Incident Summary

On 07-19-17, approximately 1538 hours, I responded to an

emergency back up call for service involving Officer Grossman
who was out with a suspicious subject in the park, in the area of
Main Street and Village Street. Dispatch, heard a radio click from
Officer Grossman and he was not able to respond back to dispatch
when they tried to clear him over the radio.

When I arrived on scene, along with several other officers, I made

contact with Officer Grossman. The following is a summary of his
statement: Officer Grossman stated he was patrolling in the area
of Main Street and Village Street and observed a white juvenile
male subject alone acting suspiciously; he was later identified as

Officer Grossman drove by the park area several times then exited
his vehicle in an attempt to make contact with Officer
Grossman explained that he did not know was an autistic
juvenile.

Officer Grossman made contact with and asked him what

he was doing and if he had any identification on him.
began to walk backward as if he was trying to get away from
Officer Grossman. Due to being a juvenile and displaying
odd behavior, Officer Grossman was concerned that was
going to run toward the street where vehicles travel. Officer
Grossman told not to walk away from him and attempted
to detain him for his and the public safety. Officer Grossman then
grabbed right hand and turned him around in an attempt
to detain him. pulled away from Officer Grossman and
both fell to the ground, while hitting a tree on the way down with
Officer Grossman on top of Officer Grossman was able to
control by holding his arms. Moments later care
taker Diane Nancy arrived on scene and
informed Officer Grossman who she was and that was
Autistic and was apologizing for not being there.

Due to unpredictable behavior, Officer Grossman tried to

keep calm while waiting for another officer to arrive on
scene. Once Officer OHea arrived on scene, was assisted
to his feet to be with Diane. sustained minor abrasion to
his right face. Medical was offered, but they both refused. Diane
and were then released from the scene. I provided Diane
with my contact information for parents.

On 07-19-17, approximately 1620 hours dispatch informed me that

Danielle Marie requested me to call her in
reference to an incident involving her son
and Officer D. Grossman #3930. Dispatch provided
me with a call back number of I immediately called
Danielle back and requested that we meet in person, to which
Danielle agreed. We agreed to meet up at her residence at the
location of N. 193rd Drive, Litchfield Park, AZ.

At approximately 1700 hours, I arrived at Danielles residence and

made contact with father Kevin William
. Kevin was upset and requested that the police department
do something about the incident. Shortly after Danielle arrived at
the residence and was very upset about the incident. Both Danielle
and Kevin requested to file a formal complaint on Officer
Grossman for using excessive force on their son. I provided them
with a Citizen Complaint Form and explained how the process
works.

I then requested to take digital photographs of to which

they agreed. Upon taking his shirt off, I could see that
sustained abrasions to his back, right back arm, left
shoulder and his right knee. Digital photos were taken by me using
a department cell phone and were later downloaded to
evidence.com.
Danielle requested that she complete the form at her leisure and
would contact me when it was completed. I provided both Danielle
and Kevin with my contact number before I departed their
residence.

On 07-20-17, approximately 1030 hours, Kevin called me and

requested for me to stop by his residence to turn in the Citizen
Complaint Form due to the fact that he was unable to drive to the
Police Station. I arrived at Kevins residence approximately 1100
hours and formally accepted his complaint written by Danielle.
While speaking with Kevin, he informed me that there might be
witnesses to this incident an employee at the Barber Shop, which
was across the street from the park.

On 07-20-17, approximately 1125 hours I received a phone call

from Diane and requested that I meet up with her, so she could
turn in her written statement. We agreed to meet back at Kevins
house at 1200 hours. When I arrived on scene, I met up with
Diane and formally accepted her written statement to which she
had typed and signed.

I then drove to W. Main Street in attempt to make contact

with employees at the Barber Shop. When I arrived at the Barber
Shop, I made contact with Daniel Richard
. I asked Daniel if he saw anything yesterday involving an
officer and a kid who was at the park across the street from their
business. The following is a summary of Daniels statement;
Daniel stated he was sitting outside with several of his co-workers
having a conversation. Daniels back was facing the park, but he
glanced back and forth to his side to see the park and what was
going on with police presence. Daniel first observed and
thought that he was on drugs, but then thought that might
also be autistic. Daniel did not see the entire incident, but saw
Officer Grossman help up onto his feet. I asked Daniel
who was with him and if his co-workers also witnessed the
incident. Daniel stated that Frank was sitting across from him.
I then made contact with Frank Ismael
. I asked Frank if he saw anything yesterday involving an
officer and a kid who was at the park across the street. Frank said
he did not see anything. Frank said, he and his co-workers came
out because they saw several officers at the park and was
wondering what was going on.
On 07-20-17, approximately 1748 hours I met with Officer
Grossman and discussed his action and the police report in regard
to his incident. Officer Grossman explained that the park is often
frequented by juveniles who do drugs and he often patrols the
area during his shift. From his training and experience as a DRE
instructor, Officer Grossman believed that behavior was
consistent with someone using an inhalant. From his experience in
dealing with people doing inhalants, they tend to be unpredictable,
become violent and lash out at other people.

During first contact, Officer Grossman explained that he believed

to be inhaling and did not know that was autistic.
Officer Grossman intention was to detain for everyones
safety. When broke away, Officer Grossman attempted to
regain control of but both fell on the ground.

Once he was notified by Diane that was autistic and due to

was still struggling; and was unsure how he would act
since there are many different levels of autism, he decided to wait
for back up.

Based on my investigation, talking to witnesses and re-viewing the

body camera; I believe that Officer Grossman did not know that
was autistic at first impression due to being alone
without his caregiver and he was displaying odd behavior; which
Officer Grossman believed based on his training and experience
as a DRE Instructor that behavior was consistent with
someone using an inhalant.

When Officer Grossman contacted he was wearing his

class C uniform, with a police badge and name on the front,
shoulder patches and Buckeye Police lettering on the back.

I further conclude that Officer Grossman only used the necessary

force to hold on the ground until a secondary officer
arrived. The unfortunate act of going to the ground was caused by
trying to break away from being detained and both
and Officer Grossman falling into a tree and then to the ground.
Officer Grossman remained calm during the entire event and tried
to calm down from his initial response. This was evident in
the reviewing of both the report and the body worn body camera
footage.
In my review, I do believe Officer Grossman failed to differentiate
the difference between a teenager using an inhalant and a
teenager with autism. The actions of both are similar and in this
short time of contact prior to falling to the ground it would have
been difficult. I would recommend that Officer Grossman attend
the Critical Intervention Training class to help recognize the
difference between both drug user and mental illness.

Recipient's Comments/Response: I have reviewed the complaint filed by Danielle
and the investigation conducted by Sergeant Halim in regards to an Incident
involving Officer Grossman. During my review I have also reviewed the police report
along with officer worn body camera footage during the incident. In Danielle Leibels
complaint she mentions that her son was assaulted by
Officer Grossmann. Danielle further states that was with his caretaker Diane
and that she was present during the incident. Diane stated she let
walk around while she was inside the music center and only came outside to see
both Officer Grossman and on the ground. Danielle also wrote in the
complaint that Officer Grossman mishandled and brutally took to the ground
with unreasonable force. She further mentioned in closing of negligence and
excessive force along with abuse of power by Officer Grossman. Sergeant Halim
attempted to locate independent witnesses that may have been at the Barber shop
in the area when advised by Kevin father). Sergeant Halim did
speak with individuals at the shop but they did not see the incident occur only them
on the ground afterwards. I reviewed Officer Grossmans report and believe he
established reasonable suspicion to stop who was alone acting in the
manner which described. Officer Grossman was calm during the initial contact and
was asking basic questions. When he felt the need to detain further is when
reacted by trying to pull away. Unfortunately they both fell striking the tree
during the fall to the ground causing abrasions to In the review of the body
camera footage there is no clear evidence that would prove not the case. In regards
to the allegations claimed by Danielle, There is no evidence that Officer Grossmann
brutally had taken to the ground and there was no use of excessive force.
The only force used was when he held on the ground, this was by kneeling
next to while holding one arm along with his right shoulder for control.
Officer Grossman did not feel safe letting off the ground until a secondary
officer arrived due to how may react. This is clear during the review of the
body camera footage. I found that Officer Grossman acted within the law and did not
abuse his power as a sworn officer and was not negligent as an officer during this
incident. As a coordinator being involved with critical intervention training I do
recognize the similarities of a teenager who would have used an inhalant, to actions
of someone with autism. We continue to train our officers to be better familiarized
with many mental illnesses that we may encounter. This is a very difficult task even
when looking at just autism which is a complex disorder. The disorder covers a large
spectrum of symptoms, skills and levels of impairment that would be very difficult to
teach officers to recognize them all. If caretaker was within sight of
this would have also helped prevent this incident to alert the officer of his condition. I
would agree with the recommendation to have Officer Grossman attend a critical
intervention training class in the future. Officers attending this training will always
help them improve their skills in dealing with mental illness.

NARRATIVE:

ON 07-19-2017 AT APPROXIMATELY 1535 HOURS, I WAS IN THE

AREA OF N. VILLAGE ST
AND W. MAIN ST IN BUCKEYE. DURING THAT TIME I HAD
OBSERVED A SUBJECT LATER
IDENTIFIED AS STANDING AT THE CORNER OF
THE MENTIONED
INTERSECTION. I CONTINUED TO OBSERVE WALK HALF
WAY UP THIS SMALL STREET
WEST AND THEN BACK EAST (ESTIMATED 50 FEET DISTANCE).
WHILE WAS DOING
THIS I OBSERVED SOME OBJECT IN HIS RIGHT HAND THAT HE HIT
AGAINST HIS LEFT PALM
AND THEN IMMEDIATELY BRING HIS HANDS UP TO HIS FACE IN
WHAT APPEARED HE WAS
SMELLING SOMETHING. (I FELT THIS WAS SUSPICIOUS AS KIDS
AND ADULTS HAVE BEEN
CONTACTED IN THIS SAME AREA IN THE PAST DOING DRUGS
AND OTHER ILLEGAL ACTIVITY)
AFTER WHAT APPEARED WAS SMELLING A SUBSTANCE
FROM HIS HANDS HIS BODY
WOULD LOCK UP AS HE HEAD WOULD TILT TO THE SIDE AND
ARM OUTWARD ABOVE HIS HEAD.
AFTER A FEW SECONDS, WOULD RETURN TO NORMAL
BEHAVIOR AND CONTINUE THIS
SAME HAND MOVEMENTS ALONG WITH THE BODY LOCKING UP. I
NOW DROVE BY TO GET
A BETTER LOOK AT WHAT HE WAS DOING WHERE HE MADE EYE
CONTACT WITH ME AND TURNED
HIS BACK AS IF HE WAS ATTEMPTING TO HIDE THE OBJECT IN
HIS HAND.

I NOW DROVE DOWN W. MAIN ST AND MADE A U-TURN AT

SCHOOL HILL RD AND PROCEEDED
BACK TO N. VILLAGE ST. AS SOON AS BECAME VISIBLE,
I OBSERVED HIM DOING
THE SAME ACTIONS OF SMELLING THIS UNKNOWN OBJECT AND
THEN HIS BODY LOCKING UP
IMMEDIATELY AFTER. BASED ON MY TRAINING AND EXPERIENCE
AS A DRUG RECOGNITION
EXPERT AND HAVE CONTACTED MULTIPLE PEOPLE IN THE PAST
UNDER THE INFLUENCE OF A
DRUG(S), WAS DISPLAYING SIGNS OF SMALL HITS OF
AN INHALANT. DUE TO
APPEARING THAT HE MIGHT HAD BEEN INHALING SOME TYPE OF
SUBSTANCE FROM HIS HANDS,
I EXITED MY PATROL IN AN ATTEMPT TO SPEAK TO HIM.

I ASKED WHAT WAS HE DOING WHERE HE REPLIED HE

WAS DOING NOTHING. I HAD
ASKED HIM WHAT WAS IN HIS HAND WHICH HE STATED IT WAS A
STRING AS HE HELD IT
UPRIGHT WITH A CLOSED FIST. I ASKED IF HE HAD ANY
IDENTIFICATION WITH HIM
WHICH HE STATED NO. DURING MY BRIEF CONVERSATION WITH
HE WAS SWEATING
PROFUSELY AS SWEAT DROPS WERE COMING OFF HIS FACE
AND HE STARTED TO WALK
BACKYARDS AWAY FROM ME IN WHAT APPEARED AN ATTEMPT
TO FLEE.

I REACHED OUT AND GRABBED ARM AND ATTEMPTED

TO DETAIN HIM TO
INVESTIGATE HIS ACTIONS FURTHER IS WHEN HE BEGAN TO
PULL AWAY FROM ME AND TRIED
TO RUN IN THE NORTH WEST DIRECTION. AS
ATTEMPTED TO FLEE WHILE I WAS
STILL HOLDING HIM, WE BOTH FELL ON THE GROUND NEXT TO A
TREE. HAD HIS
BACK AGAINST THE TREE AND THEN EVENTUALLY ROLLED
CLOSER TO THE GROUND. I WAS
ABLE TO HOLD ONTO BY BOTH OF HIS ARMS AS HE
LAID DOWN ON THE GRASS.
PUSHED OFF THE GROUND TWICE IN WHAT APPEARED
FOR HIM TO BREAK FREE FROM
MY HOLD.

KEPT ASKING ME IF HE WAS GOING AWAY AND DURING

THAT TIME A FEMALE ADULT,
DIANE APPEARED FROM ACROSS THE STREET
ADVISING THAT SHE WAS
AUNT AND THAT WAS AUTISTIC.

CONFIRMED THAT HE KNEW DIANE AND I EXPLAINED

TO I WAS GOING TO
SLOWLY RELEASE HIM AND TO CALM DOWN WHICH HE AGREED.
DURING THIS TIME, OFFICER
T. O'HEA HAD ARRIVED AND ASSISTED ME WITH GETTING
TO SIT UP AND ENSURING
HE HAD NO WEAPONS ON HIS PERSON. I REQUESTED
TO SIT NEXT TO DIANE AND I
EXPLAINED TO DIANE WHAT I HAD OBSERVED AND WHAT HAD
TRANSPIRED. DIANE INFORMED
ME THAT IT WAS COMMON FOR HAVE SOME TYPE OF
STRING IN HIS HANDS AS IT
HELPS HIM WITH HIS NERVES.

A SHORT TIME LATER, SGT E. HALIM HAD ARRIVED ON SCENE

AND I HAD EXPLAINED TO HIM
WHAT HAD HAPPENED. SGT E. HALIM SPOKE WITH DIANE AND
PROVIDED HER WITH HIS
CONTACT INFORMATION IF SHE HAD ANY FURTHER QUESTIONS.
WAS RELEASED TO
DIANE.

HAD A SCRATCH ON THE RIGHT SIDE OF HIS FACE

NEXT TO HIS EYE. THEY WERE
OFFER MEDICALLY ATTENTION BUT HAD REFUSED ANY
TREATMENT. FOR THE PURPOSE OF THIS
REPORT I ONLY HELD ONTO ARMS/WRISTS AND
NEVER ATTEMPTED TO RESTRICT HIS
BREATHING. WHILE ON THE GROUND MY BODY WAS ADJACENT
TO HIS AS HE WAS UP AGAINST
A TREE WHICH ASSISTED WITH KEEPING STILL.

Recipient's Comments/Response: After viewing the body camera footage, I find that
Officer Grossman was not using excessive force when handling the juvenile. At first contact,
the juvenile was acting and talking normally. Officer Grossman stated he was patrolling in
the area of Main Street and Village Street and observed a white juvenile male subject acting
suspiciously; he was later identified as . When Officer
Grossman contacted he was wearing his class C uniform, with a police badge and
name on the front, shoulder patches and Buckeye Police lettering on the back. Officer
Grossman explained that the park is often frequented by juveniles who do drugs and he
often patrols the area during his shift. From his training and experience as a DRE instructor,
Officer Grossman believed that behavior was consistent with doing an inhalant.
From his experience in dealing with people doing inhalants, they tend to be unpredictable,
become violent and lash out at other people. Officer Grossman has not been trained in
handling special needs people or mentally ill persons. Only certain Officers in this
department went to Critical Incident Training (CIT) due to restricted number of available
seats during the training. Under the definition of Reasonable Suspicion established by the
Supreme Court in 1968 case in which was it ruled that police officers should be allowed stop
and briefly detain a person if, based upon the officers training and experience, there is a
reason to believe that the individual is engaging in criminal activity. (ARS 13-3403A1 stated
A person shall not knowingly Breath, inhale or drink a vapor-releasing substance containing
a toxic substance. A person who violates any provision of this section is guilty of a class 1
misdemeanor or a class 5 felony. For the purpose of subsection A and E, vapor-releasing
substance containing toxic substance means paint or varnish dispense by use of aerosol
spray, or any glue, that releases vapor or fumes containing acetone, volatile acetates,
benzene, butyl alcohol, ethyl alcohol, ethylene dichloride, isopropyl alcohol, methyl alcohol,
methyl ethyl ketone, pentachlorophenol, petroleum ether, toluene, volatile ketones,
isophorone, chloroform, methylene chloride, mesityl oxide, xylene, cumene, ethylbenzene,
trichloroethylene, mibk, miak, mek or diacetone alcohol or isobutyl nitrite.) The officer is
given the opportunity to freeze the action by stepping in to investigate. The officer has the
right to briefly detain a suspect for investigatory purposes. Unlike probable cause that uses
a reasonable person standard, reasonable suspicion is based upon the standard of a
reasonable police officer. While reasonable suspicion does not require hard evidence, it
does require more than a hunch. A combination of particular facts, even if each is
individually insignificant, can form the basis of reasonable suspicion. In this case Officer
Grossman knew the area was frequented by juveniles who often doing drugs and other
police officers were aware of the situation and had made arrests in the past dealing with
juveniles doing drugs. This park is often patrolled by Officer Grossman as part of his daily
work routine. Based on the fact that Officer Grossman provided what he had observed prior
to contacting he had reasonable suspicion to detain if necessary during his
investigation. Also, due to being a juvenile and displaying odd behavior, Officer
Grossman was concerned that was going to run toward the street where vehicles
travel. Officer Grossman told not to walk away from him and attempted to detain him
for everyones safety. The injury sustained by was due to him trying to get away
from Officer Grossman where they both fell and back scraped against the tree.
Officer Grossman only applied force necessary to gain control of Once
complied, Officer Grossman assisted to stand and be next to his care taker. Medical
was offered and they refused. From the time Officer Grossman first made contact with
and by the time Officer OHea arrived on scene, the incident took place for
approximately 4 minutes. It is my recommendation that Officer Grossman will attend the
next CIT class to better himself in dealing with mentally ill person and special need people.

mental illnesses that we may encounter. This is a very difficult task even when looking at
just autism which is a complex disorder. The disorder covers a large spectrum of symptoms,
skills and levels of impairment that would be very difficult to teach officers to recognize them
all. If Connors caretaker was within sight of this would have also helped prevent this
incident to alert the officer of his condition. I would agree with the recommendation to have
Officer Grossman attend a critical intervention training class in the future. Officers attending
this training will always help them improve their skills in dealing with mental illness.
