Theproblemsthatmanypeoplearefacinginthepatriotmovementstemagreatdealfromthesimple
misunderstandingofwordsintermsrelatingtobanking,law,andevenpolitics.Thisisaquickfirstdraftofanin
depthexposewhichIshallpublishsooninhopesthatonceandforall,Notariesarenotwillfullyorunknowingly
puttingtheirnecksoutonthelineinanattempttoqualifyanadministrativelegalprocedure.

AgreatdealofthismisuseofNotariesstartedfromtheeducationaleffortsofJackSmithofRightWayLawand
VictoriaJoyofAngelwiththeInkwellMinistries.AlthoughsomeofwhatJack,Victoriaaswellasmanyother
PatriotsspeakaboutinrelationtotheNotaryProtestconcept/methodIdounderstandfromaveryesotericlevel
however,theultimatedemiseofboththeNotariesandthepeoplewhousethisProtestConceptarebasedonthis
simplefact:

Themisunderstandingofthewordacceptanceintheworldofbanking,negotiableinstrumentslaw,lawmerchant
andtheUCC.

ANotarysprincipledutyistoprotesttheacceptanceofforeignandinlandbillsofexchange,drafts,notesand
otherinstrumentswhenpresentedforpayment.

Hereisarudimentarydefinitionofacceptanceasitappliestobankingornegotiableinstruments:

AcceptancemeansHonorwhichmeansPaynothingmore,nothingless.

Patriotsareutterlymistakenwhentheythinkthattheycantenderaninstrumentforpaymentandifacreditorfails
tocreditthedebtorsaccountthatactionissubjecttoprotest.Themisunderstandingagainspawnsfromthe
Englishlanguageandtheuseofacceptance.HereisanexamplesentencethatisthebasisfortheNotarialProtest
concept.

Itenderedmyinstrumentfordischargeandthecreditorrefusedtoacceptmyinstrument.

TheabovesentenceisjustplainEnglishandnotlegaleseorbankerspeakwhichwouldbeutilizingthedefinitionof
acceptancewhichwouldapplytoNotariessuchasinUCC35013505.
Thewayinstrumentsworkincommercearelikethis:

IfIpurchaseatruckloadofmerchandisefromamanufacturerandupondeliveryofthemerchandiseItendera
draftorbillofexchangeinstrumenttotheshipper.Theshipperwillthentaketheinstrumenttothemanufacturer
andlatertheiraccountsreceivabledepartmentwillpresentmyinstrumentforcollection.

SincetheinstrumentinthiscasewillbedrawnagainstabankwhereImaintainanaccountthebankismy
fiduciary.

Nowtherearethreebasicscenariosastohowthisinstrumentmaybenegotiated.
Bydepositviamail.
Bypresentmentinperson.
EFTterminal.

Forthepurposeofthisdiscussionwewillonlyaddressinpersonpresentment.Letssayhypotheticallythatthe
accountsreceivabledepartmentsendsacompanyrepresentativedowntothebanktomakepresentmentofthe
instrumenttendered.ThebankhastwooptionsonlyHonororDishonor.Thesewordshaveesotericmeanings

howeverintheworldofcommercethereareonlytwomeanings.Honor=Accept=PayorDishonor=Refuse=
Defend.IfthebankchoosestodishonortheinstrumentthenthepayeemayhireaNotaryPublicforthepurposeof
protestingthenonacceptance(payment)oftheinstrument.

Protestisdefinedasaformaldeclarationmadeinordertofurnishthepartiessecondarilyliablewiththeevidence
ofthedishonoroftheparticularpaperwhicharebillsofexchange,drafts,notesetc.

Theproteststepsaregenerally:

ANotarymaysendthenoticeofdishonoredinstrumentbymailordeliveritinpersontotheMakerofan
instrument.IntheeventtheMakerfailstoHonortheinstrumenttheNotarywillproceedtomemorializethe
dishonorbywayofformalprotest.

Aprotestisanadministrativejudgmentbyanofficerofthestate.Asanoperationoflawthereisnothingfurther
pursuanttothedoctrinesofStareDecisisandResJudicata.

Fromthispointtheholderoftheinstrumentaswellastheprotestcertificatecanbringitbeforeacourtandhave
itacteduponinthesamenatureasadefaultjudgment.

Inthealternativetheholderoftheinstrumentandprotestcertificatecouldsueforstatutorydamagesresultingfrom
thedishonorandwouldhavethetacitagreementandwintheirsuitbasedupontheprotestcertificate.

Thereismuchmoretocomelaterhoweverthebottomlineisthatyoucannottenderaninstrumentforpayment
andprotestagainstthenoncreditingofonesaccount.Bluntly,thepatriotsusingtheprotestmethodaredoingitall
backwards.

TheendresultofthismisapplicationisNotarieshavegonetojailformalfeasanceofpublicoffice.Asaforinstance
OregonchangedtheirrevisedstatutestospecificallynoteabouttheabuseoftheNotarialProtestespeciallywhen
Protestingnoncommercialpaper.Idohoweveragreewithagreatmanythateverythingiscommerce,especially
whenlookingattheworldfromaRedemptionperspective.Theproblemfurtheristhatsimpleadministrative
duelingandthedocumentsinterchangedbetweenadversepartiesarenotdraftsassomeguruspurportbeing
subjecttoprotestintheeventofdishonor.

Inthealternativeifonetendersapromissorynoteorotherinstrumentfordischargeofadebt,theyalmosthaveit
right.However,thatconceptshouldbepredicatedonlyonHouseJointResolution192,PublicLaw7310andUCC
3603(b).Itispossibletouseinstrumentforanadministrativeprocesstodischargedebtbutintheend
dischargeisutterlyunnecessarysimplyduetothefactthatyoucanbeatthebanksbasedonthefollowing:
