1. Social justice

The Agricultural Land Reform Code has been designed to promote economic and social stability. Being a
social legislation, it must be interpreted liberally to give full force and effect to its clear intent, which is
to achieve a dignified existence for the small farmers and to make them more independent, self-reliant
and responsible citizens, and a source of genuine strength in our democratic society. (Coderias v. Estate

2. RA 3844, as amended by RA 6389 abolished and outlawed share tenancy and put in its stead the
agricultural leasehold system. (Tan v. Pollescas, GR 145568, Nov. 17, 2005) CASTRO A

Sec. 3. Composition of Code. In pursuance of the policy enunciated in Section two, the following are
established under this Code:

"(1) An agricultural leasehold system to replace all existing share tenancy systems in agriculture;

"Sec. 4. Automatic Conversion to Agricultural Leasehold. - Agricultural share tenancy throughout the
country, as herein defined, is hereby declared contrary to public policy and shall be automatically
converted to agricultural leasehold upon the effectivity of this section.

a) The parties are the landholder and the tenant;


b) The subject is agricultural land;
c) There is consent by the landholder for the tenant to work on the land, given either orally or in
