to strengthen implementation, upon recommendation
of the Committee.
ii. Recommend pertinent strategies for the improvement of the program.
iii. Participate in activities geared towards the prevention and complete eradication
of Rabies.

D. PROVINCIAL AGRICULTURIST
i. Established animal Rabies laboratory diagnostic capabilities to ensure better services
to the people.
ii. Ensure the availability and adequate supply of animal anti-Rabies vaccine at all times
in coordination with Bureau of Animal Industry.
iii. Undertake free anti-Rabies Vaccination of Dogs giving priority to high risk depressed
areas.
iv. Maintain and improve animal Rabies surveillance system.
v. Establish and maintain Rabies Free Zone/Area in coordination with the LGUs, DOH
and DA.
vi. Immediately facilitate for the approval of the sale and use of Veterinary and
Human Barbiturate drugs and veterinary euthanasia drugs by the DOH.
vii. Strengthen the training of field personnel and the Information Education
and Communication (IEC) activities on Rabies prevention and control and
responsible pet ownership.
viii. Conduct research on Rabies and its control in coordination with other agencies.
ix. Formulate minimum standards and monitor the effective implementation of
this Ordinance.
x. Encourage collaborative activities with the DOH, DepEd, DILG, DENR, NGOs, POs
and other concerned sectors.

E. DEPARTMENT OF EDUCATION:
i. Strengthen Rabies education program through school health teaching/curriculum
approved by the NRCC.
ii. Assist in the Dog mass immunization campaigns in the community.
iii. Encourage collaborative activities with the OPAG, PHO, NGOs, POs and other
concerned sectors.
iv. Integrate proper information and education on responsible pet ownership in
the relevant subjects in the Elementary and High School levels

F. PRESIDENT, LIGA NG MGA BARANGAYS:


i. Adopt and implement this Ordinance in all barangays of the province;
ii. Create the Bantay Rabis sa Barangay Task Force;
iii. Strictly enforce and monitor dog leashing and confinement in all barangays
iv. Facilitate the conduct of mandatory routine census to update dog population in all
barangays.
v. Adopt measures on compulsory dog registration, vaccination and impounding of stray
animals.
vi. Encourage the populace not to resort to Tandok as remedy to dog bite incidents.
vii. Include in the ABC Regular Meeting Agenda the Local Rabies Prevention and
Control Program and reports of accomplishment of BRPCC;
i. Prohibit the trade of dog for meat, selling of dog meat and carcasses, dog farming,
and/or slaughtering of dog for commercial consumption and to strictly penalize
offenders in accordance with law and this Ordinance
ii. Initiate measures to attain Rabies Free Barangay;

G. DILG PROVINCIAL DIRECTOR


i. Furnish relevant orders and circulars to ensure implementation and compliance of the
roles and responsibilities of the LGUs in support of the program.

H. PNP PROVINCIAL DIRECTOR


i. Formulate and implement measures in coordination with the City and Municipal
Police Stations, that will totally remove all stray dogs in the province.
ii. Disseminate information and adopt measures on dog registration and vaccination.
iii. Lead in the enforcement and provide assistance and security during stray dog control
and mass immunization
iv. Participate and assist the committee in the proper implementation of the program.
v. Assist in dog population control.

I. PROVINCIAL LEGAL OFFICER:


i. Attend to and resolve all disputes, complaints or grievances that may arise in relation
to the implementation of this Ordinance.
ii. Recommend penalties to violators in accordance with existing laws.
iii. Initiate and exhaust all means for amicable settlement between the opposing parties
or individuals.
iv. Set case hearing and notify the concerned individuals of the schedule.

J. NON-GOVERNMENT ORGANIZATONS AND ACADEME:


i. Participate and assist in the implementation of the Provincial Rabies Control
Programs by extending their support in any capacity initiatives, viz:
a. Community mobilization/participation;
b. Health education/information dissemination on rabies and responsible pet
ownership among students;
c. Mass animal anti-rabies vaccination campaigns;
d. Surveillance/reporting of rabies cases in animals and humans;
e. Initiate proposals and observe the implementation of ordinance or regulations
regarding rabies control measures.
ii. Provide technical assistance if available;
iii. Collaborate with the various coordination committees in the formulation of policies
and guidelines regarding rabies control;
iv. Participate in any other activities geared towards the prevention and complete
eradication of Rabies.

SECTION 9. RESPONSIBILITIES OF PET OWNER: - All Pet Owners shall be required


to:
a) Have their Dog regularly vaccinated against Rabies and maintain a registration card
which shall contain all vaccinations conducted on their Dog, for accurate
record purposes.
b) Submit their Dogs for mandatory registration.
c) Maintain control over their Dog and not allow it to roam the streets or any
Public Place without a leash.
d) Be a responsible Owner by providing their Dog with proper grooming, adequate food
and clean shelter.
e) Within twenty-four (24) hours, report immediately any Dog biting incident to
the Concerned Officials for investigation or for any appropriate action and place
such Dog under observation by a government or private veterinarian.
f) Assist the Dog bite victim immediately and shoulder the medical expenses
incurred and other incidental expenses relative to the victims injuries.
SECTION 10. LOCAL ANIMAL REGISTRY OFFICE. The Provincial Veterinary
Office is designated as the central registry of all rabies related undertakings in the province. As such,
all barangays in the province including private clinics and private veterinary practitioners conducting
dog vaccinations are directed to submit updated reports in the office. No veterinarian shall vaccinate
dogs without dog registration certificate issued by the Provincial Veterinarian.

SECTION 11. DOG REGISTRATION. There shall be a compulsory registration of all


dogs in the city, municipality and barangays. All dogs found within the province, including those
that had been previously registered shall be registered at their respective municipal veterinary office
or to the barangay concerned.

SECTION 12. A registration fee and license tag fee shall be collected. The registration fee
shall be TWENTY PESOS (P20.00) and the license dog tag fee shall also be TWENTY PESOS
(P20.00). If the registration fee and license dog tag fee were collected by the Barangay, sixty percent
(60%) of the said amount shall be remitted to the Municipal Treasurers Office while the remaining
forty percent (40%) shall remain in the barangay. This shall constitute the Special Fund of the
C/MRPCC and BRPCC to be used in implementing this ordinance, respectively.

SECTION 13. DOG IMMUNIZATION. There shall be a scheduled free mass anti-rabies
vaccination in every city, municipality and barangay for registered dogs giving priority in high risk
areas. Likewise, the Office of the Provincial Veterinarian is open to conduct daily vaccination with a
one needle-one animal policy from Monday through Friday to accommodate unvaccinated ones.

SECTION 14. Only healthy dogs shall be vaccinated against rabies using vaccine registered
and licensed by the Bureau of Animal Industry (BAI). Private veterinarians or group is allowed to
conduct rabies vaccination, with the consent and authority of the Provincial Veterinarian or his
deputy pursuant to Section 13 hereof.

SECTION 15. DOG VACCINATION TAG. Dog tag shall be issued upon vaccination, in
which the color and shape shall vary from year to year to easily identify the vaccinated from
unvaccinated animals. Private veterinarians or group shall only issue dog vaccination tag assigned
by the NRPCC/SKPCC as stated in this section.

SECTION 16. INFORMATION AND EDUCATION CAMPAIGN. Rabies education and


Responsible Pet Ownership modules approved by the NRPCC shall be utilized for consistency and
that Public lectures on Responsible Pet Ownership and rabies awareness will also be conducted
during public forum and extension services, as well aired in local radio station for wider
dissemination.

NRPCC approved educational reading materials on rabies shall be made available for
distribution to different schools, public libraries and barangay halls. Poster-version of such materials
shall be posted to pet shops as requirement on public awareness.

SECTION 17. SPECIAL EVENT. Pursuant to Executive Order No. 84 dated March 13,
1999 of the Office of the President, every month of March is hereby declared as The National
Annual Rabies Consciousness Month. Further, every September 28 shall be declared as the World
Rabies Day.

Pet and Dog shows shall also be encourage and conducted during foundation anniversary,
fiesta and other celebrations as part of the activity to encourage peoples awareness on rabies and
promote Responsible Pet Ownership.

SECTION 18. DOG POUND. Recommended withholding pen must be provided by the
BRPCC in every barangay which may serve as temporary shelter for BRPCC- apprehended dogs
prior to collection for impounding in the Municipal pound.

SECTION 19. Dog owners shall have 24 hours to claim their animals from the barangay
collection pen. All unclaimed dogs after this period will be transferred to the municipal pound and
dog owners shall have five (5) days from confinement to claim them. Beyond this time, the animal
shall be disposed in accordance with the law and this Ordinance.
SECTION 20. The dog owner shall be liable to pay the corresponding impounding fee in
accordance with existing laws, ordinances, rules and regulations enacted by concerned LGU.

SECTION 21. All vicious, temperamental and dangerous dogs must be humanely
disposed/euthanized of under the supervision of the Animal Welfare Officer or duly designated
person, in accordance with RA 8485 as amended by RA 10631, the Animal Welfare Act and all
existing laws and its rules and regulations.

SECTION 22. SLAUGHTERING OF DOGS. Slaughtering and selling of dogs for meat
shall be strictly prohibited. This may spread rabies and other diseases especially if the said dogs are
stray or of unknown origin. Slaughtering and selling of dogs meat includes but shall not be limited to
buying and/or selling of dogs, dog meats and carcasses, dog farming, collecting and/or slaughtering
of dogs for commercial consumption.

SECTION 23. Slaughtering of dogs maybe allowed only as provided in accordance with the
provisions of Animal Welfare Act of 1998 or RA 8485, pursuant to Department of Agriculture
Administrative Order No. 25, Series of 2007, if done as part of the religious ritual of an established
religion or sect or a ritual required by a tribal or ethnic custom of indigenous cultural communities
as in religious feast and offering and the like provided that it must be coordinated first with the
BRPCC and the NCIP.

SECTION 24. EUTHANIZING PROCEDURES. Killing of dogs may be allowed in the


following instances:
a) When subject animals are afflicted with incurable disease as determined and certified by a
duly licensed veterinarian; with the aim to end the suffering of the dog.
b) For the purpose of population control
c) To prevent imminent danger to human being
d) If used in authorized research and experiments as provided for by the Animal Welfare Act of
1998, as amended.
e) Euthanizing procedure shall be in accordance with AO No. 13 Series 2010 The Revised
Rules and Regulations on the Euthanasia of Animals of the Department of Agriculture.

SECTION 25. PRE-EXPOSURE MANAGEMENT. A free pre-exposure anti-rabies


vaccine shall be provided and be maintained by the province, and municipal Bite Centers to protect
all individuals engaged in rabies-related activities and all personnel of the Veterinary/Agriculture
Services engaged in rabies prevention and control.

SECTION 26. POST- EXPOSURE MANAGEMENT. A post-exposure treatment shall be


given to any person bitten by a rabid animal at minimum expense or free subject to the availability
of stock, otherwise, the dog owner shall purchase the needed human vaccine. Priority anti-rabies
vaccination shall be administered to indigent victims.

The Provincial Health Office and the DOH PHT in the province shall take necessary
arrangements for possible inclusion of a Dog Bite Preventive Vaccination under PhilHealth
availment and reimbursement.

SECTION 27. In case the animal that has bitten or scratched a human is not available for
testing, the victim shall be regarded as having been exposed to a rabid animal, thus in urgent need of
preventive vaccination measures.

SECTION 28. A vaccinated dog that bites a human shall still be observed for a period of 14
days while the victim shall undergo preventive vaccination. The preventive vaccinations maybe stop
if the suspect dog lives after the observation period, at the discretion of the attending physician

SECTION 29. A dog that has bitten a human shall not be vaccinated, killed or euthanized
within the 14 days observation period. In cases when it is deemed necessary to vaccinate or kill the
animal, the attending veterinarian must secure clearance or permission from the committee.
SECTION 30. When an unvaccinated dog is bitten by a confirmed rabid animal, it shall be
euthanized immediately and disposed of properly. No tissues or secretions from a clinically rabid
animal shall be used for human or animal consumption.

SECTION 31. REPORTING OF RABIES CASES AND SURVEILLANCE SYSTEM.


It is the duty of the dog owner and the victim to report all dog biting incidents to the Municipal
Veterinarian and Municipal Health Officer or to any licensed veterinarian or physician for proper
guidance within 24 hours after the incident. The physician will treat the bite victim, while the
veterinarian shall handle the biting animal. Should the dog die during the observation period of 14
days, the dog owner shall immediately submit the dog for rabies examination

SECTION 32. The Provincial Veterinary and Health Offices shall conduct a thorough
investigation on all incidents of dog and human rabies cases and submit reports to Committee or the
Sangguniang Panlalawigan and copy furnish for Provincial Rabies Committee and the Department
of Health, respectively.

SECTION 33. To assess the extent of rabies incidence or endemic area in the province,
veterinarians, owners and Municipal Bite Centers, Animal Bite Center, medical health facilities, etc,
shall likewise be a required to submit reports to the Provincial Health Office and the Provincial
Veterinary Office.

SECTION 34. All residents in the barangay are also encouraged to take part and report all
suspected or confirmed rabies cases in both human and animals to the Barangay Bantay Rabis Task
Force or to the MRPCC.

SECTION 35. RESPONSIBILITIES OF THE OWNER OF DOGS THAT BITE


HUMANS. The dog owner shall be liable to bring the victim to a doctor. In all dog biting cases, the
dog owner shall be liable to pay 100% of all the expenses incurred during the period of medication
in cases of negligence or unprovoked bite cases.

Failure of the dog owner to assist the dog bite victim shall be penalized in accordance with
the penal provisions herein imposed. However in provoked cases and unlawful entry, the owner shall
not be liable to pay.

SECTION 36. DOG CONTROL MEASURE. The Barangay Rabies Prevention and
Control Committee or the Barangay Bantay Rabis, upon adoption of this Ordinance, shall strictly
implement mandatory confinement or leashing of dogs within their area of jurisdiction. Stray dogs
are prohibited and violators will be penalized.

SECTION 37. The local Veterinary Office shall conduct mass neutering of male and female
dogs to control dog population.

SECTION 38. A Search for the Best Rabies Control Program Barangay shall be
undertaken every year by the SK-PRPCC. The guidelines for the contest shall be provided by the
committee and will be awarded annually during Foundation or Fiesta celebration.

SECTION 39. The SK-RPCC in coordination with MRPCC and BRPCC shall promote the
advocacy that each household can maintain more than three (3) heads of dogs provided that the
owner shall have them leash or confined them inside a pen in order to provide better care by the
owner to their pets and as a way to control dog population in the community. Registered dog
breeders are allowed to maintain more than three heads.

SECTION 40. COOPERATIVE UNDERTAKING. For purposes of operational


requirements and implementation, Local government units may, through appropriate ordinance,
group themselves, consolidate, or coordinate their efforts, services, and resources for purposes
commonly beneficial to them. In support of such undertakings, the local government units involved
may, upon approval by the sanggunian concerned contribute funds, real estate, equipment, and other
kinds of property and appoint or assign personnel under such terms and conditions as may be agreed
upon by the participating local government units through Memorandum of Agreement, as provided
in Section 3 (j) of this Ordinance.
SECTION 41. PENALTIES AND SANCTIONS. To strictly implement this Ordinance,
the following are hereto provided:

1. Pet owners who fail or refuse to have their Dog registered and immunized against
rabies shall be punished by a fine of Two Thousand (P2,000.00) Pesos;
2. Pet owners who refuse to have their dog vaccinated against rabies shall be liable to pay
for the vaccination of both the dog and the individuals bitten by their dog;
3. Pet owners who refuse to have their dog put under observation after said dog has bitten
an individual shall be meted a fine of Five Thousand (P5,000.00) Pesos;
4. Pet owners who refuse to have their dog put under observation and do not shoulder the
medical expenses of the person bitten by their dog shall be meted a fine of Five
Thousand (P5,000.00) Pesos;
5. Pet owners who refuse to put leash on their dogs when they are brought outside the
house shall be meted a fine of Five Hundred (P500.00) Pesos for each incident;
6. An impounded dog shall be released to the owner upon payment of a fine of not less
than Five Hundred (P500.00) Pesos, but not more than One Thousand (P1,000.00)
Pesos;
7. Any person found guilty of trading dog for meat shall be fined not less than Five
Thousand (P5,000.00) Pesos per dog, and subject to imprisonment for one (1) to four
(4) years;
8. Any person found guilty of using electrocution as a method of euthanasia shall be fined
not less than Five thousand pesos (P 5,000.00) per act and subject to imprisonment for
one (1) to four (4) years.
9. If the violation is committed by an alien, he or she shall be subjected to deportation
proceedings;

SECTION 42. For purposes of ensuring the administrative feasibility of implementing the
provisions of the law and subject to paragraph (i) of Section 3 of this Ordinance, component LGUs
shall collect the fines imposed under Section 41 sub-paragraphs (1), (3), (4), (5) and (6), while sub-
paragraphs (7), (8) and (9) shall be imposed upon conviction by the proper court.

Any and all fines collected shall be used for the enhancement of the Rabies Prevention and
Control program within the locality concerned, as well as the achievement of the objectives
envisioned of the law and this Ordinance.

SECTION 43. IMPLEMENTING RULES AND REGULATIONS. - The OPVET, in


coordination with the OPAG, PHO, SP, DepEd, DA and concerned NGOs and LGUs shall
formulate the necessary implementing rules and regulations within sixty (60) days from the
effectivity of this Ordinance.

SECTION 44. APPROPRIATION. The amount of Two Hundred Thousand Pesos


(P200,000.00) is hereby allocated from the 20% Development Fund for the Rabies Prevention
Control Council Operations Fund. The amount necessary in the procurement of rabies vaccines
shall be included in the MOEE of OPVET, PHO, OPAG and hospital facility for Animal Bites
Treatment Centers. Thereafter funding for the succeeding years shall be provided for its continued
implementation.

The grants and Assistance received from Department of Health, Bureau of Animal Industry
and other local and foreign donor agencies shall form as part of the anti-rabies vaccine supply in-
shelves and subject to inventory.

SECTION 45. SEPARABILITY CLAUSE. If, for any reason, any provision of this
Ordinance is declared to be unconstitutional or invalid, the other sections or provisions hereof which
are not affected shall continue to be in full force and effect.

SECTION 46. REPEALING CLAUSE. Any Ordinance inconsistent herewith is hereby


revised or modified accordingly.
SECTION 47. EFFECTIVITY. This ordinance shall take effect upon its approval and
publication in accordance with law.
