Section 11, School Education Act 1999
Under section 11 of the School Education Act 1999, the Minister may exempt a child of compulsory education
age from the requirement to be enrolled at a school or registered for home education.

The exemption is to be made on the basis of the best interests of the child.

The power to exempt, in the case of a child enrolled at a non-government school, is delegated to the
Director General of the Department of Education Services.

An exemption may be granted subject to conditions specified in the exemption approval letter and the
exemption may be revoked at any time.
