This matter has been referred to the Court in its capacity as
Presiding Judge of Sangamon County for reassignment for the
sole purpose of hearing Plaintiff's Petition for Substitution
of Judge for Cause. The court notes Plaintiff has filed a
notice of appeal of Judge Cavanagh's denial of Plaintiff's
Motion for a Preliminary Injunction, but has not appealed
Judge Cavanagh's 2-615 dismissal of his complaint. Indeed
Plaintiff has filed a motion for leave to file an amended
Complaint. Pursuant to Sears Holidng Corp. v. Pappas, 391
Il. App. 3d 147 (1st Dist., 2009), Jude Cavanagh retains
jurisdiction over matters collateral or incidental to the
matter being appealed, and so retains jurisdiction over the
Motion for leave to file an amended complaint. Consequently,
Plaintiff's Petition to Substitute Judge Cavanagh is ripe for
hearing, and Judge Leslie Graves is assigned to the case for
the sole purpose of hearing said motion. The parties are
directed to contact Judge Graves for a hearing date. THE
CLERK IS DIRECTED TO SEND A COPY OF THIS DOCKET ENTRY TO
JUDGES CAVANAGH, GRAVES, PLAINTIFF AND AAG TERRY CORRIGAN.
