tomakeprovisionforthelawrelatingtotheestablishmentandmanagementofthePoliceorganizationandits
functions.
Be itenactedbytheLegislatureofSikkimintheFiftyninthYearoftheRepublicofIndiaasfollows:

CHAPTER I
Preliminary:DefinitionsandInterpretations
Shorttitle,extent 1. (1) ThisActmaybecalledtheSikkimPoliceAct,2008.
andcommencement (2) ItextendstothewholeofSikkim.
(3) ItshallcomeintoforceonsuchdateastheStateGovernmentmaybynotification
intheOfficialGazetteappoint.
Definitions 2. (1) InthisAct,unlessthecontextotherwiserequires.
(a) ActmeanstheSikkimPoliceAct,2008
(b) cattlemeansandincludescows,buffalos,elephants,camels,horses,
asses,mules,sheep,goatsandswine
(c) corefunctionsmeansdutiesrelatedtosovereignfunctionsoftheState
includingarrest,search,seizure,crimeinvestigation,crowdcontroland
alliedfunctionsthatcanonlybeperformedbythepoliceastheagency
oftheState
(d) Group`Cpostsmeansthepostssocategorizedundertherelevant
StateServiceRules

(e) Headquarters Companymeans aunitperforming administrative


andother supportfunctionsofaStateArmedPoliceBattalion
(f) insurgencyincludeswagingofarmedstrugglebyagrouporasection
ofpopulationagainsttheStatewithapoliticalorotherobjectiveincluding
theseparationofapartfromtheterritoryofIndia
(g) internalsecuritymeanspreservationofsovereigntyandintegrityof
theStatefromdisruptiveandantinationalforces
h) Magistratemeans,unlessthecontextotherwiserequires,anExecutive
Magistrateappointedunder Section20oftheCodeofCriminalProcedure,
1973andincludesapersonexercisingpowersofSubDivisional
MagistrateorDistrictMagistrate
(i) militantactivitiesincludeanyviolentactivityofagroupusing
explosives, inflammablesubstances,firearmsorotherlethalweapons
orhazardoussubstanceinordertoachieveitspoliticalorother
objectives
(j) noncorepolicefunctionsmeanssuchfunctionswhicharenotcore
functionsasdefined
(k) organizedcrimeincludesanycrimecommittedbyagroupornetwork
ofpersonsinpursuanceofitscommonintentionsofunlawfulgainby
usingviolentmeansorthreatofviolence
(l) placeofpublicamusementandpublicentertainmentincludessuch
placesasmaybenotifiedbytheStateGovernment,andincaseno
suchplaceisnotified,thenanyplaceliableforpaymentofamusement/
entertainmenttaxtotheStateGovernment.
(m) PoliceDistrictmeanssuchareaasmaybedeclaredtobeaPolice
DistrictbytheStateGovernmentbynotificationunder Section8ofthisAct
(n) PoliceOfficermeansanymemberofthePoliceServiceoftheState
(o) prescribedmeansprescribedunderthisAct
(p) publicplacemeansanyplacetowhichthepublichaveaccessand
include:
(i) apublicbuildingandmonumentandprecinctsthereof
(ii) anyplaceaccessibletothepublicfordrawingwater,washingor
bathing orforpurposesofrecreationand
(iii) suchotherplacesasmaybenotifiedbytheStateGovernment
(q) regulationsmeanregulationsmadeunderthisAct
(r) rulesmeanrulesmadeunderthisAct
(s) ServiceCompaniesmeansunitsofStateArmedPoliceBattalions
andDistrictArmedReservewhicharedeployedforlawandorderand
otherdutiesinsupportofcivilpolice
(t) ServicemeansthePoliceServiceconstitutedunderthisAct
(u) StatemeanstheStateofSikkim
(v) StateGovernmentmeanstheGovernmentofSikkim
(w) StationHouseOfficermeanstheOfficerinchargeofPoliceStation,
ofandabovetherankofSubInspectorofPolice

(x) SubordinaterankmeansallranksbelowtherankofAssistantorDeputy
SuperintendentofPolice
(y) terroristactivityincludesanyactivityofapersonoragroupusing
explosivesorinflammablesubstancesorfirearmsorotherlethalweapons
ornoxiousgasesorotherchemicalsoranyothersubstanceofa
hazardousnaturewiththeaimtostriketerrorinthesocietyorany
sectionthereof,andwithanintenttooverawetheGovernment
establishedbylaw.
(2) WordsandexpressionsusedinthisActbutnotdefinedspecificallyshall
havethesamemeaningasprovidedintheGeneralClausesAct1897,the
CodeofCriminalProcedure1973,andtheIndianPenalCode,1860.

CHAPTER II
ConstitutionandOrganizationofthePoliceService

OnePoliceService 3. ThereshallbeonePoliceServicefortheState,calledtheSikkimPolice.
fortheState MembersofthePoliceServiceshallbeliableforpostingtoanybranchof
theService,includingtheArmedPoliceoranyofitsspecializedwings.
Constitutionand 4. Subjecttotheprovisions ofthisAct
compositionof the
(1) ThePoliceServiceshallconsistofsuchnumberofPoliceofficers,including
PoliceService
membersoftheIndianPoliceServiceandtheStatePoliceService,asthe
StateGovernmentmaybygeneralorspecialordersdeterminefromtimeto
time.
(2) ThedirectrecruitmentstoGroupCpostsinthePoliceServiceshallbe
madethroughaPoliceRecruitmentCommitteebyatransparentprocessas
perrulesframedbytheStateGovernment.
(3) TherecruitmenttotherankofDeputySuperintendentofPoliceshallbe
madethroughtheStatePublicServiceCommission.
(4) ThecompositionofthePoliceServiceshall,asfaraspossible,reflect
adequaterepresentationofallsectionsofsociety,includinggender
representation.
(5) Thepay,allowances,serviceandworkingconditionsofPoliceofficersshall
beasprescribedbyrulesfromtimetotime.Theseshallalwaysbe
commensuratewiththearduousnatureoftheirduties.
(6) Policeofficersshallatalltimesremainaccountabletothelawandresponsive
tothelawfulneedsofthepeople,andshallobservecodesofethicalconduct
andintegrityasprescribed.
AppointmentofDirector 5. (1) FortheoveralldirectionandsupervisionofthePoliceService,theState
GeneralofPolice,etc. GovernmentshallappointaDirectorGeneralofPolicewhoshallexercise
suchpowers,performsuchfunctionsandduties,andhavesuch
responsibilitiesandsuchauthority,asmaybeprescribed.
(2) ThepostofDirectorGeneralofPoliceshallbetheseniormostpositionin
thehierarchyofthePoliceServiceoftheStateandnoofficerseniortothe
incumbentDirectorGeneralofPoliceshallbepostedtoanypositionwithin
theStatepoliceService.
(3) TheStateGovernmentmayappointoneormoreAdditionalDirectorsGeneral
ofPolice,andasmanyInspectorsGeneralofPolice,DeputyInspectors
GeneralofPoliceandAssistantInspectorsGeneralofPoliceasnecessary.
(4) TheStateGovernmentmay,byageneralorspecialorderinconsultation
withtheDirectorGeneralofPolice,directinwhatmannerandtowhatextent
anAdditionalDirectorGeneralofPoliceoranInspectorGeneralofPoliceor
aDeputyorAssistantInspectorGeneralofPoliceshallassistandaidthe
DirectorGeneralofPoliceintheperformance,exerciseanddischargeof
hisfunctions,powers,duties,responsibilitiesandauthority.
(5) SubjecttosuchgeneralorspecialorderoftheStateGovernment,theDirector
GeneralofPolicemayfromtimetotimeassignspecificdutiesand
responsibilitiestoanAdditionalDirectorGeneralofPoliceoranInspector
GeneralofPoliceoraDeputyorAssistantInspectorGeneralofPolicebya
generalorspecialstandingorder.

Selectionandtermof 6. (1) The StateGovernmentshallappointtheDirectorGeneralofPolicefrom


officeoftheDirector amongstofficersoftheIndianPoliceServiceintheStateCadreempanelled
GeneralofPolice forthepostandrecommendedbyathreememberscreeningcommittee
headedbytheChiefSecretaryconstitutedforthepurpose.TheScreening
Committeeshallprepareapanelofatleastthreesuitablepersons.Except
inthecasewherethevacancyisunanticipated,theScreeningCommittee
shallmakeitsrecommendationbeforethevacancyarises:

ProvidedthatincasetheScreeningCommitteecomestotheconclusion,
forreasontoberecordedinwriting,thattherebeingnosuitableincumbent
availableintheStateCadre,itmayassessthesuitabilityofempanelledIndian
PoliceServiceofficersofotherStateCadressubjecttotheirwillingnessand
concurrenceoftheCentralGovernment.
(2) TheScreeningCommitteemaydeviceitsownprocedureandshallconsider
thenamesofallempanelledofficersoftheIndianPoliceServiceinthe
StateCadreandshallmakeitsassessmentonthebasisof
(a) theperformanceappraisalreports
(b) therangeofexperiencerelevanttoprofessionalpoliceworkincluding
experienceofworkinCentralPoliceOrganizations
(c) cleanrecordofserviceintermsofindictmentoftheofficerinanycriminal
ordisciplinaryproceedingoronthegroundsofcorruptionormoral
turpitudeand
(d) dueweightagebeingassignedtoawardofmedalsforGallantry,
DistinguishedandMeritoriousservices:
ProvidedthatwheretheCommitteefindsthatnosuitableIndianPolice
ServiceOfficerisavailableintheStateCadreitshallmakeitsassessment
with regard to Indian Police Service officers of other States Cadres, in
accordancewiththeprovisotosubsection(1).
(3) TheDirectorGeneralofPoliceshallhaveaminimumtenureoftwoyears
subjecttohisnormaldateofsuperannuation:
ProvidedthattheDirectorGeneralofPolicemayberemovedfromthe
postbefore theexpiryofhistenurebytheStateGovernmentthrougha
writtenorderspecifyingreasonsconsequentupon:
(a) framingofchargesinacriminalcasebyacourtoflawor
(b) issueofchargesheetundertheprovisionofAllIndiaServices(Discipline
andAppeal)Rulesoranyotherrelevantrulesor
(c) suspensionfromservice:or
(d) incapacitationbyphysicalormentalillnessorotherwisebecoming
unabletodischargehisfunctionsasDirectorGeneralofPoliceor
(e) administrativeexigencies,inlargerpublicinterestor
(f) promotiontoahigherpostundereithertheStateortheCentral
Government:

ProvidedfurtherthattheofficermaybeallowedbytheStateGovernment
torelinquishchargeoftheposton:(i)appointmenttoapostundertheCentral
GovernmentoranInternationalOrganizationsubjecttosuchofficerhaving
givenhisconsenttosuchapostingor(ii)resignationorvoluntaryretirement
fromservice.

CreationofPolice 7. TheStateGovernment,inconsultationwiththeDirectorGeneralofPolice,
RangesandPoliceZones may,ifrequiredinpublicinterest,bynotificationdividetheentiregeographical
areaoftheStateintooneormorePoliceRanges,andtwoormorePolice
RangesintoPoliceZones.EachRangeshallbeheadedbyanofficerofthe
rankofDeputyInspectorGeneralofPolicewhoshallsupervisethePolice
administrationoftheRangeandreportdirectlytotheInspectorGeneralof
PoliceinchargeofLawandOrder,oroncreationofPoliceZones,tothe
InspectorGeneralofPoliceinchargeoftheZonecomprisinghisRange,who
shallsupervisethePoliceadministrationoverallRangesunderhimandreport
totheDirectorGeneralofPolicethroughtheAdditionalDirectorGeneralof
Police,LawandOrder,ifappointed.
PoliceDistricts 8. TheStateGovernment,inconsultationwiththeDirectorGeneralofPolice,
maybynotificationdeclareanyareawithinthestatetobeaPoliceDistrict.
Theadministrationofthe Policethroughout such district shallvestin the
Superintendent of Police who may be assisted by as many Additional,
AssistantorDeputySuperintendentsofPolice,asdeemednecessaryand
arenotified.
DistrictlevelSpecial 9. (1) For thepurposeofdealingwithaparticularcategoryofcrimeorproviding
Cells,SubDivisions betterservicetothecommunityatlargeincludingvictimsofcrime,the
StateGovernmentmay,inconsultationwiththeDirectorGeneralofPolice
andbynotification,createoneormoreSpecialCellsineachPoliceDistrict
tobeheadedbyanofficeroftherankofAssistant/DeputySuperintendent
ofPolice.
(2) TheStateGovernmentmay,bynotification,divideeachPoliceDistrictinto
asmanySubDivisionsasdeemednecessary,tobeheadedbyanofficer
oftherankofAssistant/DeputySuperintendentofPolice.
PoliceStations 10. (1) TheStateGovernmentmay,inconsultationwiththeDirectorGeneralof
Policeandbynotification,createasmanyPoliceStationswithasmany
OutpostsasnecessaryinaPoliceDistrict,dulykeepinginviewthepopulation,
thearea,thecrimesituation,theworkloadintermsoflawandorder,andthe
distancestobetraversedbytheinhabitantstoreachthePoliceStations.
(2) APoliceStationshallbeheadedbyaStationHouseOfficernotbelowthe
rankofSubInspectorofPolice.
(3) TheStateGovernmentshallensureavailabilityofadequatestrengthofstaff
ateachPoliceStation,dulybasedonthepopulation,incidenceofcrime,
lawandorderrelatedworkload,andthegeographicalarea.
(4) TheStateGovernmentshallprovide,asearlyaspossible,eachPolice
Stationwithallessentialamenitiesincludingareceptioncumvisitorsroom,
separatetoiletsformenandwomen,andtodealwiththetasksrelatingto
administrationofspeciallegislationsrelatingtowomenandchildren.
(5) EachPoliceStationshallhaveaWomanandChildProtectionDesk,staffed
asfaraspossiblebywomenPolicepersonnel,torecordcomplaintsof
crimesagainstwomenandchildrenandtodealwiththetasksrelatingto
administrationofspeciallegislationsrelatingtowomenandchildren.
(6) EachPoliceStationshallprominentlydisplayalltherelevantinformation
requiredtobemadepublic,includingtheSupremeCourtguidelinesand
directions,asalsodepartmentalordersonarrests,andthedetailsregarding
thepersonsarrestedandheldinlockups.
(7) EachPoliceStationshallmaintainageneraldiaryinsuchformastheState
Governmentmayprescribe,whereinshallberecordedallthecomplaints
andchargesreceived,actiontakenthereon,namesandparticularsofpersons

arrested,theoffenceschargedagainstthemandthepropertytakenfromtheir
possession.
Termofofficeofkey 11. An officer posted as Station House Officer in a Police Station or as
Policefunctionaries SuperintendentofPoliceofaDistrictshallhaveaminimumtermoftwoyears:
Providedthatanysuchofficermayberemovedfromhispostbefore
theexpiryoftheminimumtenureoftwoyearsconsequentupon
(a) filingofchargesheetinacriminalcaseinaCourtoflawor
(b) issueofchargesheetformajorpenaltyundertherelevantdisciplinary
rulesor
(c) suspensionfromserviceinaccordancewiththeprovisionoftherelevant
disciplinaryrulesor
(d) reversiontoalowerpostforadministrativereasonsor
(e) incapacitationbyphysicalormentalillnessorotherwisebecoming
unabletodischargehisfunctionsanddutiesor
(f) administrativeexigencies,inlargerpublicinterest.
Coordinationinthe 12. (1) DistrictMagistrateswithintheirjurisdictionshallfunctionasnodaland
mattersofoverriding coordinatingauthoritiesonbehalfoftheStateGovernmentandprovide
publicimportance leadershipinthetimeofcrisislikelytoaffectthepublicpeace.
(2) Inorderthatthesefunctionariesareabletodischargethesefunctions
effectivelyinmattersofoverridingpublicimportance,theDistrict
SuperintendentofPoliceshallkeeptheDistrictMagistratefullyinformedon
allthemattersinthedistrictrelatingtothestateoflawandorderandpotential
fordisturbanceofthepublicpeaceandshallpromptlyconsulthimonall
mattersofoverridingpublicimportancerelatingtothePolice.
(3) TheSubDivisionalPoliceOfficershallkeeptheSubDivisionalMagistrate
ortheExecutiveMagistrate,asthecasemaybe,fullyinformedonallthe
mattersintheSubDivisionorotherlocaljurisdictionrelatingtothestateof
lawandorderandpotentialfordisturbanceofthepublicpeaceandshall
promptlyconsulthimonallmattersofoverridingpublicimportancerelating
tothePolice.
GeneralAdministration 13. (1) Forthepurposeofefficiencyinthegeneraladministrationofthedistrict,
itshallbelawfulfortheDistrictMagistrate,inadditiontotheprovisionsof
theCodeofCriminalsProcedure,1973andotherrelevantActsforthetime
beinginforce,toissuedirectionstothePoliceoftheDistrictinrespectof
themattersrelatingtothefollowing:
(a) thepromotionoflandreformsandthesettlementoflanddisputes
includingremovalofencroachmentsonGovernmentland,commonlands
andforestlands
(b) mattersrelatedtotheprojectsofStatelevelimportanceparticularlyin
relationtopower,industryandtourism
(c) extensivedisturbanceofthepublicpeaceandtranquilityinthedistrict
(d) theconductofelectionstoanypublicbodyorholdingofanyfunctionor
eventofpublicimportance
(e) thehandlingofnaturalormanmadedisastersormajoraccidentsand
rehabilitationofthepersonsaffectedthereby
(f) situationsarisingoutofanyexternalaggression,threattointernal
security,riot,industrialorotherstrikeetc

(g) matterrelatedtoprotectionofwomen,weakersectionsandminorities
(h) removalofanypersistentpublicgrievance
(i) anymatternotwithinthepurviewofanyonedepartmentandaffecting
thegeneralwelfareofthepeopleofthedistrict,orarisingoutofajudicial
pronouncement,necessitatingtheDistrictMagistratetousetheservices
ofthePoliceand
(j) suchothermattersastheStateGovernmentmayassignfromtimeto
timeinpublicinterest.
(2) ItshallbelawfulfortheDistrictMagistratetocallforinformationorassistance
ofageneralorspecialnaturefromthePolicewithrespecttothematters
specifiedinsubsection(1),andtheSuperintendentofPoliceshallfurnish
suchinformationandallnecessaryassistancetotheDistrictMagistratefor
thepurpose.
(3) SuperintendentofPolicemay,inordertoprovidePoliceserviceinrespect
ofmattersspecifiedundersubsection(1),referamattertotheDistrict
Magistratetoissuedirectionstoalloranyofthedepartmentsinthedistrict
tofacilitatesuchassistanceasmaybenecessary,andtheDistrictMagistrate
mayissueappropriatedirections,whichshallbecompliedwithbythedistrict
headofthedepartmentconcernedwithoutdemurordelay.
StateIntelligenceand 14. (1) TheStatePoliceServiceshallhaveaStateIntelligenceDepartment
CriminalInvestigation forcollection,collation,analysisanddisseminationofintelligence,anda
Departments CriminalInvestigationDepartmentforinvestigatinginterstate,interdistrict
crimesandotherspecifiedoffences,inaccordancewiththeprovisionsof
this Act.
(2) TheStateGovernmentshallappointaPoliceofficeroforabovetherankof
DeputyInspectorGeneralofPolicetoheadeachoftheaforesaid
departments.
(3) TheCriminalInvestigationDepartmentshallhavespecializedwingstodeal
withdifferenttypesofcrimerequiringfocusedattentionorspecialexpertise
forinvestigation.Eachormorethanoneofthesewingsshallbeheadedby
anofficernotbelowtherankofSuperintendentofPolice.
(4) TheStateIntelligenceDepartmentshallhavespecializedwingstodealwith
andcoordinatespecializedtaskssuchasmeasuresforcounterterrorism,
countermilitancyandVIPSecurity.
(5) TheStateGovernmentshallappointappropriatenumberofofficersfrom
differentrankstoserveintheCriminalInvestigationDepartmentandthe
StateIntelligenceDepartment,asdeemedappropriatewithdueregardto
thevolumeandvarietyoftaskstobehandled.
Technicaland 15. (1) TheStateGovernmentshallcreateandmaintainsuchancillarytechnical
SupportServices agenciesandservices,undertheoverallcontroloftheDirectorGeneralof
Police,asconsiderednecessaryorexpedientforpromotingefficiencyof
thePoliceService.
(2) TheservicessocreatedshallincludeafullfledgedForensicScience
LaboratoryattheStatelevelandasmanynumberofMobileForensicScience
Unitsasnecessarywithappropriateequipmentandscientificmanpower,in
keepingwiththeguidelineslaiddownbytheDirectorateofForensicScience
ortheBureauofPoliceResearchandDevelopmentoftheGovernmentof
India.

(3) TheStateGovernmentshallappointanofficernotbelowtherankof
SuperintendentofPoliceasinchargeofPoliceTelecommunications,and
asmanyAdditionalSuperintendentsofPoliceandDeputySuperintendents
ofPoliceasdeemednecessarytoassisthim.
(4) TheStateGovernmentshallsimilarlyappointanofficernotbelowtherank
ofSuperintendentofPoliceasinchargeofPoliceTransport,whichmaybe
locatedundertheStateReserveLines,andasmanyAdditional
SuperintendentsofPoliceandDeputySuperintendentsofPoliceasdeemed
necessarytoassisthim.
(5) TheStateGovernmentshallensureregularmaintenanceofalltheneeded
equipmentandregularreplenishmentofconsumablesforthePolice
TelecommunicationsandthePoliceTransportService.
(6) TheStateGovernmentshallalsoframerecruitmentandpromotionrules
specifyinginteraliathetechnicalqualificationsandexperiencerequiredto
manpostsuptoacertainlevelinthesaidtwoestablishments.
(7) Incaseservicesofothertechnicalexpertsorspecialistsarenecessaryfor
theinvestigationofacaseorenquiry,orhandlingofaseriouslaw&order
situation,theStateGovernmentmaytemporarilyappointorplacetheservices
ofsuchexpertorspecialistatthedisposaloftheconcerneddepartmentor
branchheadofthePoliceforaperiodasmaybedeemedappropriate.
(8) RespectiveinchargeofFireServicesintheStateanddistrictsshallprovide
allnecessaryassistancetothePoliceasmayberequiredbytheDirector
GeneralofPolice,InspectorGeneralofPolice(LawandOrder),Deputy
InspectorGeneralofPolice(Range),DistrictMagistrateandDistrict
SuperintendentofPoliceforthehandlingofLawandOrderoranyother
emergencysituation.
PoliceTrainingCentre 16. (1) TheStateGovernmentshallestablishafullfledgedPoliceTraining
Centreforensuringefficientpostinductiontrainingofalldirectlyrecruited
PolicepersonneluptotherankofSubinspector,prepromotionstraining
forallthosepromotedtohigherlevelsandsuchthematicandspecialized
inservicetrainingcoursesforPoliceofficersofdifferentranksandcategories
asdeemednecessaryfromtimetotime.
(2) TheStateGovernmentshallappointanofficernotbelowtherankof
SuperintendentofPoliceasthePrincipalofthePoliceTrainingCentre.
(3) TheStateGovernmentshallalsoappointappropriatenumberofofficers
fromthePoliceServiceinthePoliceTrainingCentrewhomaybegiven
additionalmonetaryandotherincentivessothatthebestavailabletalentin
thePoliceServiceisattractedandretainedinthefacultyoftheCentre.
(4) TheStateshallalsoensurethatpersonswithacademicaccomplishments
inthefieldsofLaw,Sociology,Psychology,Criminology,ForensicScience
andotheracademicsubjectsrelevanttoPoliceprofessionregularlyvisit
thePoliceTrainingCentreforimpartingknowledgetothetraineesintheir
respectivefields,andforwhichtheymaybepaidsuitableremuneration.

Oathoraffirmationby 18. EverymemberofthePoliceServiceenrolledunderthisActshallon


Police Officers appointmentandcompletionoftraining, makeandsubscribebeforeanofficer
appointedinthatbehalfbytheDirectorGeneralofPoliceanoathor
affirmation,insuchformasmaybeprescribed.
Certificateof 19. (1) EveryPoliceofficershallonappointmentreceiveaninsigniaandacertificate
appointment
intheformasmaybeprescribed.Thecertificateinrespectofofficers
belowtherankofInspectorofPoliceshallbeissuedunderthesealofthe
DirectorGeneralofPoliceorsuchofficerasheshallappoint,byvirtueof
whichthepersonholdingsuchcertificateshallbevestedwiththepowers,
functionsandprivilegesofaPolice Officer.

(2) Thecertificateofappointmentshallbecomenullandvoid,andtheinsignia
shallbedeemedtobewithdrawn,wheneverthepersonnamedthereinceases

(3) APoliceofficershallnot,byreasonofbeingsuspendedfromoffice,cease
tobeaPolice Officer.Duringthetermofsuchsuspensionthepowers,
functionsandprivilegesvestedinhimasaPolice Officershallbeinabeyance,
butheshallcontinuetobesubjecttothesameresponsibilities,discipline
andpenaltiesandtothesameauthoritiesasifhehadnotbeensuspended.

Uniformandbadges 20. (1) TheStateGovernmentshall,bygeneralorspecialordernotifiedinthe


orrank OfficialGazette,prescribetheuniformforthevariousranksinthePolice,
thescale,monetarygrantsforpurchaseandmaintenanceandtheprotocol
withrespecttodutiesandthewearingoftheuniform.
(2) TheStateGovernmentshall,bygeneralorspecialordernotifiedintheOfficial
Gazette,prescribethebadgesofrankandotherdistinctivebadgesthat
maybewornwiththeuniform.

(3) TheDirectorGeneralofPolice,subjecttosuchordersoftheGovernment,
mayissuegeneralstandingordersinthisregard.

SpecialPoliceOfficers 21. (1) When thePoliceforceordinarilyemployedinanyareaisnotsufficientto


dealwithasituationthreateningpeaceandsecurity,theSuperintendentof
Policeoranyofficer,speciallyempoweredinthisbehalfbytheState
Government,inchargeofthatareamay,atanytimebyawrittenorder
issuedunderthehandandsealofsuchofficer,appointforaperiodas
specifiedintheappointmentorder,anyablebodiedandwillingpersonbetween
theageof18and40years,whomheconsidersfit,tobeaSpecialPolice
OfficertoassistthePoliceService.
(2) EverySpecialPoliceOfficersoappointedshall

(i) onappointment,undergotheprescribedtrainingandthereafterreceive
acertificateinaformapprovedbytheStateGovernmentinthisbehalf

(ii) havethesamepowers,privilegesandprotectionandbeliabletoperform
thesamedutiesandresponsibilitiesandbesubjecttothesameauthorities
asanordinaryPolice Officer.
AdditionalPolice 22. (1) SubjecttothegeneralorspecialdirectionsoftheStateGovernment,the
Officers SuperintendentofPolicemay,inconsultationwiththeDistrictMagistrate,
appointordeputeadditionalPoliceofficerscomprisingofsuchranksor
gradesforthepurposeprescribedbytheStateGovernmentforsuchtime
andonsuchpayastheauthorityprescribedinthatbehalfmaydetermine.
(2) EveryAdditionalPoliceOfficeruponsuchappointmentshall

(i) receiveacertificateinaformapprovedbytheStateGovernmentinthis
behalf

(ii) bevestedwithallorsuchofthepowers,privileges,dutiesand
immunitiesofaPoliceofficerasarespeciallymentionedinthe
certificateand

(iii) besubjecttotheordersoftheSuperintendentofPolice.

(3) ThedeploymentordeputationofsuchAdditionalPoliceOfficermaybe
madeattherequestofanypersonrequiringsuchPolice,andthecostof
suchdeploymentshallberecoveredbytheDistrictMagistrateinsuchmanner
providedinsections421and422oftheCodeofCriminalProcedure,1973
forrecoveryoffines,orbyanyotherlawforthetimebeinginforce,orby
suitinanycompetentCourt.

CHAPTERIII

TheCivilPolice

Recruitment 23. (1) The CivilPoliceshallcompriseofallpersonnelofSikkimPoliceotherthan


ArmedPolice,andthestrengthofthevariouscadres,theCriminal
InvestigationDepartment,StateIntelligenceDepartmentandbranches
oftheCivilPoliceshallbeasprescribedbytheStateGovernmentfrom
timetotime.
(2) RecruitmenttotheCivilPoliceshallbeinaccordancewiththeRulesnotified
bytheStateGovernment.TheDirectorGeneralofPolice,subjecttothe
provisionofthisAct,shallcauseanannualrecruitmenttobeconductedto
allGroupCvacanciesintheCivilPolicerequiredtobefilledbydirect
recruitment:
Providedthatthequotafordirectrecruitment,inrankstowhich
directrecruitmentisconducted,shallbesofixedbythe StateGovernment
astoprovideafairbalancebetweenthedifferentranksandprospectsfor
promotiontoeligibleandmeritoriousofficersateachlevel.
(3) EveryCivilPoliceofficeroninitialrecruitmentshallundergoinductiontraining
atthePoliceTrainingCentre.Theperiodandsyllabusoftrainingshallbeas
maybeprescribed,whichmayberevisedfromtimetotimeonthe
recommendationsoftheDirectorGeneralofPolicesubjecttothegeneral
directionsoftheStatePoliceBoard.
Scaleofarms 24. ThearmamentoftheCivilPoliceshallbefixedwiththeapprovaloftheState
andammunition Government.Distributionofarmstodistrictswillbefixedontheorderofthe
DirectorGeneralofPolice,whobymeansofStandingOrdersshalllaydown
theprocedurestobefollowedforcustodyandcareofarms,ammunition,
stockofmaterialforrepairandmaintenance,orthemannerinwhichdamaged
andunserviceableweaponsaretobedisposedoff,andprocedureincaseof
lossofanyweaponorammunition.

ServiceConditions 25. (1) TheDirectorGeneralofPolicewiththeapprovaloftheStateGovernment


ofPrimaryRanksofthe shallevolveandlaydownapropersenioritycummeritcriterionforpromotion
CivilPolice throughatransparentprocess,fordifferentranks.
(2) ThepromotionofCivilPoliceofficersshouldbelinkedwithscreening
examinations andtraining, soasto ensurehigherlevelsofprofessional
competenceandaccountability.
(3) InordertoprovideafasttrackforcareerprogressiontoPoliceofficers,at
least50percentofdirectrecruitmentpostsshallbeearmarkedforbeing
filledupthroughpromotiononthebasisofsenioritycummeritasperthe
laiddowncriteria.
(4) TheGovernmentshallendeavortointroduceashiftsystemintheCivil
Policetoensureproperworkinghoursconsistentwithefficiencyin
performance.
(5) TheDirectorGeneralofPolice,withtheapprovaloftheStateGovernment,
shalltrytooutsourceasmanynoncorePolicefunctionsaspracticable,to
enablePolice OfficerstoconcentrateoncorePolicefunctions.
Controland 26. (1) (a) TheStationHouseOfficershallassignworkandcontrolandsupervise
Supervision thefunctioningofthestaffofthePoliceStationandPolicePostsinhis
charge

(b) TheSubDivisionalPoliceOfficershallgenerallycontrolandsupervise
thePoliceStationsunderhischarge,andissuesuchdirectionsasmay

supervisetheworkoftheSubDivisionalPoliceOfficersandPolice
StationsandPolicePostsinthedistrictandissuesuchdirectionsas
maybenecessarytobetterachievetheobjectsofthisAct.

(d) TheRangeDeputyInspectorGeneralofPoliceandtheInspectorGeneral
ofPolice,LawandOrdershallgenerallycontrolandsupervisethework
ofthedistrictsandtheRangetobetterachievetheobjectsoftheAct.

(e) ForotherCivilPoliceunitstheDirectorGeneralofPolicemay,byspecial
standingorder,prescribethecontrollingandsupervisoryauthorities.
(2) SubjecttoprovisionsofthisActandanyrulesmadethereunderthe
DirectorGeneralofPolicebygeneralorspecialstandingordersmay
prescribefromtimetotimethefunctionsthatneedtobepreformedby
thevariousranksofCivilPoliceinrelationtoeachdutyandresponsibility.
(3) SubjecttogeneralorspecialstandingordersoftheDirectorGeneralof
Police,thecontrollingandsupervisingofficerofthePoliceStation,Police
SubDivision,PoliceDistrictorotherCivilPoliceunitmay,bymeansofan
ordercommunicatedinwriting,prescribethefunctionstobeperformedby
variousranksoftheCivilPoliceunderhiscontrol,whohavebeenassigned
anyspecificdutyorresponsibility.
(4) Forthebettermanagementofspecializeddutiesandfortheprofessional
developmentofthemembersoftheCivilPolice,theStateGovernment
mayconstitutecadresorsubcadreswithintheGroupCpostsandinthe
StatePoliceService.
ConductandDiscipline 27. (1) Every CivilPoliceOfficershallperformtothebestofhisability,the
functionsrequiredfromhiminrelationtoanydutyorresponsibilityassigned
tohim,subjecttotheprovisionsofthisAct,rulesmadethereunderand
thegeneralorspecialstandingordersoftheDirectorGeneralofPolice.

(2) Anynonperformanceordeficiencyinthestandardofperformanceshall
makethePoliceofficerliablefordisciplinaryactioninaccordancewiththe
conductanddisciplinaryrulesprescribedbytheStateGovernmentforthe
purpose.
MountedPolice 28. (1) TheremaybeprovidedfortheState,suchnumberofMountedPoliceas
maybedeterminedbytheStateGovernmentfromtimetotime,forthe
purposeofpatrols,crowdcontrolandaccesstodifficultareas.

(2) TheDirectorGeneralofPoliceshallissuestandingorderswithregardto
procurement,management,maintenanceandtrainingoftheMountedPolice.

CHAPTER IV
ArmedPoliceUnits

StateArmedPolice 29. To assisttheCivilPolicepromptlyandefficientlyindealingwithgroupprotests


BattalionsandDistrict andviolentdisturbancesinvolvingbreachesofpeaceorlawandorder,andin
ArmedReserves disastermanagementfunctions,aswellastodischargesuchdutiesthatrequire
thepresenceofarmedpolice,theStateGovernmentshallcreateappropriate
numberofArmedPoliceBattalionsfortheState,includingprovisionofwomen
units,ofwhichappropriatemanpowerstrengthsmaybedeployedinthePolice
Districtsdependingupontherequirement.

Roleand 30. (1) TheArmedPoliceBattalionswillbeaStatelevelreserve,tobedeployed


functions underspecificordersoftheDirectorGeneralofPolicetoaidandassistthe
CivilPoliceindealingwithvirulentandwidespreadproblemsofpublicdisorder
orotherformsofviolence,needingdeploymentofArmedPolicebeyondthe
resourcesoftheDistrictPoliceorsuchotherdutiesasmaybeproscribed.

(2) UnitsoftheDistrictArmedReserve,oncedeployedinthedistricts,will
functionunderthecontrol,directionandsupervisionoftheDistrict
SuperintendentofPolice,andshallbethearmedwingoftheDistrictPolice
todealwithanemergentlawandorderproblemorsuchotherdutiesasmay
beprescribed.UnitsoftheArmedPoliceBattaliondeployedforimportant
securityfunctionsshallalsobesubjecttosupervisionoftheheadofthe
StateIntelligenceDepartment(andtheofficerdesignatedasinchargeof
Security)whomayissueappropriateorderstotheunitsthroughtheDeputy
InspectorGeneralofPolice,ArmedPoliceortheCommandantoftheArmed
PoliceBattalionfortheirnecessaryaction.
Organizational .31. (1) ACommandant,equivalentinranktoSuperintendentofPolice,shall
structureofthe headeachArmedPoliceBattalion.TheCommandantshallbeassisted
ArmedPolice byaDeputyCommandant,equivalentinranktoAdditionalSuperintendent
Battalionsetup ofPolice,whowillalsobetheSecondinCommandoftheBattalion.
EachBattalionshallbedividedintoappropriatenumberofService
CompaniesandaHeadquartersCompany,eachofwhichwillbe headed
byanAssistantCommandant,equivalentinranktoDeputySuperintendent
ofPolice.

(2) TheArmedPoliceBattalionssetupofthe Stateshallbeheadedbyan


officeroforabovetherankofDeputyInspectorGeneralofPolice,
dependingonthenumberofBattalionsintheState,whoshallbe
responsiblefortheadministration,training,operations,preparedness
andwelfareofpersonnelofalltheArmedPoliceunitsintheState,
undertheoverallguidanceandsupervisionoftheDirectorGeneralof
Police.
(3) ThedutiesoftheheadoftheArmedPoliceBattalionssetup,theDeputy
InspectorGeneralofPoliceoraboverank,theCommandant,theDeputy
Commandants,theAssistantCommandants,InspectorsofPoliceand
otherranksoftheServiceandtheHeadquartersCompaniesshallbeas
maybeprescribedbytheStateGovernment,ortheDirectorGeneralof
PolicewiththeapprovaloftheStateGovernment,fromtimetotime.
Recruitment 32. (1) DirectrecruitmenttotheArmedPoliceBattalions,otherthaninthe
ministerialandtechnicalcadres,shallbelimitedtotherankofConstable
only,andshouldasfaraspossiblereflectadequaterepresentationofall

sectionsofsociety.SubInspectorandaboverankintheArmedPolice
shallformacommoncadrewiththeCivilPolice.
(2) Theeducationalqualifications,agelimitandprocedureforrecruitmentto
therankofConstableshallbeasmaybeprescribed,andtherecruitment
shallbedonebyaPoliceRecruitmentCommittee.Subjecttotheprovisions
ofthisAct,theDirectorGeneralofPoliceshallcauseanannualrecruitment
tobeconductedtofillallvacanciesintheBattalionsrequiredtothefilled
bydirectrecruitment.
Training 33. (1) Besides theinitialtrainingofrecruitsatthePoliceTraining Centreorthe
StateArmedPoliceHeadquartersasmaybedeterminedbytheState
Government,itshallalsobeensuredthatallranksintheseunitsundergo
anannualrefreshertrainingprogrammeby rotation,overandabove
specializedtrainingindifferentskillsasneededbydifferentcategories.To
achievethis,eachBattalionwillhaveonefullcompanyearmarkedasthe
TrainingReservetoprovideforrotationaltrainingtoallpersonnel.
(2) Theannualrefreshertrainingcourseshallbemandatory,andordinarilythe
personnelundergoingsuchtrainingshallnotbewithdrawnfordeployment
onlawandorderoranyotherduty.
(3) Thecurriculafortheinitialaswellasannualrefreshertrainingcourses,
besidesphysicalskillsandfitness,shalllaydueemphasisontheknowledge
ofConstitutionalandlegalrightsofthecitizensaswellasskillsrelatingto
individualandcollectiveinteractionwiththepublic,withspecialemphasis
oncourteousandimpartialbehavior.
(4) Thecontentandmethodologyoftheannualrefreshertrainingcoursesas
wellastheotherspecializedcoursesforthepersonneloftheArmedPolice
Battalionsshallbereviewedandrevisedfromtimetotimebytheofficer
headingtheStateArmedPoliceBattalionsetup,inconsultationwiththe
TrainingWingoftheStatePolice,andundertheoverallguidanceofthe
DirectorGeneralofPolice.
Conductand Discipline 34. EveryArmedPoliceOfficerondutyshallensurethemaintenanceof
peaceandtranquilitytothebestofhisabilityandshall
(i) obeywithoutdelay,alllawfulordersofhisofficialsuperiors
(ii) notexercisehisdiscretiontousedisproportionateorexcessiveforce
(iii) notexercisehisdiscretiontorefrainfromusingappropriateforceto
maintainthepublicpeace,onextraneousconsiderationsorinpursuance
toordersorsuggestionsfromapersonotherthanhisofficialsuperior
(iv) notusehisposition,uniformorarmstointimidateanypersonother
thanwhenrequiredintheproperdischargeofhisduties.
Deployment 35. (1) ThedeploymentofunitsandsubunitsoftheStateArmedPoliceBattalions
shallberestrictedtoonlythosesituationswheresuchdeploymentis
consideredabsolutelynecessary.

(2) TheDistrictSuperintendentofPoliceshallcarefullyscrutinizeeachrequest
fordeploymentofDistrictArmedReservereceivedfromthefieldofficers.
Similarly,theDirectorGeneralofPoliceshallcloselyscrutinizeeachrequest
forthedeploymentofanyforcefromtheStateArmedPoliceBattalions
receivedfromanyDistrictSuperintendentofPolice,DeputyInspector
GeneralofPoliceofaRange,InspectorGeneralofPolice,LawandOrder
oranyotherfieldofficer,beforeorderingsuchdeployment.Thescrutinywill

includearealisticdeterminationofthequantumofforcerequiredasalso
thedurationforwhichthedeploymentisrequired.
(3) Thedeploymentshallbemadeforafixedperiod,asspecifiedintheorder,
andunlessthesameisextendedbyaspecificorder,theforceshallreturn
toitsheadquartersontheexpiryoftheinitialperiod.
(4) ItshallbethedutyoftheDistrictSuperintendentofPoliceandtheheadof
theArmedPoliceBattalionsetupinrespectoftheBattalionpersonnel,to
ensurethatthatpersonnelofthesearmedunitsaredeployedinamanner
thatensurestheirregularandconstantpreparednessfortheirtasks,as
alsoafairrotationofdutybetweenthevarioussubunitsoftheArmed
PoliceBattalionsattheStateHeadquartersandinthedistricts.
(5) Whileordering deploymentofanyarmedpolice unit,duecareshallalsobe
takentoensureasfaraspossible,thatthepersonnelareabletotakedue
rest andalsoavailaweeklyoff.
Armament 36. (1) ThearmamentoftheArmedPoliceshallbeasfixedwiththeapprovalof
theGovernmentandshallbeobtainedinthemannerprescribed.Distribution
ofarmstoBattalionandDistrictArmedReserveswillbefixedontheorder
oftheDirectorGeneralofPolice,whobymeansofStandingOrdershalllay
downtheproceduretobefollowedforcustodyandcareofarms,ammunition,
stockofmaterialfortherepairsandmaintenance,andthemannerinwhich
damagedandunserviceableweaponsaretobedisposedoff,andthe
procedureincaseoflossofanyweaponorammunition.

(2) Theadequacyofarms,equipment,mobility,communicationetc.foreach
BattalionaswellastheDistrictArmedReserveshallbeassessedregularly
onanannualbasisbytheofficerheadingtheStateArmedPoliceorganization
inconsultation withtheCommandantsandtheDistrictSuperintendentof
Policeconcerned.

SuperintendenceandAdministrationofPolice

Superintendenceof 37. (1) ItshallbetheresponsibilityoftheStateGovernmenttoensureanefficient,


StatePolicetovestin effective,responsiveandaccountablePoliceservicefortheentireState.
theStateGovernment Forthispurpose,thesuperintendenceofthePoliceservicethroughoutthe
StateshallvestinandbeexercisedbytheStateGovernmentinaccordance
withtheprovisionsofthisAct.

(2) TheStateGovernmentshallexerciseitssuperintendenceoverthePolice
serviceinsuchmannerandtosuchextentsoastopromotetheprofessional
efficiencyofthePoliceandtoensurethatthePoliceperformanceisatall
timesinaccordancewiththelaw.Forthispurpose,theStateGovernment
shalllaydownpoliciesandguidelines,settingstandardsforqualitypolicing,
facilitatetheirimplementationandensuringthatthePoliceforceperforms
itsdutiesinaprofessionalmannerwithfunctionalautonomy.
StrategicPolicing 38. (1) TheStateGovernmentshall
PlanandAnnual (a) onthebasisofareportoftheDirectorGeneralofPoliceinthisbehalf
PolicingPlan andinaccordancewiththerecommendationsoftheStatePoliceBoard
establishedunderthischapterfinalizeaStrategicPolicingPlanfora
fiveyearperiod(hereinafterreferredtoastheStrategicPlan)withAnnual
SubPlans(hereinafterreferredtoastheAnnualPlan)dulyidentifying
theobjectivesofpolicingsoughttobeachievedduringtheperiodand
settingoutanactionplanfortheirimplementation
(b) inmakinghisreporttheDirectorGeneralofPoliceshallbeguidedby
reportsofthespecializedandotherunitsofthePoliceandtheDistrict
SuperintendentsofPolicewho,inturn,shallformulatethesamein
consultationwiththecommunity
(c) placebeforetheStateLegislatureacopyofthisplanassoonasitis
finalized.SubsequentStrategicPlansshall,thereafter,belaidbefore
theStateLegislatureeveryfiveyears
(d) placebeforetheStateLegislatureatthebeginningofeachfinancial
year,aProgressReportontheimplementationoftheStrategicPlanas
wellastheAnnualPlanfortheprecedingyear.
(2) TheStrategicPlan,theAnnualPlanandtheProgressReportshallbemade
readilyaccessibletothepublic.
StatePolice 39. TheStateGovernmentshallestablishaStatePoliceBoardtofacilitatethelaying
Board downofpolicies,evaluateperformanceandensurethefunctionalautonomyof
StatePoliceServicesubjecttotheprovisionsoflaw.TheStatePoliceBoard
shallfunctioninthemannerprovidedinthisAct.The Boardshallmeetasoften
asdeemednecessary,butatleastonceinsixmonths.

Functionsofthe 46. (1) TheStatePoliceBoardshallperformthefollowingfunctionsnamely,
StatePoliceBoard
(a) framebroadpolicyguidelinesforpromotingefficient,effective,responsive
andaccountablepolicinginaccordancewiththelaw
(b) approvethefiveyearsStrategicPolicingPlanandAnnualPolicing SubPlan
(c) identifyperformanceindicatorstoevaluatethefunctioningofthePolice
Service.Theseindicatorsshall,interalia,includeoperationalefficiency,
publicsatisfaction,victimsatisfactionvisavisPoliceinvestigationand
response,accountability,optimumutilizationofresources,and
observanceofhumanrightsstandardsand
(d) reviewandevaluateorganizationalperformanceofthePoliceServicein
thestateasawholeaswellasdistrictwiseagainst(i)theAnnualPlan,
(ii) performanceindicatorsasidentifiedandlaiddown,and(iii)resources
availablewithandconstraintsofthepolice.
(2) Tillsuchtimeanappropriatelawismadeonthesubject,theStatePolice
BoardshallalsofunctionastheStateVigilanceCommissionandperform
thesamefunctionsinrespectoftheSikkimVigilancePoliceasareperformed
bytheStatePoliceBoardinrespectoftheStatePolice,withDirector
VigilanceactingastheMemberSecretary,whoshallbeanofficernotbelow
therankofInspectorGeneralofPolice.
Expensesofthe 47. (1) Nonofficialmemberswouldbeentitledtosuchremunerationorallowances
StatePoliceBoard asmaybenotifiedbytheStateGovernmentfromtimetotime.
(2) Theexpensesonaccountofremuneration,allowancesandtravelin
connectionwithofficialbusinessoftheStatePoliceBoard,inrespectofthe
IndependentMembersoftheBoardshallbebornebytheStateGovernment.
Transactionof 48. (1) NoticeformeetingsoftheBoardshallbeissuedbytheMemberSecretary
BusinessbytheBoard atleast15(fifteen)daysbeforeeachmeeting.Membersdesirousofraising
anitemfordiscussioninthemeetingshallsendnoticesoastoreachthe
MemberSecretaryatleast7(seven)daysinadvanceandtheitemshallbe
takenupwiththeapprovaloftheChairmanoftheBoard.
(2) AllmeetingsshallbeheldatGangtokunlesstheBoarddecidesotherwise.
ArecordofproceedingsoftheBoardshallbemaintainedbytheMember
Secretarywhoshallcausethemtobecirculatedwithin15(fifteen)daysof
eachmeeting.
(3) ThequorumforameetingoftheBoardshallbeonethirdofthefilledup
membersoftheBoard.Intheabsenceofquorum,themeetingshallbe
adjournedtothesametimeonthenextworkingday,andnoquorumshallbe
requiredforsuchadjournedmeeting.
(4) TheBoardmaydeviseitsownprocedurefortransactionofbusinessin
accordancewithprovisionsofthisAct.
Annual Reportofthe 49. (1) The Boardshall,withinthreemonthsaftertheendofeachfinancialyear,
State Police Board presenttotheStateGovernmentareportonitsworkduringthepreceding
yearaswellontheevaluationofperformanceofthePoliceService.

(2) TheStateGovernmentshallcausesuchAnnualReporttobelaidbefore
theearliestsessionoftheStateLegislaturefollowingitsreceiptfromthe
Board,alongwithanactiontakenreport.

AdministrationofPolice 50. (1) TheadministrationofthePolicethroughouttheStateshallvestinthe


DirectorGeneralofPoliceandinsuchAdditionalDirectorsGeneralof
Police,InspectorsGeneralofPolice,DeputyInspectorsGeneralof
Policeandotherofficers,asmaybeappointed.
(2) TheadministrationofPoliceinadistrictshallvestintheDistrict
Superintendentof Police.
(3) AdministrationmeansthemanagementofthePoliceservicesubjectto
law,rulesandregulationsandwillincludeframingofregulations,supervising
thefunctioningofthepoliceatalllevels,appointmenttosubordinateranks
ofthePoliceservice,deploymentofthePolicepersonnel,posting,transfer
andtherequisitedisciplinaryactionuptoandincludingtherankbelowthat
ofInspectorofPolice,andadvisingtheGovernmentontheplacementof
officersoftherankofAssistant/DeputySuperintendentofPoliceandabove:
ProvidedthattheStateGovernmentmayinterveneintheexerciseof
theadministrativepowersbytheDirectorGeneralofPoliceoranyother
authorizedofficer,onlyinaccordancewiththeprescribedrules,regulations
orinexceptionalcircumstancesinvolvingurgentpublicinterest,the
reasonsforwhichshouldberecordedinwriting.
Powersand 51. As HeadoftheStatePolice,itshallbetheresponsibilityoftheDirector
responsibilitiesofthe GeneralofPoliceto:
DirectorGeneral (i) advisetheGovernmentandtheStatePoliceBoardinallmattersof
ofPolice policing
(ii) implementthepolicies,theStrategicPolicingPlanandtheAnnual
PolicingSubPlanapprovedbytheStatePoliceBoard
(iii) administerandsupervisethepoliceservicetoensureitsefficiency,
effectiveness,responsivenessandaccountability
(iv) issuedirectionsirrespectiveofanygeneralexecutiveinstructionsto
thecontrarybutsubjecttotheprovisionsofthisActandtherules
madethereunder,forrecruitmentofconstabularyandGroupC
officerstofillinexistingandanticipatedvacanciesinaccordance
withthesanctionedstrength,asperprovisionsoftherecruitmentrules.

Police 52. (1) ThereshallbeaStatePoliceEstablishmentCommitteeheadedbythe


Establishment DirectorGeneralofPoliceandcomprisingtheheadsoftheIntelligence,
Committee CID,LawandOrderandoneotherofficernotbelowrankofInspectorGeneral
ofPolicenominatedbytheDirectorGeneralofPoliceintotheCommittee.
TheCommitteeshallberesponsiblefor:

(i) approvingallpostingandtransfersofofficersbelowtherankofDeputy
SuperintendentofPolicebetweenthevariouswingsofthePolice
organization,anddeputationoutsidetheorganizationwiththeapproval
oftheStateGovernment,andforinterdistricttransfersinallthewings:
Providedthatinrespectofanytransfertofromadistrictthe
committeeshalltakeintoaccounttherecommendationoftheconcerned
DistrictSuperintendentofPoliceandincasetherecommendationis
notacceptedthecommitteeshallrecorditsreasonsfornotaccepting
thesame
(ii) issueofgeneralpolicydirectionsandStandingOrderstothecommittees
constitutedformakingpostingsandtransferswithinaunitordistrictas
providedundersubsection(2)

(iii) hearinganddisposingofappealsagainsttransferordersissuedby
authoritiessubordinatetotheDirectorGeneralofPolice
(iv) recommendingproposalsfortransferofofficersoftherankofDeputy
SuperintendentofPoliceandabovetotheStateGovernmentsubjectto
provisionsofthisAct
(v) makingrecommendationstoStateGovernmentwithregardto
representationsinservicemattersfromofficersoftherankofDeputy
SuperintendentofPoliceandaboveanddealingwithallestablishment
mattersnotcoveredbyanyotherBoard.
(2) WiththepreviousconsentoftheStateGovernmenttheDirectorGeneralof
PolicemayconstituteaCommitteeforanyspecificunitwithinthePolice
organizationformakingpostingsandtransferswithinsuchunitoradistrict.
Procedureforpromotion 53. Promotion toeachrankinthePoliceServiceshallbebasedonseniority
of Police Officers cummerit,tobeevaluatedthroughtheresultofaqualifyingexamination
andperformanceevaluationinrespectofeachofficer.TheDirectorGeneral
ofPoliceshall,withtheapprovaloftheStateGovernment,framethe
evaluationcriteriaforeachrankandcategoryofPolicepersonnel:
ProvidedthatfortheofficersoftheIndianPoliceServicesuchevaluation
criteriashallbeasframedbytheGovernmentofIndia.
TrainingcumEducation 54. (1) TheStateGovernmentshalllaydownaTrainingcumEducationPolicy
Policyforthe Police coveringallranksandcategoriesofPolicepersonnel.ThisPolicyshall
ensurethatallPolicepersonnelareadequatelytrainedtoperformtheirjob
takingduecareofproperattitudinaldevelopment,andshallbelinkedto
careerdevelopmentschemeofpolicepersonnelindifferentranksand
categories.
(2) ThepolicyshallalsoaimtopromoteaservicecultureofPolicepersonnel
acquiringappropriateeducationalandprofessionalqualificationsasthey
advanceintheircareers.
FinancialManagement 55. (1) TheDirectorGeneralofPoliceshallberesponsibleforsubmittingthe
budgetaryrequirementsofthePoliceserviceasawholetotheState
Governmentsufficientlyinadvanceintheprecedingfinancialyear.
(2) Thebudgetaryrequirementsshallbeworkedoutonthebasisofrealistic
needsofeachbranch,wing,unitandsubunitofthepoliceservice,obtained
fromtheunitofficersconcerned.
(3) TheDistrictSuperintendentsofPoliceshalltakespecialcaretoensurethat
thefinancialrequirementsofeachPoliceStationintheDistrictsareworked
outmeticulouslyandadequatelyprojectedinthebudgetarydemandofthe
District.
(4) Thebudgetaryallocationmadebythelegislatureshallbeplacedatthe
disposaloftheDirectorGeneralofPolicewhoshallbevestedwithpowers
tospendtheamountsearmarkedundereachheadofthebudgetasperthe
financialrulesofthestateanddirectionsgivenbythestategovernment
fromtimetotime.
PoliceGazette 56. TheDirectorGeneralofPoliceshallcausetobepublishedeachquartera
PoliceGazettecontainingDepartmentalOrders,NotificationsandCirculars
relatingtothePoliceforcirculationwithinthePoliceorganization,andmay
publishappropriateportionsofthepublicationonthewebsiteofPolice
Department.

Socialresponsibilities 58. Everypoliceofficershall

(a) behavewiththemembersofthepublicwithduecourtesyanddecorum,
particularlysoindealingwithseniorcitizens,women,andchildren
(b) guideandassistmembersofthepublic,particularlyseniorcitizens,
women,children,thepoorandindigentandthephysicallyormentally
challengedindividualswhomayneedhelpandprotection
(c) provideallrequisiteassistancetovictimsofcrimeandofroadaccidents,
andinparticularensurethattheyaregivenpromptmedicalaidirrespective
ofmedicolegalformalities,andprovideallsuchinformationand
documentsaswouldfacilitatetheirortheirnextofkinscompensation
andotherlegalclaims
(d) ensurethatinallsituations,especiallyduringconflictbetween
communities,classes,castesandpoliticalgroups,theconductofthe
Policeisalwaysgovernedbytheprinciplesofimpartialityandhuman
rightsnorms,withspecialattentiontoprotectionofweakersections
includingminorities
(e) preventharassmentofwomenandchildreninpublicplacesandpublic
transport,includingstalking,makingobjectionablegestures,signs,
remarksorharassmentcausedinanyway
(f) renderallrequisiteassistancetothemembersofthepublic,particularly
women,children,andthepoorandindigentpersons,againstcriminal
exploitationbyanypersonororganizedgroupand
(g) arrangeforlegallypermissiblesustenanceandsheltertoeveryperson
incustodyandmakingknowntoallsuchpersonstheprevisionsoflegal
aidschemesavailablefromtheGovernmentandalsoinformthe
authoritiesconcernedinthisregard.
DutiesofthePolice 59. (1) TheprimarydutyfortheroleandfunctionsofthePoliceunderthis
Actshall,unlessspecifiedotherwise,bewiththePoliceoftheDistrict
concernedheadedbytheDistrictSuperintendentofPolice:

ProvidedthattheStateGovernmentmaybygeneralordercreateor
designatespecialunitsattheState,DistrictorPoliceStationlevelfor
investigation,traffic,Intelligence,LawandOrderetc.andinsuchacase
theresponsibilityforthedischargeofthefunctionshallbewithsuchUnit.
(2) ItshallbethedutyofeveryPoliceofficerpostedtoaStateUnitorthe
DistrictPoliceandanyunittherein,todischargetheroleandfunctions
assigned,tothebestofhisabilitybytheproperexerciseofthepowers
conferreduponhimunderthisActoranyotherlawforthetimebeingin
force.
(3) SubjecttothegeneralorspecificordersthatmaybemadebytheState
Governmentinthisbehalf,theDirectorGeneralofPoliceortheDistrict

SuperintendentofPolicemay,onbeingsatisfiedaboutthenecessityforso
doing,deputerequisitenumberofPolicepersonnelfortheprotectionofa
personorhispropertyorfortheorganizationofaneventorforexecutionof
anyworkauthorizedbyacompetentauthority,forsuchtimeasmaybedeemed
feasibleandproper:
ProvidedthatdeputationofPolicepersonnelforsuchpurposesmaybe
atthecostoftheapplicantortheprotecteeortheorganizersoftheevent
payableattheratesandinthemannerasmaybeprescribedbytheState
Government.
Dutiesin 60. (1) TheStateGovernmentmay,bynotificationintheOfficialGazette,declare
emergency anyspecifiedservicetobeanessentialservicetothecommunity,fora
situations specifiedperiod,whichmaybeextendedfromtimetotime,byanotification,
asmaybedeemednecessary.

(2) Uponadeclarationbeingmadeundersubsection(1)andsolongitremains
inforce,itshallbethedutyofeveryPolice Officertoobeylawfulordersof
hissuperiorofficersforthemaintenanceoftheessentialservice.
Seniorpoliceofficer 61. Asenior Police Officermayperformanydutyassignedbylaworbyalawful
performingdutiesof ordertoanyofficersubordinatetohim,andmayaid,supplement,supersede
subordinateofficer orpreventanyactionofthesubordinateofficerbyhisownactionorthatof
anypersonlawfullyactingunderhiscommandorauthority,wheneverthe
sameshallappearnecessaryorexpedientofgivingmorecompleteor
convenienteffecttothelaworforavoidinganyinfringementthereof.
Allpersonsboundto 62. Allpersons shallbeboundtocomplywiththereasonableandlawfuldirections
complywiththe givenbyaPolice OfficerinthedischargeofhisdutiesunderthisAct.Where
reasonabledirections anypersonresists,refusesorfailstocomplywithanysuchdirection,a
of Police Officer Policeofficermay,withoutprejudicetoanyotheractionhemaytakeunder
anyotherprovisionofthisActoranyotherlawforthetimebeinginforce,
removesuchpersonorarrestandproducehimbeforethenearestMagistrate
withinaperiodoftwentyfourhours.
Arrestand Detention 63. (1) APoliceofficereffectingarrestordetainingapersonarrestedinaccordance
withtheLawshall,
(i) wearaccurate,visibleandclearidentification,withnametags
(ii) prepareamemoofarrestatthetimeofarrestgivingthedateandtime
ofthearrest,andforthwithsendawrittencommunicationtohisimmediate
superior
(iii) informthepersonarrested,ofhisrighttohavesomeoneofhischoice
asanextfriend,notifiedofhisarrestordetentionassoonasheisput
underarrestorisdetained,andforthwithcausesuchapersontobe
notified
(iv) makeanentryinthediaryattheplaceofdetentionregardingthearrest
ofthepersonspecifyingthenameofthenextfriendofthepersonarrested
whohasbeeninformedofthearrestandthenamesandparticularsof
thePoliceOfficialsinwhosecustodythepersonarrestediskept
(v) arrangeforimmediatemedicalexaminationbyadoctordesignatedfor
thepurposeandforfurthermedicalexaminationevery48(fortyeight)
hoursduringhisdetentionincustody
(vi) sendcopiesofallthedocumentsincludingthememoofarrestreferred
toabove,totheMagistratehavingjurisdiction,forhisrecord

(vii) permitthepersonarrestedtomeethislawyerinsuchmannerasmay
beprescribed
(viii)causethenameandotherparticularofthepersonarrestedtobedisplayed
inthenoticeboardattheplaceofdetentionandatsuchotherplacesas

(ix) informthearrestedperson,ofhisrighttoengagealawyerandofthe
provisionsofLegalAidAuthorityforgettingfreelegalaid.
(2) Inmakinganarrestorkeepinganarrestedpersonincustody,onlythat amount of
forceshallbeusedasmaybereasonablyrequiredtoensurethatthereisno
possibilitytoescape.Handcuffingofapersonarrestedorinlawfulpolice
custodyshallberesortedtoonlywherethereisareasonableapprehension
thatsuchapersonmayturnviolent,attemptsuicide,escapeorbeforcibly
releasedfromarrestordetention.
Conductprohibited 64. (1) NoPolice Officershallwithdrawhimselffromdutiesofhisoffice
for Police Officers unlessexpresslyallowedtodobythecompetentauthority.
(2) NoPoliceofficershallresignhisofficeunlesshehasgivennoticein
writingtohissuperiorofficerofnotlessthanonemonth,andithasbeen
acceptedaspertherulesprescribedbytheStateGovernmentforits
employees.
(3) NoPoliceofficershallengageinactivityofanyotherofficeunless
expresslypermittedtodosoinwritingbytheDirectorGeneralofPolice
oranofficerauthorizedbyhim.

CHAPTER VII
PolicinginRuralAreasandVillage/TownPoliceSystem
PoliceStations 65. PoliceStationscoveringruralortownareasshallbesoorganizedastobe
coveringruralor reasonablyselfsufficientinmattersofaccommodation,amenitiesaswell
townareas asincommunicationfacilities,transportandPolicehousing.EachPolice
Stationwillalsobeequippedwithadequatefacilitiesofforensicscience
andscientificaidstoinvestigation.
SecurityofPolice 66. Specialattention shallbepaidtothesecurityofeachPoliceStation,
Stations particularlyinareaspronetoviolenceormassdisturbances.
PoliceBeat 67. ThejurisdictionalareaofaPoliceStationshallbedividedintosuitable
numberofBeats,eachcoveringaclusterofvillagesoraspecifiedtown
area,tobekeptunderthedirectchargeofaConstable,HeadConstableor
anAssistantSubInspector(calledBeatOfficer)formaintainingregularand
closecontactwiththevillagesunderhischarge.
BeatPoliceOfficer 68. TheStationHouseOfficershallensurethateveryvillageortownareain
hisjurisdictioniscoveredbyaBeatPoliceOfficeraspertheminimum
frequencyprescribedbytheSuperintendentofPolicebyageneralorspecial
order.
Dutiesand 69. ThedutiesandresponsibilitiesoftheBeatOfficershall,interalia,be
responsibilities
(a) toliaisewithcommunityelders,membersoftheCommunityLiaisonGroup,
ofBeatOfficer
ifany,theVillageDefenceParty,theVillageGuard,andtheresidentsof
eachvillageunderhischarge,andtoreview,duringeveryvisit,thecrime
preventionmeasuresinthevillage
(b) tocollectinformationrelatingtocrimesandcriminalsandactivitiesof
subversive,militantandantisocialnature,ifany,inthevillageand
communicatethesametotheStationHouseOfficer
(c) tomaintainwatchoverhistorysheetedcriminals,ifany,andotherswith
criminalrecordorbadcharacters
(d) toacquainthimselfwithlocaldisputeshavingpotentialforviolenceorwith
casteorcommunalovertones,andinformtheStationHouseOfficerofthe
samewithallavailabledetails
(e) tocarryoutanyotherpolicingtaskinrespectofthevillageassignedbythe
DistrictSuperintendentofPoliceorbyStationHouseOfficerthroughgeneral
orspecialorder.
(f) torecordanypublicgrievancesandcomplaintsinrelationtopolicingand
(g) tomaintainarecordofaforesaiddutiesandresponsibilitiescarriedoutby
himduringhisvisitandsubmitthesameregularlytotheofficerinchargeof
thePoliceStation.
VillagevisitbyStation 70. (1) TheStationHouseOfficershallvisiteveryvillageunderhisjurisdiction,
HouseOfficerand aspertheminimumfrequencyprescribedbytheSuperintendentofPolice
supervisoryofficer throughageneralorspecialorder,andshallinteractwithasmanylocal
residentsaspossiblesoastoassessthelevelofpublicsatisfactionwith
thepolice.
(2) AllsupervisoryofficersincludingtheSuperintendentsofPoliceshallregularly
visitasmanyvillagesintheirjurisdictionaspossible.Thepurposeofsuch
visitsshallbetoreviewthegeneralstateofcrime,thelawandordersituation
andtheactivities,ifany,ofviolentandmilitantindividualsorgroupsinthe

areaandtointeractwithasmanylocalresidentsaspossiblesoasto
assessthelevelofpublicsatisfactionwiththepolice.
(3) TheStationHouseOfficershallcausetobemaintainedaVillageRegister,
enteringthereinmajorcrimesincidentsorpotentialforcrimeinavillageor
townareabasedinteraliaonthereportoftheBeatOfficer,hisinformation

EnlistmentofVillage 71. TheStateGovernmentmaybynotificationprovidefortheestablishmentofa
GuardandSelection VillageGuardforavillageorclusterofvillagestobeenlistedbytheDistrict
Criteria SuperintendentofPolicefromamongstablebodiedpersonsofeithergender,
betweentheageof21and60yearsandwithunimpeachablecharacterand
antecedentswhoarepermanentresidentsofthatvillage,possessingtheability
toreadandwriteinthelocallanguage,whohavenotbeenconvictedbya
CourtoflaworhavenothadchargesframedagainstthembyaCourtoflawin
acriminalcase,ordismissed,removed,dischargedorcompulsorilyretired
fromanyemploymentongroundsofcorruption,moralturpitudeormisconduct,
andwhoarenotactivemembersofanypoliticalparty,ororganizationalliedto
apoliticalpartyoramilitantoutfit.
TenureofVillageGuard 72. ApersonenlistedasVillageGuardwillnormallyhaveatenureof threeyears,
whichmaybe renewedupon satisfactoryperformance. Norenewalshall,
howeverbegrantedtoapersonafterhecrossestheageofsixtyyearsorwho
hasservedforthreeconsecutivetermsorwhoincursanyotherconditionof
ineligibilityspecifiedintheforegoingsection.
RemovalofVillageGuard 73. AVillageGuardshallberemovedfromtheassignmentatanytimeduringthe
currencyofhisenlistmentifheincursanyconditionofineligibilitystipulated
inSection71.
VillageGuardtobe 74. TheVillageGuardshallbeapublicservantasdefinedintheIndianPenal
publicServant Code,1860.
TrainingofVillageGuard 75. TheSuperintendentofPoliceshallensurethateveryperson,onhisinduction
asaVillageGuard,isadministeredatrainingcourseofadurationandasper
thesyllabusprescribedbytheDirectorGeneralofPolice.Periodicalrefresher
trainingshallalsobeorganizedforthosewhoarereenlistedasVillageGuard,
foreachrenewedterm.
Oathor Affirmationby 76. EverypersonenlistedasVillageGuardshalltakeanoathoraffirmation,as
VillageGuard prescribedbeforetheStationHouseOfficerconcerned.

Honorariumand 77. EachVillageGuardwillbeprovidedwithanidentificationBadgeanda


identificationbadge reasonablemonthlyhonorariumanddueoutofpocketexpensesas
ofVillageGuard prescribedbytheDistrictSuperintendentofPolice.Thehonorariumsofixed
shallnotbelessthanthatpaidtoaHomeGuardintheState.
Returnof 78. AnypersonwhoforanyreasonceasestobeaVillageGuardshallforthwith
Identification deliveruptotheSuperintendentofPoliceortoanofficerauthorizedbyhim
Badgeetc.by hisIdentificationBadgeandallrecordsanddocumentsmaintainedbyhim
VillageGuard astheVillageGuard.
Dutiesand 79. ThedutiesandresponsibilitiesoftheVillageGuardshallinclude
Responsibilitiesof
VillageGuard (a) reportingtheoccurrenceofanycrimeorlawandordersituationinthe
village,attheearliest,tothePolice,andassistingthePoliceinbringingthe
offenderstobook

(b) maintainingageneralvigilinthevillagefromthepointofviewofcrime
preventionorpreventionofalawandorderproblemandpromptlyinforming
thePoliceaboutthesame
(c) remainingalertandsensitivetoanyinformationaboutanysuspiciousactivity,
movementofsuspiciouspersonsordevelopmentofanyconspiracyinthe
villagethatislikelytoleadtoacrimeorbreachoflawandorder,and
promptlypassingonsuchinformationtothePolice
(d) assistinganycitizeninarrestingorhandingovertothePoliceStationany
personorpersonsunder Section43oftheCodeofCriminal Procedure,
1973,alongwiththearms,ammunition,propertyoranyobjectionableor

Village/Town 80. Whereveritappears,onthebasisofinformationreceived,thatthereislikelihood
DefenceParties ofviolenceormajorcrimeordamagetopropertyinanyarea,theSuperintendent
ofPolice,inconsultationwiththeDistrictMagistrate,maydirectorganization
ofagroupoflocalrespectablepersonsforeachvillageorclusterofvillagesor
townforthepurposeofcarryingoutpreventivepatrolling,promotingcrime
reductionmeasuresandgenerallyassistingthePoliceintheirfunctioning.The
groupwillbecalledtheVillage/TownDefencePartyandmaynotnormally
consistofmorethan15members,withprovisionforhavingmorethanone
Village/TownDefencePartyifthesizeandpopulationofthevillageorcluster
ofvillagessorequire.ThecompositionofthePartyshallreflectthediversityof
localpopulationincludingadequategenderrepresentation.
Inductioninto 81. Members will be inducted into the Village/Town Defence Parties by the
Village/Town SuperintendentofPoliceinconsultationwiththeCommunityLiaisonGroup
DefenceParties fromamongstablebodiedpersons,andwithgoodcharacterandantecedents,
whoarepermanentresidentsofthatvillageortown,whohavenotbeenconvicted
byaCourtoflaworhavenothadchargesframedagainstthembyaCourtof
lawinacriminalcase,ordismissed,removed,dischargedorcompulsorily
retired from any employment on groundsof moralturpitude, corruptionor
misconduct, or are not connected with any political party or any allied
organizationthereof.TheSuperintendentofPoliceshallappointonemember
asleaderofthepartybasedonhisexperienceandleadershipqualities,and
may replace a member or the leader in case his work or conduct is not
satisfactory.
TenureofVillage/ 82. AVillage/TownDefencePartyshallbeorganizedforaperiodnotexceeding30
TownDefenceParties days.Providedthattheperiodmaybeextendedforafurtherperiodof30days
bytheSuperintendentofPoliceinconsultationwiththeDistrictMagistrate,for
reasonstoberecordedinwriting.

Actionagainst 83. In the event of any complaint against Village/Town Defence Party or its
MemberofVillage/ members,theSuperintendentofPolicewilltakeappropriateaction,including,
TownDefenceParties ifnecessary,removaloftheconcernedmembers.
Membershipto 84. MembershipoftheVillage/TownDefencePartyshallbevoluntaryandhonorary.
beVoluntary TheDistrictSuperintendentofPolicewillmakearrangementsforthetrainingof
themembersofVillage/TownDefenceParty,ifdeemednecessary.
IdentificationBadge 85. MembersoftheVillage/TownDefencePartyshallweartheidentificationbadge

maintainedbyhimasamemberoftheTownDefenceParty.
CommunityLiaison 87. TheDistrictSuperintendentofPoliceinconsultationwiththeDistrictMagistrate
Group shallconstituteaCommunityLiaisonGroupforeachPoliceStation,comprising
respectable local residents of thearea with unimpeachable character and
antecedents,includingretiredpublicservantsandheadsofteachinginstitutions
ifany,asrepresentativesofthecommunity,togenerallyadvisethePolicein
theirfunctioning.TheCommunityLiaisonGroupshallhaveafairrepresentation
ofgender,andallothersegmentsandprofessionsofthesocietyinvillages
fallinginthePoliceStationarea.TheCommunityLiaisonGroupshallhavetwo
representativesnominatedbyeachPanchayatSamitiinthejurisdictionofthe
concernedPoliceStationfromamongstitsmembers:
ProvidedthatnopersonconvictedbyaCourtoflaworagainstwhom
chargeshavebeenframedbyaCourtoflawinacriminalcase,ordismissed,
removed,dischargedorcompulsorilyretiredfromanyemploymentongrounds
ofcorruption,moralturpitudeormisconductshallbeeligibletobeinductedinto
theCommunityLiaisonGroup:
Providedfurther that nopersonwho isconnectedwithanypolitical
partyoranorganizationalliedtothepoliticalparty,otherthanthenominated
representativeofthePanchayatSamiti,shallbeeligibletobeinductedinto
theCommunityLiaisonGroup.
DutiesandFunctionsof 88. TheCommunityLiaisonGroupwillidentifytheexistingandemergingpolicing
CommunityLiaison needsofthearea,whichwillbetakenintoconsiderationbytheStationHouse
Group Officerwhilepreparingtheannualpolicingstrategyandactionplanforhis
jurisdiction for submission to the District Superintendent of Police. The
CommunityLiaisonGroupshallperformsuchotherfunctionsasprescribed.It
willmeetasfrequentlyasnecessary,andatleastonceineachquarterofa
year.ThemeetingsoftheCommunityLiaisonGroupshallbeattendedbythe
SubDivisionalMagistrateandSubDivisionalPolice Officeraswellasthe
StationHouseOfficer.Themeetingsshallbeopentothepublic.
PolicinginUrbanandotherNotifiedAreas
Policetobeassociated 89. Whileplanningforanymajordevelopmentactivityincludingdevelopmentof
inurbanplanning newcolonies,theconcernedagencyshallconsulttheDirectorGeneralofPolice
andsetting to assessthelikelyimpactoftheproposeddevelopmentalactivity,on the
upofnewcolonies safetyandsecurityneedsofthecitizensoranyotherpolicingrequirements,
andthesuggestionsbasedonsuchassessmentshallbegivendueconsideration
infinalizingtheplan.

Policinginthecontextof

InternalSecurityScheme 90. (1) TheDirectorGeneralofPoliceshall,withtheapprovaloftheState


Government,drawupanInternalSecuritySchemefortheentireStateas
wellasforeachofthedistrictsandmajorurbanareastodealwithproblems
ofPublicOrderandSecurityofState,asspecifictotheareaandshallplace
itbeforetheStatePoliceBoardforitsapproval.
ReviewofInternal (2) TheinternalSecuritySchemessoformulatedshallbereviewedandrevised
SecurityScheme asnecessaryonceintwoyears,andmorefrequentlyifrequired.

DistrictlevelInternal 91. DistrictlevelInternalSecurity Schemeshall bepreparedbythe District


SecurityScheme SuperintendentofPoliceandsenttotheDirectorGeneralofPolicealongwith
theendorsementandsuggestionsoftheDistrictMagistrate.
Schemetocover 92. (1) TheInternalSecuritySchemeswill,asfaraspossible,coverallmajor
backwardand problemstheareaispronetoorwhichcanotherwisebeanticipatedinthe
Inaccessibleareas wholeoranypartthereof.InpreparingtheSchemes,theDirectorGeneralof
Policeshallgivespecialattentiontolikelydisturbanceofpublicorderarising
outofnonimplementationofdevelopmentalprogrammesinthebackward
andnotsoeasilyaccessibleareas.
(2) TheSchemeswillprovidethatofficersdeployingthePolicetodealwith
situationsofconflictbetweencommunities,classes,castesandpolitical
groupsshallensurethatitscomposition,asfaraspossible,reflectssocial
diversityoftheareaincludingadequaterepresentationofweakersections
andminorities.
Securityofcritical 93. TheInternalSecuritySchemeshall,interalia,covertheroleofthePolicewith
infrastructuretobe regardtothesecurityofanyestablishmentorinstallationrelatingtocritical
coveredbythescheme infrastructureifanylocatedinthearea.
Schemetocoverspecific 94. (1) Anyorganization,whiletakingupanyactivityorprogrammewhichis
securityrequirement otherwiseunobjectionablebutmayhavethepotentialfordisturbinglawand
arisingoutofanyactivity ordermayinformthePolice,andthereupon,thePoliceshalltakesuch
orprogramme measuresasdeemednecessarytodealwiththesituation.
(2) WhilepreparingtheInternalSecuritySchemeunderSection90,thePolice
shalltakeintoconsiderationthecontingenciesofspeciallawandorder
problems,andsecurityrequirementsthatmayariseinsuchsituations.
Updatedstandard 95. The Internal Security Schemes will incorporate regularly updated and
operatingprocedure comprehensiveStandardOperatingProceduresfortheactiontobetakenby
tobeincorporatedinthe thePolice,independentlyorincoordinationwithotherconcernedagenciesin
Scheme theperiodpreceding,during,andintheaftermathofproblemsofeachkind.

CHAPTER IX
CriminalInvestigation
CrimeInvestigation 96. AreportofcommissionofacrimeshallbeenteredintherecordsofthePolice
Stationforthwithinaccordancewiththelawinsuchmannerandonsuchformat
asmaybeprescribedbytheGovernmentbyrulesorbytheDirectorGeneralof
PolicethroughStandingOrders.
Separatecrime 97. TheStateGovernmentshallinthePoliceStationsofsuchcrimeproneareas
investigationunit orurbanareasasitmayconsidernecessary,byorderseparatetheinvestigation
ofcrimefromlawandorderandotherPolicefunctionsbycreatingaSpecial
CrimeInvestigationUnit(CIU),headedbyanofficernotbelowtherankofSub
Inspector of Police, with appropriate strength of officers and staff, for the
investigationofeconomicandheinouscrimes.
Selectionofofficers 98. TheofficerspostedinCrimeInvestigationUnitswillbeselectedonthebasis
forCrimeInvestigation oftheiraptitude,competenceandintegrity.Theirprofessionalskillswillbe
Units upgraded, from time to time, through specialized training in investigative
techniques,particularlyintheapplicationofscientificaidstoinvestigationand
forensicsciencetechniques.
Tenureof 99. Officersposted toCrimeInvestigationUnitswillhaveareasonabletenure,and
officersin willberotatedtolawandorderandotherassignments.
CIU
Specific 100. (1) The officerspostedtotheCrimeInvestigationUnitswillinvestigate
offences crimessuchasmurder,kidnapping,rape,dacoity,robbery,dowryrelated
tobe offences,seriouscasesofcheating,misappropriationandothereconomic
Investigated offencesasnotifiedbytheDirectorGeneralofPolice,besidesanyother
byCrime casesspeciallyentrustedtotheUnitbytheDistrictSuperintendentofPolice.
Investigation (2) AllothercrimeswillbeinvestigatedbyotherPolice Officerspostedinsuch
Units PoliceStations.
Legalandforensic 101. Necessarylegalandforensicassistancewillbemadeavailabletoinvestigating
assistance officersduringvisittothesceneofcrimeandduringinvestigation.
Supervision 102. TheinvestigationofcasestakenupbytheCrimeInvestigationUnitpersonnel,
ofinvestigation overandabovethesupervisionoftheStationHouseOfficerconcerned,willbe
supervisedbyanofficernotbelowtherankofDeputySuperintendentofPolice,
whowillreportdirectlytotheDistrictSuperintendentofPolice.
Investigationsby 103. (1) TheCriminalInvestigationDepartment(CID)oftheStateshalltakeup
CriminalInvestigation investigationofoffencesofamoreseriousnatureorthosethatmayhave
Department interstateorinterdistrictramifications,andothercomplexcrimes,including
economiccrimesasnotifiedbytheStateGovernmentfromtimetotime
andasmaybespecificallyentrustedtoitbytheDirectorGeneralofPolice
inpublicinterest.
(2) TheDirectorGeneralofPolicemayentrusttheCriminalInvestigation
DepartmentwiththeinvestigationofanycaseregisteredwithanyPolice
StationintheStateincasespecialinvestigationisexpeditiouslyrequired,
oritisnecessarytodosotomaintainpubliccredibilityintheinvestigative
process.
Specializedunitsfor 104. The Criminal Investigation Department will have specialized units for
specificcrime investigation of cyber crime, organized crime, homicide cases, economic
offences,crimerelatingtowomen,andanyothercategoryofoffences,as
notifiedbytheStateGovernmentandwhichrequirespecializedinvestigative
skills.

Selectionof 105. TheofficerspostedtotheCriminalInvestigationDepartmentwillbeselected


officersforthe on the basis of their aptitude, professional competence, experience and
Criminal integrity. They will undergo appropriate training upon induction, and their
Investigation knowledgeandskillswillbeupgradedfromtimetotimethroughappropriate
Department refresherandspecializedcourses.
Legal 106. TheCriminalInvestigationDepartmentwillbeprovidedwithanappropriate
advisorsand numberoflawofficers,crimeanalysts,technicalexperts,specialistsetc.to
experts guide,adviseandassisttheinvestigatingofficersinthePoliceStationsorthe
CID.
Funds,powersand 107. TheCriminalInvestigationDepartmentshallbeprovidedwithadequate
facilitiesforscientific staff and funds. The head of this Department and the State Intelligence
investigation DepartmentwillbevestedwiththefinancialpowersandprivilegesofaHeadof
theDepartment.
ScientificAidsto 108. TheCriminalInvestigationDepartmentshallbeequippedwithadequatefacilities
Investigation ofscientificaidstoinvestigationandforensicscienceincludingqualifiedand
trainedmanpower,inaccordancewiththeguidelinesifanyissuedinthisregard
bytheDirectorateofForensicScienceortheBureauofPoliceResearchand
DevelopmentoftheGovernmentofIndia.
InvestigationManual 109. (1) TheheadoftheCriminalInvestigationDepartmentshallcausetobeprepared,
andCrimeReview within6(six)monthsfromthecommencementofthisAct,acomprehensive
InvestigationManualspecifyingdetailedoperatingproceduresfor
investigationofseriouscrimesandothercrimes,procedureforcollectionof
samplesforforensicanalysisbytheCIDandPoliceStationlevelCIUsand
investigatingofficers.TheManualalongwithrecommendationsoftheDirector
GeneralofPoliceshallbeplacedbeforetheStatePoliceBoardforits
approvalwithin9monthsofthecommencementofthisAct.
(2) TheCriminalInvestigationDepartmentshallpublishaperiodical
CriminalInvestigationGazette/CrimeReview,givinginformationregarding
crime,arrests,wantedpersons,warningsetc.,insuchformandwithsuch
contentastheDirectorGeneralofPolicemaydirectfromtimetotime.The
Gazetteshallbewidelycirculated,andpublishedonthewebsiteofthe
PoliceDepartment.

MaintenanceofCrime& 110. (1) TheStateCIDshallmaintaindatabankofallindicesimportantforcrime


ForensicDataBankand investigation,crimepreventionandtracingoflostandmissingpersonsand
FingerprintBureau property,andshalladministertheStateCrimeRecordsBureauandDistrict
CrimeRecordBureauforthepurpose.
(2) TheCIDshallmaintainadequatelinkageswithDistrictSuperintendentsof
PoliceandwiththeNationalCrimeRecordsBureaufordataupdatingand
exchange.
(3) TheCIDshallhaveaFingerPrintBureautobeheadedbyanofficerof
appropriaterank.TheBureaushallmaintaincomputerized,searchable
databanksoffingerprints,includingthosecollectedinthecourseof
investigationbytheBureauorbytheDistrictPolice.TheStateFingerPrint
BureaushallcoordinateactivitieswithsimilaragenciesinotherStatesand
GovernmentofIndia.TheFingerPrintBureaushallprovidetrainingto
investigatingofficersoftheDistrictPoliceanddevelopstandardoperating
procedureforlifting,developingandmatchingfingerprintsinvarious
circumstances,andshallpublishaFingerPrintingManualforthepurpose.

CHAPTER X
Training, ResearchandDevelopment

Trainingcum 111. TheStateGovernmentshallevolveaTrainingcumEducationPolicyforthe


EducationPolicy PoliceinaccordancewiththeprovisionsofthisAct,keepinginviewthecurrent
andanticipatedrequirementsofpolicing.Thepolicywill,asfaraspossible,
takeintoaccountanyguidelinesinrespectofPolicetrainingasmaybeissued
bytheUnionandtheStateGovernmentfromtimetotime.Thetrainingpolicy
shallaimatachievingtheobjectivesofimpartingknowledgeinPolicesubjects,
developingprofessionalskillsinculcatingtherightattitudes,andpromoting
ConstitutionalandethicalvaluesamongPolicepersonnel.
Trainingtobelinkedto 112. ThetrainingpolicyshallensurethatPolicepersonnelareadequatelytrainedto
promotionandposting efficientlyperformtheirjob.Successfulparticipationinappropriatetraining
programmes shall be linked asfar as possible,to the promotionof Police
personnelofdifferentranks,andtotheirpostingtodifferentassignmentsina
structuredmanner,asnotifiedbytheStateGovernmentfromtimetotime.
Methodologyin 113. In evolving the training policy, optimum advantage shall be taken of the
EvolvingTrainingPolicy methodologiesofdistancelearning,outsourcingandonthejobtraining.
Infrastructure 114. The State Government shall create and upgrade from time to time, the
ofTrainingInstitutions infrastructureandcapabilitiesoftraininginstitutionsinconsonancewiththe
holistictrainingneedsofPolicepersonnelofdifferentranks,whichshallinclude,
besidesalltypesofspecializedtraining,acompulsoryrefreshertrainingcourse
ofappropriatedurationforallranksperiodically.ForthispurposetheState
Government may also create a suitable training centre with the requisite
infrastructureinthedistrictsorintheArmedPoliceBattalions.
TraininginCentral 115. TheStateGovernmentshallensurethatfulladvantageistakenofthetraining
andRegional facilitiesavailableincentralandregionalpolicetraininginstitutions,toadequately
PoliceTraining trainPolicepersonneloftheStateinspecializedprofessionalsubjects,andto
Institutions trainthetrainersoftheStatePolicetraininginstitutions.
GuidelinesofBureauof 116. Inupgradingtheirtraininginfrastructureaswellasthecontentand
PoliceResearchetc.to methodologiesoftrainingcourses,thetraininginstitutionsshalltake
betakeninto maximumadvantageofthestandardsandpracticesevolvedorguidelines
considerationfor issuedbyorganizationssuchastheBureauofPoliceResearchand
Training DevelopmentofGovernmentofIndia,andtheNationalPoliceAcademy.
AssistancefromBureau 117. ForanobjectiveperiodicalevaluationofthetrainingpolicyoftheStateandits
ofPoliceResearchand implementation, the State Police may utilize the available assistance of
Developmentetc. organizationssuchastheBureauofPoliceResearch andDevelopmentof
GovernmentofIndia.
StateBureau 118. TheStateGovernmentmayestablishaStateBureauofPoliceResearchand
ofPoliceResearch Developmentwithprovisionforappropriatestaff,fundsandotherresourcesto
andDevelopment regularly undertakeresearch and analysison all such subjectsand issues
whichmayleadtoimprovementinthestandardsofPolicefunctioningand
performance. The State Government may also sponsor, in other reputed
organizationsandinstitutions,specialstudiesandresearchinsubjectshaving
relevancetopolicing.
Developmentof 119. The State Government may also take appropriate measures to harness
Scientificand developingtechnologyforscientificandtechnicalassistanceintheinvestigation
TechnicalAssistance anddetectionofcrime,andotherpolicingtasks.

FunctionsofState 120. ThetasksoftheStateBureauofPoliceResearchandDevelopment,when


BureauofPolice constituted,shallinclude:

(a) preparationoffiveyearPerspectivePlanstomodernizeandupgradePolice

successfullyintroducedbyotherPoliceorganizationswithinthecountryor
abroad,andassessingtheadaptabilityorotherwiseofsuchequipmentand

Regulation,ControlandDiscipline

Framingofrulesfor 121. SubjecttoanyrulesandregulationsmadeinthisregardbytheStateGovernment


administrationofPolice theDirectorGeneralofPoliceshallmakerules,regulationsorissueorders,not
inconsistentwiththisActorwithanyotherenactmentforthetimebeingin
force,inrespectofthefollowing,amongstothers,for
(a) preventionandinvestigationofcrime
(b) effectiveprosecutionofoffences,includingfilingofappeals
(c) maintenanceoflawandorder
(d)regulationandinspectionofthePoliceorganizationandoftheworkperformed
byPoliceofficers
(e) determiningthedescriptionandquantityofarms, accoutrements,clothing
andotherwherewithaltobeprovidedtothePoliceService
(f) prescribingtheplacesofresidenceofmembersofthePoliceService
(g) institution,managementandregulationofanyPolicefundforpurposes
connectedwiththePoliceadministrationincludingrewardtoinformersor
welfareofPolicepersonneletc.
(h) regulation,deployment,movementsandlocationofthePolice

Prohibitionofcertain 122. NoPoliceofficershalljoinorbeamemberofanyassociationorparticipate
practices intheactivitiesofsuchassociationwhichhasanobjective,orwhichaimsat
collectivenegotiation,onmattersrelatingtothePoliceservice.
DisciplinaryPenalties 123. (1) SubjecttotheprovisionsofArticle311oftheConstitutionandtherulesand
regulationsmadeunderthisAct,anofficeroftherankofSuperintendentof
Policeorabovemayawardanyofthefollowingpunishmenttoapolice
officerofarankforwhichheistheappointingauthority
(a) reductioninrank(providedthatsuchreductioninrankshallnotbetoa
rankbelowtherankinwhichsuchofficerwasrecruited)
(b) compulsoryretirement
(c) removalfromserviceor

(2) AnyPoliceofficeroftherankofSuperintendentofPoliceorabove,subject
totherulesmadeinthisbehalf,mayawardanyofthefollowingpunishments
toanyGroupCPoliceofficerunderhisofficialcontrol

(d) finenotexceedingonemonthspayor
(e) reprimandorcensure.
(3) AnAssistantSuperintendentofPoliceoranofficerofequivalentrankmay
awardthepunishmentofreprimandorcensuretoanofficeroforbelowthe
rankofSubInspectorof Police.
(4) AnyofficerofandabovetherankofInspectorofPolicemayaward
punishmentstoConstablesandHeadConstables,asprescribedintherules
framedunderthisAct.
(5) Anypunishmentmentionedinsubsections(1),(2),(3)or(4),awardedto
anofficer,willnotaffecthisliabilityforprosecutionforanycriminaloffence
committedbyhim.
Suspension 124. (1) APoliceofficeroforabovetherankofSuperintendentofPolicemayplace
aPoliceofficeroftherankofInspectorofPoliceorbelowsubordinateto
him,undersuspension
(a) whereadisciplinaryproceedingforawardofpunishmentagainsthimis
contemplatedorispending
(b) whereintheopinionoftheaforesaidauthority,thereisaprimafacie
casethatsuchofficerhasengagedhimselfinactivitiesprejudicialto
thesecurity ofStateor
(c) whereintheopinionoftheaforesaidauthoritythereisprimafacie evidence
inrespectofanycriminaloffenceunderinvestigation,inquiryortrial.
(2) Everyorderofsuspensionpassedunderthissectionshallbeinwriting
givingbrieflythereasons.
(3) Whereanofficerisplacedundersuspension,whetherin connectionwitha
disciplinaryproceedingorotherwise,andanotherdisciplinaryproceedingis
orderedagainsthimduringthecurrencyofthatsuspension,theauthority
competenttoplacehimundersuspensionmay,forreasonstoberecorded
inwriting,directthattheofficershallcontinuetobeundersuspensionuntil
thecompletionofalloranyofsuchproceedings.
(4) Anorderofsuspensionsomademayatanytimeberevokedormodified,or
inanycasebereviewedeverysixmonthsorearlier,suomotuorona
representationmadebytheofficerundersuspension,bytheauthoritywhich
madetheorderorbyanyauthoritytowhichsuchauthorityissubordinate.
(5) Ineverycasewheretheperiodofsuspensionexceedsoneyear,thecase
shallbereportedtotheDirectorGeneralofPolicewhoshallthereafterreport
thesametotheStatePoliceBoard.
Misconduct 125. APoliceofficershall,inadditiontoanyotherdelinquentactorbehaviouras
specifiedintherelevantrules,beliablefordisciplinaryactionforanyofthe
followingmisconduct,namely:
(a) disobedienceoflawfulorders
(b) neglectofduty
(c) insubordinationoroppressiveconduct

(d) malingeringorunauthorizedabsencefromduty
(e) actofcowardice
(f) misuseofauthorityor
(g) anyactunbecomingofaPoliceofficer.
Appealagainstordersof 126. (1) Anappealagainstanyorderofpunishmentpassedagainstanofficerunder
punishment thisActoranyrulesmadethereunder,shalllie:
(a) wheretheorderispassedbytheDirectorGeneralofPolice,tothe
StateGovernmentand
(b) wheretheorderispassedbyanofficersubordinatetotheDirector
GeneralofPolice,totheofficernexthigherinrankinthePolicehierarchy
whopassedsuchorder.
(2) Noappealshalllieafteraperiodof45(fortyfive)daysofpassingtheorder
ofpunishment:
ProvidedthattheStateGovernmentortheDirectorGeneralofPolice
mayrelaxtheperiodwithinwhichtheappealshouldbefiledforjustandsufficient
reasonstoberecordedinwriting.
Separatesetofrulesfor 127. TheStateGovernmentshallframetheclassification,controland appeals
Policepersonnel rulesforPolicepersonnel,whichwill,amongotherthings,ensuretimely
disposalofdisciplinaryproceedings.
Policeofficers 128. (1) EveryPolice Officernotonleaveorundersuspensionshall,forallpurposes
alwaysonduty ofthisAct,beconsideredtobealwaysondutyandmayatanytimebe
deployedinanypartoftheState.
(2) Notwithstandingthegrantofcompensatorybenefitsinlieuofholidaysor
weeklyofforforservicebeyondofficeworkinghourstheappropriatePolice
authoritiesandtheStateGovernmentshallensurethatallPolicepersonnel
getreasonablenumberofholidaysandtimeoffs.
Policeofficer 129. No Police Officershallabdicatehisdutiesorwithdrawhimselffromhis
nottoabdicate placeofpostingordeploymentwithoutproperauthorization.

PoliceAccountability

Additionalmechanism 131. Inadditiontotheexistingmechanisms,functions,dutiesandresponsibilities


forPoliceaccountability ofthedepartmentalauthorities,accountabilityofthe Police shall be further

Accountabilityforconduct
PoliceAccountability 132. TheStateGovernmentshallestablishaPoliceAccountabilityCommission
Commission (hereinafter referred toasthe Commission)consistingof aChairperson,
Membersandsuchotherstaffasmaybenecessary,toenquireintopublic
complaintssupportedbyswornstatementagainstthePoliceofficersforserious
misconductandperformsuchotherfunctionsstipulatedinthisChapter:
Compositionofthe 133. TheCommissionshallhavethreememberswithacrediblerecordofintegrity
Commission andcommitmenttohumanrightsandshallconsistof
(a) AretiredHighCourtJudgewhoshallbethechairpersonofthe Commission
(b) AretiredofficernotbelowtherankofSecretary/CommissionertotheState
Governmentorapoliceofficersuperannuatedintheranknotbelowthatof
theInspectorGeneralofPolice,withexperienceinpublicadministration
(c) Onepersonofreputeandstandingfromthecivilsociety:
Providedthatatleastonemembershallbewomanandnotmore

SelectionofChairperson 134. (1) TheChairpersonofthe Commissionshallbeappointedfromapanelof

(2) Membersofthe Commission,otherthantheChairperson,shallbeappointed
ontherecommendationoftheselectionpanelconstitutedunderthisActfor

(3) VacanciesintheCommissionshallbefilledupassoonaspracticableand
innocaselaterthanthreemonthsafteraseathasfallenvacant.
(4) InselectingmembersoftheCommissionthePanelshalladoptatransparent

(b) persistentneglecttoperformdutiesoftheCommission
(c) occurrenceofanysituationthatwouldmakeamember
ineligibleforappointmenttotheCommissionunder Section135or
(d) anymemberengaginghimselfduringhistermofofficeinanypaid
employmentoutsidethedutiesofhisoffice.
StaffoftheCommission 138. (1)Members oftheCommissionshallbeassistedbyadequatestaffwith
requisiteskills,forefficientdischargeofthefunctionsoftheCommission.
(2) Thestrengthofthestaff,theirremunerationandconditionsofservice
shallbeasprescribedbytheStateGovernment,keepinginviewthesize
oftheState,itspopulationandtheaveragenumberofcomplaintsagainst
thePolice,the additionalfunctionsentrustedtotheCommission,and
shallbeperiodicallyreviewedandrevised.
(3) ThesubordinatestaffshallbeselectedbytheCommissioninteralia,ona
contractualbasis,throughatransparent process.
(4) Theremunerationandothertermsandconditionsofserviceofthestaff
shallbeprescribedfromtimetotime.
Conductofbusiness 139. TheCommissionshalldeviseitsownrulesfortheconductofitsbusiness.
Functionsofthe 140. (1)TheCommissionshallinquireintoallegationsofseriousmisconduct
Commission againstpolicepersonnel,asdetailedbelow,eithersuomotuoronacomplaint
receivedfromanyofthe following
(a) avictimoranypersononhisbehalf
(b) theNational,ortheStateHumanRightsCommissionifconstituted

DirectorGeneralofPoliceif,intheopinionofthe Commission,thenature
ofthecasemeritsanindependentinquiry.
(3) TheCommissionmaymonitorthestatusofdepartmentalinquiriesand
actiononthecomplaintsofmisconductagainst GroupA,GroupBand
GroupCpolicepersonnelthroughquarterlyreportsobtainedfromtheDirector
GeneralofPoliceandissueappropriateadvicetothePolicedepartmentfor
expeditiouscompletionofinquiry,ifintheCommissionsopinionsuch
inquiryoractiononthecomplaintsisgettingundulydelayed.
(4) TheCommissionmayalsocallforareportfromandissueappropriateadvice
forfurtheractionorifnecessaryadirectionforafreshinquirybyanother
officer,totheDirectorGeneralofPolicewhenacomplainant,being
dissatisfiedbytheoutcomeof,orinordinatedelayintheprocessof,
departmentalinquiryintohiscomplaintofmisconductbyaPoliceofficer,
bringssuchmattertoitsnotice.
(5) TheCommissionmaylaydowngeneralguidelinesfortheStatePoliceto
preventmisconductonthepartofthepolicepersonneland
(6) TheCommissionshallalsoperformthefunctionsoftheStateHumanRights
Commissionlistedundersection12oftheProtectionofHumanRightsAct,
1993,fortheStateofSikkimandmakesuitablerecommendationstothe
Governmentandtheauthorityconcerned.Inperformingsuchfunctionsthe
Commissionshallbeprovidedallnecessaryinformation/assistanceasit
mayreasonablyrequire,byallconcerned.
Powers 141. (1)Inthecasesdirectlyenquiredbyit,theCommissionshallhaveallthe
oftheCommission powersofacivilcourttryingasuitundertheCodeofCivilProcedure,1905
andinparticularinrespectofthefollowingmatters
(a) summoningandenforcingtheattendanceofwitnessesand
examiningthemonoath
(b) discoveryandproductionofanydocument

(2) TheCommissionshallhavethepowertorequireanypersonsubjecttolegal
privilege,tofurnishinformationonsuch pointsormattersas,intheopinion
oftheCommission,maybeusefulfor,orrelevantto,thesubjectmatterof
theinquiry, andanypersonsorequiredshallbedeemedtobelegally

Commissionmay,withthepriorsanctionoftheStateGovernment,and
afterrecording thefactsconstitutingtheoffenceandthestatementofthe
accusedasprovidedforintheCodeofCriminalProcedure,1973,forward
thecasetoaMagistratehavingjurisdictiontotrythesame.TheMagistrate
towhomanysuchcaseisforwardedshallproceedtohearthecomplaint
againstthe accusedasifthecasehasbeenforwardedtohimundersection
346oftheCodeofCriminalProcedure1973.
(4) EveryproceedingbeforetheCommissionshallbedeemedtobeajudicial
proceedingwithinthemeaningsof Sections193 and228andforthe
purposesofSection196oftheIndianPenalCode1860,theCommission
shallbedeemedtobeacivilcourtforallthepurposesofsection195and
Chapter XXVIoftheCodeofCriminalProcedure,1973.
(5) TheCommissionshallhavethepowertoadvisetheStateGovernmenton
measurestoensureprotectionofwitnesses,victimsandtheirfamilieswho
mightfaceanythreator harassmentformakingthecomplaintorfor
furnishing evidence.
(6) TheCommissionmayvisitanyPoliceStationlockuporanyotherplaceof
detentionusedbythepoliceandifitthinksfititmaybeaccompaniedbya
Policeofficer.
Statementsmadetothe 142. Nostatementmadebyapersoninthecourseofgivingevidence before
Commission theCommissionshallsubjectthatpersontoacivilorcriminalproceeding
orbeusedagainsthiminsuchproceeding,exceptaprosecutionforgiving

145. (1)TheCommissionshallprepareanannualreportattheendofeachcalendar
oftheCommission
year,interalia,containing
(a) thenumberandtypeofcasesofseriousmisconductinquiredinto
byit
(b) thenumberandtypeofcasesofmisconductreferredtoitbythe
complainantsuponbeingdissatisfiedbythedepartmentalinquiryinto
hiscomplaint
(c) thenumberandtypeofcasesincludingthosereferredtoin(b)abovein
whichadviceorrecommendationwasissuedbyittothepolicefor
furtheraction
(d) theidentifiablepatternsofmisconductonthepartofPolicepersonnel
inthe Stateand
(e) recommendationsonmeasurestoenhancepoliceaccountability.
(2) TheannualreportoftheCommissionshallbelaidbeforetheState
Legislatureinthebudgetsessionandshallbeapublicdocument,made
easilyaccessibletothepublic.
(3) TheCommissionmayalsopreparespecialreportswithrespecttospecific
casesdirectlyinquiredintobyit.Thesereportsshallalsobemadeeasily
accessibletothepublic.
Rightsofthe 146. (1)TheComplainantmaylodgehiscomplaintrelatingtoanymisconduct
complainant orseriousmisconductonthepartofPolicepersonneleitherwiththe
departmentalpoliceauthoritiesorwiththeCommission:
ProvidedthatnocomplaintshallbeentertainedbytheCommissionif
thesubjectmatterofthecomplaintisbeingexaminedbyanyother
Commission,oranyCourt.
(2) IncaseswhereacomplainanthaslodgedacomplaintwiththePolice
authorities,hemayinformtheCommissionatanystageofthedepartmental
inquiryaboutanyunduedelayintheprocessingoftheinquiry.
(3) Thecomplainantshallhavearighttobeinformedoftheprogressofthe
inquiryfromtimetotimeanditsresultbytheinquiringauthority
(theconcernedpoliceauthorityortheCommission).

orofhisDepartmenttotheCommission.
(2) ItshallbethedutyoftheheadsoftheDistrictPoliceandtheStatePolice
aswellasanyotherconcernedStateagencytoprovidetotheCommission
allinformationitmayreasonablyrequiretoperformitsdutiesprovidedforin
thisChapter.
Interference
148. WhoeverinfluencesorinterfereswiththefunctioningoftheCommission,except
withthefunctioning
inthecourseoflawfulduty,shall,onconvictionbyacourtoflaw,beliableto
oftheCommission
afineortoanimprisonmentforatermnotexceedingoneyear,orboth.
Explanation: Anythreat,coercionorinducementofferedtoanywitnessor
victimofpolice misconductorseriousmisconduct,shallbe deemedtobe
interferencewiththefunctioningoftheCommission for the purposes of this
Section.

Accountabilityforperformance

performance andreviewtheperformanceofthePoliceServiceinthe Stateasawhole
andalsodistrictwise.Forthispurpose, theBoardshall

(a) identifyperformanceindicatorstoevaluatethefunctioningofthePolice
Service,whichshall,interalia,includeoperationalefficiency,public
satisfaction,victimgratificationvisvispoliceinvestigationand
response,accountability,optimumutilizationofresources,andhuman
rightsrecord
(b) reviewandevaluateorganizationalperformanceoftheState Police
against(i)theAnnualPlanprovidedforinthisAct,(ii)performance
indicatorsasidentifiedand laiddownbytheBoarditself(iii)resources
availablewith,andconstraintsofthePolice
(c) laydownpolicyguidelinesforgatheringinformationandstatisticsrelated
toPoliceworkand
(d) suggestwaysandmeanstoimprovetheefficiency,effectiveness.,
accountability,andresponsivenessofthePolice.
Reportsof 150. (1)The Boardshall,attheendofeachcalendaryear,prepareandforwardto
theBoardonpolice theStateGovernmentanannualreportonPolice performance,whichshall,
performance interalia,includerecommendationsforimprovement.
(2) ThisreportshallbelaidbeforetheStateLegislatureinthebudgetsession
andshallbeapublicdocument,madeeasilyaccessibletothepublic.
Protectionofaction 151. NosuitorotherlegalproceedingshalllieagainsttheStateGovernment,
takeningoodfaith the StatePoliceBoard,itsmembersandstaff,thePoliceAccountability
Commission,itsmembers,stafforanypersonactingunderthedirectionof
theBoardortheCommission,inrespectofanythingwhichisingoodfaith
doneorintendedtobedoneinpursuanceoftheprovisionsofthisChapter.

CHAPTER XIII

WelfareandGrievanceRedressalMechanismforPolice Officers

WelfareOfficerand 152. (1)AnofficernotbelowtherankofDeputyInspectorGeneralofPolice,inthe


WelfareCommittee officeoftheDirectorGeneralofPolice,shallbe designatedasWelfare
Officertoadviseandassisthimintheimplementationofwelfaremeasures
forPolice Officers.
(2) ThefunctionsanddutiesoftheWelfareOfficershall,interaliainclude
administrationandmonitoringofwelfaremeasuresforPolicepersonnel,
suchas
(a) healthcare,particularlyinrespectofchronicandserousailments,and
includingpostretirementhealthcareschemesforPolicepersonneland
theirdependents
(b) fullandliberalmedicalassistancetopolicepersonnelsufferinginjuryin
thecourseofperformanceofduty
(c) financialsecurityforthenextofkinofthosedyinginharness
(d) postretirementfinancialsecurity
(e)grouphousing
(f) educationandcareercounselingandtraininginappropriateskillsfor
dependentsofpoliceofficersand
(g) appropriatelegalfacilitiesofdefenceofpoliceofficersfacingcourt
proceedingsinmattersrelatingtobonafidedischargeofduty.
(h) monitorthewelfareactivitiesundertakenbyvariousPoliceunitsinthe
State.
(3) TheWelfareOfficershallbeassistedbysuchsubordinateofficersas
prescribedbytheDirectorGeneralofPolice.
(4) APoliceWelfareFund,undertheadministrationandcontroloftheWelfare
Officer,shallbecreatedforthewelfareactivitiesandprogrammesfor
Policepersonnel,whichwillhavetwocomponents
(a) outrightfinancialgrantbythe Stateand
(b) matchinggrantbythestatetothecontributionsmadebythePolice
personnel,towardsthewelfarefund.
(5) TheWelfareOfficershall,intheperformanceofhisfunctions,beguidedbythe
normsandpolicies,laiddownbyaWelfareCommitteeandratifiedbythe
DirectorGeneralofPolice.TheWelfareCommitteeshallcompriseofoneor
twopolicepersonnelofdifferentranksfromeachunitorwingofthePolice
servicetobenominatedbytheDirectorGeneralofPolice.
(6) TheWelfareOfficershallalsointeractwithothergovernmentdepartments,
public sector undertakings and other organisations to facilitate gainful
employment for retired police officers, and for the dependents of police
personnelwhohavelaiddowntheirlivesinduedischargeoftheirduties.
Insurancecover, 153. (1)TheStateGovernmentmayprovideinsurancecoverageforallorspecific
allowances categoryorclassofPoliceofficersagainstanyinjury,disability,ordeath
andmedicalfacilities causedinthecourseofperformanceoftheirduty.

(2) Police Officerspostedinspecialwings,suchasCounterTerrorism


Operations Units,BombDisposalSquads,CommandoGroupsetc.shallbe
paidriskallowancecommensuratewiththerisksinvolvedinthoseduties.
(3) Inadditiontofacilitiesasmaybemadeavailableinhospitalsforgeneral
treatmentandspecialisedservices,Policepersonnelmayalsobeprovided
withamedicalinsurancecoverthatwouldenablethemtokeepuptherequired
standardsofhealthandphysicalfitness.
(4) Facilitiesforstressmanagement,includingpsychologicalcounseling,to
copewithprofessionalstressshallbegivendueattentioninallpoliceunits
andestablishments.
GrievanceRedressal 154. (1)TheDirectorGeneralofPolice,withtheapprovaloftheStateGovernment
shallputinplaceafair,transparent,andparticipatorygrievanceredressal
mechanismforlookingintoindividualaswellascollectivegrievancesof
Policepersonnel,whichshallbefreelyreceivedandchanneledupwards
fromalllevelsoftheorganization.Tillsuchtimeanyothermechanismisput
inplacetheWelfareOfficerandtheWelfareCommitteeindicatedinSection
152shallservethepurposeandreporttotheDirectorGeneralofPolice.
(2) Thegrievancesthatcannotberedressedbythesaidmechanismshallbe
forwardedtotheStatePoliceBoard,whichinturn,shallmakeappropriate
recommendationstotheStateGovernmentforremedialmeasures.
(3) Ananalysisofthegrievances,theircausesandtheirimpactonthemorale
andefficiencyofthePoliceServiceshallbecarriedoutannually.This
analysisshallbeincludedintheannualreportoftheStatePoliceBoard.
Workinghours 155. TheStateGovernmentshalltakeeffectivestepstoensurethattheaverage
hoursofdutyofaPolice Officerdonotnormallyexceedeighthoursaday:
ProvidedthatinexceptionalsituationsthedutyhoursofaPolice Officer
mayextendupto12hoursorbeyond.Insuchcases,adequatecompensation
andfacilitiesshallbeprovidedtothePolicepersonnel.

GeneralOffences, Penalties, andResponsibilities
Orderinstreetsandpublicplaces

Regulationofpublic 156. (1)TheDistrictSuperintendentofPoliceoranofficernotbelowtherankof


assembliesand Assistant/DeputySuperintendentofPolicemay, wherenecessary,direct
processions theconductofallassembliesandprocessionsonanypublicplace,road,
streetorthroughfare,andprescribetheroutesbywhichandthetimeat
whichsuchaprocessionmaypassortheplaceatwhichandthetimefor
whichanassemblymaybeheld.
(2) Itshallbedutyofanypersonintendingtoorganizeaprocessiononany
road,streetorthoroughfare,ortoconveneanassemblyatanypublicplace,
togiveintimationinwritingtotheconcernedDistrictSuperintendentofPolice
ortheSub DivisionalPoliceOfficer.
(3) TheDistrictSuperintendentoranyofficernotbelowtherankofAssistant/
DeputySuperintendentofPolice,onreceiptofsuchintimationorotherwise,
anduponbeingsatisfiedthatsuchanassemblyorprocession,ifallowed
withoutduecontrolandregulation,islikelytocauseabreachofpeace,may
prescribenecessaryconditionsincludingmakingprovisionsforsatisfactory
regulatoryarrangements,onwhichalonesuchassemblyorprocessionmay
takeplace.Underspecialcircumstancestoberecordedinwriting,the
concerned officermayalsoprohibittheassemblyorprocessioninpublic
interest.Allordersanddirectionsshouldbegivenwithin48(fortyeight)
hoursofreceiptofintimation,asfaraspossible.
Assembliesand 157. (1) AMagistrateoranyPolice OfficernotbelowtherankSubInspector
Processionsviolating ofPolice,authorizedinthisbehalfbytheDistrictSuperintendentofPolice,
prescribedconditions maystopanyassemblyorprocessionwhichviolatestheconditionsset
undersubsections(1)and(3)ofSection156,andordersuchassemblyor
processiontodisperse.
(2)Anyassemblyorprocessionwhichneglectsorrefusestoobeyanyorder
givenundersubsection(1)aboveshallbedeemedtobeanunlawful
assemblyunderChapterVIIIoftheIndianPenalCode,1860.
Regulation 158. (1) AnyMagistrateortheDistrictSuperintendentofPoliceoranyofficernot
oftheuse belowtherankofAssistant/DeputySuperintendentofPolicemayregulate
ofmusic thetimeandthevolumeatwhichmusicandothersoundsystemsareused
andother inconnectionwithanyperformancesandotheractivitiesinornear
soundsystems streetsoranypublicplacethatcauseannoyancetotheresidentsofthe
inpublic neighborhood.

(2) Itshallbethedutyofanypersonintendingtoorganizeaneventor

suchintimationorotherwise,anduponbeingsatisfiedthatsuchanevent,if
allowedwithoutduecontrolandregulation,islikelytocauseabreachof
peaceorannoyancetotheresidentsoftheneighborhood,mayprescribe
necessaryconditionsincludingmakingprovisionsforsatisfactoryregulatory
arrangements,onwhichalonesucheventmaytakeplace.Allordersand

Directionstokeeporder 159. (1) AnyMagistrateorthe DistrictSuperintendentofPoliceoranyotherPolice
onpublicroads Officerauthorizedbyhiminthisbehalf,throughageneralorspecialorder,
maygivereasonabledirectionstothepublictokeeporderonpublicroads
aridstreets,thoroughfares,oranypublicplace,inordertopreventobstruction,
injury,orannoyancetopassersbyortoprevent pollution.
(2) AnyMagistrateortheDistrictSuperintendentofPolicemayissuegeneral
directionsundersubsection(1)inrespectofthe wholedistrictoranypart
thereof.
Penaltyfordisobeying 160. Anypersonnotobeyingthelawfulordersissuedunder Sections156,157and
ordersordirections 158maybearrestedandonconvictionbyaCourtoflaw,shallbeliabletoa
fine.
Powertoreservepublic 161. (1) AnyMagistrateortheDistrictSuperintendentofPolicemay,bypublicnotice,
places,anderectbarriers temporarilyreserveforanypublicpurposeanystreetorotherpublicplace,
andprohibitthepublicfromenteringtheareasoreserved,exceptonsuch
conditionsasmaybespecified.
(2) (a) TheDistrictSuperintendentofPolicemayauthorize anyPoliceofficer
toerectbarriersandothernecessarystructuresonpublicroadsand
streets,tocheckvehiclesoroccupantsthereofforviolationofany
legalprovisionsbythem.
(b) Inmakingsuchorder,theDistrictSuperintendentofPoliceshall
prescribethenecessarystepsforensuringthesafetyofpassersby.
(c) Thesetemporarystructuresshallberemovedoncethepurposefor
whichtheywereinstalledisover.
SavingofControlof 162. Notwithstandinganythingcontainedinthischapter,nothingshallbedeemed
MagistrateoftheDistrict tohaveinterferedwiththegeneralcontroloftheMagistratesoftheDistricton
themattersassignedtothemunderanylawforthetimebeinginforce.
OffencesagainstthePolice
Obstructionin 163. Anyperson,whoobstructsthedischargeofdutiesandfunctionsofapolice
Policework officer,shall,onconviction,beliabletosimpleimprisonmentnotexceeding
threemonthsorfineorboth.
Unauthoriseduseof 164. WhoevernotbeingamemberofthePoliceService,wears,withoutobtaining
Policeuniform permissionfromanofficerauthorizedinthisbehalfbytheStateGovernment
by a general or special order, a Police uniform or any dress having the
appearanceorbearinganyorthedistinctive marksofthatuniform,shall,on
conviction,bepunishedwithimprisonmentnotexceedingsixmonthsorfineor
both.
Refusaltodeliverup 165. Whoever,havingceasedtobeaPoliceofficer,doesnotforthwithdeliverup
certificateetc.on his/hercertificateofappointment,clothing,accoutrementsandotherwherewithal
ceasingto suppliedtohimfortheexecutionofhisduty,shallonconvictionbyacourtof
bePoliceofficer law,beliabletoafine.
Falseormisleading 166. Whoevermakesafalsestatementorastatementwhichismisleading
statement inmaterialparticularstoaPoliceofficerforthepurposeofobtaininganybenefit
madeto shall,onconviction, bepunishedwithimprisonmentforatermwhich may
thePolice extenttothreemonthsorafineorboth.

Derelictionofdutyby 167. (1) Whoever,beingaPoliceofficer

(a) willfullybreachesorneglectstofollowanylegalprovision,procedure,

(b) withoutlawfulreason,failstoregisteraFirstInformationReportas
required bySection154oftheCodeofCriminalProcedure,1973or
(c) isfoundinastateofintoxication,whileondutyor
(d) malingersorfeignsillnessorinjuryorvoluntarilycauseshurtto
himselfwithaviewtoevadingdutyor
(e) actsinanyothermannerunbecomingofaPolice Officershall,on
conviction,bepunishedwithimprisonmentforatermwhichmayextend
tothreemonthsorwithafineorboth.
(2) Whoever,beingaPolice Officer:
(a) isguiltyofcowardiceor
(b) abdicatesduties,orwithdrawsfromdutiesorremainsabsentwithout

annoyance,riskdangerordamageoftheresidentsorpassersby
(n) neglectstofenceinorprotectanywell,tankorotherdangerousplaceor
structure.
(2) TheStateGovernmentmay,bynotificationintheOfficialGazette,
prescribeaminimumamountoffinethatshallbeimposedonapersonon
convictionforanyoffencementionedinsubSection(1).
(3) Itshallbelawfulforanypoliceofficertotakeintocustody,withoutawarrant,
whoevercommitsanyoftheoffencesmentionedinsubsection(1).
(4) WhoevercommitsanyoffenceundersubSection(1),on subsequent
convictionshallbeliabletoenhancedpunishment.

Procedureforposting 170. (1)Allgeneraldirections,regulationsandpublicnoticesissuedunderthisChapter


directionsandpublic shallbepublishedbypostingnoticesintheofficeoftheDistrictand
notices SubDivisionalMagistrate,BDO Office,andPanchayatofficeofthelocal
areaaswellasinthelocalityaffected,byaffixingcopiesinconspicuous
places nearthebuildingorplacetowhichthenoticespeciallyrelates,or

ProvidedthattheSuperintendentofPolicemay,onbeingsatisfiedthat

Prosecution for offences172. SubjecttotheprovisionscontainedinSection300oftheCodeofCriminal
underotherlaws Procedure,1973,nothinginthisActshallbeconstruedaspreventingany
Personfrombeingprosecutedandpunishedunderanyotherlawforanything
madepunishablebythisAct.
Summary 173. (1) AcourttakingcognizanceofanoffencepunishableunderSections160
disposalof and169maystate,uponthesummonstobeservedtotheaccusedperson,
certaincases thathemay,byaspecifieddatepriortothehearingofthecharge,pleadto
thechargebyregisteredletter,andremittothecourtsuchsumasthe
courtmayspecify.
(2) Whereanaccusedpersonpleadsguiltyandremitsthesumspecifiedin
thesummonsundersubsection(1),nofurtherproceedingsinrespectof
theoffenceshallbetakenagainstthatperson.
Recoveryofpenalties 174. ProvisionsofSections64to70oftheIndianPenalCode1860andSections
andfinesimposedby 386to389oftheCodeofCriminalProcedure1973shallapplyto

CriminalProcedureshallapplyforcomputingtheperiodoflimitation.

officerasinformersshall,saveinsofarasanysuchfeesorsumsbelong
undertheprovisionsofanyenactmentinforcetoanylocalauthority,becredited
totheStateGovernment:

Revocationoflicence (2) AnylicenceorwrittenpermissiongrantedunderthisActmayatanytime
besuspendedorrevokedbythecompetentauthority,ifanyofitsconditions
orrestrictionsisinfringedorevadedbythepersontowhomithasbeen
granted,orifsuchpersonisconvictedofanyoffenceinanymatterto
whichsuchlicenceorpermissionrelates,orifthereislikelihoodofbreach
ofpeace.

Whenlicenceisrevoked, (3) Whenanysuchlicenceorwrittenpermissionissuspendedorrevoked,or


granteedeemedtobe whentheperiodforwhichthesamewas grantedhasexpired,theperson
withoutlicence towhomthesamewasgrantedshallforallpurposesofthisAct,bedeemed
tobewithoutalicenceorwrittenpermissionuntiltheorderforsuspending
orrevokingthesameiscancelled,oruntilthesameisrenewed,asthe
casemaybe.

Licenceandpermission (4) Everypersontowhomanysuchlicenceorwrittenpermissionhasbeen


tobeproducedwhen granted,shall,whilethesameremainsinforce,atallreasonabletime,
required producethesame,ifsorequiredbyaPolice Officer,

Explanation: Forthepurposeof.thissectionanysuchinfringementorevasion
by,orconvictionof,aservantorotheragentactingonbehalfofthepersonto
whomthelicenceorwrittenpermissionhasbeengrantedshallbedeemedto
beinfringementorevasionby,orasthecasemaybe,convictionoftheperson
towhomsuchlicenceorwrittenpermissionhasbeengranted.
Pubicnotices 181. Anypublicnoticerequiredtobegivenunderanyoftheprovisionsofthis Act
howtobegiven shallbeinwritingunderthesignatureofacompetentauthorityandshallbe
publishedinthelocalitytobeaffectedthereby,byaffixingcopieshereofin
conspicuouspublicplaces,orbyproclaimingthesamewithbeatofdrums,or
byadvertisingthesameinsuchlocalnewspapersEnglishorregionallanguage
orHindiasthesaidauthoritymaydeemfit,orbyanytwoormoreofthese
means andbyanyothermeansitmaythinksuitable:
Providedthatthe Competent Authoritymay,onbeingsatisfiedthat,it
isinpublicinteresttobringanyregulationintoforcewithimmediate e f f e c t ,
makesuchdirectionorregulationwithoutpreviouspublication.
Consentofcompetent 182. WheneverunderthisAct,thedoingortheomittingtodoanythingorthevalidity
authoritymaybeproved of anything depends upon the consent, approval, declaration, opinion or
bywritingunderhis satisfactionofacompetentauthority,awrittendocumentsignedbyacompetent
signature authoritypurportingtoconveyorsetforthsuchconsent,approval,declaration,
opinionor satisfactionshallbesufficientevidencethereof.
Powertomakerules, 183. (1)TheGovernmentmaymakerulesandregulationsforcarryingoutthe
notificationinofficial purposesofthisAct.

(2) EveryruleandregulationmadeunderthisActshallbemadebynotification
rulesbeforetheState
intheOfficialGazette.
Legislature
(3) EveryruleandregulationmadeunderthisActshallbelaid,assoonasmay
beafteritismade,beforetheStateLegislature:
Providedthatalltherules,regulationsandordersrelatingtoadministration
oftheStatePoliceestablishmentexistingimmediatelybeforecommencement
ofthis ActshallbedeemedtohavebeenmadeunderthisActunlessany
provisionthereofisfoundinconsistentwiththisAct.

PowerofAdditional 184. SubjecttoSection121,theAdditionalDirectorGeneralofPolice,Inspector


DirectorGeneralof GeneralofPolice,DeputyInspectorGeneralofPoliceandSuperintendentof
Policeetc.toissue Police,andCommandantofaBattalionmayissuestandinginstructionswithin
StandingInstructions theirrespectivejurisdictiontocarryoutthepurposesofthisAct.

Powertoremove 185. (1) IfanydifficultyarisesingivingeffecttotheprovisionsofthisActtheState


difficulties Governmentmay,bynotificationintheOfficialGazette,makesuch
provisionsasitdeemsnecessaryorexpedientforremovingthedifficulty.
(2) Everynotificationissuedunderthissectionshall,asSoofasmaybeafter
itisissued,belaidbeforethelegislature.

Personsaggrieved 186. Inthecaseof anyruleororder madebytheState Government underan


mayapplytoState authorityconferredbythisActandrequiringthepublicoraparticularclassof
Governmenttoannul, personstoperformsomedutyoract,ortoconductororderthemselvesor
reverseoralteranyrule thoseundertheircontrolinamannerthereindescribed,itshallbecompetent
ororder

toanyaggrievedpersontomaketherepresentationtotheStateGovernment
toannul,reverse,oralterthe,aforesaidruleororder.

Repealandsaving 187. (1)ThePoliceAct,1861,initsapplicationtotheStateofSikkim,ishereby


repealed.
(2) Notwithstanding such repeal, anything done or any action taken or any
proceedinginstitutedundertheActsorepealedshallbedeemedtohavebeen
doneortakenorinstitutedunderthecorrespondingprovisionofthisAct.
(3) AllreferencesinanyenactmenttoanyoftheprovisionsoftheActsorepealed
shallbeconstruedasreferencestothecorrespondingprovisionofthisAct.
