Take a close look at the Islamic law of Jihad. This is page 140 of the second volume of Hedaya, the fiqh of

Sacred Injunction
Jihad is enjoined in Surah Al-Anfal and Surah At-Taubah. Muslims are commanded to fight pagans until
resistance ceases and only Allah is worshiped. People with scriptural religions are to be fought until they are
subjugated and submit to extortion. The Jihad imperatives are outcome oriented, unlimited by geography or
time.

8:38. Say to those who have disbelieved, if they cease (from disbelief) their past will be forgiven. But
if they return (thereto), then the examples of those (punished) before them have already preceded (as
a warning).

8:39. And fight them until there is no more Fitnah (disbelief and polytheism: i.e. worshipping others
besides Allh) and the religion (worship) will all be for Allh Alone [in the whole of the world ]. But
if they cease (worshipping others besides Allh), then certainly, Allh is All-Seer of what they do.

The Order to fight to eradicate Shirk and Kufr

9:29. Fight against those who (1) believe not in Allh, (2) nor in the Last Day, (3) nor forbid that
which has been forbidden by Allh and His Messenger (4) and those who acknowledge not the
religion of truth (i.e. Islm) among the people of the Scripture (Jews and Christians), until they pay the
Jizyah with willing submission, and feel themselves subdued.

The Order to fight People of the Scriptures until They give the Jizyah

Divine Ordinance
Surah Al-Baqarah ordains Jihad for Muslims.

2:216. Jihd (holy fighting in Allh's Cause) is ordained for you (Muslims) though you dislike it, and
it may be that you dislike a thing which is good for you and that you like a thing which is bad for you.
Allh knows but you do not know.

Jihad is made Obligatory

Slay the Infidels

Surah Al-Baqarah, Surah An-Nisa' and Surah At-Taubah contain similar expressions. Since At-Taubah
was next to last in sequence of revelation, its intolerant & violent verses abrogate earlier, more tolerant
and passive revelations including 2.256.

2:191. And kill them wherever you find them, and turn them out from where they have turned you
out. And Al-Fitnah is worse than killing. And fight not with them at Al-Masjid-al-Harm (the
sanctuary at Makkah), unless they (first) fight you there. But if they attack you, then kill them. Such is
the recompense of the disbelievers.
 The Command to fight Those Who fight Muslims and killing Them wherever They are found

4:89. They wish that you reject Faith, as they have rejected (Faith), and thus that you all become
equal (like one another). So take not Auliy' (protectors or friends) from them, till they emigrate in the
Way of Allh (to Muhammad ). But if they turn back (from Islm) , take (hold) of them and kill them
wherever you find them, and take neither Auliy' (protectors or friends) nor helpers from them.

Combatants and Noncombatants

9:5. Then when the Sacred Months (the Ist, 7th, 11th, and 12th months of the Islmic calendar) have
passed, then kill the Mushrikn (see V.2:105) wherever you find them , and capture them and besiege
them, and prepare for them each and every ambush. But if they repent and perform As-Salt (Iqmat-as-
Salt), and give Zakt, then leave their way free. Verily, Allh is Oft-Forgiving, Most Merciful.

This is the Ayah of the Sword

War is permanently established

The quote does not turn up in the canonical hadith collections. Citations on the web all circle back to
Hedaya. There are at least two sayings relevant to the continuity of Jihad.

This is a variant of the infamous genocide hadith in which the Profit made genocide of Jews a
prerequisite for Resurrection Day. Clearly, he expected Jihad to continue until the end of the world.

Sahih Bukhari Volume 4, Book 52, Number 177:

Narrated Abu Huraira:

Allah's Apostle said, "The Hour will not be established until you fight with the Jews, and the
stone behind which a Jew will be hiding will say. "O Muslim! There is a Jew hiding behind
me, so kill him."

The Profit also said that Jihad would be performed continuously until the end of the world.

Sunan Abu Dawud Book 14, Number 2526

Narrated Anas ibn Malik:

The Prophet (peace_be_upon_him) said: Three things are the roots of faith: to refrain from
(killing) a person who utters, "There is no god but Allah" and not to declare him unbeliever whatever
sin he commits, and not to excommunicate him from Islam for his any action; and jihad will be
performed continuously since the day Allah sent me as a prophet until the day the last member
of my community will fight with the Dajjal (Antichrist). The tyranny of any tyrant and the justice
of any just (ruler) will not invalidate it. One must have faith in Divine decree.
 War is murderous and destructive
The words used in the Qur'an are variants of qital, meaning 'fight/kill'. How do you suffer injury or
death struggling against your ego and temptations? Surah At-Taubah 9.111 defines believers as those who
fight in Allah's cause, killing and being killed.

9:111. Verily, Allh has purchased of the believers their lives and their properties; for the price
that theirs shall be the Paradise. They fight in Allh's Cause, so they kill (others) and are killed.
It is a promise in truth which is binding on Him in the Taurt (Torah) and the Injeel (Gospel)
and the Qur'n. And who is truer to his covenant than Allh? Then rejoice in the bargain which
you have concluded. That is the supreme success .

Allah has purchased the Souls and Wealth of the Mujahidin in Return for Paradise

Advancing faith or repelling evil

Advancing the faith is a matter of expanding Dar al-Islam by bringing new lands and people under
Islamic domination. In Surah Ar-Ra'd 13.41, Allah promises to give the land to Muslims through
conquests. In Surah At-Taubah 9.33, he declares the purpose of making Islam dominant.

13:41. See they not that We gradually reduce the land (of disbelievers, by giving it to the believers, in
war victories) from its outlying borders. And Allh judges, there is none to put back His Judgement
and He is Swift at reckoning.

Punishment is by Allah, and the Messenger's Job is only to convey the Message

9:33. It is He Who has sent His Messenger (Muhammad ) with guidance and the religion of
truth (Islm), to make it superior over all religions even though the Mushrikn (polytheists,
pagans, idolaters, disbelievers in the Oneness of Allh) hate (it).

Islam is the Religion That will dominate over all Other Religions

Ibn Kathir's tafsir of Surah Al-Anfal 8.39 tells us through its title that war is commanded against pagans
for the elimination of polytheism and rebellion against Allah.

This excerpt from Hedaya, Volume 2, page 216 informs us that imposition of Jizya is a punishment for
disbelief in Allah. We learn that disbelief is an evil which must be removed from the world by conversion to
Islam or death. But people with scriptural religions can be let off in exchange for annual extortion payments.
 Page 216 gives us a vital hint of the mercenary motivation of Islam. Page 144 testifies against the interest
of Islam by exposing intent to project a false perception of its motivation. They want their victims to
perceive that they are being attacked for the sake of religion, not for plunder. And, if the prey accept the
false premise, they may capitulate without a fight.

Page 214 displays the mercenary mission of Islam to the discerning eye. This excerpt clearly shows us
that the property, widows and orphans of attack victims are plunder for their Muslim attackers.
Various passages
Jihad is ordained for Muslims in Surah Al-Baqarah 2.216. They are commanded to wage it against
pagans in Surah Al-Anfal 8.39 and against Jews, Christians & Zoroastrians in Surah At-Taubah 9.29.
Muslims are enjoined to fight the disbelievers nearest them in Surah At-Taubah 9.123.

Muslims are warned in Surah At-Taubah 9.38-39 of eternal damnation if they do not answer the call to
Jihad They are promised admission to Allah's celestial bordello as a reward for Jihad in Surah At-Taubah
9.111 and Surah As-Saff 10-12. Numerous ayat enjoin Muslims to "strive hard and fight with your wealth
and your lives".

Holy war
To be holy, Jihad must be waged for the purpose of Allah's good pleasure in making his word superior:
world domination. Sahih Muslim 19.4294 informs us that holy war would be profaned by embezzling the
spoils, killing children, mutilating bodies or fleeing from battle. Embezzling the spoils is prohibited because
accrual of spoils is the real purpose of Jihad. If you have any doubt of this fatal fact, read Surah Al-Anfal
8.1, 41 & 67. The children of persons attacked are part of the spoils. The spoils belong to Allah and Moe,
who gets the top 20%, first pick. Mutilating bodies was taboo among the Arabs. Fleeing from battle was a
sign of lack of faith; a mark of hypocrisy if not kufr.

Fard Ain
Fard means obligation. Obligations binding on Muslims individually include prayer, fasting, Hajj.
Zakat and defensive Jihad. Fard al-kifaya is a communal obligation from which the Ummah is discharged
once a sufficient number have answered the call. Offensive Jihad is fard al-kifaya.

The holy war discussed in page 140 of the second volume of Hedaya is fard al-kifaya: offensive warfare; a
communal, not an individual obligation. If you read Sahih Bukhari, you will discover that sheiks, minors,
women, slaves, debtors, men with dependent parents, the blind & lame and those too poor to afford weapons
are excused from the fard al-kifaya of offensive Jihad. Those are only obligated to fight when Dar al-Islam is
invaded and in danger of being over-run.

Those who stay behind are expected to support the Jihad with prayer, funds, propaganda and
supporting the families of the mujahideen. One who dies neither going out nor intending to go out;
without scars of battle, will meet Allah as a hypocrite, destined for the fire.

India. Hedaya fills in some gaps and points out the differences between the Hanafi & Shafi'i schools of Shari'ah.
While Hedaya is dense, printed in an antique font and difficult to read, it is well worthwhile.

The Book of Jihad by Abi Zakaryya Al Dimashqi Al Dumyati concentrates on the fiqh of Jihad. Page 18
discusses fard al-Kifaya and shows us that Jihad is a communal obligation which must be performed in
every year when it is possible.

Reliance of the Traveller is the classical manual of Shari'ah of the Shafi'i madhab. Book O, Chapter 9
includes the laws pertaining to Jihad.O9.0 and O9.1 define Jihad and describe the communal obligation to
perform it in every year. Buy hard copy from Amazon.

The Risala : A Treatise on Maliki Fiqh by 'Abdullah ibn Abi Zayd al-Qayrawani is the handbook
of Maliki fiqh. Its law of Jihad begins on page 284. Risala is better printed and scanned than Hedaya &
Reliance; it is much easier to read but less detailed.
