CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This Lease Contract made and entered into this ______, 2014 in _____
__, by and between:

21th CONSTRUCTION DEVELOPMENT


CORPORATION, a corporation duly organized and existing under the laws
of the Republic of the Philippines, with principal office at No. 28 Lot 12,
Block 94 R. Papa Avenue cor. P. Garcia Street, AFPOVAI Village, Fort
Bonifacio, Taguig City, herein represented herein by its President, Richard
Guo, hereinafter referred to as the LESSOR

and

ASUKI DEVELOPMENT & CONSTRUCTION MANAGEMENT INC.,


a corporation duly organized and registered under the law of the Philippine
s, with address at No. 25 Arty 1st Brgy Talipapa Novaliches Quezon
City, represented herein by its Vice President, JT
Chen, hereinafter referred to as the LESSEE.

WITNESSETH: That

WHEREAS, the LESSOR is the owner of the Tower Crane QTZ80


equipment, the list of which is hereto attached and made as integral part
hereof;

WHEREAS, the LESSEE desires to lease the above mentioned


equipment and the LESSOR is willing to lease out
the same unto the LESSEE, is subject to the following terms and con
dition hereinafter specified:

NOW, THEREFORE, for and in consideration of the foregoing premis

and the mutual covenants and obligations hereinafter contained and t
o be
performed, the LESSOR hereby leases and the LESSEE hereby acce
pts
by way of leasefrom the LESSOR and leased premises subject to th
e following terms of conditions:

1. TERM: This lease shall be for a period of 5 (FIVE)


months, commencing on _________ and ending on _________ renewable
upon mutual agreement by both parties, provided the
LESSEE gives thirty (30) days notice to the LESSOR of his intention to
renew the lease of the subject premises.

2. RENTAL RATE: The LESSEE shall pay a total monthly rental of ONE
HUNDRED SEVENTY THOUSAND PESOS: (Php170,000.00), Philippine
Currency. All rental payments shall be payable to the LESSOR.
3. DEPOSIT: That the LESSEE shall deposit to the LESSOR upon
signing of this contract and prior to move-in an amount equivalent to the
rent for two (2) MONTHS or the sum of PESOS: THREE HUNDRED
FORTY THOUSAND PESOS (Php340,000.00), Philippine Currency.

4. TERM OF PAYMENT: The Lessee shall pay the Lessor every first
day of the month covered by updated checks to be issued and delivered
upon the signing of this contract;

5. DEFAULT PAYMENT: In case of default by the LESSEE in


the payment of the rent, such as when the checks are dishonored or
bounced for any reason, the LESSOR at its option may terminate this
contract and pull out the equipment rented out by the Lessee as well forfeit
whatever rental deposit or advances have been paid by the LESSEE.

6. DELIVERY: The Lessee must be responsible for the mobilization


/ demobilization of the equipment.

7. DAMAGES AND LOSSES: During the lease term, in the event the
materials are lost or damaged, the lessee shall pay to lessor the value of
the parts of the equipment.

8. SUBLEASE: The lessee is not allowed to sublease the materials.

9. VIOLATION: Any violation of the term herein set forth by either


LESSEE or LESSOR shall be sufficient ground for termination of this
Contract of Lease by the LEESOR with damage accuring to the innocent
party.

10. ATTORNEYS FEES: In case of court litigation by virtue of non-


payment of the agreed rent or any other breach of this agreement on the p
art of the LESSEE, the LESSOR shall have the right to collect the amount e
quivalent to 20% of the total obligation due as liquidated damages and reas
onable fees, exclusive of the cost legally accrued.

11.
RULES AND REGULATIONS: The LESSEE agreeto abide by the existing
rules and regulations promulgated by the LESSOR.

12. ENTRY BY LESSOR: The LESSOR or its authorized agent shall, by


previous arrangement with the LESSEE, have the right to examine the
materials object of this lease contract to determine whether or not said
materials are use for which they are intended and to monitor damage that
needs repair.
13. REPAIR AND MAINTENANCE: The Lessee shall be responsible for
whatever damage/repair needed by the materials during the duration of the
lease contract.

14. The Operator of the equipment must be provided by the Owner but
the salary must be provided by the Lessee. The Operator must handle
directly under the management of the Lessee.
IN WITNESS WHEREOF, the parties hereto have signed these presents on
the date and at the place first above mentioned or written.

In their instrumental witnesses, all known to me and to me known to be the


persons who executed the foregoing instrument and acknowledged to me t
he same is their own free and voluntary act and deed and that of the princip
al represented.

This instrument refers to a CONTRACT OF LEASE of the construction


materials, consisting of four (4) pages including this page.
