CITY ORDINANCE NO. 2008-34

AN ORDINANCE ESTABLISHING UNIFORM GUIDELINES IN THE

PROPER WAY OF DISPOSAL OF USED OIL WITHIN THE
JURISDICTION OF THE CITY OF CABADBARAN AND PROVIDING
PENALTIES THEREON.

WHEREAS, it has been observed that there are now several small
motor service shops, motor pool and individuals that constantly utilized
petroleum based products for lubrication of motor vehicles and engines
within the city;
WHEREAS, seldom or with very little attention given by the community is
the practice of simply disposing used oil in our canals, creeks or vacant
lots where they could throw the oil totally unaware of the hazardous
effect it could possibly bring to the environment.

BE IT ORDAINED, by the 1st Sangguniang Panlungsod, in its 65 th

Regular Session assembled that
SECTION 1. Title This Ordinance shall be known as Used Oil
Ordinance.
SECTION 2. Definition of Terms:

1. Used Oil - shall pertain to any petroleum based

products for lubrication of motor vehicles
and engines that have already been used.
2. Proper Disposal - any act where it includes the responsible
throwing of used oil in a safety container.
3. Safety Container - shall include but not limited to metal drum (with
a lid or cap), plastic container or metal
container that can be used for storage.

4. Transporter any person (natural or juridical) who is licensed

to buy, collect and transport used oil.

SECTION 3. Scope: This Ordinance shall apply to all small motor service
shops, motor pool and individuals that utilized petroleum based products for
lubrication of vehicles and engines.
SECTION 4. Manner of Storage Used oil shall be contained in a
safety container. The safety container shall be placed in an enclosed
structure with a roof so as to protect it from rain and not to be easily
accessed by unauthorized persons. The container should be checked
regularly for leaks.
The owners of motor shops or individuals who generate used oil
may then coordinate with the authorized transporter for the collection of the
used oil.
SECTION 5. Prohibited Act It shall be unlawful to dispose used oil in
the creeks, rivers, canals or vacant lots.

SECTION 6. Penalties Any person or entity who is found to commit

the unlawful act provided for in Section 5 hereof shall be penalized as
follows:
1st Offense - P 2,500.00
2nd Offense - P 3,500.00
3rd Offense - P 5,000.00 and revocation of permit in case
of establishments which generate used
oil.
SECTION 7. Repealing Clause All previous Municipal/City Ordinances
found to be inconsistent with the present ordinance shall be modified and /or
repealed accordingly.

SECTION 8. Suppletory Clause This Ordinance shall be construed as

to support any national laws or any national agencies memoranda, circulars
and/or directives and never in the intent of this Ordinance to defeat the
purpose of national agencies.

SECTION 9: Effectivity Clause This Ordinance shall take effect immediately

after complying with the publication requirement.
