The Parties
2. The Plaintiff; Marija Blazanin (herein after referred to 8.$ ":Marlja"),is a Croatian events
plaener/eoncert promoter. Marija has a m-ong reputation as North America's only Croatian female
special eVe$ planner/concert promoter within the Croatian community organizing such events as
concert, theatrical/plays, fiJm previews, Iectares and seminars, Matija has developed a strong
. reputation within the artistic, academic and. political communities in Croatia, Canada. and USA.
;;. .The Defendant, Marko Perkovic also known as "Thompson" (hereinafter referred. to as
"Marko'~) is a popular Croatian singj;:! who performers for Croatians around the world.
OVerview
5. In May 2007, the D~fen~ hired Marija to organize Marko's entire North. American fall
2007 concerttour (heroinafierrefexred to as '~A: 2007 Tom"). Relying on the1tagreement,~ja.
took all necessary stops te fulfil her obligatio:ns s:egarcllngtbeNA 2007 Tour. No:twitbstandingtJrls,
the Defendants have to date failed to! (a) pay Macljaher commissions, whic.h. are due and owing to
her, (b) reimburse Marlja for losses suffered as a result oftb.e Defendants' negligent a:tid improper
conduct, in breach of the express and implied teens of then- agreement; and (c) reimburse Marijafor
costs Incurred, which are due and owing to her.
The Agreement
(b) Maxija. fot lI.et services, was to receive 20% of the net proceeds from all
performances held d1lrl:ng the coarse of the NA 2007 Tour;
(c) In addi:'tio~Marlja was to receive 30% of the net proceeds from the Toronto
Concert ticket sales; and
Cd) Costs of the NA 2007 Tour were to be paid from. the gross proceeds of all
perfonnaaces.

7. At all material times, Mroiji complied Wlthher obligationsunderthe teJ.mS of the Agreement
and took all steps to properly organize :m.d manage the 'NA 2007 Tour.
8. In breach of the express and implied terms of the Agreement, the Defendants engaged in
improper conduct which resulted in. additional costs associated with the cancellationand re"
scheduling of performances during the NA 2007 TotU'. 'Ibis resulted 3n additional costs to the
Plafutift of $18,445.65 which ar-edue and ow.in:g to the Plafu:tlff.
9. In ;furtherbreach of the Agreement., the Defendants heve failed. to pay Mro:ijtc
(a) the agreed to 20% commission from tJle net performance proceeds ofthe NA 2001
Tour, in the amount of $267115.02;
(b) costs of printing ()fadtnission ti,c,:etslU.S. 'Visa agent, printing oft-shtrts, customs,
ete, which were paid for byM~a, aad fl.'ltwhich Manja is en:titledto be reimbursed.

(c) $7,975.65 in additional costs ao,d out of pocket expenses incurred bytb.ePlaintiff as a
result of tho D~fenda:o.ts'~ches of the Agreemers;
10. As a.result oitha pefendants' Wl'ongful conduct; the Plaintiff has suffered and continues to
suffer loss and damage.
11. The plaintiff relies on Rule 17.02 (f), (g) and (h) o;tthe Bules o/Civil Procedure.

4: The Defendants plead and the fact i$ that at all material times the
Plaintiff, had total control of all money paid and received In regards
to the tour and that.she pald herself and expenses as she wished
and only forwarded what was left over to the Defendants.

5. The ,?efendants plead and the fact is that it was only after she was
advtsec that she was not going to be In charge of the future concerts
because of her negligence and lack: of proper accounting In regardS
to expenses and receipts, did she come up with the fictitious figures
that are part of this lawsuit.
6. 'rhat the Defendants plead and the fact is that the Plaintiff could have
paid herself what she wished for she was with the money in Canada
whfle they were in Croatia and received what the Plaintiff deemed as
their share.
7. At the start, the Plaintiff was offered 20% commission for organizing
the ioronto concert, which she accepted.
8. The Plaintiff then offered to organize all other concerts In the tour.
The perencants agreed that she would organize travel to and from
the concerts, .coordinate with local organizers as well as distribute
tickets, meals. hotel accommodations and would be responsible for
equipment venue amongst other things associated with the tour.
9. At the end of the tour. the Defendants met with the Plaintiff so she
could provide her accounting. There were money problems because
tha Plaintfff was very inconsistent and made many errors in
accounting. At the end, the Plaintiff was in debt to the Oefendants
and promised payment confirming It bye-mail of some $14,125.00.
The Defendants pleads a set off for this amount.

1q. The Defendants plead ana the ract /$ that the Plalntlff then became
persistent requesting that she handle the Oefendant's future
concerts.
11. The Defendants refused to employ the Plaintiff for future concerts
for, although, there were 6000 people at the Tor.onto concert, the
Plaintiff made accounting and advised only 2,900 tickets were sold.
The Defendants plead and the fact Is that the Plaintiff pocketed the
difference since most sales were cash at the door. The Defendants
therefore plead and the fact Is thai they are entitled to proper
accounting from the Plaintiff.
13. The Plaintiff was negligent In her duties throughout the tour with
poor airplane connections; with vans which were too small for the
band; poor choice of hotel rooms; in Los Angeles and vancouver the
tour-arrived without hotel reservations. There were problems with
sale of t-shlrts, CD's, and tickets.
14. The Plaintiff was specifically Instructed 'not to speak with the media
about the concerts, but failed to follow these !n~tructions and
provided a press release to the Globe and Mail. As a result, the
location venue cancelled the concert and then she announced to the
press that the concert will now be held at a secret place hardly
conducive to ticket sales. The Plaintiffs negligence and deliberate

breach of contract caused the Defen<lanfs to loose money on the
Toronto concert compared to what could have been made.
15. The Defendants plead and the fact 15 that this claim should be
dismissed against them with costs on a complete Indemnity basis.

18. The Oef~ndants plead and the fact is that the Plaintiff,was neg.llgent
in the performance of her duty and as 'a result, the Defendants
suffered damaqes for the concerts did not make as much money as ,
expected if the organization and management by th~ Plaintiff was
not negligent and haphazard.

19. The Defendants plead and the fact ls that the Plaintiff presented
herself as being an expert in tour management and Defendants
relied on her to their economiC detriment.
20 -. The Defendants plead and fact Is that the Plaintiff breached her
contract with the Defendants thereby oausing damages to them.
