EX-PARTE MOTION TO SET THE CASE FOR PRE-TRIAL CONFERENCE

COMES NOW, the plaintiff, through the undersigned counsel and

unto this Honorable Court, most avers:

1) That the records of the case will show that defendant had already
filed his answer and no subject pleadings was filed;

2) That being the last pleading, the case should already be set for pre-
trial conference pursuant to Sec. 1, of Rule 18 of the 1997 Rules of
Civil Procedure.

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable Court that the above-entitled case be set for pre-trial
conference.

Other relief and remedies as may be deemed just and equitable under
the premises are likewise prayed for.
