Given the delay in implementation of
Acts even after Parliament endorses it,
National Councils legislative committee
recommended that an Act shall come
into force upon assent of The Druk Gyal-
po in line with Article 13 (1) of the Consti-
tution for which a commencement date
or a separate circular is not necessary to
bring an Act into force.
Presenting the report on the imple-
mentation status of Acts passed by the
Parliament yesterday, the committee also
recommended that while tabling a bill in
the Parliament, the agencies concerned
should simultaneously draft relevant
rules and regulations and the bill must be
accompanied by a financial memoran-
dum to ascertain the cost implications.
Adequate budget, human resources and
infrastructures must be provided to ef-
fectively implement the Act.

The government shot down the oppo-
sitions recommendations on Central
Schools with the majority of parliamentar-
ians voting against the proposals present-
ed in the National Assembly yesterday.
The opposition made three recom-
mendations. The first was to give open
admission in the Central Schools to
every student from class seven onwards.
The second was to retain the schools in
the villages. The third was to do away
with the 5km radius to be eligible for
admission in the Central Schools.

tion, said that while Central Schools
have benefited underprivileged chil-
dren in giving equitable quality educa-
tion there are concerns surrounding the

tions to the government, the
committee observed that even
after the enactment of Acts by
the Parliament, the agencies
concerned took more time in
formulation of rules and regu-
lations to fully implement the
Act.

Khandu said that the average
time taken for framing and
adoption of rules and regula-
tions following an enactment
of Act is close to two years.
Some Acts also took
about six years for implemen-
tation while some were imple-
mented without delay having
adopted the rules and regula-
tions in a few months, he said,
while presenting the report.
Citing the Education City
Act 2012 and the Alternate
Dispute Resolution Act 2013,
Sangay Khandu reported that
the two Acts were not imple-
mented at all.
Although some agencies
reported that the Acts have
been implemented even with-

Responding to the rec-
ommendations, education
minister Norbu Wangchuk
said most of the 51 Central
Schools are established in the
remoter dzongkhags. How-
ever, the minister acknowl-
edged prevalence of inequity
of facilities between boarders
and day scholars in the Cen-
tral Schools. But he said there
are plans to provide the same
benefits for the day scholars.
From next year the gov-
ernment is planning to give
uniforms, shoes and station-
ery, to even the day scholars.
The only thing the day schol-
out the rules and regulations,
the committee observed that
the sections that require sub-
ordinate legislations cannot
be implemented so it was as-
sumed that such Acts could
not be fully implemented.
Sangay Khandu cited the
example of the Road Act 2013
on the right of way for all na-
tional highways requiring a
distance of 50 feet from the
centerline of a road on either
side. At the same time, the Act
also states that the govern-
ment may, if in its opinion it
is necessary to provide and
prescribe a right of way for
dzongkhag roads by a notifi-
cation in writing.
The committee reported
that the clauses pertaining to
the right of ways for dzong-
khag roads and farm roads
were not enforced until the
Cabinet endorsed the road
rules and regulations in May
2016.
Considering such issues,
Sangay Khandu said that the
local government officials
were not able to determine
and administer the road right
of way while approving the
construction approvals of

Sustainability of the Cen-
tral Schools is a priority, the
minister said. Capital outlay
in the 11th Plan for Central
Schools is 0.5 percent and it
is not something to be con-
cerned about, he said, add-
ing this years budget alloca-

Lyonpo also said that the
Nu 4.3 billion (B) spent on the
Central Schools would have
to be used even if the Cen-
tral Schools werent started.

to construct multi-purpose
halls, laboratories, new infra-
structures in the old schools,
and additional facilities, he
said. He added that opening
of Central Schools didnt re-
quire the taking of loans since
the recurrent expenditure
houses in the dzongkhag and
villages.
This led to discrepancies in
the enforcement of law as some
authorities imposed a blanket
50ft right of way for construc-
tions of any houses along the
sides of all type of roads, others
approved constructions along
the sides of roads without
considering any right of way
requirement in absence of a
notification or regulations.
The delay in implementa-
tion of Acts were attributed to
inadequate human resources,
budget and infrastructures, re-
quirement to submit the final
draft to the board/commis-
sions/committees resulting
in either adoption or further
review, time taken for com-
prehensive research works,
consultative meetings and
translations, among others.
Deliberating on the com-
mittee recommendations,
some members pointed out
the need for a time period to
frame rules and regulations
to implement the Acts while
some were against it.

Nima said that Article 13 (I) of
the Constitution and chapter
was met from domestic rev-
enue and capital expenditure
was a grant from India.
On compulsorily admis-
sion for children from classes
seven, the minister said the
decision would be better left
for the parents to decide. If
children were to be given
admission in Central Schools
compulsorily, the existing
77 lower secondary schools
would have to be closed
down, he said, also pointing
out that it would deprive par-
ents from making decisions
on their childrens education.
On the second recom-
mendation to retain existing
schools in the villages, the
minister said that there is no
policy to close down existing
schools because of the Cen-
tral Schools. Even now there
is no school which has closed
down because of the Central

required for how and when
to implement the Act that the
Parliament has passed, he
said, adding that some Acts
were explicit while some re-
quired rules and regulations
to support them.

Pema Dakpa said that claus-
es in some of the Acts were
left flexible for which a time
frame was necessary to draft
the regulations to implement
the Acts. Its important that
the rules and regulations
are drafted within five to six
months and the copies should
be sent to the agencies con-
cerned and the Parliament
members, he said.
After the drafting of the
regulations within the speci-
fied time period, Pema Dakpa
said awareness on the Act was
also necessary.

Khandu was also against pro-
viding a time frame. As soon
as a law is passed as indicated

trys hope is that if the Cen-
tral School is able to provide
quality education, then the
existing schools might close
down naturally, he added.
On the 5km radius issue,
the minister said that it was
introduced to give priority
to the children coming from
far-flung areas. But the prin-
cipals have been considerate
to take in underprivileged
children even from within
the 5km radius despite hav-
ing such criteria, he said. He
added that the 5km radius is
an interim measure.
Once the Central Schools
have adequate boarding fa-
cilities and classrooms the
children even within the 5km
radius should naturally be eli-
gible for boarding facilities,
the minister said.

period is provided in some
cases which is justified.
As for time required to
consult people, he said peo-
ple are consulted and the bills
put up for feedback during the
drafting stage.
The Legislative Committee
was assigned the review work
on the implementation status
of Acts as per the resolution
of the 35th Plenary Session
of the Council in March last
year. The committee then met
and identified nine important
Acts passed by the Parlia-
ment to be reviewed for its
implementation status. The
committee collected infor-
mation on nine Acts and the
relevant rules and regulations
from the agencies concerned
and reported its preliminary
findings at the 37th plenary in
April 2016 following which the
house directed the committee
to extend the review work to
the Acts passed since 2008.
Given time constraints, the
committee could review only
28 of the 36 Acts passed so far.

Indian Rupee (INR) reserve
account is not a result of the
improvement in the funda-
mentals of the economy. The
government has been selling
dollars to maintain the INR
reserve.

al, reported this to the house
during the deliberation on
the annual budget report on
June 17.
The Eminent Member re-
ported that the government
sold USD 197 million (M),
equivalent to INR 12.443 bil-
lion (B), from April 17, 2014 to
May 30 this year. He said that
its important that the people
know the true picture of the
economy.
He said the INR reserve
has improved not as a result
of the improvement in the
economy. The government
needs to do much more to
earn the INR and improve the
economy, he said.
According to the budget
report, INR reserve stood at
Rs 10.86B by the end of June
last year.
The total convertible
currency reserve was USD
746.4M, out of the total inter-
national reserves of USD 916M
at the same point of time last
year. The total reserves were
more than adequate to meet
12 months of essential im-
ports.
The reserve management
policy allows the conversion of
convertible currencies in the
reserves into INR.
However, the Eminent
Member said sale of dollars in
such a manner was neither
sustainable nor desirable. If
the government portrays a
wrong picture of having enough
money in the INR reserve, he
said the economy would face
consequences - pressure from
the private sector for INR, for
example.
Any improvement in the
INR reserve should be reflective
of the improvement in the fun-
damentals of the economy. The
Eminent Member citing exam-
ples said the economy still faces
a huge current account deficit
and there has been delays in
implementation of hydropower
projects.
The current account defi-
cit widened to Nu 36.1B (28.83
percent of GDP) in financial
year 2014-15 from Nu 29.7B
(26.40 percent of GDP) in the
previous year. This was a result
of higher imports.
In the future budget re-
ports, he said the government
should report how much of
the international reserves were
sold so as to give a true picture
of the economy to the people.

his concern saying that selling
dollars in such a manner would
pose risks to the economy. The
government has said the Rupee
reserve has improved but it has
not said how those Rupees was
earned, he said.
The budget report states
the countrys economic growth
momentum picked up due to the
revival of domestic demand and
continued expansion of ongo-
ing construction of hydropower
projects. In 2014, the growth rose
to 5.5 percent from a low of 2.1
percent as a result of contain-
ing aggregate domestic demand
under import and credit restric-
tions imposed to stem shortages
of Indian Rupee reserves.
As of June 30 last year,
the external debt stock was
Nu118.676B or USD 1.855B
accounting for 94.8 percent of
GDP. Of this total, about 31.6
percent was convertible cur-
rency debt and 68.4 percent
Rupee debt.

Work on Druk Bindu hydropower begins

Works on the Detailed Project
Report (DPR) for Druk Bindu
Hydroelectric Power Project
(DBHPP) in Tendu, Samtse
kick-started on June 15. Druk
Green Power Corporation
(DGPC) is implementing the
task.
The Bhutan Power Corpo-
ration (BPC) initially carried
out the pre-feasibility studies
and had suggested a capacity
of 12 megawatts (MW) hydro-
power from the Bindu river
in Tendu. DGPC is currently
preparing the detailed report
for about 18 to 20 MW.
During the DPR, DGPC of-
ficials in the head office said
the project layout has been
optimised as compared to
earlier studies by considering
the full potential until the bor-
der. The hydrological study has
also been carried out based on
additional data available since
the feasibility study conducted
by BPC.
At the moment, a contractor
has been identified for the drilling
works.
This drilling is done to iden-
tify the quality of the rocks inside
the soil, the official said, adding
that samples would be collected.
These samples will be sent for
testing in Thimphu.
The contractor, meanwhile,
has been given about 87 days to
complete all five drilling works.
The DPR is scheduled to con-
clude in December this year.
DGPC officials also said that
the topographical survey of the
project has been completed and
the other geological investigation
works were under progress.
DBHPP is one of the hydro-
electric power projects in the
country that Bhutanese inves-
tors can take up. The cost of the
project will be determined only
once the scope of the project is
finalised, DGPC officials said.
Tender for the project can
be floated only after investment
is approved by the board and the
government, the project man-
ager Karma Tshering said. Dur-
ing construction phase the local
communities would benefit with
business opportunities.
The estimated annual energy
production of about 82GWh can
assist domestic energy security
if consumed within the country
and earn rupee if exported to
India.
The project shall also en-
hance domestic competencies in
investigation, design, engineer-
ing, and construction, DGPC
officials said.

Monitoring retention of health workers and transformative education

care for all Bhutanese, officials
from various organisations met
yesterday to discuss key indica-
tors in the monitoring progress
in terms of transformative edu-
cation and retention of health
workers.
Organised with technical
and financial support from
World Health Organisation
(WHO), the one-day workshop
saw participants from health
ministry, Khesar Gyalpo Uni-
versity of Medical Sciences,
Medical Council and WHO
regional and country office.
The participants reviewed
the achievements, identified the
gaps and proposed the way for-
ward for 2017-18, including the
technical support required from
WHO over the next two years.
They also discussed the key
indicators required to monitor
progress and to ensure that qual-
ity healthcare will continue to be
provided free to all Bhutanese.
Retention of health work-
force in places where they are
most needed, and scaling up
and transformation of health
professional education among
physicians and nurses/midwives
were found essential to ensure
free quality healthcare for all
Bhutanese, according to WHO.
According to Bhutans
Human Resources for Health
(HRH) country profile in 2014,
although the density of physi-
cians, nurses, and midwives per
1,000 population has doubled
from 2002 to 2014, the number of
health workforce is still below the
benchmark set by WHO of 2.28
doctors, nurses, and midwives
per 1,000 population. In addition,
retaining frontline health work-
ers, particularly women in basic
health units in the most difficult
districts, is an issue for the health
ministry.
Officials said that WHO rec-
ognised the challenges posed by
providing a sufficient number of
competent health providers to
ensure free quality health care
and achieving universal health
coverage more than a decade
ago.
The issue, according to WHO
officials, is prominent in all coun-
tries in the world independently
according to their level of devel-
opment.
Ensuring production, de-
ployment and retention of a suf-
ficient number of skilled health
workers is the key to sustain free
healthcare in Bhutan and achieve
the sustainable development
goal for health (SDG3) targets,

To address these challenges,

Regional collaboration for climate
resilience in the Himalayan region

Unless countries in the Hima-
layan and downstream region
strengthen collaboration to
address food, water and en-
ergy issues, the region is likely
to face an unprecedented food
crisis. This was the underlin-
ing message of the two-day
regional Knowledge Forum on
Climate Resilient Development
in Himalayan and Downstream
Regions, held in New Delhi from
1617 June 2016.
Jointly organized by the Min-
istry of Agriculture and Farmers
Welfare (MOAFW), International
Centre for Integrated Mountain
Development (ICIMOD), and
Institute of Economic Growth
(IEG), the event brought togeth-
er policy makers, scientists and
development practitioners from
Himalayan and downstream
countries, including Bangla-
desh, China, India, and Nepal.
Over the two-day meet, partici-
pants shared innovative ideas
to promote climate resilient
development by addressing the
food-water-energy nexus from a
regional perspective.
We need to work hard to
make sure that mountain issues
and their downstream linkages
are well reflected in regional and
global discussions. We need new
knowledge in this area to make
sure that it guides in the devel-
opment of effective adaptation
strategies in the region, said
David Molden, Director General
of ICIMOD. This knowledge is
critical to achieving the 2030
Agenda for Sustainable Devel-
opment, he added.
Achieving Sustainable De-
velopment Goals will require in-
tegrated solutions, efficient and
sustainable use of land, water
and ecosystems, strengthened
linkages between communities
in upstream and downstream
areas, and increased regional
and sub-regional coordination
and connectivity. These key
issues were actively discussed
during the Forum.
In the whole SDG proc-
ess, mountains are somehow
left behind, but there is a space
for this and the mountain
countries need to develop their
own targets and mechanisms
to address climate change and
sustainable development,
said Yuba Raj Khatiwada, Vice-
Chairperson of National Plan-
ning Commission, Government
of Nepal. He also highlighted
ICIMODs pilot project on cli-
mate smart villages, which he
said has now been adopted by
the government and included in
the national planning process.
The Himalayan and down-
stream region has a great op-
portunity now especially with
a river basin approach in a co-
ordinated manner. Australias
most important water basin,
Murray-Darling, has flourished
due to strong knowledge and
management support for two
decades and Australia is ready
to share their experience and
expertise to take appropriate
measures in three Himalayan
basins Ganges, Indus and
Brahmaputra, said Harinder
Sidhu, Australian High Com-
missioner, India. She added
that for the countries, creative
and innovative solutions are key
towards improvement in food,
water and energy.
Regional collaboration is
needed on knowledge on spe-
cific sectors and research on
single issues. Climate change
is not uniform in the region and
might be very diverse and the
impact is more on low income
areas of all nations, said Manoj
Panda, director of Institute of
Economic Growth, India.
The level of impact and
the coping mechanisms are
different in low and high in-
come areas of all countries of
Himalayan region. This is where
diversity and equitable develop-
ment is key.
For sustainable devel-
opment inclusiveness is not
enough. We need equity and
equitable development that
lets all men, women and chil-
dren benefit equally, said Qazi
Kholiquzzaman Ahmad, chair-
man of Palli Karma-Sahayak
Foundation, Bangladesh. He
added that the region needs to
build social capital at the insti-
tutional and individual level, lo-
cally, nationally and regionally.
Institutionalizing benefit-
sharing Payment for Ecosystem
Services (PES) is seen as a good
initiative to forge the linkages
between upstream Himalayan
and downstream regions. The
PES, also known as payments
for environmental services, are
incentives offered to commu-
nities of upstream catchment
areas in the mountain region
for their role in managing land,
sources of water and ecosystem.
Such a PES system is being insti-
tutionalized in Nepals Dhanku-
ta district to promote the linkage
between the Dhankuta town
residents and the villagers of
remote Nibuwa and Tankhuwa.
In Indias Himachal Pradesh, like the Arctic Council, a no-

transplantation season, but

Hoping for rainfall, Khandu
joined several farmers from 11
gewogs who had come to con-

in Punakha, yesterday.
Local leaders, monks of the
Punakha dratshang and dzong-
khag officials jointly conducted
the ritual to bring rain and allow
paddy transplantations across
villages in Punakha.
According to the dratshang,
the Kanjur-Lingkor is being con-
ducted to not just bring timely
rain but also for a bountiful har-
vest.
Four of the 11 gewogs in
Punakha: Guma, Toewang, Baap
and Chubbu are affected by lack
of rain, senior dzongkhag agri-
culture officer, NB Adhikari said.
The problem is occurring
because irrigation water has to
be shared among many farmers.
With no rainfall, the quantity of
available water is decreasing.
However, NB Adhikari said
other measures are being pur-
sued so that farmers can com-
plete transplantation on time.

After four consecutive unsuc-
cessful seasons, Thimphu City
FC finally broke the curse and
lifted their first Thimphu A-
League title at the Changlim-
ithang Stadium on Sunday.
Under a revamped team,
City scored a staggering 44
goals in 14 games, the high-
est in the season. At the same
time, the team also conceded
the least number of goals (11)
and registered five clean-sheets
during the league.
City could have been the
first invincible team to have
won a league title in the coun-
try, however, a 2-0 defeat at the
hands of Druk United in the
final game of the season held
the team from achieving such
glory.
